The Athletic’s Nicole Auerbach breaks down the Protecting Athletes, Schools and Sports Act sponsored by U.S. Senators Joe Manchin (D-WV) and Tommy Tuberville (R-AL). The main points, per Auerbach: “The bill would make any state laws that include revenue sharing illegal. It would also allow the NCAA to prohibit certain types of deals, such as those with gambling companies or alcohol brands. The NCAA would be in charge of enforcing and investigating such rules, but it would have the support of the Federal Trade Commission, which would handle the registration of agents and collectives as well as the national public NIL deal registry. Collectives and boosters would be required to be formally affiliated with specific schools. The act would guarantee health insurance for sports-related injuries for uninsured student athletes for eight years following graduation from a four-year institution. That responsibility would either fall upon the school at which the athlete played and/or a newly formed trust fund taken from 1% of annual proceeds from revenue-generating collegiate tournaments, including the NCAA men’s basketball tournament and the College Football Playoff. Athletes would only be able to transfer and play right away after completing their first three years of academic eligibility. Exceptions to this would include a death in the player’s family or a head coach or position coach leaving the school.” (link)

USA Today’s Steve Berkowitz points out that a “news release from Tuberville’s and Manchin’s offices announcing the bill included prepared, specific statements of support from [NCAA President Charlie] Baker, four presidents of Power 5 conference schools and the Big 12 and [SEC]. This is contrast to a general statement that the NCAA issued late last week when after another bipartisan effort at a college sports bill was launched by Sens. Richard Blumenthal, D-Conn.; Jerry Moran, R-Kan.; and Cory Booker, D-N.J., who unveiled a discussion draft of a bill.” (link)

On3’s Andy Wittry examines several NCAA toolkits and memos for lobbying Congress on crafting a federal college sports bill and points out that “one talking point provided in each division’s toolkit seemed to tease potential concessions that the NCAA could be willing to make to athletes in the highest-revenue-producing sports to achieve its Congressional goals.” Specifically, the talking point states: “A small but important percentage of student-athletes compete in sports that generate significant revenue for their universities. With Congress’ assistance, we are open to exploring various mechanisms to potentially address these student-athletes’ unique economic interests in a way that is fair, equitable and sustainable.” The documents also ask schools in each division: “Which student-athletes on your campus can serve as key voices in sharing their experiences as a student-athlete with your community and federal legislatures?” More from Wittry. Troy AD Brent Jones joins Connect/Fox Sports’ Bryan Fischer from the 2023 NACDA Convention to discuss the Trojans’ successful 2022-23 campaign, the momentum a 12-win football season has had on fundraising and ticket sales, ensuring the department grows in all sports and more. Jones explains when Football HC John Sumrall came on board, the Trojans set a goal of selling 12K season tickets. The previous high was 10,600. “Now why is that important? You’re talking about Troy University. We're in the third-smallest town in FBS. We have an amazing fan base, but it's a rural area. … So, what do we want to do? We want to challenge ourselves. By the first game we were able to hit 12K total season tickets. We launched a Football Excellence campaign that $100K was our goal within the first 60 days. We blew past that to $250K.” Troy relaunched the campaign after the season with a goal of $500K, and Jones says the Trojans have now raised $350K toward that goal. Penn State AD Pat Kraft talked a lot about collectives and the Nittany Lions’ NIL efforts yesterday, saying: “The way we look at it is this is the new scholarships. So we’ve been raising money for scholarships. We will continue to raise money for scholarships. But, the NIL piece is becoming more and more prominent, and it’s not just in football. It is now in every sport. And so, you know, James [Franklin] is passionate, because I think, as we look at where we are, we’ve got to continue to get better at it. But I will say this, I think we’re in a much better spot. … I think we’re behind, but I think we’re making up ground fast, and at a pretty good clip.” Kraft also noted there is still a transition process among fans and donors who have been conditioned to avoid compensating players, “so it’s just taking us time to move this battleship to say, ‘No, it’s okay. This is okay.’ Then you got to run the operations of it. You don’t know which way to look, because the guidelines are all over the place. And so you’re like, ‘How do you maneuver this?’” (link)

