Xavier AD Christopher tells the Cincinnati Enquirerer’s Williams that adding football is a “definite maybe. The program itself makes sense. The challenge we have is we don’t have a facility. We’re trying to balance the football idea with building a College of Medicine facility. We’ll try to make a decision by the end of the year. … We often compare ourselves to Dayton and Butler, competitively, for students and in sports. They are using football as an enrollment driver. It's a way to bring 110 men to campus.” On adding sports in general, Christopher remarks: “Athletics is not the most important thing Xavier does, but it may be the most visible. Xavier is an enrollment-driven institution. As we were going through the process (of adding lacrosse), we came to the realization that our 19 sports are almost entirely net-revenue positive to our institution – the tuition (athletes) pay, room and board.” Over the past decade, the Musketeers have invested roughly $30M in upgrades to the Cintas Center, and Christopher points out that “we are currently in a two-year project to redo suites and hospitality spaces. Suites are one of the last things that haven’t been touched yet. We’re at a point we’ve probably gotten Cintas to about where it needs to be for today’s moment.” (link)

Despite the drama that has surrounded the ACC and Pac-12 this year, Sports Illustrated’s Forde points out the leagues won more national titles than any other conference. With nine championships apiece, the ACC and Pac-12 oustripped the SEC (8), Big 12 (4) and Big Ten (3). ACC Commissioner Phillips: “The question is, how many resources do you need to be successful? Are we chasing a dollar amount, or are we chasing success? Maximizing revenue, that’s the reality of modern-day college sports. You can’t be tone-deaf to that, and we aren’t. … But we want to continue to be a conference that chases success—academically and in all 28 sports, by all 15 schools. I believe you can have it all in the ACC. I believe we’ve proved that.” More. (link)

USA Today’s Wolken calls the NCAA’s memo regarding adherence to its NIL regulations above state laws “common sense,” adding: “Regulating how schools interact with booster collectives strikes me more as a competitive issue not a rights issue. That’s the NCAA’s neighborhood, not any legislature’s. … Ultimately, if you're part of the NCAA and enough members have agreed that it’s against NCAA rules to use collectives in that manner, then the NCAA should be able enforce those rules. Of course, that only works in theory. In reality? Hahaha … . We have seen enough from the NCAA over the last three years to realize it has no shot of regulating, investigating, or enforcing anything with regard to NIL. And, if the NCAA does try to take a school to task, the threat of litigation will prompt an instant backtrack.” Wolken goes on to note “The final play for new NCAA president Charlie Baker may essentially be going back to Congress once again after years of failing to get an NCAA-friendly bill to the floor and saying, ‘Hey, we tried to do this ourselves. We can’t. You are the only ones that can save us.’” On that front, Woken is skeptical, “Coming up with a bill that satisfies lawmakers from both parties and can get 60 votes in an evenly divided Senate seems impossible,” particularly with the general election cycle looming. CBS’ Dodd reports there “was an attempt to place bets totaling six figures” on the Alabama-LSU baseball game in April which resulted in the Crimson Tide parting ways with HC Bohannon. But “because of the casino's betting limit – that can vary from bet-to-bet and sport-to-sport based on circumstances – Bohannon's friend was able to bet only in the low five figures. That was more than enough to set off alerts that led to an investigation that resulted in the coach's firing.” A source involved with the investigation tells Dodd it was “very stupid. Very stupid. When the facts come out of that case, everything that gentleman did was stupid." If the Bohannon scenario indicates the system is working, Dodd wonders whether the NCAA should ease its restrictions on gambling. U.S. Integrity CEO Holt believes they need to be reconsidered. “At the end of the day, you're not really likely to have any influence. … Why can't a baseball player at LSU bet on a basketball game involving the University of Michigan?" NCAA Managing Director of Enforcement Hicks acknowledges it’s a question that needs to be answered but notes it’s difficult terrain to navigate. "Our membership is going to have to wrestle with what's the proper place for our rules on this issue." Holt provides more perspective, noting something is flagged (which is not necessarily indicative of wrongdoing) roughly once per 900 games. “Are we OK with one out of every 900 events having something wrong with it? I don't know. It's a heck of a lot better than Europe." (link)

Former New Mexico State men’s basketball student-athletes Benjamin and Odunewu have settled their hazing/sexual assault lawsuit against the university, and NMSU says the terms will be disclosed “soon.” Attorney Youngers: “The important thing was getting a settlement that reasonably compensates them and allows them to put this matter behind them, and helps them to move on. Because a lawsuit like this can end up being a second victimization, where they have to go through months, if not years, of dealing with all the issues." The state’s attorney general is still reportedly considering whether to file criminal charges. (link)

