Northern Illinois AD Frazier joins the One Question Leadership Podcast and talks about the number of states that are reducing or eliminating DEI staff positions in higher ed. Frazier explains the topic is “bubbling up” among young professionals in the college athletics industry, adding: “I'm quite sure the NCAA staff is tracking this, I just think that ultimately we might be taking a little bit longer than necessary to at least address the issue on a public basis. I think when you're inconsistent on any level it shows weaknesses in leadership, and I think that for me, having the pulse of the student athlete voice, the community voice, the campus voice, that's the job, that's the speed of the game. So, I think right now this is good for me to have been in the session and know that I [can] go back to my campus to mobilize and make sure that we can answer the question. People are leaving their jobs, people are being let go, people are changing what they can do in those respective states right now because there's – in their words – attack on diversity, equity and inclusion and those who are facilitating it. … There’s no such thing as standing still. We’re either moving forward or we’re moving back, and I think in this regard it's going to be hard to justify no action or at least some level of understanding, especially from a collection of very alert and vibrant students that are on our campuses that are looking for these types of things to be able to gauge our commitment to the overall student-athlete welfare.” (link)

The Salt Lake Tribune’s Monson defends Utah AD Harlan’s recent raise and extension, contending that leading a modern athletic department requires the ability to navigate a landscape defined by “winning and money.” Monson adds: “Stability often comes via the first one, and the Utes under Harlan are having and enjoying exactly that. Utah teams won seven conference championships over the 2022-23 year, five in the Pac-12, including the biggest trophy of all — a football title and a trip to the Rose Bowl. It was the second straight football championship and Rose Bowl appearance for the Utes. … In the 2021-22 fiscal year, the most recent with numbers available, Utah sports generated $115.7M, record revenue for the school, measured against $111.8M in expenses, leaving Utah with a surplus of more than $3.8M. In addition, Ute sports gained nearly $30M in donations. The U. also likes to boast about its 93 percent score in the NCAA Graduation Success Rate among athletes. Decide for yourselves, then, whether a million bucks is the appropriate amount to pay an AD every year (some make well in excess of that) at a public university, and whether bonuses of up to $350,000 make sense.” (link)

The Ringer’s Clark asserts nothing, including Congress, is going to stop the NIL era in college athletics and goes on to question why ADs and administrators would even want to change the current setup. “I understand why the NCAA wants (very unlikely) antitrust protections—so it can swat away future legal challenges. But the hand-wringing over NIL has always been strange to me: There is a system in place in which players get paid and the schools don’t have to do much of anything about it. It has made coaches’ lives worse, but they are paid handsomely to problem-solve. If NFL players suddenly got their salaries crowdfunded, would [Buffalo Bills owner] Pegula lobby to change it because it gave [Bills HC] McDermott more sleepless nights? … Other sports are bleeding viewers and interest. But only college football—the clear no. 2 sport in the country—is lobbying Congress to overhaul something that’s thriving.” Lots more. (link)

+ West Virginia AD Baker has promoted Men’s Basketball AC Eilert to Interim HC for the 2023-24 campaign with plans to conduct a national search afterwards. Baker: “Ultimately what I came to recognize, was that conducting this search in late June was difficult for many of our candidates and also it put our talented student-athletes at a real disadvantage.” (link)

Sports Illustrated’s Johnson observes that it should come as no surprise that Maryland has a Black president, AD and football HC given the university’s location in Prince George County, which “was for a long time regarded as the richest majority Black county in the entire nation. … PG County is still a staple of what a Black upper-middle class community can truly be. And perhaps nobody connected to Maryland athletics embodies this part of the world like Locksley, who grew up in D.C. as a Terps fan.” Locksley notes that “in this area, you didn't have to apologize for being a successful Black person. I don't know if you can always do this everywhere. So, I am who I am. I don't think I have to change because I think who I am is I'm able to relate or find common ground amongst everybody. That's one of the things I think sports allows you to do.” Johnson notes Terps AD Evans came to College Park with something to prove after his time at Georgia, and Evans explains: “Trust is two components: character and competence. First, you've got to be competent enough to do the job. I needed to show people that I had a level of competence to do the job. The character was a challenge for me because people are going to put you in a box when you've done something wrong. ‘He's this.’ As I've learned, you can regain trust. It's extremely hard to regain trust, but it takes time and it comes by your actions.” Lots more from Johnson. (link)

