Big 12 Commissioner Brett Yormark tells the New York Post’s Andrew Marchand and SBJ’s John Ourand that his main message to Pac-12 Commissioner George Kliavkoff when the two recently spoke was that he is sorry to put the league in a difficult position, “but this was something that we had to do. And this was something that the board and our key stakeholders encouraged. I'm sorry that my gain is your loss. We had a very collegial conversation. George was fantastic, and I'll be seeing him again in a couple of weeks at some industry meetings.” Yormark points out that he had been open about the Big 12’s ambition to expand: “Maybe some people in the industry didn't like it that I was so intentional about it, but I'm very transparent. In fact, I telegraphed it. I just felt that was the right way to do it versus other things that I've witnessed and observed in our industry over time, where transparency really wasn't the case." Yormark on the Big 12’s decision to retain Endeavor: “The No. 1 thing that Endeavor was asked to do was to evaluate our TV deal to identify what the goal post would look like moving forward and if we could get something done quickly. … At the time, I didn't realize that was really the last big media deal that was available, especially in our industry of collegiate athletics. Sometimes in life you gotta get lucky. And we got a little lucky.” (link)

ECU AD Jon Gilbert says the Pirates are happy with their position in the AAC: “We sell a lot of tickets, we have a lot of people come to our games. If you look at our ESPN and ESPN+ broadcasts, we are at the higher end of our peers.” Asked whether ECU would consider leaving if a better financial situation presented itself, Gilbert responds: “Finances are real. Your broadcasting partner, they have to be willing to fund those things. It really is complex when you look at realignment and you also have exit fees.” (link)

Indiana AD Scott Dolson says IU is in the “exploratory stages,” of upgrading Memorial Stadium. “We don’t have a project yet. But at the same time, we know we need to modernize Memorial Stadium, just like we did Simon Skjodt Assembly Hall. What I want to do is put together a plan for that modernization, from a fan experience standpoint.” To that end, IU has tapped Nations Group to survey fans and season-ticket holders about what they’d like to see in the stadium. A news release regarding the project outlined the potential for a “reimagined concourse, new social gathering spaces, upgraded concessions and restrooms, and a series of enhanced premium seating options and locations.” Dolson: “I think the overall existing structure is strong, but I think at the same time, as we get feedback and the project comes together, I think modernizing it will be up to how large the project ends up being. We want to keep the same feel of the stadium, but at the same time, we’ll modernize it. Other than the north and south ends, what will that entail, I don’t know yet.” (link)

Arkansas AD Hunter Yurachek tweets that he’s invited ESPN Men’s Basketball headliner Jay Bilas to campus in Fayetteville on Yurachek’s own dime to have “full transparency on our revenues and expenses. If you are going to make a seven-figure salary covering college athletics you should probably be educated on college athletics.” Yurachek’s invitation comes after Bilas called Yurachek’s recent op-ed about the need for NIL regulation “nonsense.” Bilas was quick to respond: “I’ve been there, and LOVED it!! What a fabulous place!! I didn’t sense poverty, nor the end of college sports around the corner. But, if that is indeed the case for you, Division II or III is open to join! Somehow, I doubt that is a serious consideration.” (link)

Bestselling author James Andrew Miller joins The Ringer’s Bryan Curtis and David Shoemaker to discuss the state of ESPN and what comes next after the Penn gambling deal. Miller says very few people would’ve predicted the Penn deal was in the works six months ago and adds: “I don't want to say it sounds like a fire sale going on, but this doesn't reek of an element that's part of a grander strategic plan. It seems like a one-off, almost done in haste and with a partner that you would never have expected them to be in business with.” Miller also indicates he does not detect a grand strategic plan guiding ESPN’s actions right now: “It turns out this conundrum that ESPN is facing is actually really, really difficult to navigate. It’s financial, it’s cultural, it involves the behavior of consumers. It involves a lot of their competitors, too, who have recently been able to do certain things that they weren’t able to do years ago.” When assessing the state of ESPN overall, Miller remarks: “Look, I don't want to over-dramatize it, but think of the cable bundle as like a cancer inside the ESPN organization, and what's going on right now with this gambling deal, it's almost like ESPN is receiving a stem cell transplant – just to push the metaphor a little bit more – as we watch. … The old days are clearly gone.” Full podcast. Legal Matters…
+ Northwestern maintains the lawsuit filed yesterday by former Baseball ACs Dusty Napoleon and Jon Strauss and former Director of Baseball Operations Chris Beacom is “without merit and the University intends to contest it vigorously.” (link)
+ U.S. Department of Education Assistant Secretary for Civil Rights Catherine E. Lhamon has confirmed that Baylor is immune from certain Title IX complaints “to the extent that they are inconsistent with the University’s religious tenets.” Baylor had sought assurances from the federal government that it could not be punished in response to several complaints of discrimination against LGBTQ+ people, including one in which Baylor was accused of neglecting to address the homophobic harassment of one student by her peers, refused to recognize an LGBTQ+ student group, and pressured university media to not report on LGBTQ+ student events and protests. Religious Exemption Accountability Group Director Paul Carlos Southwick, whose organization filed the complaint on the student’s behalf, notes letter from Lhamon doesn’t mean the complaints have been closed. “It doesn’t appear to meet a wholesale exemption from sexual harassment regulations, but the language is really vague in general.” (link)

