Colorado Chancellor Phil DiStefano says clarity on the Pac-12’s media rights negotiations is expected to be presented to campus CEOs by Commissioner George Kliavkoff today. “I’m eagerly awaiting to hear what the commissioner has to say. But at this point, the 10 schools are staying together and awaiting a message from the commissioner. … [CU’s] goal is to stay within the Pac-12 and have a media deal coming up shortly. That’s our goal. And I believe the presidents and chancellors of the Pac-12 are together on that.” DiStefano also remarks he has had no contact with the Big 12 or Commissioner Brett Yormark. (link)

Tennessee AD Danny White calls the NCAA’s ruling on the recruiting violations found to have occurred under former Football HC Jeremy Pruitt a “tremendous result for everyone involved. I think that it is a fair solution. College sports and all of the dynamics around it have changed so drastically over the last few years, but with the transfer portal and with NIL and the involvement of both of those things, from the onset, it never felt right for us to punish a bunch of kids that had nothing to do with any of the penalties that were involved in terms of a postseason ban.” Regarding how the fines will be paid, White says: “We're still working through logistics on how we manage that, but our capital projects, the large ones are self-sustaining projects and they're either funded through major philanthropic gifts that are either designated for those projects, and that can't change, it won't change.” (link)

Pittsburgh AD Heather Lyke is asked about her experience as a female AD and says the “job is just really about leadership. It’s about relationship-building, managing complex situations in a very visible setting, it's about building great relationships with coaches, and you can do that whether you're a male or female. But it is different. Obviously, I didn't play football, but I certainly understand the game. I don't think about it necessarily personally, but I know other people do. I think we have a group of colleagues – you know, there's five or six of us Power 5 females – so we know each other pretty well and we share experiences and ideas. It’s a bit rare, but at the end of the day I really think it's about your own individual leadership abilities.” On finding a family balance, Lyke explains: “I really focus on quality of time with them versus quantity because you're never going to capture the quantity that you want, but when you are together, really try to make it good quality time.” She adds: “I think being a role model to my own kids about the importance of your job and what you pour into it and how you try to do it really well, I think that is being a role model whether you realize that not or not at the time.” (link)

The Denton Record-Chronicle’s Brett Vito profiles North Texas AD Jared Mosley’s ascension to the post and asks former Mean Green/current West Virginia AD Wren Baker about his experience with Mosley. Baker: “I made what I thought was a pretty strong financial offer. Jared said he was going to pray and think about it. He got an email from a daily devotion he subscribes to. The title of the devotion was the same as the title of his speech when he took the Hall of Fame job. He called me back and said that he was being led to stay. I called him back the next day and offered him more money and told him, ‘God speaks to me, too. He told me to pay you more. You need to take this job.’” Now that he’s in the AD chair, Mosley acknowledges there is a lot of work to be done as UNT joins the AAC. “We’re working with less square footage per student-athlete than almost anyone in the American. Getting [the athletic center] to where we need it to be will be a catalyst for almost anything we want to do down the road.” To raise the necessary $20M, Mosley says expanding the donor base is critical. “We need to change our approach, how we try to bring people on board and captivate an audience. It will be with improved marketing plans, game day presentation and making people a part of what we do.” (link)

Extra Points purveyor Matt Brown joins Connect’s Steph Garcia Cichosz to talk about the launch of Athletic Director Simulator 3000, an Oregon Trail-style computer game that allows users to navigate realistic scenarios a DI AD might encounter. Situations range from donor relations and NIL to sponsorship opportunities and gameday operations, and ADS3000 challenges players to manage a budget, Directors’ Cup ranking and local support while avoiding NCAA investigations and scandals. Beyond just serving as a fun thought exercise, Brown explains the game could eventually serve as a way to conduct case studies for athletic departments. “The framework for the game can be adapted very easily and I do think this is something that maybe we should continue to talk about with schools. We within the Extra Points and within the D1.ticker universe have so much school-specific data that could we turn around and build a Rice Athletic Director Simulator or a Sacred Heart Athletic Director Simulator and use that to help either a prospective candidate or an associate AD or somebody like that better understand that experience? INFLCR CEO Jim Cavale tells ESPN/SEC Network host Paul Finebaum he believes the question of classifying student-athletes as employees is the biggest issue facing college football at the moment. “Because whether it’s employment, whether it’s sharing revenue, big-time college football players are in a situation where they deserve probably a bigger piece of the pie. And the way it is looked at — let’s just say an SEC school does $215M in gross revenue as an athletic department. Let’s say $130M of that comes from football. Well, at the pro level, $65M of that $130M would go to payroll for players. That’s the big discrepancy. It’s unlike anything in American labor that’s being looked at right now in the Johnson vs. NCAA case.” Cavale goes on to intimate that a possible solution involves sharing revenue with student-athletes while not designating them as employees: “(Oklahoma AD) Joe Castiglione, to me, did a great job saying we need Plan B, Plan C, Plan D and Plan E. I think we do. A lot of people think that there’s ways to use NIL. It’s called BNIL — broadcast NIL — to share revenue with athletes without them becoming employees.” (link)