SI’s Johnson also examines some of the more creative incentive clauses in the contracts of newly hired Football HCs, including Arizona State HC Dillingham, who is eligible for bonuses if a certain number of players enroll in the honors college. If three to six players enroll, Dillingham will receive $50K. If seven-11 enroll, he will receive $100K, and if 12 or more enroll he’ll earn $250K. He will also get $37,500 if the team GPA is at least 2.7; $62,500 if it meets 2.8; $100,000 if it hits 2.9; and $150K if it’s 3.0 or above. If the Sun Devils max out their academic performance in a given year, Dillingham can earn up to $935K in extra compensation. Meanwhile, Auburn HC Freeze must seek written approval from Tigers AD Cohen to copy (at his own expense) and keep “practice, drill or game film and/or any practice or game scripts, schedules and/or playbooks.” Johnson notes clauses like these “aren’t rare for coaches, but the specificity here is interesting.” Lots more. In the spring of 2022, Oregon volleyball student-athlete Williams made allegations that she was played when she was not healthy, that the school misled her on the severity of her ankle injury and that Ducks HC Ulmer pressured her to either transfer or medically retire using “tactics that made her feel harassed, mentally abused and ostracized by her Oregon teammates” reports the Register-Guard’s Hansen, who adds: “Williams' allegations led to an independent investigation that was finalized in July 2022. The report did not make recommendations or determine whether the underlying facts violated UO policies, expectations or contract terms.” The school’s comment from Senior Assoc. AD for Communications Stanton: “The health and safety of our student-athletes is our highest priority at the University of Oregon. Our medical team provides first-class care and works in close consultation with the student-athlete on any decision involving returning to activity. Student-athletes are never cleared if they are physically unable to participate.” More. (link)

According to the Charlotte Observer’s Della Costa, Davidson “is reviewing anti-hazing policies and auditing sports team traditions after receiving a complaint from a member of the men’s swimming and diving team. The complaint alleges freshmen were forced to participate in team activities outside of practices and competition — some of which resulted in injuries — because of tradition. It left the member ‘traumatized,’ according to the complaint provided to The Charlotte Observer. Freshmen were ‘expected to perform’ dances in their Speedos during campus events, including in front of the student section at a home men’s basketball game.” Director of Media Relations Pfeifer on behalf of the school: “The health and safety of every Davidson College student is our highest priority, and the college takes hazing allegations very seriously.” (link)

Arkansas professor Harry asked 18 Razorback student-athletes – five men and 13 women on non-revenue sport teams who volunteered to participate in the study – about the impact abortion laws would have or have had on their decision to enroll. Nine of the student-athletes were pro-life while the other nine were pro-choice. The pro-choice athletes came from several different home states and countries, and ranged in their religious affiliations from atheist to Christian and generally noted aligning with the Democratic Party or no political party. Those who were pro-life were either from Arkansas or came to Arkansas from states with similarly restrictive abortion laws. “Pro-life athletes predominantly identified as Christian, but there were weaker connections between their stance on abortion and political party affiliation. Still, many athletes holding pro-life beliefs struggled to support portions of the state laws prohibiting abortions stemming from rape or incest.” Most athletes, regardless of how they felt about abortion, said that they did not see how Roe’s reversal influenced athletics. None of the student-athletes interviewed, even those who were “saddened,” “disappointed” or “scared” by the state laws, said they would choose a different institution or transfer based on Arkansas’ strict laws concerning abortion. Overall, Harry concludes the “trend toward athlete activism in other social justice arenas does not—yet—appear to extend to the issue of abortion rights.” (link)

The NFL will begin requiring rookies to attend mandatory education sessions on gambling, and ESPN’s Holder reports a group of league officials is “making in-person visits to team facilities to emphasize and clarify what activities are prohibited amid the rapid proliferation of sports gambling.” The six key principles the league will emphasize are: don’t bet on the NFL; don’t gamble at your team facility, while traveling for a road game or staying at a team hotel; don’t have someone bet for you; don’t share inside information; don’t enter a sportsbook during the season; and don’t play daily fantasy football. NFL VP/Chief Compliance Officer Perel insists there is no double standard when it comes to placing gambling restrictions on coaches, staff and players while the league signs sponsorship agreements with sportsbooks. “It’s just a little bit of apples and oranges. … At the end of the day, what that is about is bringing in new fans, keeping fans engaged, giving them the opportunities to engage in these things, versus what we all do personally and what we should not be doing to protect integrity." With TikTok’s future in the U.S. uncertain, Sportico’s Feldman examines how some sports brands are approaching the platform and finds that, for the most part, it’s business as usual. Warner Bros. Discovery SVP for Digital Sports Strategy Bernstein: “We’re not watching C-SPAN 24/7, but we definitely have Google News alerts, and everybody is following the trades and trends where it looks to be headed.” TikTok, Bernstein continues, remains a priority for the company, mostly because younger audiences spend so much time on the platform. At the same time, Feldman points out that adapting to a constantly changing social media landscape is part of the job. Utah Jazz Senior Director of Content Treasure says if she could learn one thing about what social media will look like a year from now her first question would be “What’s still around? … The only thing constant in social media is that you can only affect what you can affect, and there will be change.” (link)

