The Pac-12 conference office has been slow to provide clarity on the legalities associated with the league’s dissolution, as Oregon State AD Scott Barnes explains to The Mercury News’ Jon Wilner. “I’m frustrated that we haven’t gotten the information as quickly as we had hoped. It is trickling in. We need to get that buttoned down.” Wilner subsequently sought answers from the league and asked: “Why is it taking so long to determine the assets, liabilities and governing control? The Pac-12 declined to comment. What is the process and who’s involved? The Pac-12 declined to comment. When might full clarity emerge? The Pac-12 declined to comment. The same radio silence that defined the Pac-12’s messaging strategy throughout the media rights negotiations is at work in this endeavor. Which is fine – the conference isn’t obligated to share information with the media. But it’s required to assist Washington State, Oregon State and the outgoing schools by any means necessary. And once again, headquarters has failed to execute at the necessary level.” One source tells Wilner: “Any well-run business should, within 48 hours, have the most up-to-date profit-and-loss statement, balance sheet and liabilities and assets. At the latest, they should have had this at the end of August, knowing the odds were pretty good Stanford and Cal were leaving. … The conference has been so poorly managed on so many levels.” Two complicating factors involve the recent hire of CEO Morane Kerek, who has been in the role for less than a month, and the fact that the 10 outbound members have not provided the Pac-12 with formal departure notices. Wilner wonders whether the announcements and public comments by the ACC, Big 12 and those outbound schools “constitute legally binding departure notices” and whether a settlement might be forthcoming. “In realignment, billable hours are undefeated.” (link)

Big Ten Commissioner Tony Petitti tells The Athletic’s Nicole Auerbach that divisions in an 18-team league are untenable for several reasons. “They’re very difficult to balance because they’d have to be large. And secondly, if you’re playing nine conference games and you’re breaking into divisions, you’re playing so much against your own division that you’re not really crossing over. The inability to see other teams and really connect the conference is not ideal. So, there’s a competitive aspect to it, but there’s also a practicality.” Petitti also tells Auerbach Colorado’s decision to join the Big 12 “increased some inbound conversations.” Though the league doesn’t have a pro-rata clause, Auerbach reports Fox “upped the amount it was willing to pay at Petitti’s request” to bring Oregon and Washington on board, and Petitti says: "Oregon and Washington, they had, really, intent; they were working hard to make it an option for them. They really, really wanted to be in the Big Ten. We felt that throughout the whole process." Petitti also agrees with SEC Commissioner Greg Sankey that the College Football Playoff needs to be reevaluated in light of the recent realignment. “It's our job to make sure that whatever was created makes sense. I will say my No. 1 [goal] is access.” Does the league have plans to expand further? Petitti: “We’re extremely happy where we are.” (link, link)

The Athletic’s Chris Vannini observes that “it was SMU’s booster culture and connection with the university that brought about the Death Penalty [in 1987]. In a full-circle moment, it’s a new booster culture and alignment with the university that brought the program back to this moment. The school that dominated ‘NIL’ long before it was legal has plans to do it again.” SMU Board of Trustees Chair David Miller tells Vannini the Mustangs are not here by accident. “It’s been a growing feeling for the past decade or so. There’s no question that over that time, increasingly, the leadership of the university, the faculty have embraced the premise that athletic success is important. It impacts the brand. It impacts the way the university is perceived. You can have both.” ACC Commissioner Jim Phillips adds: “They had a strong sales pitch. They were really well organized and strong in their beliefs about SMU. It was done professionally.” Meanwhile, Mustangs AD Rick Hart tells Vannini he’s always wanted to be an AD in the ACC, and “to do it at SMU, in my wildest dreams, it hadn’t entered my mind.” Lots more on the Mustangs’ path back from Vannini. USF is the recipient of a $25M gift from Tampa General Hospital to name the Center for Athletic Excellence, an operations facility that will be included as part of USF’s new on-campus stadium project and will feature dedicated clinical space for TGH. The gift will also name the university’s athletics district. Bulls AD Michael Kelly: “We cannot thank Tampa General Hospital enough for their generous support. This $25 million gift is the largest-ever gift to USF Athletics and will help us build a world-class training facility for our athletes as part of our on-campus stadium project. In addition, this unique partnership will provide our student-athletes and the Tampa Bay community with unparalleled behavioral health and wellness services in this state-of-the-art facility. We are grateful to TGH for believing in our vision for the future of USF Athletics and for playing an instrumental role in helping us build what will be one of the finest athletics districts in all of college sports.” (link)

