The Athletic’s Stewart Mandel gets an unnamed Pac-12 official on the record to provide more context around yesterday’s angle of new players coming to the table for the league’s media rights opportunity: “Think about what the media and technology companies have been going through the last nine months — economic downturn, soft ad market, worse stock performance for most of those guys in decades, layoffs, writers and now actors strikes. It’s been a brutal economic time. We’re just starting to come out of that. What we’ve seen is, every time we wait, we get more opportunities and better numbers.” More key notes from Mandel: “Two league sources told The Athletic on Friday there’s not unanimity among the presidents to expand at all. It would take an 8-2 vote, and at least two schools — one of them assumed to be Oregon — don’t currently support it. The rationale being, they’d rather compete with fewer schools for the Pac-12’s berth in the expanded College Football Playoff, not to mention sharing CFP revenue with fewer mouths.” (link)

Kansas AD Travis Goff sits down with D1.ticker/Connect’s Kristen Eargle to discuss the new-look Big 12, renovations to Memorial Stadium, the overall momentum of the football program and lots more. Goff acknowledges there was a period of feeling some instability following the departures of Texas and Oklahoma but now says the tone throughout the conference is optimistic. “Bob Bowsby at the time led us through the additions of these four [new members], was decisive, was strategic and went out and got it done. Now, here we are, fast forward a couple years, instability in the industry generally and in some of our conferences out there, but we really feel incredibly aligned, I think we feel like there is real stability. Part of that is there’s some strength in numbers.” On Commissioner Yormark: “Amazing brand builder and he's stretching all of our comfort zones and I think without question that's what we needed in the Big 12. The Richmond Times-Dispatch’s David Teel posits the shift of some ACC football and basketball games to the The CW constitutes a win for fans who have trouble finding games amid the oft-confusing array of streaming options. Meanwhile, The CW President Dennis Miller explains there is a “very strong desire to really build live sports into The CW for the first time and take care of our broadcasters and advertisers. Live is what we know works in broadcast, so we are in conversations with lots of leagues and teams right now. … With all of the sports tectonic plates shifting right now, (Gray and Raycom) brought to our attention that there was an opportunity to capture high-quality college football and basketball with the ACC. We want to improve the value of the real estate on weekends for CW affiliates, so it lined up very nicely with our affiliate groups, including Gray and Sinclair and Nexstar and others. We quickly moved into negotiation mode.” As for what comes next after the deal expires in 2027, Miller tells Teel: “We’re going to get better and better at being a platform for sports. I’m really confident this will be a long-term play for us, but I haven’t had time to focus on 2027 yet.” (link)

SBJ’s Abe Madkour breaks down what the NCAA must take into consideration for its media rights negotiations: “It seems like a certainty that the women’s basketball tournament will be sold as a stand-alone after it drew record ratings this past April. But what else? The women’s and men’s College World Series both rated very well, and women’s gymnastics and volleyball also have audiences. Supporters of these sports are advocating for them to be pulled out and sold individually. The fear is that if the NCAA pulls out too many popular sports, the package will become so diluted it will lose any value and defeats the purpose of maximizing rights fees and distribution. Remember, these are only for the championships — not the regular season or the conference championships. It’s limited inventory and that’s what the NCAA and Endeavor will have to navigate as they go to the marketplace. … Talks are expected to unfold later this year.” (link)