Salvi, Schostok & Pritchard attorneys Pat Salvi II and Parker Stinar say they will be filing a third lawsuit [their second] against Northwestern on behalf of a third anonymous client. Salvi and Stinar say the second and third suits will include the same co-defendants, as well as ACC Commissioner/former Northwestern AD Jim Phillips. Stinar tells Sports Illustrated’s Johnson: “This isn’t just a [Pat] Fitzgerald issue. This isn’t just a football issue. Rules & Regulations…
+ The NCAA Playing Rules Oversight Panel (PROP) approved increasing the scenarios when teams have the advantage of playing a player up in women’s lacrosse in order to curtail physical play outside the critical scoring area. A one-minute releasable penalty would be assessed for several types of fouls when occurring between the restraining lines, and officials can also give a five-minute red card for contact to the body if they think the contact warrants a greater penalty. All red cards are now a five-minute non-releasable penalty instead of the previous two-minute penalty. More women’s lacrosse rules changes. (link)
+ The PROP also approved expanding video review in men's lacrosse to include coaches' challenges for the 2023-24 academic year for all NCAA competitions, not just during NCAA championships. The panel also approved a measure stating that any time a player's helmet comes off during a live ball scenario, the officials will stop play immediately, and the player will leave the field. More on the rules dictating when coaches can challenge and when video review is allowable. (link)
+ Additionally, the PROP approved a clearer definition of a bona fide competition in men's and women's swimming and diving. Under the new rule, non-collegiate athletes cannot participate in an official program of collegiate meets. However, non-collegiate athletes will be allowed to compete in exhibition events conducted outside the meet program. The panel also approved an optional rule for team diving competitions whereby a team will consist of three divers from the same school; each diver will complete one-third of the prescribed list of six dives/two dives at any level; and the team will complete one dive from every group (front, back, reverse, inward, twist and armstand), for a total of six dives, along with other requirements. News from Northwestern…
+ Former Northwestern football student-athletes Lloyd Yates, Warren Miles-Long, Simba Short and Tom Carnifax today spoke publicly for the first time about allegations of hazing within the program. Long described Northwestern as a program where "sexual violence and sexual assault was rampant,” and Yates added: “We were physically and emotionally beaten down, and some players have contemplated suicide as a result. … "We were thrown into a culture where physical, emotional and sexual abuse was normalized. … It’s something where you say, ‘That’s not going to happen to me.’ You’re going to fight back. And when it happens, it’s uncontrollable. You’re dominated by the culture." Yates also noted it was especially difficult for players of color. Plaintiffs attorney Crump: “It is apparent to us that it is a toxic culture that was rampant in the athletics department at Northwestern University. What they shared with us was clearly a pattern and practice of a culture that was predicated on physical intimidation, harassment, discrimination, abuse both mentally and sexually, and it was normalized. … This is not just relegated to the football program at Northwestern University. It’s not an individual coach. It’s widespread. It falls on the doorstep of Northwestern University as an institution." More from the press conference. (link, link)

