On-going federal case Johnson v. NCAA could “lead to a new order in college sports that restates the economic relationship between athletes and their schools,” per Sportico’s Michael McCann, who notes with a deadline of next Tuesday to explain “efforts” to reach a settlement, whatever is disclosed will be enlightening. McCann: “If the parties don’t reach a settlement, and Johnson advances past a motion to dismiss, the case will progress toward potential pretrial discovery that would be much more invasive than what schools faced in House v. NCAA and other antitrust litigation. And if Johnson goes to trial and the athletes win, the NCAA and member schools could be on the hook to pay billions of dollars in damages. … A denial [of the NCAA’s motion to dismiss] by [Judge John] Padova would move the case into another phase where the judge will determine if the case should become a class action—possibly on behalf of all Division I college athletes dating back to 2016 or 2017—and oversee pretrial discovery. … Like House, Johnson could settle at some point, with a settlement paying many thousands of former and current college athletes and changing rules to acknowledge them as student employees. The alternative is to gamble the courts will side with the NCAA. That hasn’t been a good bet of late.” More. (link)

Nebraska plans to significantly increase its scholarship allocation via a three-year phased approach that will see the school eventually provide the maximum number of allowable scholarships for women’s sports, and approximately 80% of the maximum amount for men’s sports, for a total of 433 for the 2028-29 campaign. The process will start through the addition of 78 new scholarships for the 2026-27 academic year, including 48 grants for female and 30 for male student-athletes, lifting the department’s total scholarship number to 360. NU plans to continue the process with the addition of 32 scholarships in 2027-28 (17 for women/15 for men) and 41 awards in 2028-29 (31 for women/10 for men). Nebraska AD Troy Dannen: “The decision to significantly increase our number of scholarships reaffirms Nebraska’s commitment to the student-athlete. This will not only help each of our teams compete at a high level, but it will also better support many student-athletes in their education and pursuit of a college degree.” (link)

Portland AD Scott Leykam visited with John Canzano on The Baldcast to provide his “State of the Union” on the Pilots’ athletics department, dig into the current state of the West Coast Conference and more. Here are some key takeaways…
➤ On the changing environment in college athletics: “It's adapt or perish. You have to see where the opportunity still exists to be successful. I think for a school like ours, it's how do you be as good as you can be and still stay true to the university mission and values. But the reality is … when we became a billion-dollar industry with TV rights and otherwise 10, 15 years ago, it was going to change. And it has changed, and it's changed quickly, and we have to adapt. And if you don't like it, don't do it anymore. But it's all about adapting. Some of it's great. I mean, every day is something new, but it's happened probably a lot quicker than a lot of us would like.”
➤ The state of the WCC: “I feel good with where we are from a membership standpoint, right? … Once you get down to eight or nine members, you're one or two defections away from not existing anymore, and that's obviously not what we want for this conference. We're bummed Gonzaga is leaving. I'm happy for them. I think they've earned a chance to explore, but we'll miss that rivalry and that partnership in the league. Oregon State, Washington State, that was a great fit for everybody. … I like the Denver add a lot, for a lot of sports, and know that they will make the investment they need in basketball. Seattle is a school that should have been in our league 10, 15 years ago. UC San Diego is just a different model, and I hope it's a model that we continue to explore. This is a league that was, when I got to the conference office in 2008, small private schools. And then we took that chance on BYU, which was a large private school and it worked. And then we took two-year chances on Washington State and Oregon State, large public schools and it worked. So you can't sit on your laurels, but I feel a lot better than where we were this time last year and know that we still have some expanding to do.” More from Leykam. (link)

Tennessee Football student-athlete Joey Aguilar has been granted a 15-day temporary restraining order by Knox County Chancery Court Chancellor Christopher Heagerty, prohibiting the NCAA from restricting Aguilar’s eligibility because he played junior college football prior to his DI career, per the Knoxville News Sentinel’s Adam Sparks. The TRO serves as a temporary stop gap ahead of the preliminary injunction hearing that is now expected to be set for Feb. 13, per ESPN’s Pete Thamel. Heagerty cited four reasons for issuing the emergency TRO: Plaintiff has demonstrated a substantial likelihood of success on the merits of his claim that the NCAA’s “JUCO rule” violated the Tennessee Trade Practices Act; immediate and irreparable injury will result to the Plaintiff if the restraining order is not issued; The balance of harms favor Plaintiff. The requested relief runs only to Aguilar. And the NCAA suffers no harm if Aguilar can play NCAA football for a fourth full season; and no adequate remedy of law exists before a hearing can be had due to the time-sensitive nature of Plaintiff’s claim. The NCAA has released a statement regarding Tennessee Football student-athlete Joey Aguilar’s TRO that reads: “This outcome – after the plaintiff withdrew from a federal lawsuit and separately filed a lawsuit in state court with the exact same facts – illustrates the impossible situation created by differing court decisions that serve to undermine rules agreed to by the same NCAA members who later challenge them in court. We will continue to defend the NCAA’s eligibility rules against repeated attempts to rob high school students of the opportunity to compete in college and experience the life-changing opportunities only college sports can create. The NCAA and its member schools are making changes to deliver more benefits to student-athletes, but the patchwork of state laws and inconsistent, conflicting court decisions make partnering with Congress essential to provide stability for all college athletes.” (link)

