Northwestern President Michael Schill joins the Daily Northwestern student newspaper to discuss the hazing allegations and explains why he decided to override his initial two-week suspension for former Football HC Pat Fitzgerald and ultimately part ways with him. “I was affected by reading your coverage, I was affected by additional allegations we received, I was affected by the impact it was having on our community. I came to the realization that I had over-weighted the individual knowledge. The coach had been the leader of a small entity for over 15 years, and he was charged with responsibility for our student athletes and the culture. … I came to the conclusion that he had failed, and he didn’t try to find out what was happening and he had to bear responsibility for that.” Regarding Wildcats AD Derrick Gragg, Schill states there is “no conversation ongoing about his employment. I am supporting him, I am meeting with him about the prospective steps, but there is no process, conversation or discussion of his employment status. He is the athletic director. If there should be allegations, just like anybody else involved, we will investigate that.” Schill also says he doesn’t feel his job is in jeopardy, nor does he believe the allegations should have any impact on the Ryan Field rebuild. + Utah State will interview eight AD candidates virtually this week, according to CollegeAD, which reports the search committee will then narrow down the list to three or four applicants who will meet with incoming President Betsy Cantwell. CollegeAD also reports USU’s goal is to have a new AD in place by the middle of August at the latest. (link)

The Athletic’s David Ubben and Jesse Temple catch up with Former Texas/Kansas AD DeLoss Dodds, former Wisconsin Football HC/AD Barry Alvarez, former Nebraska Football HC/AD Tom Osborne and former Minnesota/Miami (OH)/Denver AD Joel Maturi to get their thoughts on what lies ahead for college sports. Dodds observes: “It looks to me like the big schools, the bell cows, are going to the top. And when that happens, you lose a bunch of schools at the bottom. Eventually, the big ones will eat the little ones.” On what he would change if he were in charge of future moves, Dodds adds: “I don’t know who you would move, but if you had four regions, kept it geographic so kids didn’t have to travel so far to compete. It hurts all sports. Basketball in the Big Ten now, I don’t know how they do that. I’m sure they come up with a doable thing, but I’d like it more regionalized where more schools would be involved. If you had four regions, you could involve a lot of institutions and not be dropping people off the bottom.” Osborne adds: “I’m hoping the ACC and the Big 12 and the Pac-12 find a good solution or arrangement. It certainly does appear that the Big Ten and SEC are, at this point, probably best constructed financially to survive for the long haul.” Maturi, meanwhile, insists SEC Commissioner Greg Sankey wants what's best for college athletics, “but at the same time, I’m not so sure what’s best for college athletics is the expansion of the major conferences. I’m not so sure that’s the real answer.” (link)

Attorneys for Arizona State swimmer Grant House, TCU women’s basketball student-athlete Sedona Prince and former Illinois football student-athlete Tymir Oliver last week filed a memorandum in a California federal court, arguing that college athletes who were denied NIL opportunities before 2021 should be allowed to sue in a class action. Specifically, Sportico’s Michael McCann explains, the players “seek certification of classes for football and men’s basketball players, women’s basketball players, players in other sports starting in 2016 and all DI athletes who competed or will compete from June 15, 2020 (when the complaint was filed), to the date of judgment in the case, which is currently scheduled to go to trial on Jan. 27, 2025.” Plaintiffs’ attorneys Steve Berman and Jeffrey Kessler argue the “NCAA, member schools and the Power 5 conferences have conspired in violation of federal antitrust law to deny NIL opportunities until 2021 and continue to deny athletes a share of broadcasting revenue (BNIL),” per McCann. They also contend they’ve presented realistic methodologies to demonstrate class-wide injuries. For instance, they note that available facts “overwhelmingly demonstrate” that Electronic Arts would have published a college football game if the NCAA had not prohibited players from earning NIL as a condition of their eligibility.” More analysis from McCann. Big South Commissioner Sherika Montgomery talks about her ascension to the commissioner’s role, telling the Charlotte Observer’s Alex Zietlow: “To be the first woman and first woman of color as fourth commissioner, it’s a tremendous honor, a tremendous blessing. But I think it’s also a testament to the commitment of diversity, equity and inclusion — but also just the diversity of perspective — within our conference.” Former Commissioner Kyle Kallander says he knew right away Montgomery would “progress in this business rapidly and really become a leader in the industry.” Why? “Because of her. Because of her way of working with people, her understanding of the business and what’s important, her commitment to the student-athlete, and the fact that she knows the Big South Conference — I think that’s really important.” Montgomery notes that “being a transfer student-athlete really changed my entire career, and probably my life. It was when I transferred from the University of Memphis that really made me understand my student-athlete experience off the court, out of the classroom. What does this blue disc mean that says ‘NCAA’? What are the 8,500 bylaws that I’m governed by, that I’m not really familiar with?” (link)

