Rutgers President William Tate IV joins former longtime Pittsburgh Steeler/LSU standout Ryan Clark to discuss topics including the importance of alignment, his time in Baton Rouge, his experience with current LSU AD Verge Ausberry and more. When it comes to alignment, Tate asserts that “you have to have an alignment between the administration of the university, the athletic director and their team, and the individuals who are going to support you in NIL. You used to call them boosters. It is a little more complicated than that now, but the NIL community, the legislative groups, and the governor’s office all have to be aligned. This is the difference between winning and losing. Losers are misaligned. Winners are aligned.” Tate uses his departure from LSU as an example of what happens when alignment changes: “We had a shift in political philosophy. That comes with consequences. As a leader you have to ask yourself how aligned you are with the company’s philosophy. When you are not aligned, you ask hard questions about your professional growth. You cannot just complain about it. You have to decide where you can be great and go into the market to find out your value.” (link)

LSU claims it has not "formally terminated" former Football HC Brian Kelly and is “now seeking to fire Kelly ‘for cause’ and potentially avoid paying a full buyout of nearly $54M,” according to ESPN’s Dan Wetzel, who adds: “The filing claims that LSU informed Kelly's representatives of this position on Monday. According to a copy of the suit obtained by ESPN, ‘LSU's representatives had a call with Coach Kelly's representatives, where LSU took the position that Coach Kelly had not been formally terminated and informed Coach Kelly's representatives, for the very first time, that LSU believed grounds for termination for cause existed.’” In their filing, Kelly’s lawyers are seeking "a declaratory judgment confirming that LSU's termination of Coach Kelly is without cause and that Coach Kelly is entitled to receive the full liquidated damages provided for in [his contract]." The filing also pushes back on three points made by LSU: “Coach Kelly's representatives informed LSU that Coach Kelly disagreed with each of LSU's new positions, including (i) the idea that he somehow had not been terminated, (ii) that the then-Athletics Director Woodward was not acting with authority (in a meeting attended by several LSU athletics officials, including the current Athletics Director [Verge] Ausberry), and (iii) that there were any grounds for termination with cause (or that LSU could manufacture any such grounds after his termination), thus necessitating this action.” The filing goes on to contend that “LSU repeatedly confirmed, both publicly and to Coach Kelly, that the termination was due to the Team's performance, not for cause." James Madison AD Matt Roan recently jumped aboard the school’s equipment truck, “Diesel Duke,” to take an almost 300-mile jaunt to Marshall in honor of his father Pete, who retired from the trucking industry back in March 2020 after a massive stroke left him paralyzed on one side of his body. Discussing his father’s career and the lesson it taught him, Roan said: “You sacrifice for your family. You work hard for anything in life. My dad is very blue collar. You're not better than anybody. Probably the thing I appreciate the most. No matter what you do, be best at it.” The almost six-hour drive also reinforced Roan’s appreciation for the behind-the-scenes effort of the Dukes’ equipment crew while providing him with a touch of nostalgia. Roan: “There are just so many people and so many things that go into, whether it's home or on the road, pulling these games off. [...] I thought a lot about my old man. You think about how much you appreciate the people who sacrificed for you to get where you are. For me, that's nobody more so than my parents. Even though he wasn't in the truck with me, he was in the truck with me.” More. (link)

More from Pittsburgh AD Allen Greene, who tells Pittsburgh Sports Now’s Nathan Breisinger  about the Panthers’ rev-share approach: “It would be disingenuous for me to sit here and say the number’s X because in a month it’s going to be X plus Y or it’s going to be X exponentially. In my mind, the number in itself relatively speaking for those who are particularly interested in football is irrelevant. It’s all based on what we think our peers are doing, and if our peers are going to spend more, then we are going to spend more. … We have people in place in each program who determine what is the best use of those dollars. We will evaluate how they do. If we feel like we got to make modifications to their autonomy then we will.” As for overall resources: “All we try to do is squeeze the most juice out of the orange as possible. Our peer groups are different. When we were at Auburn and at Ole Miss and at Tennessee, your peers are Texas and Alabama, [Texas A&M] had lots of money, your Floridas, you’re in a different peer group. Our peer group is not them. We want to make sure that we’re identifying our peer group and what it is that they’re doing and us making sure that we are competitive in that space. … We are a program who is working toward consistent national prominence and the first thing you have to do when you’re running a race is worry about the person in front of you, and then once you overtake them, then you worry about the next one. We’re worried about overtaking whoever the heck is in front of us and that sometimes changes depending on the week.” (link)

