After the recent NCAA DI Men’s Basketball Committee meeting, during which tournament expansion was discussed, NCAA SVP of Basketball Gavitt remarked: “The committee must be good stewards for the Division I Men's Basketball Championship. They are committed to doing their due diligence looking at a few different models to make an informed decision that's in the best interests of the championship, and that may very well include deciding against expansion.” North Carolina AD Cunningham was selected as vice chair and will serve as chair in 2024-25, following SWAC Commissioner McClelland’s term in 2023-24. SEC Commissioner Sankey signs an extension that would keep him with the conference through 2028. Alabama President/SEC President Bell: “During a time of great change in college athletics, Greg Sankey has been a positive force for advancing the SEC and a thought-leader across the national landscape. The presidents, chancellors and athletic directors of our institutions hold him in great regard - respect which he has earned through his years of excellent service. I appreciate his proactive and collaborative approach to leadership and look forward to working with him for many years to come.” (link)

On3’s Prisbell camps with Big 12 Commissioner Yormark, who says he’d be “a little disappointed” if membership isn’t back at 14 within two years, with “guiding principles” for candidates including leadership, geography, cultural fit, athletic performance and brand upside. He wants to position the league to be a leader on “innovation and access” and says that “everything I do is all about getting on the [minds] of future student-athletes and doing things that will connect with that Gen-Z demographic.” On NIL, Yormark expresses a preference for a federal bill, thinks moving collectives under the umbrella of a department’s fundraising foundation would be a “burden,” and, when advising membership on state law vs association rules, tells them they “have got to adhere to NCAA policy…100%.” More, including using basketball as a catalyst to drive awareness and revenue, as well as control of data as it relates to sports gambling. Disney CEO Iger says of ESPN during an interview on CNBC: “We want to stay in that business. That said, we are going to be open-minded there too, not necessarily about spinning ESPN off, but looking for strategic partners that can either help with distribution or content, but we want to stay in the sports business.” As for a potential move to direct-to-consumer (DTC), Iger says he is more certain about when that would happen, but declined to provide specifics. Iger also stated the company is open to “selling or spinning off Disney’s legacy cable networks … and its broadcast group,” which would not include the worldwide leader, stating “They may not be core to Disney.” (link, link); An unidentified member of the Pac-12 CEO Group to JohnCanzano.com’s namesake on if Iger’s comments may have slowed the pace of the Pac-12’s new deals: “Not a reach. Disney and others going through serious shifts in last months.” The same leader says it “will be worth the wait.” (link)

Meanwhile, the ACC has inked a deal with The CW Network to air 50 football and basketball games every season through the 2026-27 campaign. More details: “In addition to 13 football games, The CW will broadcast 28 men’s basketball games and nine women’s basketball games. These games will be featured in December, January and February with men’s basketball doubleheaders taking place every Saturday afternoon and women’s basketball games on Sunday afternoons. Raycom Sports will produce all games for The CW.” ACC Commissioner Phillips: “The CW’s national distribution will directly benefit our student-athletes, teams, alumni and fans.” (link)

The News & Brews Sports Biz podcast tackles financial intricacies of NIL Collectives. On the recent Internal Revenue Service memo that could challenge tax-exempt status classification, James Moore’s Kurdziel: “This is a shot across the bow coming from the IRS. Now, it’s not certain how this will proceed because the IRS has approved many exemptions for these entities already and now is kind of going back on it a little bit and questioning it…I think that if you are a 501(c)(3) collective, you’re going to need to pause and check with attorneys, accountants and others to figure out what to do next—whether that’s to continue to receive contributions, and at the very least, not receiving them as tax-deductible contributions.” As for other tax-related issues, the firm’s tax partner Spiwak discusses a collective’s obligation for funds received. “When you think of a NIL Collective on its own, whether set up as tax exempt or for-profit, you really have to look at its obligation in return for the income it is receiving. For example, if a collective is getting a pledge or contribution and that is its money to keep regardless of how and when it is used, it’s income. If we have to delve into more of a contract-type basis where if the money is received it can only be used for certain sports or a promotional advertising purpose, and if it’s not used in that way it has to be given back to the person or business who gave it, it may not be taxable income at that point and can be more of a restricted-type asset.” More on the tax implications, including state and local tax discovery on the podcast. USA Today’s Jacoby and Kuchar analyze how public Power 5 schools are vetting incoming student-athletes for sexual misconduct or violent offenses with over half relying on student-athletes’ disclosure and multiple departments reportedly out of compliance with NCAA requirements to verify if any such instances have occurred. Of the resources provided, less than half of disclosure forms ask about pending criminal charges and single digits inquire about juvenile delinquency, arrests, past investigations or civil lawsuits. The NCAA’s decentralized approach, allowing each institution to create its own “reasonable steps” creates a wide variance, to which Otterbein (DIII) professor McCray states: “If the NCAA wanted everybody to take all of those steps, they would have written a very clear policy telling everyone to take those steps. They didn’t. Nothing in the NCAA guidance tells you you have to do more than the bare minimum.” As an example, Wisconsin has a written policy it implemented in 2019, “but it says nothing about steps officials will take to vet incoming recruits,” and UW states it is in compliance. Badgers Senior Assoc. AD/SWA Smith believes uniformity would be valuable: “For an issue of such great importance and magnitude. I think it would be helpful to have a standardized approach throughout the country.” UTSA is the lone DI institution and one of two NCAA members following the Tracy Rule and AD Campos says the process serves a deterrent for student-athletes with issues, adding: “We hope that we’re recruiting student athletes that we can trust, but for them to also know that we are going to verify from another school your background, I think that shows the seriousness of what we are trying to do.” (link)

Former Georgia football recruiting analyst Bowles, who survived the January car crash that killed multiple members of the Bulldogs program, has filed a lawsuit against the estate of former recruiting analyst LeCroy, who died in the crash, and former student-athlete Carter. Bowles alleges LeCroy and Carter were racing at speeds in excess of 100mph prior to the crash and that the UGA Athletic Association made false statements regarding rental vehicle use, while ignoring LeCroy’s dangerous driving record. Bowles seeks reimbursement for more than $170K in medical bills, as well as unspecified amounts for future expenses, wage loss and mental and physical pain and suffering, as well as punitive damages. Sixty-five percent of college and university business offers are confident about their institution’s financial outlook over the next decade, according to a new survey from Inside Higher Ed, with 19% lacking confidence for the next 10 years. The outlook for the next year is mixed with 36% of Chief Business Officers expecting their financial condition to worsen, compared to 47% at public institutions. For FY23, 62% say they will finish with an operating margin in black – that figure falls to 51% without federal economic recovery funds. 22% of CBOs and 41% of private school CBOs stated using endowment funds “over and above its normal spending levels” in the last year. Also notable, 13% of CBOs stated having “serious internal discussions” about a merger with twice as many believing their school should consider a merger in the next five years. (link)

Daktronics finished FY23 with a 23.4% increase in sales to a record $754.2M. For the year, orders dropped by 19.5% and the company has a current backlog of $401M. In addition to the $100M in capital commitments announced earlier this year, Daktronics ended FY23 with $25.2M in cash and marketable securities in addition to a $17.8M line of credit. (link)