Bestselling author James Andrew Miller joins The Athletic’s Deitsch to discuss the managerial changes at ESPN. Miller explains the recent appointment of ESPN President of Programming and Original Content Magnus to President of Content is a ringing endorsement from ESPN Chairman Pitaro. “What Jimmy is basically saying to Burke Magnus is I have so much confidence in you as an executive – not as just a program executive, but as an executive – that I'm willing to give you the keys to this castle. And, by the way, it is – it's 4,000 employees and it's all content. It’s the big job.” Broadly speaking, Miller says this is the “calm before the storm” of moving to DTC (direct-to-consumer). “Very quickly, I think probably in two, three years, you're going to see a fundamental change in the way ESPN is transmitted and distributed.” Also, Miller observes that Pitaro is spending a lot of time with Disney CEO Iger, “who clearly trusts him, and he’s clearly on the shortlist for Bob’s successor.” Full podcast. + The Alabama Board of Trustees Compensation Committee approved new contracts for 12 Crimson Tide coaches, including Baseball HC Vaughn, whose five-year deal will net him $900K annually. Vaughn can also earn $10K if his program reaches or exceeds an 85% graduation rate and achieves an Academic Progress Rate score above the NCAA-defined cut score. On-field bonuses range from a half-month’s salary for winning the SEC Tournament to 2x his monthly salary for winning a national title. His buyout is set at $2.25M for the coming season and drops down to $1.8M in July of 2025 and $900K in July of 2026. Vaughn doesn't have a buyout in the final two years of his contract. Meanwhile, Women’s Basketball HC Curry’s new four-year deal is worth $550K per annum; Men’s Golf HC Seawell inked a five-year contract worth $285K per season; Gymnastics HC Johnston will earn $205K annually over the next five years; Softball HC Murphy inked a five-year contract for $530K yearly; Women’s Swimming HC Geer will net $160K annually for the next three years; Women’s Tennis HC Berhane’s salary is set at $135K per year for the next three; and Track & Field/Cross Country HC Waters is set to earn $275K annually through June 30, 2027. Paciolan President/CEO Damron joined Connect’s Garcia Cichosz from the 2023 NACDA Convention to discuss the elevation of women’s sports, whether that’s translating into more female fans, ticketing trends and how universities are capitalizing on data from mobile ticketing. In discussing the latter, Damron says the “best data is coming from those newly transferred mobile tickets, and what we're seeing is 30% of that data coming in is new to our customers’ database. So, they're using that to actually help market other athletic events as well as other third-party events.” Damron also notes Paciolan’s partnership with SeatGeek goes live July 1 and says Paciolan “partnered with them because they’re a technology- and data-driven company, and they’re focused on customer service and the customer experience.” Check out the full Q&A on Connect. Texas has sold out of its football season ticket allotment of over 68K, the most in school history, per Action Network’s McMurphy, who notes the figure does not include student tickets, which are expected to surpass 20K. (link)

Stanford inks a three-year deal to make StubHub the official ticket marketplace for the Cardinal, per SBJ’s McCormick, who notes: “As part of the deal, StubHub is integrating with Vivenu, a German-based ticketing company that just was unveiled as Stanford Athletics’ new primary ticketing distributor. The tie-up will make one-click listing of tickets on StubHub available to Stanford season ticket members. Stanford will receive analytic data support and audience insights from StubHub to help the athletic program reach new buyers, drive demand from existing users, build stronger pricing strategies, and, ultimately, increase attendance.” (link)

Georgia Tech Executive Assoc. AD/Chief Revenue Officer Nieves talks with SBJ’s Karp about the Yellow Jackets’ plans to reimagine the football tailgating experience in midtown Atlanta via the Helluva Block Party initiative. Nieves explains the idea is to “reposition the front door” on game days. “Legends, our multimedia rights holder, has worked with corporate partners to re-envision what activations could look like, and how they could bring corporate elements to the fan zone. … For us, [we] really looked at how gameday experiences have really transitioned from kind of the table-and-chair fan zones to more interactive and engaging four-hour experiences.” The school has been working directly with the city to shut down a three-block portion of North Avenue six hours before kickoff. The area will reopen for traffic at the beginning of the third quarter. (link)

+ Front Office Sports’ Fisher reports it’s “basically over for DraftKings in their attempt to outmaneuver Fanatics in the hunt for PointsBet's US operations. Fanatics sweetens their $150M offer to $225M, above the $195M DK offered. And DK missed today's deadline to submit a binding offer. The NCAA has sent out a memo to schools informing them that “if a state law permits certain institutional action and NCAA legislation prohibits the same action, institutions must follow NCAA legislation.” In an FAQ section of the memo, the NCAA argues: “NCAA rules are adopted by member schools. It is not fair to those schools who follow the rules to not enforce rules against those who choose not to do so. Schools who do not like the application of a particular rule should work through the NCAA governance process to change the rule. Unless and until the membership changes a particular rule, all schools, as part of a voluntary membership, are required to comply.” Practically speaking, Kennyhertz Perry attorney Winter notes it’s “going to be a question of whether the NCAA is actually going to penalize a school. … Are they going to go after A&M? They could have already gone after Arkansas, but they haven’t. They keep sending out these memos. But they obviously haven’t done much.” In such a circumstance, Winter says the school would likely sue the NCAA, which would then be risking a ruling that would cement the concept of state laws superseding NCAA rules. Winter also submits, however, that the NCAA may be sending a message that “if we don't take a stand, as an entity, we become irrelevant.” (link, link)