Incoming Elon AD Jennifer Strawley talks about her vision for the department: “As we begin to move forward and try to understand what intercollegiate athletics looks like in the future, we have to be proactive in how we think about what’s best for Elon. Ole Miss Assoc. General Counsel Ane Debro visits @1QLeadership to discuss her position and the role of providing legal counsel to an athletics department. Debro talks about the difference in tempo working in athletics versus working as the general counsel on campus. Debro provides insights on how her responsibilities go beyond compliance, which include providing legal answers that help things move a bit faster within the department. The conversation wraps with Debro's thoughts on student-athletes and NIL. She observes there is a “different tempo within athletics, and those coming in have to figure out if they want to work within the tempo or will they operate at their own pace." Debro also advises asking the same questions “regardless of how fast or slow you move. What are the facts, what is the end goal and how do we get there?” She goes on to submit that “in terms of NIL, student-athletes should start by finding out who they are as individuals, because that is what people are going to look at in terms of allowing the student-athlete to represent a company." U.S. District Judge Michael Urbanski has ruled that a former Radford baseball player who accused former Highlanders Baseball HC Karl Kuhn of mistreating minorities must use his real name for his lawsuit to continue. Urbanski found that allowing the student to proceed as John Doe would be unfair to Kuhn. “There is an inherent inequality in allowing an accuser to proceed pseudonymously while the defendant is forced to defend himself publicly.” Rob Dean, the attorney who represents the former player, said he intends to keep the case alive by going public. Connecticut has settled a lawsuit filed by former women's soccer player Noriana Radwan, who lost her scholarship after flipping the middle finger in the direction of a TV camera as the Huskies celebrated winning a conference championship in 2014. Per the agreement, Radwan will receive just over $46K to cover the cost of her student debt at Hofstra, where she transferred after losing her scholarship. Her attorneys will receive $162,500. UConn also has agreed to revise its student-athlete handbook to make it clear how long athletes have to appeal the loss of a scholarship. (link)

UTSA and New Mexico State have canceled their four-game home-and-home football series slated to begin in 2024, according to Football Schedules’ Kevin Kelley, who reports the Aggies terminated the series due to their transition to Conference USA. NCAA SVP of Basketball Dan Gavitt joins The Field of 68’s Jeff Goodman and Robbie Hummel to discuss the NET, rule changes, tournament expansion and more. Gavitt says he doesn’t know how much of an appetite there is for a 96-team field, “but there was really good discussion last week at a real high level. We didn't get into a lot of detail because it's just really the first time that they had talked about expansion. We're going to take the rest of the summer and fall into the early winter to do a much deeper dive and study what benefits, challenges, even goals of expansion are, like why would you expand? What are you trying to achieve? Are you creating greater value?” As for whether the NCAA will ever divulge the NET formula, Gavitt says the “complicating factor” is the NET isn’t a simple formula like the RPI. It was developed through artificial intelligence, so “I’m not sure there’s a simple way” to explain it. Gavitt does acknowledge the NCAA could do a better job of communicating the NET’s components. JohnCanzano.com’s eponymous purveyor caught up with Big Sky Commissioner Tom Wistrcill ahead of today’s Media Day, and Wistrcill notes the league values ambition while remaining true to its core values. For instance, Wistrcill asserts that “Saturday college football is sacred for some of our campuses. That means we’re not playing football games on Wednesday night or Tuesday night. I lived that in the MAC. I need to find a way to drive value for the Big Sky without playing games all over the place during the week — that’s my challenge.” Canzano points out that as an FCS conference, the Big Sky “flies under the radar nationally. Its best football and men’s basketball players are prone to being flight risks. And the last Form 990 filed by the conference showed $14M in total revenue for the conference. By comparison, that’s roughly the budget of the UCLA men’s basketball program.” Wistrcill subsequently notes: “Our members are not talking about what to do with hundreds of millions of dollars. We’re talking about what to do with a couple hundred thousand here and there.” (link)

Sportico’s Michael McCann explains the NCAA could challenge recent state laws limiting its authority by arguing those laws unlawfully interfere with the Commerce Clause and the Contract Clause of the U.S. Constitution. In fact, McCann points out the NCAA has adopted this strategy before and won. During the NCAA’s investigation into former UNLV Men’s Basketball HC Jerry Tarkanian, Nevada Gov. Robert Miller signed into law a statute that required NCAA investigators to honor due process safeguards, thereby creating a conflict between state law and NCAA rules. The NCAA sued and the U.S. Ninth Circuit Court of Appeals ruled Nevada’s statute violated the Commerce Clause because it placed the NCAA in an untenable position. In fact, Judge Ferdinand Fernandez noted that Nevada’s statute would likely trigger a “patchwork problem.” Other states, Fernandez reasoned, could and likely would pass laws that create due process rights for in-state NCAA members. Since those laws would likely vary, the NCAA would be unable to apply a national standard. McCann: “The capacity of the NCAA to challenge states is both a blessing and a curse as it lobbies Congress for a federal NIL law that would preempt state NIL laws. On one hand, Miller illustrates why the NCAA needs one set of rules to function as a national entity. But on the other hand, the NCAA already has favorable case law to support its enforcement abilities. Whether the organization is willing to test that precedent in court is a choice the NCAA, not Congress, needs to make.” (link)