The NCAA has denied North Carolina WR Tez Walker’s eligibility waiver for this season, and Tar Heels HC Mack Brown says in a statement that “I don’t know that I’ve ever been more disappointed in a person, group of people, or an institution than I am with the NCAA right now. It’s clear that the NCAA is about process and couldn’t care less about the young people it’s supposed to be supporting. … Shame on you, NCAA. SHAME ON YOU!” Tar Heels AD Bubba Cunningham has also released a statement outlining several pertinent facts in Walker’s case, including the cancelation of the football season at Walker’s original institution, NC Central, where Walker never actually played. Furthermore, Cunningham notes both NC Central and Kent State support Walker’s immediate eligibility, and Kent State has supported UNC in providing “overwhelming evidence” detailing Walker’s mental health needs. “Arbitrarily prohibiting a student-athlete from competition – when that student-athlete has played two seasons of football in the last five years at one school and wants to play closer to home for legitimate family and mental health reasons – does not make sense. This decision undermines the fair treatment of student-athletes and further erodes the public confidence in our national governing body.” (link, link)

James Madison Asst. AD for Compliance/NCAA Committee for Legislative Relief Chair Stephen LaPorta insists the NCAA does care about mental health, “as demonstrated by the DI Board vote in April that will now require all member schools to provide for the first time increased mental health resources and medical support for college athletes, among other benefits. For student-athletes who transfer for a second time and do not receive a waiver to compete immediately, those resources and support systems are available as they acclimate to their new schools prior to competing the next year.” (link)

The U.S. Department of Labor’s proposed new overtime rule that would require employers to pay employees who make $55K or less for overtime could have impacts on college athletes, according to Sportico’s Michael McCann, who points out that whether professional athletes are exempt from the Fair Labor Standards Act has triggered litigation in the past. He goes on to explain that “if college athletes are employees, their potential eligibility to form a union or multiple unions (such as by school, sport and/or conference) would become a key factor in determining compensation. This is a complex area of law. State laws vary on the eligibility of public sector employees – including those employed at state colleges – to unionize and recognition of employee status under the FLSA would not guarantee unionization rights.” Even as non-union employees, student-athletes could sign employment contracts with their schools outlining their pay. The rate and method of payment, along with nature of the work, “would be prime factors in assessing if the athletes are FLSA exempt or non-exempt,” McCann continues, noting that if “college athletes are non-exempt, they would be owed minimum wage and overtime pay for compensable ‘work’ hours. Those hours would cover games, practices and team travel. … Athletes at Georgetown, George Washington, American, Howard and other D.C. schools could benefit from D.C.’s minimum wage of $17 per hour, the highest in the country, and overtime pay of $25.50 per hour.” More from McCann. + Conference USA signs a multiyear agreement making IMG ARENA the league’s official data rights collector for football and men’s and women’s basketball. Commissioner Judy MacLeod: “This data rights partnership with IMG ARENA helps Conference USA remain in control of its statistical data as we see the substantial increase in use of that data. These efforts pair well with the enhanced visibility CBS Sports and ESPN are providing our programs as we kick-off our new media agreements.” (link)
+ The Atlantic 10 will relocate its HQ from Newport News, Va., to Washington, D.C. The move will begin in November and is expected to be complete in June 2024. The new 5K-sq. ft. office is located in the National Center for Higher Education building that houses headquarters for The American Council on Education (ACE) and other tenants in higher education, including an NCAA satellite bureau. Commissioner Bernadette McGlade: “Washington provides access to a highly educated, diverse community that embraces Fortune 500 companies, innovative technology and is the political center of the world, all factors in the current college athletics landscape. + NC State, Pittsburgh, West Virginia and Cincinnati have joined the The Collective Association, which now has 21 Power 5 members. The TCA has also released a statement calling on Congress to include it in discussions regarding NIL. “As an organization of collectives that works directly with student-athletes and has firsthand knowledge of how NIL is working – favorably and unfavorably – we are the most effective resource to identify solutions to create a system that serves the many parties involved. … In a system that has seen an explosion of money changing hands in recent decades…TCA is excited about the opportunity to support student-athletes' ability to earn their well-deserved compensation. Disney-Charter Saga…
+ Disney releases a statement indicating it’s “unfortunate that Charter decided to abandon their consumers by denying them access to our great programming. While they have stated their ‘indifference’ to the needs of millions of paying customers, we will not lose sight of what’s most important – investing in the highest-quality stories, news and sports for our audience. The question for Charter is clear: do you care about your subscribers and what they’re telling you they want – or not? Disney stands ready to resolve this dispute and do what’s in the best interest of Charter’s customers. (link)
+ Meanwhile, Charter CEO Chris Winfrey remarked during today’s Goldman Sachs Communacopia + Technology Conference that “as more video customers who value sports content migrate to alternative sources, our incentive to do a deal is reduced. … The idea that you could solve for DTC profitability by letting linear burn to the ground” is not sustainable. We have always thought of video as being an asset to our broadband connectivity business, but it’s on the verge of flipping and becoming a liability.” Winfrey also noted that “in an alternative world, if you had an environment where you don't carry Disney content, what sports content would be left? The answer would be very little, but we could deliver smaller packages at a much better price.” Also from Winfrey: “At the end, Disney is the lynchpin, ESPN is the lynchpin. And I don't mean that in a bad way. I mean it in a very complimentary way. They have the opportunity to lead here and drive the industry.
