Realignment Rumblings: Boulder Edition…
+ ESPN’s Pete Thamel reports the “Big 12’s presidents and chancellors voted unanimously Wednesday night on a conference call to accept Colorado as a new member. Colorado still has not formally applied for Big 12 membership, which is expected to happen tomorrow. But tonight’s Big 12 vote marks another necessary step toward Colorado joining the Big 12. Colorado's Board of Regents is expected to vote on the move from the Pac-12 to the Big 12 on Thursday, which is another step toward finalizing the move.” (link)

+ Arizona President Robert Robbins tells The Athletic’s Max Olson: “All I keep saying is, you know, we're just waiting to get a deal. And then everybody has to evaluate the deal on its merits. I've been pretty steadfast in that stance." (link)
+ The New York Post’s Andrew Marchand observes: “Big-12 also outmaneuvered Pac 12 by negotiating a clause with ESPN for pro-rata if Power 5 schools were added. This is also why Big Ten is an unlikely landing spot, at the moment, because there is no guaranteed more money with expansion.” (link)
+ Attorney/Frank the Tank’s Slant purveyor of the same name: “When the history of this latest round of realignment is written, it’s key to point back to Netflix’s stock price drop in the first 2 quarters of 2022. They don’t even show live sports, but that was the moment that Wall Street flipped the whole script on media companies. Wall Street went from rewarding high content spending to grow streaming to demanding streaming be profitable on a dime. That impacted spending everywhere in the entertainment industry that’s still being felt today. The top brands like the Big Ten (or Marvel or Barbie) would still get full investment, but the profitability bar got even higher by Fall 2022. The Big 12 didn’t haggle and took the security of signing effectively an extension to their current deal. They did it *just* in time. … The Pac-12 really did end up with the single worst possible time to look for a new TV rights deal in the past 40 years. The fact that they were looked in the marketplace as merely “nice to have” tanked their leverage. … If the Big 12 had gone to the open market like the Pac-12, they’d probably be screwed, too. The greater forces of the economics of streaming are driving conference realignment in the same way cable households did in the 2010s.” (link)

Mountain West Commissioner Gloria Nevarez talks expansion, San Diego State and the overall landscape of college sports with The Mercury News’ Jon Wilner and JohnCanzano.com’s proprietor of the same name. Regarding SDSU, Nevarez points out the league’s bylaws are meant not to stop schools from leaving, but to protect the league and “provide enough of a financial exit fee so that we can either backfill with new members or right-size any negative impact on our media contracts. … We have policies that look a lot like other leagues and we implemented them and they worked this time. And I think for us the best thing to do is keep San Diego State and we were fortunate that was able to happen this time. Will it be in the future? Who knows but for now we're pretty happy to have them as members in good standing.” Nevarez also insists there was “good thinking” behind NIL and around the Transformation Committee, but whenever a proposal “hits the greater system and we have to go to a collective vote, that's where things get jammed up. Either you need a champion from the center – i.e. NCAA leadership – to marshal these things through or you need to federate in some way so that the different levels can depart in important areas and make their own rules.” Full podcast. Utah AD Mark Harlan yesterday talked about how the Pac-12 was forced to go to market with its media rights sooner than it wanted: “I think at the end of the day, when you go back to June 30 last year which was just a hard day when the L.A. schools left. I think we were pretty clear as the remaining 10 that we were going to work hard together and support the commissioner and support our board, which is the presidents and chancellors. Just do everything we can to go out into the market. We didn’t want to go out into the market at that time. That was never our plan. Others caused that and it’s been a long journey.” Harlan also acknowledged that he’s been “more impatient than I should be at times,” but expressed confidence that “at the end of the day I think we are going to end up in a really good spot.” (link)

ESPN Chairman Jimmy Pitaro confirms a shift to a streaming model is in the works but insists there is no plan to upend its linear networks. “The [traditional TV] model has been very good to Disney.” Pitaro also addressed the network’s search for a strategic partner: “Can’t comment on who we’re talking to. I will emphasize the fact that we believe there are parties out there that can help us on the content side. You can draw whatever conclusions you want from that, but my priority is when we do launch flagship channels directly to the consumer, a la carte, that the content proposition is as compelling as it can be.” (link)

Several administrators met in Indianapolis this week to discuss ways of strengthening the NCAA’s interim NIL policy, and Yahoo’s Ross Dellenger reports the “two-day, fact-finding meeting ended, as expected, without definitive decisions or specific proposals. However, with NCAA president Charlie Baker in attendance, administrators discussed ways to provide more transparency in the NIL space. That may include the creation of a database for NIL deals, a more uniform contract for such deals and a registry for those participating in NIL with athletes, such as agents and collective representatives.” Florida Executive Assoc. AD for Administration Lynda Tealer explains there’s been no discussion about “walking anything back” when it comes to NIL, adding: “Is there a way to add [something] about how student-athletes understand who they are doing business with? Is there an interest in that? Can you do that? That’s the question. Would it be to the benefit of student-athletes? Anything that helps athletes understand who they are interacting with and what they can count on and what’s real, that was really the issue.” (link)