Changes are coming to the National Letter of Intent program, per The Athletic’s Auerbach, who reports NLI penalties will no longer apply if NLI signees request a release because of a head coaching change. Additionally, NLI penalties won’t apply if athletes leave after one academic semester/quarter. “One other change, per source: Four-year transfers will also be able to sign an NLI after entering the portal. They don’t have to do this, but signing an NLI would trigger a recruiting ban. So, once you sign it, other schools are supposed to stop reaching out. These changes come from the Collegiate Commissioners Association (CCA), which has overseen the NLI program for nearly 60 years. They take effect for prospective student-athletes signing 2024-25 NLIs.” (link)

The Grove Collective Executive Director Jones talks with On3’s Prisbell about donor fatigue in the NIL space and says: “If you’re not winning the championship, people [donors] are going to say, ‘Man, screw this. I gave [dollars] under the impression this was going to help us win championships and be competitive.’ And if you’re not doing it every single year, the cost still goes up – that’s a problem. There is this growing feeling: Is this going to be the reality every year? And is the price going to continue to increase? If we raised $6M last year, is it going to have to be $9M next year, and then $12M? If it doesn’t change, and we are stuck with the same marketplace that we are today, it is not sustainable for a 95% donor-funded model.” Those donations, Athliance CEO Schoenthal points out, don’t come with the perks donors receive from donating directly to universities, such as having a facility named after them. As such, Schoenthal believes it’s important for collectives and universities to emphasize that the situation is short-term. “The future is going to be revenue share, and also internal group licensing. The smart collectives are letting big donors know, ‘This is a two- to three-year window that we need you.'” Lots more. (link)

In terms of collectives’ buying power, SMU’s The Boulevard Collective would trail only Oregon’s Division Street, Boulevard Executive Director Schoemann tells JohnCanzano.com’s namesake, who adds: “Oregon’s collective has billionaire Phil Knight backing it, among others. Last year, I was told by one UO donor that the initial buy-in for Division Street, Inc. was $500K and that didn’t get you a say in who the collective did business with. Schoemann told me that the SMU collective was included in the analysis done by consulting firms trying to gauge whether the school was a good fit for the Pac-12. Schoemann adds: “We have had good feedback. I believe SMU is being analyzed in a number of ways and we’re part of the component.” (link)

Executive Senior Assoc. AD/SWA McQueen has been promoted to Deputy AD. She will assume leadership for all external units, including Marketing, Advancement, Tickets, Licensing and MMR and retain sport oversight responsibilities for men's basketball, women's basketball and women's lacrosse. Finally, Chief of Staff Ely has been promoted to Assoc. AD/Chief of Staff and will serve as the department's liaison to human resources and coordination with the President and Cabinet. Additionally, new Senior Assoc. AD Brock will add sport oversight of women's soccer and the men's and women's cross-country and track and field programs; Assoc. AD McKendry will provide oversight for the cheer and dance programs; and Assoc. ADs Rush and Tizio will combine to provide sport oversight for field hockey and wrestling. Former Fresno State Wrestling AC Colon and over 1K other volunteer coaches filed a lawsuit accusing the NCAA and member schools of orchestrating a wage-fixing conspiracy, per Sportico’s McCann, who notes the plaintiffs are seeking class-action certification. The suit argues NCAA members adopted bylaws permitting schools to pay as much as they liked for head coaches and for a certain number of assistant coaches, but any other assistant coaches must be designated “volunteers” and are denied pay “beyond minimal, incidental non-cash benefits.” McCann notes this so-called $0 salary cap will be phased out July 1, and the NCAA argues the coaches can’t show they were “injured’ in the legal sense because they agreed to be volunteers and it’s unknown whether they would have been hired had they demanded compensation. Plaintiffs’ attorney Lieberman emphasized the appeal of coaching DI instead of DII by drawing a comparison with the legal profession. “Paralegals often go to law school and become lawyers, but no one would view those two jobs as reasonably good substitutes.” (link)

Michigan lawmakers have introduced a bill that would amend the state’s current NIL law, which Kennyhertz Perry attorney Winter notes is not as comprehensive as other recently amended bills. It would, however, prevent the NCAA and its members from barring athletes from earning NIL compensation and would allow schools to facilitate deals. (link)

Seton Hall will construct a new Basketball Practice Facility inside the Richie Regan Recreation & Athletic Center. The project will include a new basketball court, locker rooms, lounges, offices, sports medicine room, strength and conditioning room, film room, enhancements to the women’s hoops facility and more. Pirates AD Felt: “With the new practice facility and the enhanced women's basketball facilities within Walsh Gymnasium, we strive to equip our student-athletes with the resources they need to flourish at the highest level of college basketball and compete for conference and national championships."
