LEARFIELD CEO Gahagan tackles several topics with Fox Sports/Connect’s Fischer at the 2023 NACDA Convention, including the evolution of multimedia rights deals, how brands are responding to the growth of women’s sports, the impact of NIL on fan engagement and lots more. Inflation, Gahagan tells Fischer, is not having any “meaningful impact” on brand partnerships. “In fact, if anything, we continue to see growth of our multimedia rights advertising business, both at the national level and at the local level. I think the signs are positive for fiscal ‘24. We're encouraged by every discussion that we're having right now across our properties and, again, even with some more bigger brand national partners, so there doesn't seem to be any indication right now that there's pullback at least in our business.” Gahagan also mentions that LEARFIELD has made great strides in diversity and inclusion within its own company over the past two years and explains how that has positively affected not only the company’s culture, but also its business dealings. “If we’re leading by being more diverse if we're leading by greater inclusivity inside of our own walls then it makes it so much easier to have conversations in earnest with brands about leading with that mission as well, and it's really resonated more and more with brands as they wanted to create campaigns to speak to the female audience.” The full conversation is now available on Connect. JohnCanzano.com’s eponymous namesake reports that Pac-12 Commissioner Kliavkoff met with notable SMU donor Miller during Kliavkoff’s trip to a Mustangs men’s hoops game back in February. “Said one SMU source who interacted with Miller at the game. He walked up to me, leaned into me, and whispered ‘We had a very good day.’ … In fact, Miller and several other elite SMU donors spent the rest of that evening quietly celebrating what they believed was a major step toward joining the Power 5 Conference.” A member of the Pac-12 CEO group also confirms Miller has “been involved” with SMU’s P5 ambitions. Despite not having been formally invited by the Pac-12, both SMU and San Diego State “are acting like they know an invitation is coming,” according to Canzano, who cites an SMU campus source as saying over the weekend: “If they expand, we’re in.” While leaving the AAC requires 27 months’ notice and a $10M exit fee. Canzano says he spoke with “several high-profile SMU donors in the last week. One of them runs his own private-equity firm. Another is in the oil business. A third specializes in mergers and acquisitions. Collectively, they painted the same picture — SMU’s donors are motivated and willing to subsidize the school’s entry into the Pac-12.” One donor remarked: “The pockets are there. Money isn’t an issue.” (link)

Tulsa AD Dickson says the Golden Hurricane is closing in on setting a record for number of donors and dollars raised during the annual Champions Fund, which helps the athletic department cover roughly $2.5M in scholarships that aren’t endowed. Dickson also talks about NIL, saying there’s “probably no question that it needed [to be] revamped. We’d operated a certain way for over a century. Things have changed. Probably didn’t do the best job out of the gate when we brought in this whole NIL thing. What we were trying to do was mirror what the Olympics had done for its athletes, which was really just to allow additional support. Somehow, we interpreted that to mean you could just raise money and entice kids. That never was what it was meant to be.” More. (link)

UNC Asheville unveils its $20M ALL IN comprehensive capital campaign meant to “significantly improve the student-athlete experience for eleven of the Bulldogs' 16 sports programs.” Projects to be undertaken include improvements to Karl Straus Track, where the school will install an eight-lane resurfaced track, brand new video and scoreboard, and additional seating. To date, $4M has been raised for this project, which is already underway and slated to be complete next month. Upgrades to the soccer complex, including a synthetic turf field, new grandstands, a press box, and an expanded fieldhouse are also part of the campaign. (link)

Syracuse AD Wildhack wraps up the 2022-23 athletic year in a press conference with reporters. Asked if the Orange would like to move NIL operations in-house, Wildhack says: “We still have to see what happens with the legislation, so I don’t want to be too premature with my answer.” On the facilities front, Wildhack expects 5G to be functional inside the JMA Wireless Dome in time for the fall and says a full reseating of the dome is on pace to be finished for the 2024 football season. Since prominent supporter Weitsman announced he would no longer provide NIL support, Wildhack says a number of people have stepped up “in significant ways to support our NIL efforts. They’ve done so quietly. We were thankful to Adam for his support, but we’ve had others who have stepped up, and I think we’re in a better place today with NIL than we were 90 days ago.” Full presser. (link)

