Army West Point and the AAC are progressing in their discussions regarding the Black Knights joining as a football-only member. ESPN’s Pete Thamel reports a “realistic timeline for a decision is the end of the month. There’s optimism on both sides as they dive further into the details to figure out a potential arrangement. The Army-Navy game would be a non-conference game if Army joins the AAC and still be played after the season.” (link)

Former Fox Sports President Bob Thompson predicts more schools will find themselves in the position Oregon State and Washington State are in now. “Can't really expand anymore. You really need to realign and/or retract.” Crakes Media Principal Patrick Crakes agrees: “Indeed the next round of college realignment is likely to feature several schools that get left behind. Given the apparent low to no growth nature of the next 5-10 years for media revenue there probably won’t be room for every school that’s currently getting top level economics.” (link)

Michigan State Football HC Mel Tucker earned $6M from the time MSU launched its investigation into allegations of sexual misconduct and Tucker’s suspension without pay on Sunday, per USA Today’s Kenny Jacoby, who reports the school’s hearing administrator initially set the hearing for August 22 and 23, but Tucker’s attorney, Jennifer Belveal, said she was unavailable either of those dates. The administrator then suggested 10 dates in September, all weekdays. “Only one of those days did not work for Tracy and her attorney, Karen Truszkowski, the emails show. But Tucker and Belveal said they were unavailable for any of the other nine. MSU policy indicates investigations will generally be completed within 90 days of the filing of a formal complaint. In this case, the investigation lasted 216, “largely because Tucker did not meet with the investigator for three months, while he and Belveal tried to stop the investigation,” according to Jacoby. Meanwhile, Title IX attorney Ann Olivarius tells Jacoby that Tucker may avoid the hearing if he reaches a settlement with the school first, but Olivarius says MSU should be “very cautious about offering him a payout,” given its history of mishandling sexual abuse allegations. “I would never advise them…to pay him out at all.” (link)

Yahoo’s Ross Dellenger notes that through two weeks, the new football clock rules are “doing exactly as intended, decreasing games by: 3-4 offensive snaps; 6-7 total plays (counting special teams); and 5 minutes of total time.” 247Sports’ Chris Hummer notes the average plays per game per team is down from 68.7 last year to 67.3. Utah Gymnastics HC Tom Farden will keep his position following an investigation conducted by Husch Blackwell, which found that while his behavior caused some athletes to feel an “increased fear of failure,” it did not rise to the level of “severe, pervasive or egregious” acts of abuse as defined by the NCAA and SafeSport, The Salt Lake Tribune’s Andy Larsen reports. Farden faced multiple allegations by multiple gymnasts, including throwing objects in anger, and Farden admitted that he once told a gymnast she would be a “nobody working at a gas station” if not for the gymnastics team. Farden will be put on an improvement plan and monitored. Utes AD Mark Harlan: “We still consider the experiences reported by members of the program over recent years with great care, compassion and sensitivity. As you can read in the report, there were a handful of instances in which Coach Farden should have demonstrated greater compassion and self-control, and better professionalism. I met with Coach Farden this week to express my disappointment and to share with him my expectations moving forward.” (link)

Ole Miss football student-athlete DeSanto Rollins has filed a lawsuit against the university and Rebels HC Lane Kiffin. Rollins says he was kicked off the team for missing practices and meetings during a "mental health crisis” and accuses Kiffin and the university of failure to provide equal protection, racial and sexual discrimination, and other allegations, per ESPN’s Heather Dinich, who notes Rollins is seeking $10M in compensatory damages and $30M in punitive damages. The complaint alleges that Kiffin intentionally took adverse action against Rollins "on account of race for requesting and taking a mental health break, but not taking adverse action against white student-athletes" for the same request. It also alleges sexual discrimination on the grounds that Ole Miss has not taken "adverse action against female student-athletes for requesting and taking a mental health break." Ole Miss, however, says that not only has the school not received a lawsuit, but that Rollins “was never removed from the football team and remains on scholarship. In addition, he continues to have the opportunity to receive all of the resources and advantages that are afforded a student-athlete at the university." (link)