Missouri State will petition the NCAA for a postseason waiver that would allow its football team to play in a bowl game this season, despite rules blocking first-year FBS programs, according to CBS’ Brandon Marcello. Bears AD Patrick Ransdell: "We know the history of what that looks like, and it's traditionally not been looked at favorably, but we will be petitioning, and we'll see where that goes. We'll let the chips fall where they fall." That said, Ransdell argues the logic behind the NCAA’s rules is antiquated: "In today's world, you can reinvent your team in a matter of weeks. … If we're really in the business for student-athletes and the betterment of the student-athlete experience, there's no reason we should be punishing the student-athletes who are working hard day in, day out and deprive them of a postseason opportunity when there's really no good reason to do that." A Texas man is facing multiple charges after allegedly threatening Louisville Football HC Jeff Brohm and his family, quarterback Miller Moss and other student-athletes on the team. 38-year-old Brian Mandel of Corpus Christi, Texas, has been indicted on six counts of terroristic threatening and one count of extortion. Exact motivation for the threats is unclear, but the alleged crimes are said to have occurred following the Cardinals’ loss to Cal. Cards AD Josh Heird: "Our student-athletes and coaches deserve to compete, learn and grow without fear. We are committed to supporting them and reinforcing the values of respect, integrity and accountability that define our program. [...] We commend law enforcement for their swift and decisive action in addressing this matter. Threats of violence have no place in our community or in sports, and we will continue to work closely with authorities to ensure a safe environment for all." (link)

Disney and YouTube have remained in contact right up to last night’s Monday Night Football game, according to Puck’s John Ourand, who notes there’s been “no indication that they’re any closer to a deal. On Sunday, Morgan Stanley research analyst Ben Swinburne wrote that Disney is losing $30M in revenue a week. The impasse centers on pricing, not technology, as Ourand reports ESPN has offered YouTube the same ~$10 per-subscriber rate as Comcast, Charter, and DirecTV, adding: “Thanks to its extraordinary growth trajectory, which is all but assured by its $3.5T parentco, YouTube TV wants a better rate than other distributors. And that, of course, would be a bridge too far to ESPN. Since its origins, the cable video business has been beholden to most favored nation clauses, which assure bigger distributors like Comcast that they’re getting the best rate. If ESPN were to give in to YouTube TV’s demand, the M.F.N. clauses would likely kick in, and chairman Jimmy Pitaro would presumably have to offer the same rate to Comcast, DirecTV, and Charter. (And if they don’t have M.F.N. clauses, they’ll likely have new affiliate sales executives.) I’m told that Disney views this sort of capitulation as a major concession.” The dispute, Ourand writes, underscores a power shift in the pay-TV ecosystem: once, networks like ESPN held all the leverage during football season; now, YouTube can weather marquee games going dark. American Council of Trustees and Alumni President Michael Poliakoff sent a letter to Big Ten presidents and chancellors today urging them to abstain from voting on the capital investment deal. From the letter: “All governing board members … have a responsibility to ensure that America’s institutions act in the best interest of all stakeholders, especially the public. And yet there is a credible claim that governing boards have received insufficient information to make any such determination with respect to the Big Ten Enterprises proposal. This would be a shocking lack of transparency given the stakes of this transaction. … To restore integrity to this process, we urge each governing board to adopt a clear resolution requiring that: the university president or chancellor abstain from any Big Ten vote on the proposed transaction until his or her governing board has been fully briefed; the board is provided with all relevant documents, analyses and legal opinions and; the board has formally authorized the president or chancellor to vote on behalf of the institution. Furthermore, the Big Ten’s governance structure should be amended to ensure that boards of trustees and regents are not merely informed but serve as the ultimate authorities on any future decision involving the sale, transfer or monetization of university-owned athletic assets.” Full text. (link)

Front Office Sports’ Amanda Christovich gets this from an unnamed B1G board member: “some are discussing the possibility of litigation to force university presidents to share details of the investment proposal with board members. The first board member suggested to FOS that Congress or governors’ offices could assert themselves into this process as well. [...] Finally, board members could also threaten the jobs of their university presidents. Michigan and USC’s presidents are especially vulnerable, as they are serving on an interim basis.” (link)

