Coastal Carolina Chair of Athletics/Executive Advisor to the President/former Ameritrade Chair/CEO Moglia calls on NCAA President Baker to do less lobbying and more leading, writing in a guest column for Sportico: “Baker’s strategy of going to Capitol Hill for help makes sense for a politician (and maybe the government can help), but it puzzles me, because I can’t imagine any business seeking out government to solve its problems.” Moglia goes on to assert that Baker’s repeated insistence that student-athletes don’t want to be designated as employees is an “absurd obfuscation of the real issue: Student athletes who are getting money are professionals, and they want to be paid for what they do, regardless of whether they’re categorized as employees or some other term.” The NCAA’s roadmap for fixing this problem, Moglia continues, should include the acknowledgement that student-athletes are professionals (he favors the term “professional student-athlete” over “employee”), reinstituting the transfer rule, and creating NIL transparency and uniform NIL deals. Illinois Whitman says the recent scandals involving gambling in college sports have only reinforced his position against online wagers on college sporting events. “I don’t know that anybody is surprised. This is something we’ve been talking about for some time. To be clear, I think it sets forth some of the reasons I’ve been worried about it. I and my colleagues, I don’t think any of us are necessarily… we’re not opposed to sports gambling. We’re opposed to college sports gambling. To me, there’s a very distinct difference between gambling on professional sports and gambling on college sports. I think some of those situations here on the last several weeks laid on display the reasons for some of those differences.” Whitman was among those who lobbied during the state’s legislative session, during which lawmakers voted to hold off legalizing online in-state gambling on college sports for another year. Florida Gulf Coast AD Kavanagh sits down with SBJ’s Nethery to discuss NIL, inflation and other financial concerns. Kavanagh notes student-athletes in the transfer portal want to know what type of NIL compensation is available, “and we just don't have resources to just jump into that without trying to be judicious as to where we are with cost of attendance or now Alston awards. We've had dialogue (presumably about a collective), we haven't had anything committed yet, but we're like most others we're still trying to figure out what is the landscape. We certainly saw what the IRS came out with a couple days ago, and that certainly will pause the number of folks who want to help. The tax write-off is important to them, so I think more than anything we're trying to monitor the space and, at the same time, if we are ignorant to it, it will come back and hurt us.” Full interview. The San Diego Union-Tribune’s Zeigler and Kenney offer some advice to San Diego State ahead of tonight’s deadline to leave the Mountain West before its exit fee doubles to roughly $34M: “Let the deadline come and go. Don’t send any more letters. Let phone calls go to voicemail. Ignore text messages and email. Shoo away carrier pigeons. Release the growling dog when the mailman arrives. Go on vacation to a remote village in Bhutan. Get off the grid. … Conspiracy theorists will assert that this was their strategy all along. Trust us on this: It wasn’t.” The duo also points out last week’s letter exchange with Commissioner Nevarez, while suboptimal, does have a silver lining. “Nevarez does not ultimately speak for the conference; its presidents do. And late June and early July are prime vacation season, when commencement is behind them and fall semester is more than [a] month away, and presidents and their six-figure salaries disappear to the far corners of the planet. Convening the board to unravel it all, even electronically, is nearly impossible. A conference source indicated it might be another two weeks before the full board can meet, and only then would it definitively debate and decide SDSU’s status.” Until then, Zeigler and Kenney reiterate their advice to wait. “If the Mountain West isn’t forcing SDSU to show its hand right now, why flip over your cards?” (link)

Tennessee State AD Allen has lofty goals for the newly launched ice hockey program, which will start as a club sport with a long eye toward DI membership as well as a women’s team. “I want the next P.K. Subban. I want the next Ryan Reaves, the next Willie O’Ree. I want a name. But it starts somewhere, and it starts today.” Nashville Predators CEO Murphy says the franchise plans to help TSU along the way, noting that “we’re partners – it’s really that simple. Ten or 20 years from now, when (TSU) is winning the Frozen Four, we can look back at this day as the reason why.” Allen goes on to remark that the “work is valuable because we’re opening up an opportunity in the HBCU space that should’ve already been there, in my opinion. We’re creating opportunities for individuals that aspire to be students at an HBCU, but now they can play the game they love. It’s pretty cool. We hope others will follow.” (link)

USF announces 2025-26 as the inaugural season for its beach volleyball team. The Bulls' first beach volleyball student-athletes are slated to arrive on campus in fall 2024 and will spend the 2024-25 academic year training and playing in exhibition matches. Construction on the USF Beach Volleyball Complex is scheduled to begin in fall 2023 with a target completion date of summer 2024. (link)