Former North Carolina Supreme Court Justice Robert Orr argues the NCAA’s current transfer restrictions violate antitrust law, writing: “After all, it’s the collective power of the NCAA and those 1200 institutions who have imposed punitive limitations on these student-athletes by limiting their ability to transfer. Of course, these limitations apply to absolutely no one else who walks the campus halls or treads on the sports fields of the universities. Administrators, coaches, professors, other students, literally everybody, can jump to a new school with no punitive limitation – except students wanting to play college sports governed by the NCAA. As much as athletes transferring may irritate the schools and fans, there is a fundamental right to do so without any sort of punishment or limitation.” Orr goes on to enumerate the various criteria that must be met for transfer waivers to be accepted for mental health reasons and asserts the “obvious takeaway from this burdensome waiver standard…is that the NCAA and its member institutions don’t really want players transferring because of mental health reasons unless the mental health issues are so extreme that the player would be of no use to the original school’s athletic endeavors.” Full op-ed. Ball State AD Jeff Mitchell joins D1.ticker/Connect’s Kristen Eargle to highlight some of the fan and student engagement initiatives that are being implemented this fall, the revenue generation components associated with adding outdoor luxury suites and other fan engagement initiatives during home football games, why the Cardinals are well-positioned in the MAC and more. Mitchell on leveraging football to drive engagement with other sports: “That cross-promotion concept is very real. Football is going to generate our biggest fan base, and if we can continue to promote the fact that we're going to have a field hockey match, for example, on Sunday after the football game, that can drive attendance there and highlight a sport that some people don't know about. And it's incredibly exciting. Our student-athletes are talented and we want to highlight them as often as we can and certainly in meaningful ways.” Full conversation now available on Connect. (link)

“WMT is a compelling study on how a focus on problem-solving can lead to natural growth,” SBJ’s Ethan Joyce observes, noting that the company “has gone from tech consultant to tech integrator to finally, the digital platforms business it is today. WMT’s work with Snapdragon is a clear example of that problem-solving in action.” Specifically, WMT solved the problem of bringing four separate Ticketmaster integrations together in one app to account for Snapdragon Stadium’s various tenants, and WMT Founder/CEO Andres Focil tells Joyce that the ability to keep the user inside the Snapdragon Stadium app increases monetization opportunities by allowing for activities like concert promos. Focil: “There is an opportunity for people to start thinking about sports and entertainment as one. There are opportunities also to think about different sports and how there’s cross and how we can create a marriage between both, and just allowing venues to be able to explore other fan engagement and revenue opportunities. ... We’re really building an agnostic stack which can pretty much integrate to anything, regardless of whoever the provider may be. In the future, we can build out a solution and a digital ecosystem that ties all of their systems together.” More. (link)

MoffettNathanson Senior Managing Director Craig Moffett Q&As with Stratechery’s Ben Thompson about the Disney-Charter dispute and says the “real driving force of the change in leverage was…ironically that the structure of the media business in the United States gave so much leverage to the media companies. After 20 years of them using it, they had effectively used it all up to the point that they had sucked all the profit out of the video business from their distributors. There was this actually very ironic argument that by going direct-to-consumer with their streaming apps, the media companies would be able to capture the transport margin that the cable companies were collecting. They didn’t call it transport margin, they just called it the margin that their distributors were making. The irony was they weren’t making any margin anymore because they’d already taken it. … You had this industry structure that was set up with the bundles that existed in the old days of television, and the old days – meaning until a week or so ago – and those bundles protected the media companies from having any price signals transmitted to the end user.” In other words, Moffett explains, the “real change in leverage wasn’t that the content wasn’t as good, the real change in leverage was that Charter wasn’t making any money anymore, so they became a very dangerous negotiator because when you have nothing to lose, you can negotiate very, very hard.” Moffett also muses that it “looks to me like Google is walking away with the video distribution industry. People from the linear video world underestimate just how powerful YouTube is, not YouTube TV, but how powerful YouTube is.” He goes on to remark, though, that YouTubeTV is dominating the vMVPD market and “if they’re not careful, Disney is going to end up in a world where Google owns video distribution and where you’re back to the TCI model where there’s really only one distributor that you get to negotiate with.” Lots more in the full interview. Fifteen Dartmouth men’s basketball players have filed a petition with the NLRB to unionize and join SEIU Local 560. (link, link); Dartmouth says in a response to the petition: “We have the utmost respect for our students and for unions generally. We are carefully considering this petition with the aim of responding promptly yet thoughtfully in accordance with Dartmouth’s educational mission and priorities.” (link)

Sportico’s Michael McCann and Daniel Libit point out that even if Dartmouth men’s hoops players are designated as employees, that doesn’t mean it can or will happen at other DI universities because the “NLRA does not govern the relationship between public universities and their workers; that is a question of state labor law and state labor boards, which vary widely across the 50 states, with some ‘labor friendly’ and others ‘management friendly.’” They also note Ivy League schools don’t award athletic scholarships “while basketball players at DI colleges are ‘paid’ in a sense via athletic scholarships. Whether an athletic scholarship changes the calculus of employee recognition is unclear and could itself become a source of litigation.” McCann himself notes that “this will take time to play out (years, given the role of courts). As is often true with law, change via law is slow and must go through extensive procedure. So be cautious with the inevitably exaggerated and probably inaccurate media headlines on this.” (link, link)