Iowa State AD Pollard joins SBJ’s Nethery to discuss the NIL environment and the Cyclones’ preparations for a new-look Big 12. He says of the former: “Where the lines get blurred is this notion of pay-for-play and employment and the use of NIL to justify probably doing things that you shouldn't be doing. And that's what I think is caused not only the challenges, but the confusion because a lot of young men and young women and their parents think that's happening everywhere, and the majority of our student-athletes really aren't involved in that much NIL or NIL at all and it's not front and center of what they're thinking about when you’re recruiting them. But they're aware of the stories because the 1% is what is written about in all the media and gets used as what's wrong with college athletics.” On future expansion, Pollard acknowledges it’s always possible but says: “We don’t need it to happen and, quite frankly, I don’t want it to happen…because I know it’ll be at the expense of somebody else.” Full interview. This project will have something for everyone — affordable tickets, the best premium seating, real home field advantage. Oh yeah, and parking & tailgating are key priorities. USA Today’s Wolken asserts the NCAA’s adjudication of the allegations against former LSU/current McNeese State Men’s Basketball HC Wade is tantamount to conceding that paying players is okay, “even if it comes right out of a coach’s bank account.” He adds: “If it takes your organization 51 months to come up with a 10-game suspension and some various minor recruiting restrictions for a guy who was caught on a wire tap talking about buying a player and paying players from a joint bank account with his wife, in clear violation of NCAA rules, there’s not much use enforcing them in the first place. … Once the IARP rules on Kansas — and, based on precedent, we shouldn’t expect much actual accountability from the accountability folks — they will be shut down and remembered as the biggest waste of time and money in the history of NCAA governance.” Wolken goes on to posit that as the NCAA continues lobbying Congress for the power to enforce its own rules, it’s the rules themselves that need to be addressed. + Fears of a recession have yet to impact the executive search business, Prodigy Search Founder/CEO Carmichael tells SBJ’s Lefton. “Lots of recession chatter, but we haven’t seen anyone pumping the brakes.” Excel Sports Management’s Nolan Partners President Biagini adds: “In places like Florida and Texas, they’ve heard all the talk about recession, but told us it's just not there yet, so they are going to keep hiring and building.” Lefton also notes hybrid work schedules are likely here to stay, per TurnkeyZRG CEO Perna, who says: “It’s a core culture question now in attracting and keeping talent and those companies that are the most flexible and adaptable with respect to hybrid will win in the talent marketplace. It can’t just be ‘here’s a cell phone and a laptop’ anymore. Companies have to learn how to build a team culture within a hybrid model, so employees still feel like they are part of a team." (link)

Sports Media Watch reports: “Despite airing on ESPN2 to accommodate the NBA Draft, Thursday’s LSU-Wake Forest Men’s College World Series semifinal averaged 2.09 million viewers — the largest audience for the event since Game 2 of the Oregon State-Arkansas final in 2018 (2.16M). The previous high was set just three days earlier on Monday, when the same matchup averaged 2.02 million on ESPN. Outside of the final, this year’s three LSU-Wake Forest games (Wednesday’s matchup averaged 1.89 million) delivered the three-largest MCWS audiences ever on the ESPN family of networks.” For context, the top MLB game on ESPN this season was the Red Sox-Yankees on Sunday Night Baseball two weeks ago with an average of 1.94M. + The entire Ole Miss football staff was recently certified in mental health first aid, per Football Scoop’s Barnett, who explains the certification involved “an eight-hour class and a two-hour assignment, which centered on two things: 1) creating a culture where players feel just as comfortable treating a mental ailment as a physical one, and 2) recognizing that they are not experts in the mental health field, training each staff member to identify mental health issues as they arise and then implement an action plan where the athlete or staff member gets the help they need.” Rebels Asst. AD for Sport Psychology Nicholson: “The culture starts with the coaches. … When your coach believes that your mental health is important, it’s more likely that the athlete is going to believe and take care of their mental health. Because it decreases, wildly decreases, the stigma of reaching out for help and getting mental health support.” The Rebels are believed to be the first DI staff to receive the certification. (link)

A group of former Major League Baseball scouts has sued the league, claiming it “blacklisted” older scouts and used analytics and the pandemic as “pretext for coordinated and systemic discrimination based on age.” Robert Goodman, the scouts’ lead attorney, tells the Los Angeles Times’ Shaikin and DiGiovanna: “When Major League Baseball makes a big deal about traditions, and honoring those traditions, and then it does something like this, it’s destroying its own brand. If you’re trying to be America’s pastime and then suddenly people who have been involved in America’s pastime for 30 or 40 or 50 years are completely locked out, there is something wrong.” Co-counsel Abeita adds: “These guys largely haven’t provided any information that the scouts did anything wrong. All they did was get older. The law says you cannot banish someone just because of their age.” In its response to the suit, MLB says: “We do not comment on pending litigation. However, we look forward to refuting these claims in court.” (link)

U.S. District Court Judge Herlong, Jr. this week ruled that a dozen former youth cheerleaders who allege sexual abuse can pursue unjust-enrichment and negligence claims against Varsity Brands and Varsity Spirit, both of which are owned by Bain Capital. Herlong also dismissed seven other counts against the Varsity defendants, including those alleging racketeering activity, fraud and civil conspiracy, per Sportico’s Libit, who notes the allegations involve Rockstar Cheer and Dance, which was a member of Varsity’s top-tier “Family Plan” rebate program. Libit also notes that in allowing the unjust-enrichment claims to proceed, Herlong ruled the plaintiffs had successfully stipulated that they “conferred benefits” on the company through their payments of gym and competition fees and other expenditures, and they “retained those benefits under inequitable circumstances.” (link)
