The NCAA NIL Working Group has been tasked with exploring backup plans in the event Congress does not pass an NIL bill, according to On3’s Prisbell, who reports the DI Council received updates from the subcommittee during its meetings last week. Prisbell’s source notes the NCAA will continue pursuing a federal NIL bill and adds: “A larger stakeholders meeting is expected to occur at the end of July in Indianapolis to solicit additional feedback on a potential draft of an NIL-specific proposal. That could be in the form of a draft of a federal bill to present to Congress or new overall NIL-specific guidelines. Specific elements that will be included in a potential NIL proposal remain unclear.” Last week’s meetings did not include discussions about potential revenue-sharing or employee models. Also from Prisbell’s source regarding more permissive NIL laws in Texas and other states: “The NCAA is a voluntary organization. If [schools in] Texas want to go way outside the guidelines and say, ‘We don’t have to follow NCAA rules,’ the NCAA can say, ‘We don’t have to invite you to NCAA championships either.'” (link)

The California bill that would create revenue sharing opportunities for student-athletes in the state will be delayed for at least a year. Per USA Today’s Berkowitz: “California’s legislature operates in two-year sessions that start in odd-numbered years. Under state law, if a bill has been introduced in the first year of a session, a member can choose to have its consideration continued into the second year. [...] Because each chamber of the legislature generally spends the first half of each calendar year considering bills that have been introduced by their own respective members, it is possible the Senate will not take up this bill again until June 2024.” (link)

The Mountain West maintains that San Diego State has notified the league of its intention to exit despite SDSU reaffirming its membership hours before last week’s deadline to give a one-year notice of departure. The San Diego Union-Tribune’s Zeigler reports that in response to the Aztecs’ letter on Friday stating they would not be resigning, the conference stated that, per its bylaws, it is withholding a $6.6M payment due the university this week as the first installment of the exit fee “in connection with our receipt of the SDSU Notice of Resignation.” Zeigler observes the conference could be employing any of three strategies: “simple envy and retaliation,” gain leverage should the league attempt to negotiate a lower exit fee if SDSU receives a Pac-12 invite later this summer, or attempting to “broker a long-term commitment from SDSU to the conference, further milking the Aztecs for NCAA Tournament shares in men’s basketball and their value to television partners.” (link)

BYU AD Holmoe talks about his interactions with Big 12 Commissioner Yormark, saying: “The strategy is, he doesn’t run things by the ADs at a really simple level. He’ll come and challenge you like, ‘this is what I want to do.’ The first couple of times he did that, the ADs were like, ‘Woah, this has never been done before.’ We’ve adjusted and adapted and changed some things. He’s been good about, when the vast majority of the room says, ‘not the right time,’ he’ll drop it. But he’ll push it a long way down the road. He doesn’t give up easily. He’s got us all on our toes. I think that’s a good place to be.” Holmoe goes on to say the Cougars jumped at the chance to hold events in Mexico. “I was the first to raise my hand. It fits right into our mission and the goals that we have, to be able to get access and exposure. Those are two key pillars that we focused on in independence. Those aren’t going to change in the Big 12. Now, because you have teams from Texas (and) there are a lot of Hispanic people in the state of Florida, around Orlando. Then you have the church. The Patriots’ leader says of landing in the big chair: “Of course, you want to win championships, retain really good coaches and staff, and continue to build on our momentum. And you've got to galvanize this community. It's a young university. The more we can bring connectivity to not only the Mason alumni base, but also to Northern Virginia and Fairfax, the better we'll be overall. … I told the search committee, 'If you just want me to make basketball better, I'm not the one,' because I want to have a transformative experience for all student-athletes. I want to win championships across the department and I get thrilled when I know we earned three this spring. … I recognize I'm just one person and I'm not going to solve all the problems in the first six months and it's going to take everyone in the department to rally behind making Mason better. I want to hear their ideas. I want to hear their approaches. Facilities upgrades continue at Michigan, where $41M in infrastructure improvements are underway, including $8M to fund “production room upgrades” inside the Crisler Center, $12M to replace to two video boards at Michigan Stadium, an additional $4M to fund “permanent safety additions for access” to the new video boards, and $5M to replace the audio system inside the Big House. Liberty AD McCaw joins A Sea of Red in the first of a two-part interview to discuss the Flames’ move to Conference USA, saying it will bring “tremendous television exposure, unlike we’ve ever had before with eight linear games for football. Our television partners being ESPN and CBS Sports are going to give us exposure that our programs have never had. … There’s an opportunity to really brand Liberty more than we have ever been able to do so previously on a national scale.” McCaw also notes the “men’s basketball package will be substantial. We will find out exactly what that means here later in the summer for our program. Linear broadcasts for championships in baseball, softball, and some other programs, women’s basketball, there will just be a lot more national exposure that we haven’t had in the past.” (link)

New York Governor Hochul has signed the state’s amended NIL bill into law, which, as previously reported, was heavily modeled after the Oklahoma law. On3’s Crabtree reports Syracuse “played a notable role in drafting the legislation.” (link)

Meta on Thursday plans to release a microblogging app similar to Twitter called Threads, and the Wall Street Journal’s Rodriguez notes: “Social media veterans and analysts see the planned app as a formidable competitor for Twitter, which has faced falling revenue and other challenges since Musk took over the company in October.” Mozilla Chief Product Officer Teixeira, who has worked as an executive at both Meta and Twitter, believes “a new microblogging leader will emerge to supplant Twitter, but it is far from a foregone conclusion that the winner will be Meta.” (link)