Pac-12 Commissioner George Kliavkoff this week indicated that “neither the Conference nor I have a position with respect to the proper composition of the Pac-12 Board. This is fundamentally a dispute among members. As Commissioner, I will follow lawful directives of the Board pursuant to the Constitution and Bylaws and consistent with my duties in the best interests of the Conference.” However, The Mercury News’ Jon Wilner notes that in practicality, Kliavkoff’s actions are telling. In his response to the complaint filed by Washington State and Oregon State, Kliavkoff wrote: “Your suggestion that 10 of the Conference’s 12 members have ‘withdrawn’ from the Conference within the meaning of the Bylaws is mistaken. … We simply cannot accept the suggestion that only two members – Oregon State University (OSU) and Washington State University (WSU) – now have the right to determine by themselves all issues affecting the Conference, and determine the course of all revenue coming into the Conference, to the exclusion of the other 10 member schools.” Wilner notes the dispute now may revolve around whether the 10 schools have withdrawn or given “notice of withdrawal,” which is the wording used by OSU and WSU as well as the league bylaws. “Key point: The bylaws do not define ‘notice of withdrawal’ and whether it must come in writing.” (link)

Ohio State AD Gene Smith explains his goals when he meets with lawmakers in Washington, D.C., next week include educating legislators on the differences that exist among DI schools. “We take for granted here at Ohio State, as do many of our colleagues in the Big Ten or the SEC or the ACC, etc., what we can do for student-athletes. We can do some things for student-athletes that other Division I institutions can't do because of the resources that we're blessed to have. So, I want to educate them that we're at the top of the pyramid.” As for what he’d like to see in a federal solution, Smith cites standard contracts, agent/representative certification requirements, strengthened enforcement, “some method to bring transparency to the numbers…so that there’s a market defined across the country,” and protection from student-athletes being classified as employees. “If we can get that, that would kind of be the Holy Grail.” More from Smith. ESPN’s Dan Murphy observes the contradiction of Michigan State Interim President Teresa Woodruff distinguishing how the “MSU of today” is handling allegations of sexual misconduct while simultaneously bringing back former Football HC Mark Dantonio, “who coached Michigan State through one of the most successful eras in program history on the field [and] also presided over the team during the ‘MSU of old,’ a time when the athletic department was accused of mishandling sexual misconduct complaints.” Spartans AD Alan Haller defends his decision to bring in Dantonio, saying yesterday: “Mark Dantonio is a man of integrity. Since his retirement, he's continued to be a presence and a unifying force in the MSU community. When I called him, he selflessly offered to do whatever he could to help the football program." Murphy: “During Dantonio's 13-year tenure, at least 16 Michigan State football players were accused of sexual assault or violence against women.” (link)

California Governor Gavin Newsom yesterday signed a bill ending restrictions on taxpayer-funded travel for state workers traveling to parts of the country with anti-LGBTQ+ laws. The Collective Association plans on making the trip to Washington, D.C., next week for the House Committee on Small Business’ NIL hearing despite not being invited. Spyre Sports Group Co-Founder Hunter Baddour tells On3’s Nakos: “Collectives work as closely with student-athletes on a daily basis as anybody, so to not have the voices of these two groups when you claim you want to solve some issues, and you have the best interests of student-athletes in mind is just nonsensical. … I think that if you asked, 98% of student-athletes would speak favorably about NIL and the opportunities that they’ve had. They want to express those feelings that they do not feel like the current landscape is broken. It’s been positive for them. We believe that as TCA is, and that’s why we want to have a voice and be a part of these conversations.” (link)

ACC Supervisor of Officials Alberto Riveron talks with the AP’s Aaron Beard about the role of the off-site replay review center and says: “We’re not, in the middle of the third quarter, going to move the ball by a yard or a yard and a half, or put a second back on the clock. Because again, players play, coaches coach and officials officiate. Down the line, we’re all going to make mistakes. It’s to catch the big mistake – the egregious mistake – and to stay consistent throughout the process.” In 2022, there were 820 plays overturned on replay review on 1,927 stoppages (42.6%) at the FBS level for the regular season and league championship games. Among Power 5 leagues, the Big 12 had the lowest overturn percentage at 34%, followed by the SEC (35.2%), Big Ten (46%), ACC (50%) and Pac-12 (54%). The Pac-12 had the longest average review time at two minutes, six seconds, while the other four leagues ranged from one minute, 23 seconds to one minute, 36 seconds. The Oakland Board of Trustees approved a plan to build the $5M, 15K-sq-ft Varsity Basketball Training Center, which will feature locker rooms, a team lounge, film room, and offices for the men’s and women’s basketball teams. NC State’s newly installed 166’x43’ Daktronics video board did what it was supposed to do after a lighting strike near Carter-Finley Stadium caused a power surge. Namely, it shut itself down and rebooted. Daktronics National Sales & Marketing Manager Will Ellerbruch: “We have built into our products a surge suppression system, which you have a surge suppressor at your laptop, probably, or your TV -- same kind of deal. So if there's too much power that comes into or too little power that comes into an electronic device, like our big video board, then that's what that system is designed to do. .. From our point of view, it was a success. NC State – awesome job working together, getting the thing back up and running. The board did what it’s supposed to do, and then our team jumped into action. So we’re very happy with how that all came out.” (link)