Sportico legal analyst Michael McCann breaks out some of the facets of the College Athletes Protection and Compensation Act of 2023 draft legislation proposed by U.S. Senators Richard Blumenthal (D-CT), Cory Booker (D-NJ) and Jerry Moran (R-KS) for a closer inspection. McCann observes the “creation of [the College Athletics Corporation] would be new for college sports, but not for the American economy. Congress has created corporations that, though they vary, function in some ways like a business while being accountable to government oversight. Amtrak, the Federal Deposit Insurance Corporation and the Corporation for Public Broadcasting are all examples of such corporations.” McCann goes on to suggest the CAC is likely to face pushback, “especially regarding its subpoena power. The organization could be viewed as threatening and potentially chill the NIL market. College athletes who find themselves under CAC investigation might feel like they need to hire attorneys. The CAC’s role in certifying agents could also face resistance. Sports agents are ordinarily certified by labor organizations, such as the NFLPA or NBPA; the CAC will not be one.” More from McCann. Connect’s Steph Garcia Cichosz Q&As with Cal gymnastics student-athlete/DI SAAC representative Elise Byun about the importance of the student-athlete voice, NIL and national standards, and the challenges that student-athletes face in today’s landscape. In discussing what NIL is really like from the student-athlete perspective, Byun explains: “At least for women’s sports I can say that NIL has done great change. It puts us on the map, it shows that, one, female student-athletes are amazing athletes in general, and, two, it gives visibility that our sports are fun to watch, and if you put us on broadcast people will watch. I think that's really exciting. But I think the kind of harsh reality of NIL is that it impacts recruiting and with all the different state legislators and all the different rules, it's hard to make that an even playing field, so hopefully in the future we can see some of that change.” Full interview. Florida football student-athletes during SEC Media Days shared their thoughts on the recruitment of former QB commit Jaden Rashada & reports of a $13M NIL deal. Gators center Kingsley Eguakun told reporters: “I mean… I believed it, I guess. But at the end of the day, reporters can report anything they want. For real. It was really up in the air. But if he did and (they) felt like they had to give him that to come to the school, then it is what it is. Like I said, I’m not worrying about anybody else’s pockets because it doesn’t do anything for me. He’s not going to give me any of that.” UF WR Ricky Pearsall added: “We understood it was the recruiting process and NIL is a thing now. So, all the guys respect him and his decision. I think all the guys are just worried about what’s going on in the locker room, not necessarily outside stuff.” (link)

Kliavkoff at the Podium…
+ Pac-12 Commissioner George Kliavkoff kicked off Pac-12 Media Day from Resort World in Las Vegas. On the media rights front: “The longer we wait, the better our options get, and I think the board (of directors) realizes that.”
+ On speculation around members departing for other leagues: “I kind of know where the source of that is coming from. I discount that because I know the truth.”
+ Utah AD Mark Harlan supports that notion: “Our words and actions speak for themselves. We are a proud member.”
+ As for potential additions, Kliavkoff: “I’m not going to disclose conversations with any candidates. We’ve never given anyone an indication that (the process) would be anything different.”
+ Kliavkoff also called a potential student-athlete employee model an “existential threat” with the fear that “money dries up” for Olympic sports.
+ Oregon AD Rob Mullens on media rights: “It feels like there's been substantive progress (on the media deal) in recent weeks. When you get some additional players at the table, it can kind of speed things along.”

The Autonomy Five have released a statement of support for the legislation brought forward by Senators Richard Blumenthal (D-CT), Cory Booker (D-NJ) and Jerry Moran (R-KS). The statement in part: “Given the ever-changing landscape of college athletics, developing a federal standard that will preserve college athletics and serve as a uniform name, image and likeness (NIL) standard for athletes and institutions across the country is now essential. We are pleased to see that momentum continues building in both the Senate and the House to address this issue. Our conferences welcome additional efforts in the future, and we look forward to engaging with lawmakers on both sides of the aisle to continue making progress on bipartisan legislation in Congress. On3’s Pete Nakos has obtained a draft of NIL legislation crafted by U.S. Senator Ted Cruz (R-TX) and reports the bill, “dated July 3, does not have a title yet but would nearly check off every item on NCAA President Charlie Baker‘s wishlist. Along with a section focused on liability – all but granting the NCAA an antitrust exemption – the proposed legislation states athletes are not employees and includes a state law preemption. The proposed bill ensures states are barred from enacting laws on compensation, employment status, athlete eligibility or NIL.” Nakos also points out the bill is in contradiction to Texas’ recently passed state law, which had support from both Texas and Texas A&M. Cruz’s bill would also require NCAA member institutions to provide anonymized data on all NIL deals each year, specifically the description of services rendered and the amount of compensation provided. LEAD1 CEO Tom McMillen wonders of the College Athletes Protection and Compensation Act “who is going to be the cop on the watch?” McMillen continues: “On one hand, the NCAA has some enforcement part, but then you have other organizations. It is the schizophrenia, I think, that Congress is dealing with. They don’t want to give the NCAA carte blanche, like [Senator Joe] Manchin [D-WV] and some of them did because there’s concern about the NCAA. But then some of the ways they organized it are very complicated. You’ve got this entity that will be very athlete-centric but has subpoena power. How that holds with the NCAA remains to be seen.” Enforcement, McMillen continues, is “wide open in all these bills. They sometimes rely on attorneys general, sometimes give the NCAA the ability to create rules and then they create this other entity. That’s a little confusing to me.” McMillen reiterates his position that any viable bill must be simple, “and then you may have to concede some points. That you have differences of approaches is not helpful, as Mitch McConnell said, to getting a bill done.” (link)