+ Former Northwestern Football HC Fitzgerald’s attorney, Dan Webb, has released a statement in response to today’s press conference which reads, in part: "As regards our client, Coach Pat Fitzgerald, no arguments were made that would present any substantive, detailed, factual allegations, let alone evidence, about Coach Fitzgerald's conduct. The statements made by the lawyers and former student athletes, and those contained in the complaint filed by the one unnamed plaintiff, still fail to cite any specific facts or evidence beyond the broad-based statements published in the July 8 article. … The facts and the evidence will show that Coach Fitzgerald implemented and followed numerous procedures and protocols to ensure that hazing would not occur, and he repeatedly emphasized…that hazing was forbidden and, if anyone was aware – or was the victim – of hazing that they should immediately report it so that he could stop it.” Full statement. Mountain West Commissioner Gloria Nevarez during MWC Media Days says she recently spoke with football student-athletes about NIL, and “generally speaking, our student-athletes thought it was great. But pay-for-play is a problem. We need Congress to assist in a solution to help the NCAA regulate NIL in a way that we can prevent pay-for-play. Without national regulation, you can't have national competition which culminates in national championships.” In discussing the recent news that San Diego State will remain a member of the conference in good standing for 2023-24, Nevarez remarks: “As you can appreciate, I'm not going to be commenting on the deliberations of the board or the details of the resolution. Suffice it to say I feel like we landed in a very, very good spot and we're very much looking forward to moving forward with San Diego State.” Nevarez does confirm that “as a member in good standing,” San Diego State’s conference distribution has been released. She also makes the observation that “conference movement was an anomaly. Now it seems to be a regular part of business, and what I found is that we have very strong conference policies that are designed to not completely prevent schools from leaving because we acknowledge that movement is going to happen, but that protect the conference when those things happen. Certainly, we’ll continue to evaluate those and tighten them up but…I'm really pleased where we ended up at the end of the day.” Full presser. (link)

Stanford President Marc Tessier-Lavigne will resign after an independent review of his research found flaws in studies he supervised going back decades. An outside panel of scientists cleared Tessier-Lavigne of accusations of scientific fraud and misconduct but said the 2009 Alzheimer’s study in question had “multiple problems” and “fell below customary standards of scientific rigor and process.” European studies professor/former University of Chicago Provost Richard Saller will take over as interim president on September 1. Documents obtained by On3’s Andy Wittry shine a light on the SEC’s lobbying strategy for NIL regulation, including this from a document labeled SEC Day on Capitol Hill: “The NCAA cannot fix this, only Congress can fix this. … The NCAA has not shown the ability to effectively regulate NIL activities or enforce its rules prohibiting booster involvement in recruiting or inducements or pay-for-play.” Another of the “Key Points for Congress” states: “The SEC’s view is that prohibiting boosters/collectives from involvement in the recruitment of high school and transfer athletes is the simplest and most effective approach.” Another SEC talking point characterizes the potential designation of student-athletes as employees “catastrophic” for non-revenue sports. According to the briefing document, many schools would be forced to eliminate both men’s and women’s athletic programs, and “we expect some lower resource universities to do away with athletics altogether.” The league defines its five needs as: establishing a uniform set of NIL rules; keeping NIL out of recruiting; prohibiting pay-for-play and clarifying that student-athletes are not employees; protecting student-athletes from unscrupulous actors and ensuring compliance with rules; and providing legal protection to allow for change in college athletics without resulting in existential legal exposure. Cleveland State AD Scott Garrett argues the 2022-23 season was the best in Vikings history, telling Crain’s Cleveland Business: “You can look at a number of competitive success stories…then layer in community and fan engagement, particularly with fundraising and our academic success and record number of all-league honorees. Then you package all that with all of our community activations and how aligned we are some of revenue-generating success, and it has to be our best year ever.” Regarding the success of the women’s hoops team, Garrett notes: “We spent a lot of time on grassroots things like building relationships and exposure. Now we have the opportunity to translate that support and visibility into revenue-generating activity.” Garrett adds: “We have tripled our fundraising over the last five years. It’s at an all-time high and the runway continues to grow.” (link)

Speaking as part of a Texas High School Football Coaches Association panel, Houston AD Chris Pezman shares his thoughts on the current state of NIL and the transfer portal: “Where we absolutely screwed up was introducing both of those at the exact same time because you created a free-market system for players to be able to transfer but at the same time you introduced money into that decision. The two things we’ve always tried to keep out of our environment were agents and boosters. In one fell swoop we let them all in. … It’s pay for play. We are kidding ourselves if we call it anything else.” Pezman goes on to acknowledge that tampering is a real issue, but with many coaches contacting players through third parties it can be difficult to prove. “In our case, we had a kid leave and went to another school. The coach had gotten to another player that was in the portal on FaceTime and then had that kid go to our locker room the same day he left us and was walking around saying, ‘I need to talk to that kid, I need to talk to that kid.’ You find out about this and you’re like, there’s no proof. The Atlanta Journal-Constitution has issued corrections to its recent investigation into the Georgia football program’s handling of sexual abuse allegations against its players and recruits. According to Editor-in-Chief Leroy Chapman, AJC editors and attorneys investigated each complaint raised by UGA officials and found two elements of the story that did not meet the news organization’s journalistic standards. Chapman also indicates the review found no instances of fabrications in the story, as the university’s letter had alleged; however, Alan Judd, the reporter who authored the story, was let go for violating the AJC’s journalistic standards. Regarding the errors themselves, the AJC’s editors said they could not substantiate one of the article’s key assertions about Bulldogs Football HC Kirby Smart’s tenure: namely, that 11 players remained with the team after women reported violent encounters. The “precise count of 11 players” could not be substantiated under the AJC’s standards. In a second error, the article improperly joined two statements a detective made minutes apart into a single quotation. Doing so did not change the meaning of the quote, but the way it was presented to readers failed to meet AJC standards. (link)

