President Donald Trump on Friday shared his take on NIL and the priority for funding to go to football programs: “I think that it’s a disaster for college sports. I think it’s a disaster for the Olympics. We’re losing a lot of teams. Colleges are cutting their, they would call them, sort of the lesser sports. They’re losing them at numbers nobody can believe. And they were really training grounds, beautiful training grounds. Hard-working, wonderful young people. They were training grounds for the Olympics, and a lot of these sports that were training so well would win gold medals because of it. Those sports don’t exist because they’re putting all that money into football. And, by the way, they’re putting too much money into football because colleges don’t make – even the most successful universities don’t make that much money. … I think the NIL is a disaster for sports. It’s horrible for the Olympics. I think it’s actually horrible for the players. And you’re losing all of these great sports. They’re not college football.” Trump also believes in a salary cap, especially given the strain that not having one puts on athletic department finances. Trump: “You’re going to have these colleges wipe themselves out, and something ought to be done. And I’m willing to put the federal government behind it. But if it’s not done fast, you’re going to wipe out colleges. They’re going to get wiped out, including ones that do well in football. They can’t pay $12M, $14M, $10M, $6M for players. They won’t be able to stop. There’ll always be that one player, they only have that player, they’re going to win the national championship. And they’ll have 100 colleges thinking the same thing. SBJ’s Chris Smith was in Las Vegas for the Intercollegiate Athletics Forum when the Utah-Otro Capital news hit & gathered some insights from those at the event on the high-profile topic of private equity…
➤ Davis Polk Partner/Head IP & Commercial Transactions practice Frank Azzopardi: “You need to be very careful that you’re not sharing profits. And so that’s why even in the announced deal with Utah, it’s a revenue-sharing deal rather than a profit-sharing deal. It’s a very powerful thing to be a not-for-profit entity, and the IRS will audit and will not just take a structure on its face. It’s a fact-intensive exercise. And so I think in terms of the public announcement on the latest deal, they’ve certainly hit the right notes, but that will not be the end of the exercise.”
➤ J.P. Morgan Global Co-head of Sports Investment Banking Eric Menell on a potential deal between Florida State & Sixth Street earlier in the year that didn’t get past the finish line: “One of the best ways to blow up a school is if you have puts and calls at the end, where the private equity firm can force an exit, and the school has to come up with the money to pay for it. So what we set up was a very long revenue entitlement. There was no actual formal exit; at the end of a certain period of time, the economics reverted back to Florida State.”
➤ MAC Commissioner Jon Steinbrecher: “Is it an investment or is it a loan? A loan’s not exactly what I need right now. I’m just kicking the can down the road for the next AD or commissioner or president. If it’s an investment, then things get interesting. And my presidents have encouraged us to be creative and to be open-minded and to explore, but we haven’t hit on that magic elixir quite yet.”
➤ Colorado State AD John Weber: “We’re considering things that would allow us to do some outside investments that would actually generate cash back for athletics, as opposed to spinning off portions of a revenue stream to another ownership model. ... I don’t know that any of us have really hit on what the true future investable vehicle is for collegiate athletics, but someone’s going to figure it out here soon.”
➤ Also, Ohio State AD Ross Bjork to the Washington Post: “We have the biggest operating budget in the country — $320-ish million — and we spend every penny. It’s not like we’re spitting off a 10% profit every year. We have to operate basically 34 sports (of 36) at a loss, and if we have the same number of sports as, say, Texas (with 21 teams), we have a $60 million problem. We don’t, so we need to be creative. We need to drive more revenue. If that’s a permanent capital revenue partner, maybe that’s the way to do it.”

