+ Saint Mary (NE) names Southwest Baptist (NCAA DII) Asst. AD for Operations & Facilities Robbie Shay as its new AD, starting Monday. VP for Operations Nate Neufind: "Robbie brings a wealth of experience in growing intercollegiate athletic programs through a sustained culture of excellence. His knowledge, dedication and talent will help Flames Athletics as we pursue the next level of success." (link)

Fifteen Dartmouth (DI) men’s basketball players have filed a petition with the NLRB to unionize and join SEIU Local 560. (link, link); Sportico’s Michael McCann and Daniel Libit point out that even if Dartmouth men’s hoops players are designated as employees, that doesn’t mean it can or will happen at other universities because the “NLRA does not govern the relationship between public universities and their workers; that is a question of state labor law and state labor boards, which vary widely across the 50 states, with some ‘labor friendly’ and others ‘management friendly.’” McCann himself notes that “this will take time to play out (years, given the role of courts). As is often true with law, change via law is slow and must go through extensive procedure. So be cautious with the inevitably exaggerated and probably inaccurate media headlines on this.” (link, link); The timeline for Dartmouth Men’s Basketball unionization includes a response by the college by the 25th and a hearing with the NLRB regional director set for October 3, per Yahoo’s Ross Dellenger. Tulane (DI) Sports Law Professor Gabe Feldman tells Dellenger: “If the NLRB determines Dartmouth basketball players are employees, then there is a very strong argument that all private school DI athletes are employees, including walk-ons. The question then would be, ‘Does the NLRB determine that all athletes, public schools as well, are employees?’” The rise in union efforts is not foreign to the college, with the Student Workers Collective signing a new collective bargaining agreement in February. Feldman adds: “From the big picture, we are seeing the rise of unions across the country. We are seeing a rise of the workers. It’s a cliche, but a rising tide lifts all boats. There is momentum across the country. It becomes much easier to sell unionization to other groups of employees when you see this wave happening. […] Union success begets more unions which often begets more success. It’s a cycle.” (link)

LEARFIELD has completed a $1.1B recapitalization that SBJ’s Michael Smith and Bret McCormick report will “greatly reduce the company’s debt while also infusing $150M in new equity investment” into the company. Specifically, the restructuring will reduce LEARFIELD’s debt from $1.1B to $500M after an 11-month debt-restructuring process. The new arrangement comes with a new set of majority stakeholders in Clearlake Capital Group, Charlesbank Capital Partners and funds managed by Fortress Investment Group, and the company’s new board of directors will be assigned so that each firm will have representation. Other directors from outside of the majority owners could be on the board as well, per Smith and McCormick, who also note that LEARFIELD “didn't share the company’s new debt ratio, but a source indicated it was closer to 5x, down from the 30x it hovered near in mid-2022, according to Moody’s.” (link)

Jamestown is on schedule to begin using its Nelson Family Bubble around the beginning of November. President Polly Peterson: “The spring sports, the last three out of five years have barely been able to play or run at home, and this is going to allow them to have structured, efficient and really productive practices because they can be inside in a big space that’s warm enough to actually feel like your outside but you are inside. It’s become almost a necessity and not a luxury … in this part of the country. […] It allows us to demonstrate that we have the facilities to compete at this level that are comparable if not better than some of the other schools that we are going to be competing against. I think for athletes, it’s a convincing display of our commitment to supporting their preparation. (link)