“I think we need about $20 million of new cash." That was Washington State President Betsy Cantwell’s response to a query on how much the Cougars need to distribute to student-athletes each year via NIL and rev sharing. Cantwell: “Right now, we're at the bottom of every team coming into the Pac-12 for football in NIL. … We cannot stay there and compete and win. We must be winners, we must, in football, within four years (sit atop the Pac-12) because that is the time that every single media rights contract across all of college football, every conference, is up for grabs again. Between now and then, not only do we have to compete and win in football, in our conference, but we also have to exude the cool that comes with being part of a startup that we want everyone to pay attention to. NIL has a huge impact on what we are able to do competitively. [...] What we haven't learned to do, as well as our peers coming in (to the Pac-12), is fundraise for NIL to give our coach some tools that are absolutely necessary to compete and win … Football is the thing that is going to put us in a primacy position when we get to the next round of media rights changes. So (this) is the moment. [...] If we don't compete and win in football that is trouble for this institution. Like it or not is irrelevant, it's a fact.” More from Cantwell. (link)

In a Q&A with Arkansas Business, Little Rock AD Frank Cuervo discussed a number of topics, including how NIL has impacted the Trojans: “We made the early and strategic decision to opt in on the historic House settlement. For us, it wasn’t a difficult choice. We want Little Rock Athletics to compete nationally, and to do that, we must operate with the same sophistication and support structures as our peers. Opting in positioned us to recruit and retain the very best student-athletes available, while also showing our commitment to doing things the right way and being forward-thinking in our approach. To make that possible, we fundamentally restructured the way our department operates. We’ve aligned our resources, staffing and strategy to meet the moment, to ensure that our programs have what they need to succeed in this new era.” More from Cuervo. (link)

Search firms are the beneficiary of increased economic pressure on colleges, per SBJ’s Terry Lefton, who notes that “means more and bigger hires, shorter tenures for some high-profile positions and searches far outside of lifetime college coaches and ADs to fill those same roles.” TurnkeyZRG Chairman Len Perna: “Sports are a high-growth industry compared to most any, and I don’t see any slowdown. Somewhere around 20 to 30% of our business is college, and we had none just a few years ago. The trend that’s growing is looking farther outside the usual areas.” Elevate Chief People Officer Liz Moulton: “I’d say there’s the most uncertainty in college, but also the most opportunity. There’s disruption across college, golf and other places, so the institutions are looking for innovators who can create new models and get ahead of some of those [disrupting] issues. You’re also seeing new investors across sports, who come with more urgency.” Excel Sports Management President, Excel Search & Advisory Chad Biagini: “The professionalization of college administrators is helping everyone’s business in search.” More. The City of Pasadena and the Rose Bowl Operating Co. have requested a preliminary injunction and temporary restraining order “seeking to prevent UCLA from leaving the Rose Bowl or terminating its stadium lease until pending litigation against the school is resolved,” per the Los Angeles Times’ Ben Bolch, who notes a hearing has tentatively been scheduled for Wednesday morning. From Monday’s filing: “There is no way to sugarcoat it: UCLA has confirmed its imminent departure, severely destabilizing Plaintiffs’ core operations. Those operations are structured around and contingent upon UCLA. Without confirmation that UCLA intends to honor its contractual commitments — at least during the pendency of this litigation — Plaintiffs are deprived of the ability to plan and manage the stadium’s schedule and their ongoing business operations, including cultivating and securing future business partners and opportunities, retaining personnel, and maintaining confidence among the many vendors and sponsors who rely on UCLA Football. Equally troubling is the precedent UCLA is setting. Stadium and arena public-private partnerships, and the financing that makes them possible, turn on enforceable, long-term contracts, with terms that typically follow the public debt incurred. UCLA’s attempt to break its contract decades early critically undermines these structures.” (link)

UNC Greensboro has officially renamed Fleming Gym as Bodford Arena in honor of Alvin “Al” Bodford and the Bodford family for continued philanthropic support that included a recent $2M commitment that served as the largest gift of unrestricted support in Spartan Athletics history. Besides funding for athletics’ greatest needs, the gift will also provide for numerous updates to the space including vibrant new graphics, an updated entryway and ticket office and a selfie station for Spartan fans and recruits. Prominent U.S. sportsbooks are establishing a nationwide $200 betting limit on baseball wagers focused on individual pitches and prohibiting those bets from being included in parlays in an attempt to decrease manipulation incentive, per ESPN’s David Purdum, who adds Major League Baseball and authorized sportsbook partners have been in discussions about potential alterations to betting menus and limits since the summer. Noting the league has worked with the sportsbook industry to “uphold our most important priority: protecting the integrity of our games for the fans,” MLB Commissioner Rob Manfred remarked: “I commend the industry for working with us to take action on a national solution to address the risks posed by these pitch-level markets, which are particularly vulnerable to integrity concerns.” This comes after Cleveland Guardians pitchers Luis Ortiz and Emmanuel Clase were indicted over the weekend for allegedly fixing prop bets on individual pitches that won gamblers around $450K.