Buzzer publisher Eamonn Brennan observes the percentage of non-conference men’s basketball games being played at neutral sites has steadily increased from 15% in 1997 to over 20% last season and notes that “in 2023, for the first time ever, major teams played more noncon games OFF campus than ON. (54 percent!).” That figure represents a 9% increase over the previous year and is nearly double the 28% from the low point in 2007. Brennan argues the sports is worse off due to the lack of true road games, particularly between high-major programs, writing: “For a while now, college basketball has been self-conscious, status-anxious, trying too hard. It needs to just be. It needs to embrace what people actually like about it. The atmosphere. The electricity. The good games in the best arenas in front of the most devoted fans. People want the noise. They crave it. Sell it to them. … And by the way, the incentive structures aren’t the same as when they were when this problem began. The NET and quadrant team sheets do a much better job of accounting for the difficulty of playing true road games than the RPI did! Coaches: It will be fine.” (link, link)

SVB MoffettNathanson Co-Founder/Senior Managing Director Michael Nathanson joins The Athletic’s Richard Deitsch to discuss the overall sports media landscape, including Disney CEO Bob Iger’s recent comments regarding ESPN. Regarding whether ESPN’s goal of entering into a strategic partnership will alleviate its problems, Nathanson notes the company is facing a revenue problem due to cord-cutting combined with the challenge of having not truly scaled ESPN+. “The vast majority of their subs are in a bundle…so there’s not a huge cohort of fans right now outside the bundle who want to pay for ESPN+ on their own. So, they have a revenue issue. They also have a cost issue because, unfortunately, they have a lot of fixed-cost contracts that are only rising just as revenues are falling. The solution that we've been saying is…the way you fix this problem is by having a ‘monopoly’ control of all sports.” Nathanson notes, for example, Sky Sports in the U.K. carries nearly every Premier League game, while in the U.S., multiple networks have various valuable properties; therefore, it’s difficult to convince customers to commit to any one single network/streaming service year-round. Nathanson also intimates Disney might be wise to incorporate more sports into Hulu and ESPN+ to make the bundle itself more valuable. “We keep saying the bundle is the best invention for everyone. Don’t kill the bundle so fast. They’re all killing the bundle as fast as they can.” (link)

Apple SVP of Services Eddy Cue told the Daily Mail the company’s focus for media rights: “I can't justify throwing what I think are the best engineers in the world on a small subset product. It has to be this kind of a partnership because our level of investment is significant. This isn't 'hey, I've got an opening from 8pm to 10pm tonight and I'm going to put this game on'. That's not the way we're doing it. We're all in on this as an investment point of view, so it doesn't work unless it's something significant. […] But, in general, are we going to sign something, any league, that is to a specific country or small a subset of countries? I highly doubt we would ever do that. I can't see a scenario in which we would want to invest and do that because we're not a typical distributor, we're not just trying to fill in some gaps that we have. This (MLS deal) is our number one thing, and we want it to be a huge success. If we were going to do something else it wasn't because it would be number two, it's because it would be another number one around it and we would want it to be, so I think that's the difference that we have.” (link)

The U.S. Federal Reserve is set to raise interest rates today by a quarter-percentage point, which will mark a 22-year high. Per WSJ’s Nick Timiraos, economic growth has “likely been too firm in recent months for Fed Chair Jerome Powell to signal that Wednesday’s increase in the Fed’s benchmark short-term rate will be the last of the current tightening cycle, as investors anticipate.” (link); Meanwhile, U.S. consumer confidence increased to 117.0, a two-year high, according to the Conference Board. U.S. Senators Joe Manchin (D-WV) and Tommy Tuberville (R-AL) have released their long-awaited college sports bill called the Protecting Athletes, Schools, and Sports (PASS) Act of 2023. The Athletic’s Auerbach breaks it down and notes one way it’s different from other legislation is that it states student-athletes must complete their first three years of academic eligibility before allowing them to transfer without penalty. ACC Commissioner Jim Phillips covered several topics as he kicked off ACC Media Days, including the success initiatives the league will utilize to determine revenue distribution beginning with the 2024-25 season. Phillips notes revenue generation continues to be a priority, but adds: “I think one of the presidents said it best, are we chasing a dollar amount, or are we chasing success? I think there's a difference there. If you are chasing a number, it takes you down a different path. If you are chasing success competitively in football and basketball and all of our sports, then I think every institution has an idea of what they need.” Phillips briefly addressed the situation at Northwestern, saying: “During my 30-year career in college athletics, my highest priority has always been the health and safety of all student-athletes. As you know, with this matter in litigation, I'm unable to share anything more at this time.” Asked about the potential of Notre Dame joining the conference, Phillips replies: “We've had a lot of conversations, let me put it bluntly, with Notre Dame, and they've been very clear. They value their independence, and I think they feel strongly that that will continue well into the future. If they ever have the desire of joining the conference, they know that we would welcome them with open arms…but they've been pretty clear about their desire to stay independent. AAC Commissioner Mike Aresco reiterates during his AAC Media Days appearance: “As you know, I am pushing for the abolition of the Power 5 nomenclature, as it is manufactured and is inaccurate in the world of an expanded playoff, realignment and media rights. We hear a lot about student-athlete health and well-being. We should not tolerate a caste system. This is flat-out wrong and I call on the media and the P5 to support doing away with it. There are 10 FBS conferences and any division at five is unhealthy. The American has been and is a Power conference, we have separated from the other so-called Group of Five conferences, our conference branding will continue to embrace the word POWER. Our DNA aligns with the so-called Power 5, and not the Group of 5.” Aresco also rails against the “professionalization of college sports,” noting: “We are almost there now. The big money era is here and likely will get worse before it either settles down or accelerates to another arms race. An NFL-like college landscape spawns many wrong incentives for young people – money over choosing a school or coach they really like, money over staying at a school or with a coach they really like, money over trying to get a good education. And often money that is not life-changing. One could argue that this is not a good thing. Will fans eventually revolt? Hard to say, we all like watching sports.” Full remarks. (link)