AAC Commissioner Aresco tells Inforum’s McFeely that “we don't discuss teams that might have an interest in our conference and where the interest might be reciprocated. That said, I will say this: [North Dakota State] has an outstanding program at the FCS level and it's been shown that FCS schools can move up and be successful in FBS. That's been shown by multiple schools. James Madison, Coastal Carolina, Appalachian State a few years ago. … We try to keep abreast of what might be happening and we always have contingency plans, but we don't discuss those publicly. Frankly, it's a little disconcerting that other conferences are now talking about which schools they'd like to add or that they might be targeting. It never used to be that way." On whether the conference would consider adding another football-only member, Aresco responds: “It's not something we would rule out by any means. You don't rule out anything, but right now we are focused on our incoming schools and we really don't have any expansion plans at the moment. But you never know." (link)

Ohio State AD Smith talks NIL, conference realignment, Big Ten Commissioner Petitti and more with the Columbus Dispatch: “A lot of people overreact when there's a newness. I think that's when you have to pause, get feedback, study, and not overreact. There are so many things we learned from the transfer portal to NIL and everything else in between.” For instance, at the advent of NIL, Smith says everyone was “focused on donors and individual contributions to the collectives. That’s viable, but what has shifted over time, which is the way it was originally intended to be, was to try and get your community involved from a business point of view. … What we've learned is that Columbus has 30,000 businesses and corporations. We needed to make sure we focused on those relationships.” OSU has hired Moody Nolan and Ruscilli as the architect and construction manager, respectively, for the St. John’s Arena and ice rink projects, and Smith notes the hope is the Buckeyes will have a plan for women’s ice hockey competition sometime in November. On his future in Columbus: “I’m healthy, I’m having fun, I enjoy what I do. … I don’t know when I’m going to retire. I have no clue. CEOs I’m blessed to work with who are retired told me I’ll know.” (link)

Florida is ready to select an architect for its $400M renovation of Ben Hill Griffin Stadium. Gators AD Stricklin: “We've engaged with vendors that specialize in iconic venues and stadium experience for both fans and players while offering a variety of solutions. It is now time to take that information and engage with an architect who can present renovation, construction and phasing options for The Swamp. … “There are many questions that come with a project of this scope, but it would be premature to speculate on the answer to many of those, including but not limited to final costs, seating capacity and specific timeline. We look forward to working along with an architect that will start providing options on what those answers could look like and allow us to continue to host college football's biggest and best fans in The Swamp." The Tennessee Board of Trustees approved a request to increase the budget for phase one of Neyland Stadium renovations by $49M to $337M. UT also released updated renderings for renovations to stadium skyboxes, which are scheduled to be completed by Fall 2024. Per the Vols’ release, the project will be “highlighted by a significant expansion to main concourse 1, inclusive of additional restrooms and an improved concessions experience. Additionally, the south end of the facility will be home to the stadium’s first-ever kitchen, commissary and loading dock.” (link)

Houston has released updated renderings of its $140M football operations center that is set to break ground in November. Cougars AD Pezman notes the facility, which will include a 20K-sq-ft weight room and several other amenities as previously reported, has “about an 18-month construction schedule that we feel very bullish about and very confident that we can deliver on, barring any unforeseen issues that could come up, like weather.” Have a look. A group of current and former Ivy League student-athletes suing the conference over its policy not to award athletic scholarships argued that the schools’ attempts to have the suit dismissed was “contrived,” adding that the policy "has no procompetitive justifications, but is merely meant to benefit defendants' bottom lines.” (link)

A group of plaintiffs has filed lawsuits claiming their personal data was improperly captured and disclosed by the official athletic websites of Florida, Nebraska, Texas and USC, Sportico’s Libit reports, adding that LEARFIELD and its subsidiary, SIDEARM Sports, are also named as defendants. Specifically, Libit explains: “At issue is whether the defendants have properly disclosed or provided an opportunity for users to consent to various tracking tools, including those engineered by Meta and Google, which share personal identification information with third parties—and if this violates federal and state privacy laws. For example, the lawsuits allege the websites violated the Video Privacy Protection Act by capturing the information of individuals who clicked on embedded videos on the team sites with Facebook’s tracking code, Pixel. … Plaintiffs’ lawyers say they’ve identified, through their ‘investigatory work,’ at least 173 SIDEARM Sports collegiate sites whose use of Pixel ‘resulted in subscribers’ Facebook ID numbers and video watching histories being shared with Facebook,’ signaling new proceedings against other schools could be coming down the pike.” A spokesperson for USC tells Sportico the “university takes data privacy very seriously and will defend itself against these allegations.” (link)

The National Athletic Trainers’ Association (NATA) has launched an inter-association collegiate standard of care toolkit to ensure the health and safety of college and university athletes. Youngstown State Deputy AD for Performance Excellence/former NATA President Lindley: “As we went into the project, the goal was to try to identify every consensus statement, every position paper, every bit of information that's out there so that the athletic trainer can sleep easier at night knowing that they can look to find the resources. We had no idea what we would end up with; but with over 1,000 resources in our resource library that are connected directly to each one of the over 500 standards, we feel great about what we've created.” (link)