Andscape’s Mia Berry examines how Tennessee State’s plans to launch the first HBCU DI hockey team could impact other programs, and Tigers AD Mikki Allen remarks: “That’d be pretty cool if you had all the HBCUs that have a neighboring NHL hockey team that, you know, adopted this model that we’re going to create. That was the wind behind this [decision] to advance the puck through Tennessee State, and we hope that other HBCUs will join us in this effort to have HBCU hockey teams all across the country.” College Hockey Inc. Executive Director Mike Snee points out that college hockey is unique insofar as successful teams aren’t always those with the biggest budgets. “The number of schools that have [hockey] are Division I, II, III schools, [but they] all played Division I hockey, which is very unique to hockey. There’s a blend of schools that play it with mammoth budgets, like Notre Dame, Ohio State, Michigan, and then schools with budgets that aren’t mammoth, yet they all compete with each other.” More. The trading card industry is still trying to get its arms around what NIL means for the marketplace, and the Washington Post’s Alex Schiffer notes that cards issued years before an athlete goes pro “carry more risk,” but the “long-term value and short-term collectability of the cards are two big questions being asked in a space where everyone craves the hottest product.” Panini VP for Marketing Jason Howarth adds: “I think that early on in 2021, we probably had maybe five or six [athletes signed to deals] across even the basketball, football landscape. In 2022 we increased that, but the number for 2023 is exponentially higher than where it was in 2021.” Schiffer goes on to point out that another issue for collectors is the “secondary market is still relatively unknown,” and it is “impossible to say what will ultimately be worth more down the road: a player’s first NIL card, or his or her first card as a professional.” (link)

U.S. Treasury Secretary Janet Yellen remarked yesterday that the Inflation Reduction Act has propelled the U.S. economic recovery: “Over the past year, our task has been to transition the economy from rapid recovery to stable growth. Our path so far shows that we are on the right track, even as we remain vigilant about potential challenges and uncertainties.” Yellen added: “The continued strength of our labor market is particularly impressive given our fight against inflation. We know that progress rarely moves in a straight line. But I still believe that there is a path to continue reducing inflation while maintaining a healthy labor market.” (link)

NCAA President Charlie Baker outlines progress being made on several fronts, including gender equity, updated NIL guidelines, the creation of a health insurance fund and key business review findings. Baker says of gender equity progress: “Since the NCAA completed an exhaustive third-party gender equity assessment in 2021, staff have been implementing recommended changes to ensure that women's sports receive equitable support and that the experiences of student-athletes in those sports are every bit as inclusive, fulfilling and rewarding as those of their counterparts in men's sports. The NCAA has made great strides in closing gaps, and recent progress was analyzed by outside experts and released last week. Progress has been made, but more work remains. This week, I designated Felicia Martin, NCAA senior vice president of inclusion, education and community engagement, to head up these efforts for my team.” Overall, Baker notes: “While there are limitations on what we alone can accomplish — which is why we continue to simultaneously advocate for Congress to take action to stabilize the future of college sports — we are committed to exhausting every avenue for reform within our control. This has been an exceptionally productive time for the team at the NCAA as we continue to work together to support more than 500,000 student-athletes participating in NCAA sports across the nation.” (link)

Action Network’s Brett McMurphy reports Florida State “has not scheduled a Board of Regents meeting for Tuesday, the deadline to notify the ACC if a team is leaving before 2024 season. FSU's board must approve any membership change, so the Seminoles will remain in ACC…for now.” (link)