Big 12 Commissioner Brett Yormark talks with Fox Sports’ Joel Klatt about his vision for the conference and says: “We have incredible ideas to create new IP and to develop new initiatives. Things that have never been done in this space before that I know are very transferable and that drive value for our member institutions and create revenue opportunities.” To put those ideas into motion, Yormark says inking a new TV deal early was the “true catalyst. I know stability gives you a true seat at the table. It gives you that voice that we were certainly looking for long-term. And we’ve leveraged it. We’ve leveraged it to innovate, to create. It gave us the green light to think about the conference differently. To grow it. To diversify it. To think about an international strategy. To create new IP. The AP’s Ralph Russo reports Michigan has “submitted its request for a negotiated resolution to the NCAA Committee on Infractions. The school and NCAA can't confirm details but this is the case involving Jim Harbaugh.” (link); Yahoo’s Ross Dellenger reports the two sides are working towards a resolution in which Harbaugh would be suspended for the first four games of this season. Former Michigan DC/current Baltimore Ravens DC Mike Macdonald is also expected to receive a one-year show-cause. NCAA enforcement staff alleges Harbaugh was dishonest about the recruiting violations purportedly committed by he and his staff in his initial meeting with investigators. (link)

Akron AD Charles Guthrie provides an update on several facilities projects, starting with upgrades to the outdoor Track & Field complex. The Zips continue to raise additional funds to complete the $1.8M project. Additionally, Akron is putting the “finishing touches” on its new men’s and women’s basketball practice facility, and in football, the department continues to “work toward our desired goal for a new InfoCision Stadium digital scoreboard.” The Zips also this offseason replaced the InfoCision turf at no cost due to a product specification error and will begin “much needed concrete repairs on lower bowl areas of the football stadium.” Student-athletes will also return to campus to find two newly renovated weight rooms. The Louis and Freda Stile Athletic weight room will feature new weights, new flooring, new lights and other amenities. Per NCAA rule changes, the Zips’ baseball and softball stadiums will be outfitted with protective safety wall pads around both parks. Additionally, a pitch clock will be installed at Skeeles Baseball Field. (link)

Sportico legal analyst Michael McCann submits that the plaintiffs suing Northwestern could use President Michael Schill’s admission that he only parted ways with former Football HC Pat Fitzgerald after rereading the ArentFox report. Initially, as reported, Schill suspended Fitzgerald for two weeks and told the Daily Northwestern that he overrode that decision after asking ArentFox for “details from the raw testimony of each person they spoke with.” McCann: “Attorneys for former players suing the school could use Schill’s interview to assert he did not treat the scandal with sufficient care and priority. They can question why Schill didn’t ask for witness details and ‘raw testimony’ before acting and why he waited to do so until after the scandal had attracted national headlines.” Furthermore, Fitzgerald remains the only person Schill has let go since the allegations surfaced as “due process” plays out, and McCann observes that “Schill did not extend Fitzgerald a chance for a hearing to address Schill’s new understanding of the situation. For a university president who preaches the value of ‘due process,’ he arguably didn’t live up to his own sermon.” (link)