Former Northwestern QB/WR Lloyd Yates has officially filed a lawsuit against the university, and USA Today’s Tom Schad reports that, per the suit, “assistant coaches were ‘ran"’ by players ‘on more than one occasion.’ The complaint defines ‘running’ as incidents in which a group of players forcibly held down a nonconsenting individual and ‘[rubbed] their genital areas against the [person's] genitals, face, and buttocks while rocking back and forth." While the suit does not identify the victims or perpetrators of the alleged hazing incidents, it does indicate the “acts were often carried out by a group of upperclassmen who dubbed themselves the ‘Shrek Squad.’ They would dress with either no shirts or shirts with holes cut out over their nipples. Some would wear thongs. The 'Shrek Squad' would flicker the lights, and chant 'Shrek is love, Shrek is life' while screaming, clapping and yelling." Other incidents described in the suit include the "Gatorade shake challenge," in which young players were pressured to chug protein shakes sometimes until they vomited, and "The Trading Block," in which coaches and players traded insults in a large-group setting. “The insults often involved exposing personal details of the coaches and teammates lives, on some occasions exposing infidelity in committed relationships or questioning sexuality in front of the entire group.” (link)

A former Northwestern volleyball student-athlete today filed a lawsuit claiming that the school and its athletic department were negligent in response to a hazing incident that allegedly occurred in the spring of 2021. ESPN’s Dan Murphy reports the player, who filed the suit anonymously, claims “she was injured while running sprints as part of a punishment sanctioned by coach Shane Davis, and that Davis ‘enabled a culture of racism, bullying, harassment, hazing and retaliation’ within Northwestern's volleyball program. Davis is listed as a defendant in the lawsuit along with the school's two most recent presidents and three most recent athletic directors.” Northwestern VP for Global Marketing & Communication Jon Yates confirms a hazing investigation was opened the next day and “appropriate disciplinary action was taken. The University canceled two games and implemented mandatory anti-hazing training." The former player is represented by attorneys Parker Stinar and Patrick Salvi, who filed multiple lawsuits on behalf of other student-athletes last week. (link)

Florida A&M AD Tiffani-Dawn Sykes announces the football program has been cleared to return to football-related activities, effective July 25. The investigation into the unauthorized video shot in the FAMU locker room is being led by the Office of Compliance and Ethics, Sykes says she will make herself available for comment once it is complete. Lamar saved money and traveled less last year after returning to the Southland, according to Cardinals AD Jeff O’Malley, who estimates the department saved $350K, which is a significant number for an athletic department that operated with a $28K surplus. O’Malley: "We looked at the figures and we were pretty pleased with what we saw. I think it's just another way to show that we're a great fit in the Southland Conference." He adds: “Everything is a bus trip for us now. There's no more taking 6 a.m. flights the morning after a game for our student athletes.” (link)

+ Maine AD Jude Killy has named former Miami (OH)/Ball State/Saint Louis Men’s Basketball AC Jason Grunkemeyer as Deputy AD. Grunkemeyer, who currently serves as Hilton Head Christian Academy AD/Boys’ Basketball HC, will mentor coaches and staff and support new and existing facilities and operations, sports medicine and sports performance. He will also be heavily involved in the day-to-day operations of the department, strategic planning, serve as a sport administrator, and will be involved in all personnel matters. (link)

Ticketmaster this week is launching its Ignite platform, which will allow clients to “customize a white-labeled app -- built by the app-builder of the team’s choice -- by making it easier to build on top of Ticketmaster’s technology through an integrated software development kit (SDK),” SBJ reports. Clients can use pre-built features or build their own custom modules. The modules include everything from helping fans manage their tickets, upgrade seats, get directions to the venue, shop concessions and merchandise, and more, including potentially, sports betting capabilities. Ticketmaster EVP/Co-Head of Sports Clay Luter: “The ticket is such an important piece, it’s going to get you in. This was just a natural evolution, let’s continue to iterate on our SDK platform. These modules make that ticket come alive more and more and our clients can start to customize and pick and choose what content they want." (link)

The Athletic’s Grace Raynor profiles Zcruit, a “recruiting database largely unfamiliar to fans of college football but paramount for many recruiting staffers working tirelessly behind the scenes.” More specifically, Zcruit “uses an algorithm to monitor the Twitter activity of thousands of recruits across the country as they announce their various offers. It then logs that data in one place for subscribers to easily access — and spy on each other.” Raynor notes that 86% of Power 5 programs and 56% of all Group of 5 schools use Zcruit, which focuses almost exclusively on Twitter to compile the offers listed by recruits. Through the use of customizable filters, coaches can set the exact parameters for their searches, including seeing who any one school or group of schools has offered. Zcruit Director Cory Nicol explains: “If I’m at Georgia and I’m the receivers coach there and I want to know what the receivers coach at Washington is doing, yeah, I could very easily go in and I could pull a list of who Washington has offered at the wide receiver position. … You can definitely go down some rabbit holes and just kind of get lost in the data. … But when you bring it all into one spot, you aggregate all the information, it is pretty cool to look at it in a really plain view, through a really clear lens.” More about Zcruit.