Construction of Montana’s $10.2M Grizzly Indoor Practice Facility has been paused for about a month, per 406 MT Sports’ Speltz, who notes: “At this point it's looking like the 111K-square-foot structure will not be available until sometime in mid-December at the earliest.” Grizzlies AD Haslam explains there have been permitting issues with the city, but “they just gave approval for us to move forward with what's called a foundational permit. So work will start up in the next couple of days. You certainly want to keep it moving along and we're glad to get it going again. … It's a building that has not been built before, so I think there were some questions on that. Depending on how quickly the (construction) time can be made up, hopefully we are done by Christmastime, December.” (link)

Evansville AD Siegfried talks about the formation of the Pathway to Excellence strategic plan, which was put together with the help of UE alumnus and former Missouri AD Alden through Alden’s firm MRJ Advisors. On the plan itself, Siegfried explains: “We talked about making this a living document. We’re not looking at grand slams, home runs. We’re looking at getting singles to continue to progress us forward. We want long-term success, so we’re not going to skip any steps.” Those steps include addressing pressing challenges, which Siegfried identifies as creativity and revenue generation. “The importance of prioritizing and allocating resources based on our strategic plan is one of those things. We're talking about how everybody in the athletics department has a responsibility basically to be fundraisers. ... It's really a shift in culture to make sure that there's a very intentional focus on generating revenue.” (link)

The Athletic’s Vannini unpacks The Brandr Group’s lawsuit against EA Sports and points out TBG “alleges EA has told Brandr partner schools that players can individually opt-in to the game without circumventing the Brandr contracts. Brandr claims that is tortious interference because schools have been pressured to potentially violate their Brandr contracts.” From the suit: “TBG heard from certain of its Partner Schools that EA was pressuring schools who had not yet opted in to the Game to approve their participation in the Game by June 30, 2023.” While TBG’s public comments have focused mostly on player representation, Vannini submits the lawsuit is “largely about business” and boils down to this: “If EA can work around our group licensing contracts to make group NIL deals, then group licensing contracts don’t mean anything.” Vannini goes on to clarify that there are no organized boycotts among student-athletes despite such calls from CFBPA Executive Director Stahl. “The CFBPA is not a players union and does not have nearly enough membership to execute a boycott. … There is no organization that speaks for the majority, or even a plurality, of college football players. As of right now at least, there is no boycott.” (link)

Disney is introducing a new advertising framework called Level Up, which is designed to incentivize brands to spend more on women’s sports content, Marketing Brew’s Meyers reports. According to Disney VP of Sports Brand Solutions Maddock, Level Up asks brands to commit to a minimum spend of $5M (tentatively) on women’s sports content via espnW across all the platforms where it has a presence, like live events, linear, streaming, and social media. Maddock notes, though, that an amount has not been finalized. “That’s why we call it a ‘framework,’ because it allows us the flexibility to work with multiple brands with different priorities and KPIs to find the right way in each of the areas on our platform to activate for their brand. But what we are asking is that brands activate with intention in all of those places—that it’s not just cherry-picking one thing.” Brands who participate will also be able to avail themselves of new offerings, including a “partner pod,” where their ads will air together. Before the ads roll, ESPN will note that the “brands that you’re about to see are helping ESPN level up women’s sports,” per Maddock. (link)

Rice AD Karlgaard will step down on August 1 to become the CEO of GSV Summit after nearly a decade leading the Owls. President DesRoches: "Since his arrival on South Main, Joe has overseen a dramatic reshaping of Rice Athletics, providing upgrades to all facets of the student-athlete experience focused on dynamic initiatives in business operations, branding, marketing and fundraising. [...] These initiatives helped position Rice to be one of six schools invited to join the American Athletic Conference beginning with the 2023-24 season, opening up opportunities to improve the visibility and competitiveness of Owl sports programs for years to come. [...] We will soon be launching a national search for our new athletics director and will provide an update on that and the interim leadership of the department in the next month." (link)