Northwestern President Michael Schill tells the Daily Northwestern that former Baseball HC Jim Foster was placed on “indefinite suspension” but wasn’t fired. Schill: “He wasn’t fired. He won’t be coaching again.” The Daily Northwestern goes on to note that Schill confirmed in an email on July 18 to the student body that former Football HC Pat Fitzgerald’s employment had indeed been “terminated,” whereas Foster had been “relieved of his duties.” Northwestern VP for Global Marketing and Communications Jon Yates: “What President Schill said was accurate – Jim Foster was relieved of his duties as coach.” Yates did not provide any further information regarding his employment status or details of his indefinite suspension. More from Northwestern AD Derrick Gragg, who tells the Big Ten Network’s Dave Revsine he “obviously supports the president and the decision that was made” to part ways with former Football HC Pat Fitzgerald. Regarding Wildcats AC Matt MacPherson, who purportedly witnessed acts of hazing, Gragg remarks: “That situation, every employee, no matter if it’s a coach or university employee, is afforded due process. So that situation is being looked into and investigated and any other allegations that come forward or in the future will be heavily vetted.” Gragg also declined to answer if he had read the entire third-party report at the time Fitzgerald was suspended for two weeks but insists Northwestern is “not burying information.” Gragg also told Revsine: “We’re not discussing the report and the process. I want to be very careful about what I say on the report and the process on the record. … I can’t speak to that (refusal to release Hickey’s report), but it’s a private institution and again I don’t want to get into the details of the report.” (link)

The Athletic’s Jayna Bardahl examines the travel experiences of Pioneer Football League teams, whose locations stretch from New York to San Diego and Minnesota to Florida. PFL Commissioner Patty Viverito acknowledges that “if we had 12 programs that were all within bus trip distance, that would be better in terms of the amount invested. But that’s not what non-scholarship football in Division I football looks like right now. Right now, what we’re looking at is 11 programs committed to this model and they happen to be scattered across the country.” An alignment of values takes precedence over geography in the PFL, Viverito continues, noting that with the exception of Morehead State, every school in the PFL is private, and many have a historically strong academic reputation. It also helps that the league is football-only, as Viverito observes a “coast-to-coast league is more problematic for almost every sport other than football.” More from Bardahl. (link)

Connect/MB Sports Matt Banker is joined by NC State Senior Associate AD/Executive Director of the Wolfpack Club Ben Broussard at the 2023 NACDA Convention to shares his thoughts on the hot-button topics in collegiate athletics, such as NIL and sports gambling and how he approaches those topics with donors. Broussard notes that NIL has “opened some boxes that we never thought would be open” with donors and adds: “It comes up almost every day in conversation with your donors either from the standpoint of: Is it okay for me to do this? Should I do this? How do I go about doing this? The message that we have at NC State that [AD] Boo Corrigan reiterates all the time is to go where your passion is. If your passion is to enable student-athletes to do more with their name, image and likeness, by all means participate in that. That's our job as a development staff to make sure that we take care of our donors’ passions, our student-athletes, and these days NIL is a big part of that.” (link)

Big Ten Commissioner Tony Petitti covers topics ranging from his learning curve since taking the job to the hazing allegations at Northwestern in his opening remarks for Big Ten Media Days. Petitti also talks about the progress being made to finalize the league’s media rights agreements and says: “The answer is simply we've made significant progress towards their completion. We appreciate the spirit of collaboration from BTN, FOX, CBS and NBC. I know that our partners will work with us to provide Big Ten student-athletes with unmatched exposure.” Petitti says he has spoken with Northwestern AD Derrick Gragg a “few times” following the hazing allegations, and “our focus has been on moving forward, what they're doing, keeping me informed about the investigations, what they're doing on campus. … The investigation will yield results about what has happened, but I think there's a commitment to understand what's expected going forward.” On slowing the growing number of players entering the transfer portal, Petitti remarks: “The first idea is, what can you do around the incentives? We need to really spend a lot of time on that. That's what I think our focus is. That's why I talk about the difference between true NIL and NIL that really isn't NIL. Northwestern will conduct mandatory anti-hazing seminars to ensure “nothing like this ever happens again,” according to Wildcats AD Derrick Gragg, who tells ESPN’s Pete Thamel: "This entire situation, it's distressing. My heart goes out to everyone who's involved – victims, of course – but I also want to stress that we have many student-athletes who do the right thing and have always done the right thing, and coaches and staff as well. As the situation evolves, we're very serious about eradicating anything that's wrong, the president and the university.” Gragg also notes the university is ensuring its anonymous reporting system works properly and says: “My background as a former student-athlete and a leader, it's in times like these ... where I'm most effective, to be honest. It starts with internal communication and making sure that our internal systems are in place and that we're communicating how we're going to move forward." (link)