Playfly Founder/Executive Chair Michael Schreiber and Big 12 Chief Brand & Business Officer Tyrell Kirkham join the Access Holdings podcast to discuss the state of college sports from their perspective, and Schreiber observes: “We wanted to build a company that could support ADs as they go through their own learning curve or when a new AD comes in—driving all of their commercial optimization across ticketing, sponsorship, naming rights, you name it.” Schreiber goes on to say the “interesting thing about sports and especially live sports, when you think about it, it's really the only category in the whole media ecosystem that's fully resilient to technology change. So we've been through so many evolutions in live sports. I mean, it started on the radio. … Now you're hitting the AI revolution, what's going to happen to live sports? But if you think about all the other media categories, whether you're talking about filmed entertainment, whether you're talking about news, you name it, they all have vulnerabilities. With the upcoming launch of the new Pac-12, conference leaders, university presidents and media partners are highlighting a rare “blank slate” moment, defined by rebuilding, brand equity and establishing long-term relevance amid a shifting college sports landscape, per SBJ’s Mary Gaughan. Pac-12 Commissioner Teresa Gould from SBJ’s Intercollegiate Athletics Forum: “There were certainly a lot of people in that spring that said, ‘You’re going to captain the Titanic. I said, ‘No, I’m going to jump in the foxhole and fight for student athletes ... to find the path forward and the bright future that they deserve.’” Fresno State AD Garrett Klassy: “We represent 3M people in the Central Valley … and we just felt like Fresno State’s student-athletes deserved a national platform. We don’t have to worry about 30 years of bad habits. We get to build a conference based on the modern student-athlete experience.” (link)

“We will have to continue to make sure that we’re within the framework that we can be effective, and that we’re giving our coaches and our student-athletes the best opportunity. We are incentivized at a high level, because there’s no one (who) wants to win more than our coaches, no one wants to win more than our student-athletes and our fans. Why in the world would we do anything but give ourselves the best chance to do that?” That’s Kentucky AD Mitch Barnhart on the debate of how UK’s deal with JMI impacts NIL in Lexington. More from Barnhart: “There’s other schools doing it very similar to what we’re doing. Whether that is through their multimedia rights partner, they’re bringing some of their collectives in house, absolutely they are. There is no one size fits all. I think that’s what everyone wants to assume, is there’s only one way. There is not only one way. There’s multiple ways to do this thing, and we think this is effective for us. ... We’ve got great people that have done an amazing job in the JMI world of providing us resources for our program, and they are concerned. It doesn’t benefit them to restrict us or to hurt our program or not give us the best chance to put the best roster we can on the court or on the field or wherever that happens to be.” (link)

On the ACC’s revenue share model: “The ironic thing about this is when I joined the Big 12 in 2009 as athletic director at Kansas State … I went from the SEC where everything was equal sharing … to the Big 12, and I learned that in the Big 12, out of the original formation of the league in the 1990s, right? 50% of the television revenue went into the pot and was shared equally among 12 schools. The other 50% of the revenue went into the pot and if … you were on broadcast television like ABC, you got $350K that week. If you were on cable, and I think we had TNT then … you got $180K and if you weren't selected for either of those two, you could go on Fox College Sports and get $10K, or you could go pay-per-view, like Joe [Castiglione] would do at Oklahoma and he'd make a lot more money on that, or you could just not be on TV because you didn't want to hurt your gate. … So, basically every Monday you would find out what the selections were for the following week. Well, guess what? Texas, Nebraska, Texas A&M, Oklahoma, were always going to be the front leaders for the ABC slots. Now this year, the ACC, we basically have gone back to the future with that model. And the good thing about it, from my perspective, is it’s actually progressive. … How can we schedule most creatively so that we have the best window? And that means we're being a better partner at Wake Forest to our big partner, ESPN, because we're willing to move a game to week zero or move a game to Thursday night or whatever. … I also know that the difference in our revenue, candidly, there's no big secret, we'll get less television revenue than we got last year, but it's still a variable that isn't the variable that determines whether we're successful.” (link)