West Coast Conference Commissioner Jackson joined Fox Sports/Connect’s Fischer from the 2023 NACDA Convention to discuss the strength of the WCC, navigating and learning the dynamics of the conference, the growth of women’s basketball, NCAA President Baker’s vision and more. Jackson asserts that women’s basketball – as well as women’s sports in general – are undervalued, and he believes college sports is about to see an “explosion” in women’s participation. “To take each of those sports, if it makes sense, and peel them off into the market to improve the financial gain I think is an important component going on here over the next 10 years.” Jackson also talks about Gonzaga being mentioned as a possible expansion candidate for the Big 12 and other leagues. “I don’t view Gonzaga as openly flirting. I think there are entities that are flirting with them and have made it public, but the fact that Gonzaga is an attractive asset to some conferences, it’s nothing new. It’s been happening since 2017. And if I were the leader of Gonzaga – which I’m not – I’d probably owe it to the institution to listen. … My perception is their leadership group is looking forward with the WCC and how we can get better and improve, and that’s been my sense during the 50 days.” The full conversation is now live on Connect. Toledo AD Blair tells SBJ’s Nethery it’s important to keep the athletic departments’ value proposition “in the queue,” as it relates to the overall university. “Within athletics, we can very much be siloed and think everybody just gets it. Well, I’m not sure everybody does get it and as financial pressures ramp up, as enrollment becomes a challenge, I think you’re going to have more people asking that question.” Blair goes on to remark that NIL is too important not to have a senior person overseeing it. “I firmly believe you need a standalone person on top of it, and I think you need somebody at the highest levels to understand how you can intertwine NIL into all the things that you do as an athletic department…from a marketing standpoint, from a branding standpoint, from a sponsorship standpoint, it’s popped up in almost every conversation I’ve had.” More from Blair. + In his notice of termination letter to former Baseball HC Bohannon, Alabama AD Byrne indicated there were other examples of prohibited conduct in the UA employee handbook that also supported letting Bohannon go for cause. Specifically, Byrne cited a violation of university or “departmental policies or procedures,” “dishonest acts,” and “conducting oneself in a manner that is offensive, abusive, unethical, contrary to common decency or morality or brings discredit to the university or lacks civility.” Byrne also cited clauses in Bohannon’s contract, including one which prohibits: “Furnishing by Employee of information or data relating in any manner to any sport, athletic program, or student-athlete, to any individual known to Employee to be or whom Employee should reasonably know to be a gambler, bettor, or bookmaker, or an agent of any such person, or the consorting or associating by Employee with such persons.” (link)

The Brandr Group has filed a complaint against EA Sports alleging tortious interference of a contract and violation of right publicity/misappropriation of likeness, among other claims. From the complaint: “Although TBG expressly informed EA of its exclusive contractual rights at collaborating schools that are implicated by the TBG-represented student-athletes included in the Game, EA is pressuring and coercing or attempting to coerce TBG’s exclusive collaborating universities to opt-in to the Game, agreeing to a structure that will reportedly pay the student-athletes a flat fee that is far below market value and does not include any payments for future royalties. … This is a textbook case of tortious interference by EA of TBG’s contractual rights with thousands of student-athletes and at schools where TBG has exclusive Collaboration Agreements. TBG files this Complaint to prevent EA Sports from intentionally interfering with its contractual rights, violating its right to publicity, and causing irreparable harm to TBG and the student-athletes it represents at collaborating schools.” Full filing. (link); Extra Points’ Brown: “Brandr is NOT suing EA Sports because they feel the group license underpays athletes, although they do believe that. The crux of the lawsuit is over what defines a 'group license' and who should be negotiating one.” (link)

Donors to the Texas-focused Texas One Fund who are also members of the Longhorn Foundation will be able to earn loyalty points by contributing to the collective, On3’s Nakos reports. Texas One Fund Director Smith: “Not only are we helping our student-athletes, we’re also giving donors the benefit which is a gamechanger. As of now, it’s still a tax-deductible donation. The ability for them to get a tax deduction and loyalty points is a really good thing.” While a precise points system has yet to be implemented, the state’s newly amended NIL law allows for easier communication between the collective and Longhorns AD Del Conte, which Smith says gives “us a little more competence.” (link)