Georgia President Jere Morehead suggests the SEC might be standing pat during this round of realignment, telling The Athletic’s Seth Emerson that “this is just my opinion, I’m not speaking for other presidents in the SEC. But to me 16 is a really good number, for a variety of reasons. And when you start getting beyond 16 I think that becomes more challenging from a scheduling standpoint. And from a standpoint of determining true championships. I suppose there could be scenarios where 18 or 20 works. But I think they’d all have to be carefully thought out. Again, I would trust our commissioner to do so. And he hasn’t indicated to me any desire to do anything but make sure that Texas and Oklahoma assimilate into the SEC in a very positive way.” Morehead is also hesitant about expanding too far beyond the league’s geographic footprint, noting: “I realize that a lot has changed in college athletics in the last couple of years. But these are still students. They are enrolled in classes. And we have a goal that they graduate from our institutions. And so I would worry about a volleyball player or a tennis player having to travel across the country in the middle of the week, or men’s or women’s basketball being another great example. The less time that they have to be in the air and away from class I think is best.” (link)

Auburn AD John Cohen talks about the possibility of playing college baseball later in the spring and into the summer. “Folks in Northern climates want to get out and see amateur baseball, but they can’t do it during the spring because of the cold temperatures. Can you imagine Ohio State and Michigan playing baseball in June in front of a packed house? That’s how college baseball is going to grow. I don’t know if we ever get there, but college baseball can’t get to where we would like it to go unless Northern climates can participate at the highest level. And those coaches in those Northern climates…do incredible jobs in adverse conditions, but in some respects you don’t ever get to see the greatness of their coaching or the full potential of their programs just because of weather. To me, that’s not fair, and I would love to see that addressed. And I would love to see that addressed through the tournament. … I would love to see this become a national game and not just a Southern or a Western game.” (link)

Coaches Corner…
+ Former Northwestern Baseball ACs Dusty Napoleon and Jon Strauss, along with former Director of Baseball Operations Chris Beacom have officially filed a lawsuit against the university, former Wildcats HC Jim Foster, Wildcats AD Derrick Gragg and other administrators. The former staffers allege that Foster bullied them, asked them to violate NCAA rules and denied medical care to certain players, per ESPN’s Adam Rittenberg, who also reports they are “suing for breach of contract and negligence, citing Foster's alleged history of bullying and abuse at previous jobs, which they say Northwestern should have discovered before hiring him from Army in June 2022.” The plaintiffs allege they began reporting Foster's behavior to Northwestern administrators in October 2022, filed a formal complaint to HR on November 30 and reported Foster to the NCAA for potential violations. It took Big West members “roughly four minutes” after hearing a presentation from Commissioner Dan Butterly to agree the league should hire U.S. Integrity, and Butterly tells On3’s Eric Prisbell: “I am prioritizing protection. We don’t have the high financial resources to go out and just do whatever we want to do. We’ve got to be very cognizant of the money we’re spending – this is one we felt was very important.” Meanwhile, Big Sky Commissioner Tom Wistrcill tells Prisbell the recent developments in the industry make the issue “real” and adds: “It heightens awareness of it. It’s a reminder that this could be us – this could be one of our schools.” Wistrcill adds that the “value [U.S. Integrity provides]” is “invaluable. It’s that insurance piece, right? You don’t really know you need it until you need it. Then you’re really glad you have it.” Big 12 Commissioner Brett Yormark: “Given the current environment, we need to go deeper with them. We need to educate our student-athletes. But it’s not just our student-athletes, it’s our coaches – it’s really the whole ecosystem. We’re also encouraging our member institutions to do a little bit more with U.S. Integrity.” More from Prisbell. (link)

Citing challenges such as sports gambling and firearm proliferation, Trenchcoat Advisors Founder Bill Priestap and Senior Advisor/former Arkansas/Kansas/Pitt AD Jeff Long advise athletic departments to conduct risk assessments that not only identify areas of vulnerability, but also prioritize them. Beyond enabling athletic departments to then build and implement incident response plans, conducting risk assessments “communicates to university leadership and major donors that the department is actively seeking to understand the risk landscape, so that it can be better positioned to safely navigate it.” Regarding the response plans themselves, Priestap and Long note they should “make it clear that athletic directors should confer with a triumvirate of legal, PR, and risk experts when a major incident occurs. Experienced risk experts have responded to numerous crisis situations. They’re not fazed by the blur of law enforcement and media activity, and they can identify critical issues and provide tailored recommendations to help resolve the situation and prevent future occurrences.” (link)