Michigan State will hold a presale exclusively for season ticket holders for the upcoming season’s matchup with Penn State at Ford Field. For $50 each, season ticket holders can purchase the same number of seats they have at Spartan Stadium. Spartans AD Haller: “Season ticket holders are incredibly important to our mission as an athletic department, which is why we wanted to give them the first opportunity to secure their tickets for this unique experience of Spartan Football at Ford Field. It was equally important that their tickets cost what they would expect to pay for a game at Spartan Stadium, and that they be given the ability to sit where they normally would. Following the NCAA’s memo concerning the adherence to its NIL requirements regardless of state laws, Texas AD Del Conte sent a letter to donors noting UT is assessing how it will “navigate the conflicting aspects of NCAA policy and HB 2804." As reported previously, plans were in place for Texas One Fund donors to be able to earn Longhorn Foundation loyalty points starting July 1. Del Conte does not specify whether that policy will be postponed. (link)

Opendorse CEO Lawrence and On3 CEO Terry do some sparring on Twitter over Opendorse’s recently released NIL projections for Year 3. Terry says On3 doesn’t publish its insights, but “you guys are at least 2X off on the high side. Collectives (Roster Value) number is way off. You guys have created quite the stir today in the industry.” To which Lawrence responds: “Our annual report is based on over 100,000+ NIL transactions and $100M+ in payments to student-athletes at 1,000+ unique collegiate institutions. Proud to provide projections based on actual primary data. Would love to see others do the same.” Terry goes on to argue that his point is not to defend On3’s data, but he continues to insist there is “no way on this planet the collectives market is even close to $936M. I've spoken to almost all the collectives, or representatives for On3 have. We see the deal flow of the athletes from both sides. It’s not close to that and to assume that the Power 5 schools’ collective totals $13M a school, it’s egregiously high and what that does is that creates an unrealistic expectation to the athlete that they think that they are worth more than they are, that they should get a bigger share of the pot. It creates unrealistic expectations on the schools and the collectives that they've got [to] achieve a level that's not possible. Those numbers aren't correct.” Full debate. (link, link)

Nike’s reported Q4 revenue of $12.83B increased 5% YoY, outpacing Wall Street’s expectations of $12.59B; however, the $0.66 EPS fell slightly short of the expected $0.67. “Gross margins fell to 43.6% in the quarter ended May 31, down from 45% in the year-earlier period. Nike said in its release that the decline was ‘primarily due to higher product input costs and elevated freight and logistics costs, higher markdowns and continued unfavorable changes in net foreign currency exchange rates — partially offset by strategic pricing actions.’" (link); The Wall Street Journal’s Pacheco and Ojea report the company expects to increase prices by low single-digit percentages on average to help offset rising costs for everything from labor to logistics while also planning to continue increasing the share of products sold through its own channels instead of wholesalers. The Los Angeles Times’ Kartje and McCollough catch up with more than a dozen search firm industry stakeholders to determine why red flags about former USC AD Bohn were missed. Baylor President Livingstone provides perspective: “What you’re trying to do in this situation is balance doing the best job vetting candidates, knowing you are never going to be 100% sure, while protecting confidentiality because you don’t want to damage someone’s reputation at their institution. Those are certainly in tension with one another. It’s about finding the right balance. Some argue that innate lack of transparency can lead to a less thorough vetting process. Others argue it must be done that way because if word leaks about one candidate, then the “whole search is over.” Overall, there was no consensus on who was to blame for the situation at USC, with some blaming the school and others blaming the search firm, TurnkeyZRG, leading Kartje and McCullough to wonder: “If seemingly every player in the system can be blamed, perhaps it’s the system that deserves further scrutiny.” (link)

Maryland AD Evans joins the Hear the Turtle podcast to discuss several topics and explains the Terps are on their third NIL strategy. After having partnered with Opendorse and hiring Director of NIL Services Wagner, Evans says: “Now we’re looking at starting one supercollective that would encompass everyone, and that would include basketball and football and so forth – not to take away from everyone, but to try to leverage our assets to the fullest extent. So we're exploring that possibility right now and continuing to add platforms for our student athletes to generate income to generate revenue off their name image and likeness, and in this day and age, whether you like it or not, and some of our fans don't like it, it is where we are and if we want to compete at the highest level, like I know we all do, this is something that we have to fully embrace. … And I want everyone to know we're going to pour all of our energy and effort into NIL because it is a gamechanger.” Full podcast. On3’s Wittry takes a look at the reality of the SEC successfully convincing each state government in its footprint to pass similar NIL laws, and Florida Representative LaMarca (R-100) points out that the “other piece of it really is where does that leave the ACC and other conferences in the state of Florida?” Meanwhile, Missouri Representative Gregory (R-51) commented on the NCAA’s recent memo concerning state laws, saying: “The funny thing to me is they basically for the longest time said that state law trumps. I feel like we passed something really good here in Missouri that some of the lines in there are what other states have done so far. So, I think we’re going to roll with it.” Texas A&M AD Bjork, however, says the Aggies wouldn’t be opposed to having to “pull back a little bit” in order to conform to a national standard but adds: “And that gets into what does pull back mean? The market is the market. We don’t need to restrict the market.” Lots more. (link)