Old Dominion has delayed plans for $20M in upgrades to Bud Metheny Ballpark, home of the Monarchs’ baseball team after deciding the construction timeline was too tight. ODU will now play its home games on campus in 2024, and construction will begin after the 2024 season. The 2025 season will be played off campus at a site to be determined. Monarchs AD Wood Selig: “There’s a lot of preliminary work that still needs to be done. Just given the time it’s going to take to formalize the stadium design and budget, we got a little nervous.” (link)

With Chelsea and Wrexham set to square off in a summer exhibition match in Chapel Hill, the Raleigh News & Observer’s Luke DeCock observes this “is a bit of an audition for Kenan Stadium as the [North Carolina] athletic department explores new revenue sources. If this goes well, it could become a summer soccer destination, giving the Triangle a piece of the action that now all goes to Charlotte. There hasn’t been a concert there since Bruce Springsteen in 2003…but that’s something the university is willing to explore. For the moment, though, this is a one-night special — sold out, on ESPN. If the weather cooperates, it could be one of the Triangle’s more memorable soccer evenings. If it goes well, it might not be the last.” (link)

Several SEC football players have remarked during Media Days that being a part of the upcoming EA Sports video game is more important than the money they might receive from it. Missouri corner Kris Abrams-Draine, for instance said: “As a college athlete, I don’t know about for everybody else, but I don’t care about money because I’ve been playing that game since I was little. It was basically just seeing myself in the game is more important than getting that little money off of that.” LSU QB Jayden Daniels added that NCAA Football ‘14 is still “probably the best game I’ve played. I had the most fun playing NCAA. Obviously, you grew up wanting to see yourself in the game.” Like his teammate, Mizzou tackle Javon Foster says: “We all grew up playing NCAA and seeing all the college teams. We just honestly as kids just wanted to be on there. So, now a lot of guys are like, ‘We just want to be on the game.’ They don’t care about anything else.” (link)

The U.S. Ninth Circuit Court of Appeals this week sided with Instagram over two photographers who accused the company of copyright infringement for allowing websites to embed their posted photos. Sportico’s Michael McCann notes that photographers Alexis Hunley and Matthew Scott Brauer “granted Instagram a royalty-free sublicense to display photos they post. Although Instagram does not grant third parties a license to users’ works, its technology permits third parties to embed public posts.” As such, McCann notes the ruling is a “positive development for social media platforms and websites that rely on embedding to generate content and accompanying revenue. Conversely, it’s a setback for photographers who promote their work on social media for professional reasons and who run the risk of media embedding their posts without their permission and without paying them.” However, the plaintiffs could eventually petition the case to the U.S. Supreme Court, and McCann believes it has certain qualities that might attract SCOTUS’ interest. “Most important, the underlying legal question of whether embedding can infringe has yielded conflicting judicial opinions. The Supreme Court might reason it must step in to clarify what the law ought to be and prevent conflicting outcomes based on where a case is tried.” (link)

+ Former Tennessee Football HC Jeremy Pruitt will appeal the NCAA’s decision to levy a six-year show-cause against him, according to Knoxville News Sentinel reporter Adam Sparks, who reports: “Pruitt’s plan of attack involves pinning the blame on young staffers and assistant coaches, claiming he was a victim of a toxic booster culture and arguing the scales were tipped in UT’s favor because it paid for an independent investigation that unearthed most of the evidence that school leaders then turned over the NCAA. The strategy is similar to what Pruitt employed in testimony to NCAA Committee on Infractions that rendered the verdict in the case.” As for Pruitt’s chances, Sparks notes: “The good news for Pruitt is that he'll get a new audience in the seven-person Infractions Appeals Committee. The bad news is that few challengers win NCAA appeals. … Over the previous three years, eight violations have been challenged on appeal, and seven were upheld. And 12 of 16 penalties were affirmed.” (link)