Sun Belt Commissioner Keith Gill covered a lot of ground in his State of the Conference remarks at the conference’s media days, including the need for a federal NIL standard: “A federal law that blocks state legislatures from trying to outdo other states with laws that effectively reduce accountability and create more opportunities for abuse is really important. NIL should not be pay-to-play, and inducements and any federal bill should affirm the prohibition and recruiting inducement and booster take the role and the recruitment of student-athletes." Gill also says it’s unlikely the league will move away from its divisional model because the “foundation of the conference was really on regional rivalries, and so everything that we need to do is promote playing those regional rivalries. … Regional rivalries are our foundation and are a critical part of our conference DNA and differentiates the Sun Belt from many other things." U.S. Senator Chris Murphy (D-CT) and Congresswoman Lori Trahan (D-MA) will relaunch an NIL bill in their respective chambers that would allow student-athletes from foreign countries to profit from their NIL while in the U.S. USA Today’s Steve Berkowitz reports the bill would also “formally affiliate collectives with their respective schools and require reviews of schools’ compliance with Title IX. … And it would prevent schools from using any group of athletes’ NIL for any purpose — ‘including a media rights agreement’ — unless it has obtained a group license from those athletes. While the bill would not require a school to pay the athletes on a team for the license, the school would be required to notify them about how much revenue it will be getting from its use of their NIL.” Also notable, the Murphy-Trahan bill places virtually no restrictions on student-athletes' NIL activities and does not require them to make disclosures about their deals. Front Office Sports’ A.J. Perez reports several former Minnesota football student-athletes and staffers have described an environment “fraught with intimidation and toxicity” under Gophers HC P.J. Fleck and “referenced the Fleck Bank’ — a system that allowed players with enough ‘coins’ to get away with positive drug tests, and other violations of team rules.” Multiple former players explain the Fleck Bank tracked community service and served as a way to keep tabs on players’ studying habits. Two former student-athletes add that informing on teammates could also earn Fleck Bank credits. Perez: “Unprompted, the term ‘cult’ was used by multiple former players and former staff members to describe Fleck’s ‘Row the Boat’ culture spelled out in the so-called ‘Fleck Book’ that players are given when they join the team.” Gophers AD Mark Coyle says in a statement to FOS: “P.J. and our program are unique. They put themselves out there in new and different ways — but always in a first-class manner — and after nearly seven years, it is clear to me, that is what makes P.J. and our program so successful. I always encourage all of our student-athletes, including every member of our football team, to reach out to me directly if they encounter any issues. Three Butler women’s soccer student-athletes are suing the school, claiming they were sexually assaulted by athletic trainer Michael Howell. All three soccer players, two of whom are still student-athletes at the university, are suing for negligence, battery, assault and intentional infliction of emotional distress. In addition to treatment that “routinely exposed players’ intimate body parts during massages.” The Athletic’s Katie Strang notes: “One player said that he threatened her by claiming he ‘knew everything about her’ including her social security number, and said he had files of photos with players engaging in underage drinking. Another player said that Howell told her he knew where she lived and referenced the pillow he had seen through her dorm window, prompting her to feel ‘frightened and powerless against him.’ A third player said he created ‘special’ additional workouts for a select few players and instructed them not to tell their coaches about this group activity.” A spokesperson for Butler University did not immediately respond to messages seeking comment. Howell, who worked at Butler from 2012 until he was put on leave in October 2021, also did not immediately return messages. (link)

Members of The Collective Association (TCA) presented a revenue-sharing model to SEC and NCAA officials last week in separate meetings, Yahoo’s Dellenger reports, adding that the framework TCA suggested includes distributing 10% of conferences’ TV revenue to a designated collective at each member school in equal shares. “The collective would then distribute money to that school’s athletes, using its status as a third party as a way to avoid triggering athlete employment.” Classic City Collective (Georgia) CEO Matt Hibbs: “We want to have this discussion. We want to have a conversation about solutions. The important piece we all want is to preserve college athletics. In order to do that, something has to change. We can’t keep doing what we’re doing and hope this just works out.” It remains unclear how TCA would distribute the revenue, but the organization says it’s open to ideas. In its request for qualifications for the design and construction of a new multipurpose arena, Cleveland State is accepting mixed-use development proposals. CSU has tapped Brailsford & Dunlavey (B&D) to consult on the project, and B&D VP Bill Mykins notes the “exact mix of what would be included in that mixed use district is to be determined. But it could include residential, commercial, other activities or uses. Residential doesn’t necessarily have to mean student housing. So we’re really looking to the market to help inform what are the best uses for that commercial district. The mixed-use district is included to help provide all the (financial) levers possible for our private partners.” (link)

Texas and Sodexo are adding 22 more Mashgin self-checkout kiosks at DKR-Texas Memorial Stadium ahead of the upcoming football season, up from 14 last year. Fans that used the Mashgin units last season checked out in an average time of 12.5 seconds while revenue at the six stands using Mashgin increased by 125%, per SBJ’s McCormick, who notes the Longhorns also used the kiosks at the school’s baseball, softball and soccer/track and field venues.