➤ Charlotte has altered its 2026 non-conference football slate, per FBSchedules.com. Originally set to begin a home-and-home series against Ole Miss by hosting the Rebels on Sept. 12, 2026, that game has now shifted locations and will instead be played on the same date in Oxford. The return game against Ole Miss will be played as scheduled in Oxford on Sept. 4, 2027, meaning the 49ers will now travel to battle the Rebels in consecutive seasons in 2026 & 2027. With the loss of the 2026 home contest against Ole Miss, Charlotte’s road game against Louisville slated for Sept. 26, 2026, has been canceled and will be replaced by a home contest to be announced later. The Charlotte Observer’s Hunter Bailey provides some additional clarity on the schedule alterations, reporting: “Ole Miss will pay Charlotte $1.8M for the [2026] matchup in Oxford, and $1.4M for the 2027 game. To replace the game at Louisville, Charlotte is working on a home-and-home deal with a G5 school. Charlotte & Louisville intend to reschedule a future matchup, but the 49ers will add the G5 home-and-home in its place, starting at home in 2026. ➤ USC has added a game against Louisiana to its 2026 football schedule, per FBSchedules.com, who notes the first-ever match-up between the two programs, slated for Sept. 12, 2026, will be played at the L.A. Yahoo’s Ross Dellenger broke the news that the Big 12 is finalizing a deal with RedBird and Weatherford Capital - via their joint Collegiate Athletic Solutions (CAS) investment vehicle - that would infuse as much as $500M into Big 12 members who opt-in through a “multifaceted strategic business partnership,” with a focus on growing commercial operations. Here are more nuggets from a number of sources…
➤ CAS is offering roughly $30 million to each member school in a capital credit line at a reduced rate. Schools are not required to accept the capital. Also, deals like Utah’s with Otro Capital would not be impacted.
➤ “CAS would put $25 million into a new entity called Big 12 properties that would house some of the league’s commercial rights.”
➤ “RedBird will also work with the Conference to identify complementary investment opportunities inside and outside of the collegiate athletics ecosystem that will create new revenue streams and long-term asset appreciation.”
➤ “Schools will be able to opt into the funds, with participants conceding future conference distributions for the upfront cash, a source said. In other words, CAS would share in revenue generated under the partnership with the involved schools. There is no equity involved in the current proposal, and no grant of rights would be signed by the conference’s 16 members as part of the deal because it is time-limited to the league’s current media deals, according to the source.”

As he approaches the end of his 28-year tenure, Oklahoma AD Joe Castiglione rejected the idea of “retirement,” instead preferring “refocus, repurpose, redirect, recalibrate.” He told attendees at SBJ’s Intercollegiate Athletics Forum that he won’t be “sitting back and doing nothing,” emphasizing that any success during his tenure was the product of “the great people that we’ve had, the collective efforts of everybody, the great intellect and skill and creativity and innovation that they bring to whatever role it is that they have.” For the next generation of ADs, Castiglione advises controlling the controllables. “We are burning through resources faster than they come in sometimes. And being very wise in the area of revenue generation and all the different vehicles that are available for us. … ADs have got to be willing to look at new models that can help us manage the world going forward, still be RevGen, still be relational, still have the ability to hire and retain great coaches and as well as your staff, still connect with stakeholders. We’re in a world that we’re going to constantly have to pivot and be flexible, and that’s the nature of our business right now.” (link)

The University of Michigan Board of Regents has authorized the law firm Jenner & Block to expand its investigation into the "situation" around former Football HC Sherrone Moore's firing. The firm was previously hired to investigate the allegations against Moore weeks ago, when the board first heard the rumors. According to the Detroit News’ Sarah Atwood: “The firm's investigation into the entire situation will continue and look into the way Moore's firing was handled and the culture of the athletic department that allowed his relationship with a subordinate to go on.” Of note, Jenner & Block is the same firm the university's board hired to investigate the allegations of former President Mark Schlissel's relationship with a university employee. Memphis AD Ed Scott talks about the pressure he feels in the AD chair, noting that he “has a city that’s relying on me,” as well as staff that have moved from around the country. “They feed their families because of decisions that I make. I make decisions on behalf of 400 student-athletes every day about what’s in their best interests and over 200 staff members, and we’re going to have a budget this year of about $80M. I feel a lot of pressure every day. I’m the first Black AD in the history of Memphis. I can’t fail. I will not fail because if I do, people who look like me don’t get a shot. And it’s not just Black people. It’s brown people, it’s women, it’s everybody else. So, yeah, I feel pressure every day. And I’m okay with that. … I’m not afraid of pressure. Kansas State AD Gene Taylor sits down for his latest Ask the AD segment. On being aggressive in the NIL space: “I would say we're very aggressive. The challenge for us has been we've had to focus so heavily on the $20,500,000 because we have to get that. Where a lot of schools are getting significant investments from their university. We work with our university, but right now, this first year, we have to fund that all through our donors and through our other revenue sources. So we haven't had a chance to really go out and get aggressive. Now that we've got the 20 million mostly in place, that's our next focus.” On private equity: “We did early on look at private equity several months ago, when it was just starting to come into college athletics. It didn't work for us. Our donors were... not skeptical, but it's just there's a lot of percentage that they take out of that they want back out of that private equity. The Utah thing's a little unique. I haven't studied it enough to really dive into it deeply. It's a little different. There are some things when I read it that I would be uncomfortable as the Athletic Director of giving up in terms of what they're doing there.” (link)

