Fifteen Dartmouth men’s basketball players have filed a petition with the NLRB to unionize and join SEIU Local 560. (link, link); Dartmouth says in a response to the petition: “We have the utmost respect for our students and for unions generally. We are carefully considering this petition with the aim of responding promptly yet thoughtfully in accordance with Dartmouth’s educational mission and priorities.” (link)

Sportico’s Michael McCann and Daniel Libit point out that even if Dartmouth men’s hoops players are designated as employees, that doesn’t mean it can or will happen at other DI universities because the “NLRA does not govern the relationship between public universities and their workers; that is a question of state labor law and state labor boards, which vary widely across the 50 states, with some ‘labor friendly’ and others ‘management friendly.’” They also note Ivy League schools don’t award athletic scholarships “while basketball players at DI colleges are ‘paid’ in a sense via athletic scholarships. Whether an athletic scholarship changes the calculus of employee recognition is unclear and could itself become a source of litigation.” McCann himself notes that “this will take time to play out (years, given the role of courts). As is often true with law, change via law is slow and must go through extensive procedure. So be cautious with the inevitably exaggerated and probably inaccurate media headlines on this.” (link, link)

Pac-12 Commissioner George Kliavkoff this week indicated that “neither the Conference nor I have a position with respect to the proper composition of the Pac-12 Board. This is fundamentally a dispute among members. As Commissioner, I will follow lawful directives of the Board pursuant to the Constitution and Bylaws and consistent with my duties in the best interests of the Conference.” However, The Mercury News’ Jon Wilner notes that in practicality, Kliavkoff’s actions are telling. In his response to the complaint filed by Washington State and Oregon State, Kliavkoff wrote: “Your suggestion that 10 of the Conference’s 12 members have ‘withdrawn’ from the Conference within the meaning of the Bylaws is mistaken. … We simply cannot accept the suggestion that only two members – Oregon State University (OSU) and Washington State University (WSU) – now have the right to determine by themselves all issues affecting the Conference, and determine the course of all revenue coming into the Conference, to the exclusion of the other 10 member schools.” Wilner notes the dispute now may revolve around whether the 10 schools have withdrawn or given “notice of withdrawal,” which is the wording used by OSU and WSU as well as the league bylaws. “Key point: The bylaws do not define ‘notice of withdrawal’ and whether it must come in writing.” (link)

Ohio State AD Gene Smith explains his goals when he meets with lawmakers in Washington, D.C., next week include educating legislators on the differences that exist among DI schools. “We take for granted here at Ohio State, as do many of our colleagues in the Big Ten or the SEC or the ACC, etc., what we can do for student-athletes. We can do some things for student-athletes that other Division I institutions can't do because of the resources that we're blessed to have. So, I want to educate them that we're at the top of the pyramid.” As for what he’d like to see in a federal solution, Smith cites standard contracts, agent/representative certification requirements, strengthened enforcement, “some method to bring transparency to the numbers…so that there’s a market defined across the country,” and protection from student-athletes being classified as employees. “If we can get that, that would kind of be the Holy Grail.” More from Smith. ESPN’s Dan Murphy observes the contradiction of Michigan State Interim President Teresa Woodruff distinguishing how the “MSU of today” is handling allegations of sexual misconduct while simultaneously bringing back former Football HC Mark Dantonio, “who coached Michigan State through one of the most successful eras in program history on the field [and] also presided over the team during the ‘MSU of old,’ a time when the athletic department was accused of mishandling sexual misconduct complaints.” Spartans AD Alan Haller defends his decision to bring in Dantonio, saying yesterday: “Mark Dantonio is a man of integrity. Since his retirement, he's continued to be a presence and a unifying force in the MSU community. When I called him, he selflessly offered to do whatever he could to help the football program." Murphy: “During Dantonio's 13-year tenure, at least 16 Michigan State football players were accused of sexual assault or violence against women.” (link)

California Governor Gavin Newsom yesterday signed a bill ending restrictions on taxpayer-funded travel for state workers traveling to parts of the country with anti-LGBTQ+ laws. Newsom: “In the face of a rising tide of anti-LGBTQ+ hate, this measure helps California’s message of acceptance, equality and hope reach the places where it is most needed.” (link)

The Collective Association plans on making the trip to Washington, D.C., next week for the House Committee on Small Business’ NIL hearing despite not being invited. Spyre Sports Group Co-Founder Hunter Baddour tells On3’s Nakos: “Collectives work as closely with student-athletes on a daily basis as anybody, so to not have the voices of these two groups when you claim you want to solve some issues, and you have the best interests of student-athletes in mind is just nonsensical. … I think that if you asked, 98% of student-athletes would speak favorably about NIL and the opportunities that they’ve had. They want to express those feelings that they do not feel like the current landscape is broken. It’s been positive for them. We believe that as TCA is, and that’s why we want to have a voice and be a part of these conversations.” (link)

ACC Supervisor of Officials Alberto Riveron talks with the AP’s Aaron Beard about the role of the off-site replay review center and says: “We’re not, in the middle of the third quarter, going to move the ball by a yard or a yard and a half, or put a second back on the clock. Because again, players play, coaches coach and officials officiate. Down the line, we’re all going to make mistakes. It’s to catch the big mistake – the egregious mistake – and to stay consistent throughout the process.” In 2022, there were 820 plays overturned on replay review on 1,927 stoppages (42.6%) at the FBS level for the regular season and league championship games. Among Power 5 leagues, the Big 12 had the lowest overturn percentage at 34%, followed by the SEC (35.2%), Big Ten (46%), ACC (50%) and Pac-12 (54%). The Pac-12 had the longest average review time at two minutes, six seconds, while the other four leagues ranged from one minute, 23 seconds to one minute, 36 seconds. The Oakland Board of Trustees approved a plan to build the $5M, 15K-sq-ft Varsity Basketball Training Center, which will feature locker rooms, a team lounge, film room, and offices for the men’s and women’s basketball teams. Golden Grizzlies AD Steve Waterfield: “Since I arrived at Oakland in 2018, President Pescovitz has championed and supported OU Athletics. Her support and the teamwork of cabinet members and others across the OU community have been instrumental in getting the project to this point. NC State’s newly installed 166’x43’ Daktronics video board did what it was supposed to do after a lighting strike near Carter-Finley Stadium caused a power surge. Namely, it shut itself down and rebooted. Daktronics National Sales & Marketing Manager Will Ellerbruch: “We have built into our products a surge suppression system, which you have a surge suppressor at your laptop, probably, or your TV -- same kind of deal. So if there's too much power that comes into or too little power that comes into an electronic device, like our big video board, then that's what that system is designed to do. .. From our point of view, it was a success. NC State – awesome job working together, getting the thing back up and running. The board did what it’s supposed to do, and then our team jumped into action.