Attorneys for Alabama Men’s Basketball student-athlete Charles Bediako have filed a motion “requesting that his preliminary injunction hearing scheduled for Friday be postponed until February 16-18,” per Bama247’s Mike Rodak, who notes the attorneys “listed discovery questions for the NCAA they want answered before the injunction hearing,” while also sending the NCAA “a list of admissions regarding the eligibility of international professional basketball players.” (link)

We're able to put our band, our spirit squads, which require a lot of rooms, in one hotel property, and then there's plenty of rooms available for fans as well. … So, I think when you couple those in, and again to one of the most lucrative deals that we've had in the history of the conference, that really I think made it a unanimous decision.” (link)

NCAA President Charlie Baker tells Sports Illustrated that the upcoming 2026 men’s and women’s basketball tournaments could be the last to feature 68 teams, calling it a “good question” and acknowledging that the organization is "working to see if we can make it 72 or 76" for 2027 and beyond. Baker also tells SI’s Pat Forde that every expansion has been with resistance: "Everyone thought the world was going to come to an end. And it didn’t." Addressing concerns that additional at-large bids would disproportionately benefit mediocre power conference teams, Baker says he remains unconvinced that would be the sole outcome; however, Forde notes that “in both 2024 and ’25, three of the four teams on the wrong side of the bubble were from power conferences. In 2023, all four of those teams came from power leagues.” (link)

More from NCAA President Charlie Baker, who criticizes schools backing eligibility lawsuits for professional players, accusing them of wanting to avoid playing "by the same rules everyone else is" and making the rulebook "disingenuous." Baker's comments to Sports Illustrated’s Pat Forde come ahead of a Friday preliminary injunction hearing for Alabama center Charles Bediako, whose TRO has allowed him to play since Jan. 24 despite signing multiple NBA contracts. Baker warns that a ruling in Bediako's favor could set a precedent for others, like former UCLA player Amari Bailey—who appeared in 10 NBA games—to return to college, potentially displacing high school recruits. Baker also notes that a string of state court rulings that favor local programs don’t quite reconcile with federal rulings and says: “We have to marry those two tracks, the state courts and the federal courts. ACC Commissioner Jim Phillips tells SBJ’s Ben Portnoy there’s “not a day that goes by that we don’t strategize and discuss the revenue piece or the marketing and branding piece. I think there’s some areas within sport, technology and innovation [we can look at]. Data and analytics have become even more important. We’re always looking at those. The use of AI — is there a role from not only revenue perspective, but just overall efficiencies within the organization? We’re going to stay aggressive, and that’s where we’ve been. We haven’t been able to just kind of rest on previous positions or rest on having all the resources that maybe some other conferences have. It continues to be such an important priority for us as we look into the future. ... When you look at revenue, [we’re] at an all-time high. Sponsorship is at an all-time high. … Moving forward, we’re well positioned as we go into 2026 and beyond, but nobody’s resting around 620 Tryon St. (ACC HQ), I can promise you that. I’ve never operated that way, and I’ve never led that way. There’s more for us to do. Some of it, I’m sure we don’t even know what we’re going to have to do when you look at five or 10 years from now, but we’ll continue to figure that out. More on the Mountain West’s new media rights deal from The Athletic’s Chris Vannini, who reports that financial terms were not disclosed, but Commissioner Gloria Nevarez confirmed legacy members will maintain their ~$3.5M annual payout, potentially subsidized by league reserves amid ongoing litigation with the Pac-12. The deal features approximately 41 football games on linear TV, including the championship game on Fox Sports, while the conference's app will transition to a paid subscription model with two pricing tiers launching in July. Schools will directly earn money based on the specific number of subscriptions they drive. Nevarez on the decision to put the app behind a paywall: “For years, we’ve been building the app, and we’re really proud of the platform and the quality of production. In this day and age of revenue sharing and NIL, we felt it was time to bet on ourselves and put a paywall around it knowing that dollars from subscriptions will go back to the school that brought those in.” (link)

The OVC commissioner search is advancing, with virtual interviews expected to begin the week of February 16 followed by in-person rounds in late February and early March, according to CollegeAD. WittKieffer is managing the process to replace Beth DeBauche, with sources indicating the salary range for the next commissioner will be $250K to $300K—a reduction from the $340,000 DeBauche was earning. Following a Tuesday ruling by the Oklahoma Supreme Court that the gist of a local resident petition opposing Oklahoma’s intention to build a new arena proved insufficient, Oklahoma and the city of Norman are now prepared to move forward with the building of a $1.2B entertainment district in Rock Creek that’s expected to include a nearly $330M arena to succeed the Lloyd Noble Center. Per SoonerScoop’s George Stoia, “The arena is expected to seat around 8K fans and would be the home for OU men’s and women’s basketball, as well as women’s gymnastics. New Colorado AD Fernando Lovo’s first month in Boulder “hasn’t been about sweeping changes,” according to On SI’s Ben Armendariz, but rather about “listening, learning, and laying a strong foundation.” Lovo: “For me, [Colorado] was a destination and a place I know we can win and win at a high level. And are you kidding me, living in Boulder? I’ll take that every day. … I’ve had incredible meetings, and I’m excited. D1Baseball’s Kendall Rogers reports there is a “great deal of confidence that the number of allowable fall games will increase from 2 to 4 during April voting with the D1 Council. The measure I'm told, had overwhelming support amongst the Division I Baseball Oversight Committee, and was pushed forward.” He adds: “Here's more scoop for you. It is still in the 'discussion' stages, but there appears to be at least some momentum involved in the potential of moving the [NCAA baseball] season back to a first weekend of March start date.