Cats Illustrated’s Justin Rowland reports that the dispute over Kentucky’s NIL structure with JMI is being driven less by new contractual revelations than by competing internal narratives about how the model is functioning in practice. Administration- and JMI-aligned sources continue to argue the deal is structurally sound and consistent with UK’s longstanding multimedia approach. Meanwhile, Rowland notes that recent struggles, including basketball’s lack of early-period signees, have intensified questions about whether the fine print of the JMI arrangement is constraining NIL execution, even as UK and JMI maintain it does not block outside opportunities. Rowland also highlights the strategic upside argument made by supporters of the deal as one source pointed above-the-cap NIL deals that most SEC schools cannot replicate: “UK has been getting six figures as an appearance fee for the head coach to be in commercials. … There’s no reason that isn’t able to translate to players as well and that should all be above-the-cap deals for their players that gives Kentucky a major advantage.” Another adds: “The ability for JMI to upsell their current sponsors on the use of players through legitimate, above-the-cap NIL deals should be a major advantage to UK through JMI.” (link)

Former Nebraska Football HC/current UCF HC Scott Frost is suing Nebraska and its board of regents over a tax liability he claims he never received. The suit, filed in the District Court of Lancaster County, Nebraska, indicates that the school told him in December 2022, just months after he was fired, that it planned to “include the present value of its 2025 and 2026 liquidated damages payments.” Frost argues the move was not correct and that it created a $1.7M tax liability he did not receive. Frost also claims the payments were guaranteed, therefore were not able to be reduced, offset or forfeited. Frost is seeking no less than $5M. More. (link)

Pete Golding’s new contract as Ole Miss’ Football HC starts with a base salary of $6.8M in Year 1, with $100K annual increases that raise his base to $7.2M by 2030; his deal also includes supplemental compensation paid by the Ole Miss Athletics Foundation, SEC win bonuses of $150K per regular-season victory starting with the fifth win, postseason incentives capped at $400K for reaching the SEC Championship Game and $1M for bowl or College Football Playoff appearances, and a buyout that pays him 75% of remaining OMAF compensation if fired without cause, while requiring him to repay 100% (50% within 30 days, 50% within one year) if he leaves for another job. New OC John David Baker will earn $1M annually through 2027, with a $100K base salary increase beginning Feb. 1, 2027, plus performance incentives. Special Teams Coordinator Jake Schoonover will make $575K through Jan. 31, 2027, increasing to $650K through Jan. 31, 2028, while offensive line coach John Garrison will earn $850K through Jan. 31, 2028. Defensive coordinator Bryan Brown, whose contract designates him as “Head Coach of Defense,” will earn $1.2M through Jan. 31, 2027, rising to $1.3M through Jan. 31, 2028. (link)

Terms of new Toledo Football HC Mike Jacobs’ five-year deal through Dec. 31, 2030, have been released via The Toledo Blade. He’s guaranteed annual compensation of $1M, plus bonuses, including $500K in base salary and $500K in annual marketing compensation with an annual increase of $100K beginning in year two (2027). Jacobs will be eligible for an automatic one-year extension for winning nine regular season games and/or making a MAC Championship game appearance with the additional year added at $100K above the final year of the agreement. Numerous bonus incentives are available, including $25K for a regular season conference crown or FBS bowl appearance, $50K for a FBS bowl win, $100K for a CFP appearance and $2M for a national title. He can also earn bonus money of $100K for reaching eight regular season victories and potentially make as much $500K for a 12-win season. The deal is 100% guaranteed with the total remaining base salary to be paid at the date of termination with mitigation and offset.