The Athletic’s Cameron Teague Robinson takes a look at the MAC’s place amid the shifting collegiate athletics landscape. Commissioner Jon Steinbrecher insists conferences don’t need to change just because others are. “You add membership for one of two reasons. You either add to survive or make yourself stronger. … Philosophically, the way we look at intercollegiate athletics and its place in higher education, it plays an important role, but it’s just one piece of the puzzle, it’s helpful. It leads to very good conversations among presidents, ADs and others. The more similarities you have, the more bridges that are built among that group of schools and it strengthens those bonds. For our budget, we have the smallest delta between the highest and lowest budgets across all of FBS, so nobody runs away from anybody financially. It’s a level playing field.” He goes on to add: “There’s a great deal of trust there. Those things can be fractured. Institutions ought to be where they need to be and what makes sense for them. …. Outside of an autonomy conference, I don’t know why you would be somewhere else.” (link)

Former New Mexico AD Paul Krebs has been acquitted of his two embezzlement charges stemming from a misappropriation of public funds to cover a chunk of the cost of a $250K booster golf trip to Scotland. Attorney General Raúl Torrez: “While we are disappointed by the jury’s verdict, we are prepared to work with the legislature to make sure that this kind of activity is clearly and unambiguously prohibited under the law and reassure taxpayers that public resources are not used for private purposes or the interests of a privileged few.” (link)

As Disney explores a strategic partnership for ESPN, CNBC’s Alex Sherman reports the Worldwide Leader held preliminary discussions with the NFL, NBA and MLB about becoming minority investors. While there are a myriad of potential conflicts, Sherman comments: “ESPN would like to morph itself into a streaming hub for all live sports. Management would like to launch a feature allowing ESPN.com or the ESPN app to funnel users to games no matter where they stream, CNBC reported earlier this year. While striking a deal with professional sports leagues wouldn’t be easy, Disney appears to be pushing the envelope on its thinking to prepare for a streaming-dominated world that includes its full portfolio of sports rights.” (link); Also notable from Sherman: “Last quarter, for the first time ever, Disney's affiliate price increases for its linear cable networks (driven by ESPN) didn't make up for the accelerating customer losses. Texas A&M President Banks announces her retirement, effective immediately, explaining in a letter that “negative press has become a distraction” following the hire of Kathleen McElroy, “a former New York Times editor who had been selected to revive the school’s journalism department,” according to the AP’s Jim Vertuno. Earlier this month, Banks told The Texas Tribune that pushback had surfaced over McElroy’s hire because of her work on race and diversity in newsrooms. A statement from the A&M system indicated “a wave of national publicity” suggested McElroy “was a victim of ‘anti-woke’ hysteria and outside interference in the faculty hiring process.” Vertuno: “McElroy’s original job offer to revive Texas A&M’s journalism program, which was celebrated on campus with a ‘signing party,’ was later changed from a tenure-track position, to a five-year role, then to a one-year job from which she could be fired at any time.” (link)

+ The Clemson Board of Trustees and the Finance and Facilities Committee gave Phase I approval for comprehensive improvements to Swann Pavilion and Littlejohn Coliseum. The $40M project includes renovations of more than 51K square feet of existing team spaces and 30K square feet of new construction. Portland State has committed to a five-year strategic plan, and Vikings AD John Johnson writes in a letter to supporters: “Central to this new Build the Ship Strategic Vision is PSU's continued allegiance to the Big Sky Conference membership, one of the nation's finest Division I collegiate conferences. This element of our program is critical to our future and to the experience of our student-athletes. The plan also outlines a more sustainable financial approach, which includes stabilizing institutional investments and increasing athletics revenue. Importantly, PSU has identified stable budget funding for Viking Athletics and will discontinue the use of university financial reserves to fund the program. New revenue, meanwhile, will come through expanded ticket sales and student attendance, new sponsorships and game guarantees, and growth in philanthropic support.” (link)