The U.S. Supreme Court ruled today that the admissions systems used by Harvard and North Carolina illegally violate the Equal Protection Clause of the 14th Amendment, effectively banning affirmative action. Chief Justice Roberts: “Both programs lack sufficiently focused and measurable objectives warranting the use of race, unavoidably employ race in a negative manner, involve racial stereotyping, and lack meaningful endpoints. We have never permitted admissions programs to work in that way, and we will not do so today.” Roberts also wrote in his majority opinion that Harvard and UNC posit that "an individual’s race is never a negative factor in their admissions programs, but that assertion cannot withstand scrutiny. Harvard, for example, draws an analogy between race and other factors it considers in admission. 'While admissions officers may give a preference to applicants likely to excel in the Harvard-Radcliffe Orchestra,' Harvard explains, 'that does not mean it is a ‘negative’ not to excel at a musical instrument. But on Harvard’s logic, while it gives preferences to applicants with high grades and test scores, 'that does not mean it is a negative' to be a student with lower grades and lower test scores. This understanding of the admissions process is hard to take seriously.” (link)

The Athletic’s Ubben asked ADs and industry stakeholders whether Saudi Arabia could “become college football’s newest super booster and turbocharge a program with tens or hundreds of millions of dollars to pay players through a collective and/or fund facility upgrades?” One industry source remarks: “I’d say close to 50% of schools and athletic department leaders would navigate their way to yes. If you’d asked me before the LIV/PGA Tour came together, I would have said less than 10%. Because even the most aggressive and thoughtful athletic directors, everyone is afraid to go first when it comes to the PIF and their involvement in American sports. And the PGA just went first.” An AD says he or she would go “way above 50%” that a school is faced with a choice like this in the next 5-10 years. Disagreement exists, however, about the feasibility of actually accepting the money given the “reputational harm,” as one AD puts it; however, the industry source notes a more likely scenario involves the money being donated by a PIF-backed third party. “That one buffer or layer, one degree removed from the PIF you could see in the next five years.” Lots more. The AP reports New Mexico State has agreed to pay $8M to settle a lawsuit brought by former men’s hoops student-athletes Benjamin and Odunewu. Benjamin and his father, William, who was a co-defendant, will receive $4.125M, while Odunewu will receive $3.875M. Plaintiffs’ attorney Youngers: “To New Mexico State's credit, they took the lawsuit very seriously. They obviously recognized that our clients had been harmed." (link)

+ Arkansas announces the “largest outdoor sports bar in college football” is coming to Razorback Stadium in the form of Big Red’s Rooftop, which will consist of three individual bars, approximately 70 bar seats and televisions throughout. Additionally, pub tables and a drink rail overlooking the field will provide fans a variety of seating opportunities. Razorbacks AD Yurachek: “In our state, an Arkansas Football gameday provides the perfect opportunity to come together with friends, family or fellow Hog fans for a tailgate or watch party. Now Razorback fans can enjoy that same experience within the stadium, as they cheer on our team from the most unique sports bar in college football – Big Red’s Rooftop.” Tickets will be sold on a single-game basis and Big Red’s is slated to open this fall. + McNeese breaks ground on its new press box at Cowboy Stadium, which features 25 suites, a 1,700-square-foot sky club and an open patio-type area. The top two levels extend goal line to goal line. Football operations, media, radio and television will be on the second level. (link)
+ North Carolina will install a new 40-foot-long LED scorer's table that will add additional space to amplify statistics and other messaging inside Carmichael Arena. Additionally, the LED display on the west side of the arena has been upgraded, allowing for increased visibility for scoreboards and information. + The St. Paul City Council held public hearings on a proposed baseball and softball complex for St. Thomas, which Tommies AD Esten says would take up about 13 acres. The master developer handed over its purchase agreement for the space to the city's port authority, which will now be in charge of cleaning up the land. Esten says that could cost about $6.4M, and once it's remediated, UST would buy it back with plans to start building. He adds: “It's an opportunity for us to provide our student-athletes training, competition, and fan facilities for baseball and softball and in turn, amenities for the community.” (link)

INFLCR CEO Cavale joins The Paul Finebaum Show to discuss the latest NIL developments and submits that if the NCAA had released its recent memo a year ago, Texas wouldn’t have passed its amended NIL law. “Instead, five days before the bill goes into action, to come out with the memo after all this work has been done, it's just another example of a passive, reactive nature that's created gaps forcing others to be proactive.” Cavale goes on to compare NIL to marijuana by pointing out that while marijuana is legal now in New York, he wonders how much was bought in dispensaries versus how much was bought illegally. “Chances are way more than half was bought on the corner (illegally). NIL is very similar. How much of NIL has had taxes paid on it? When you go back to this past year in the 2022 returns, was all of the money that flowed into the athletes paid taxes on with the IRS? Probably not. Probably less than half, but people feel okay about doing it the old way because it's legal, and I think that's just where we're at, and there's not any regulatory uniformity that is [holding people] accountable to stop that from happening and that's the pain we’re all feeling.” Full interview.
