Washington State AD Pat Chun joins The Mercury News’ Jon Wilner and JohnCanzano.com’s eponym to discuss the Pac-12’s dissolution and the next steps for WSU and Oregon State. Chun notes that while there was no singular event that led to the end of the Pac-12 as we know it, there was a series of missed opportunities. “Obviously, the league was aggressive [in adding Utah and Colorado] and then for whatever reason the aggression stopped and the league ultimately did nothing after that and sat back and watched the Pac-12 Networks underperform and watched the TV market change and a failure to pivot from strategy. And you found obviously disgruntled membership as college athletics was changing before our eyes.” As for the difficulties in securing the financial figures from the Pac-12, Chun remarks: “It's really one of the more odd responses and in a whole year and a half or two years of odd responses. You're also talking to, you know, the majority of our schools – I mean really with the exception of USC and Stanford everyone else is a public institution – so transparency is the norm. At all of our institutions when information is requested we’re obligated to give it. This is going to have to be remedied over time because we do need that information to make informed decisions and, like I said, it's just one of the many odd responses from a conference that has now over a decade of these types of responses.” Full interview. Arkansas AD Hunter Yurachek says ESPN analyst Jay Bilas hasn’t taken him up on his offer to come to Fayetteville for a look at the Razorbacks’ finances. “I think my son told me he did respond [on Twitter], but he hasn't taken me up on this offer. I don't have anything against Jay Bilas personally, but I want Jay Bilas professionally or any member of the media to be well-informed about college athletics because that's where I think we have fallen short as directors of athletics is telling our story and being very transparent about where this money goes. We have a $150M budget and about $40M of that is in payroll expenses. So, there's $110M that we reinvest into the lives of our student athletes, whether that’s scholarships, whether that's meals, whether that's travel, whether that's equipment, whatever the case may be. Every team has their own athletic trainer, their own strength and conditioning coach, they have mental health professionals, we have an incredible team of doctors that we pay all their medical expenses from UAMS. There’s not anything our student-athletes need, but if we have to start revenue-sharing in college athletics, you know what we're going to pull back on? It’s the services that we provide to our student-athletes like the mental health professionals, like the food, like the way they travel, like the equipment that we get. So, we can share revenue with student-athletes, but in the end that’s going to hurt the student-athletes’ collegiate experience, and I just want Jay Bilas and other members of the media who don’t understand that to better understand that so they can help us with our narrative.” (link)

Bilas responds, via Twitter: “Please listen to this…the standard NCAA argument: we unilaterally limit athlete compensation , and athletes get MORE as a result. Respectfully, that’s nonsensical. The highest athletic dept. expenses are paid TO THE SCHOOL! Does the NCAA limit employee pay based upon health care, parking, or other benefits? No. Coaches and ADs fly on the same planes, wear the same gear, use the same facilities, yet take no pay limit. It’s a rationalization so they don’t have to pay athletes, nothing more. Hampton AD Anthony Henderson clarifies that transfer student-athletes are those most impacted by the eligibility issues announced last week and says: “We are very optimistic that the majority of the affected student-athletes will be cleared to return to compete this fall.” Cross country, women's soccer, volleyball and football are the programs that have been impacted to date, and Henderson notes: “Even with just a question, we will not take the chance of playing that individual out of an abundance of caution and doing what is best for the success of the program moving forward.” (link)

+ Baylor has settled Title IX lawsuits with 15 women who say they were sexually assaulted while students at the university. Baylor Asst. VP for Media Relations Lori Fogleman: “While we can never erase the reprehensible acts of the past, we pray that this agreement will allow these 15 survivors to move forward in a supportive manner.” Terms of the settlements remain private. + Former Iowa football student-athletes Arland Bruce IV, Reggie Bracy and Jack Johnson and former men’s basketball student-athlete Ahron Ulis, who were charged with tampering with records for allegedly falsifying information used to register accounts on mobile sports wagering apps, have pleaded guilty to the lesser charge of underage gambling. The AP reports Bruce, Bracy and Ulis were fined $645 and that Johnson “has agreed to pay a fine of the same amount, but a sentencing document for him did not appear in electronic court records Monday.” (link)
+ From in front of the Law360 paywall: “San Diego State University can’t ditch any claims or bids for damages brought by women varsity athletes in a proposed class action accusing the school of awarding them less financial aid than varsity men athletes, a California federal judge ruled, but only the women who were enrolled as student-athletes when the complaint was launched can pursue injunctive relief. …” (link)

The Men’s and Women’s Basketball Committees received an overview of returning to pre-pandemic APR operations, which will resume fall 2023 and the results of the most recent comprehensive review of the NCAA Division I Academic Performance Program conducted by the NCAA Division I Committee on Academics. The review confirmed the APP “continues to facilitate academic success and address academic underperformance, given the changing landscape of intercollegiate athletics. With regard to the return to normal APR operations, the four-year average will include APR data from 2019-20 through 202223. In addition, public recognition of high-performing teams and APP penalties and the possible loss of access to postseason competition will resume based on the four-year cohort scores released spring 2024. Such penalties and the loss of access to postseason competition will be announced in spring 2023 and both will be imposed in 2024-25.” The Men’s Basketball Oversight Committee plans to eliminate the legislation that restricts coaches from having recruiting contact with prospective student-athletes at their school during the time of day when classes are in session. In addition, a blanket waiver will be issued, effective September 1, that would set aside the current legislation for men’s basketball while the proposal makes its way through the legislative process. Colorado State football student-athlete Henry Blackburn has received death threats after his late hit injured Colorado student-athlete Travis Hunter on Saturday. Rams AD Joe Parker tells ESPN’s Pete Thamel that “by the time the game ended on Saturday, both Henry and his mother’s cell phone numbers had been published on the Internet. They’ve been inundated with threatening calls and text messages. Henry’s campus address and his family’s home address were also published.” Parker also says: “We’re very concerned about our player’s safety, as Henry and his family have continued to receive these threats. Henry never intended to put anyone in harm’s way on the football field. ... It’s not what we teach or coach. We hope that the irrational vitriol directed at Henry stops immediately.” (link)

Sports Illustrated’s Pat Forde observes that several football HCs have acted immaturely in the past few weeks, citing Tennessee HC Josh Heupel’s decision to call a timeout down 13 points with nine seconds left, which nearly led to a brawl, Mack Brown’s criticism of the NCAA, Colorado State HC Jay Norvell’s criticism of Colorado HC Deion Sanders, and LSU HC Brian Kelly insisting he didn’t say over the summer that “we’re going to go beat the heck out of Florida State.” Forde notes Norvell explained his hat-and-glasses comment about Sanders by saying he wanted to “send a message to our players and how we run a program.” Forde: “The message his team apparently received: play dirty, play cheap, get penalized until you lose. The Rams were beaten 43–35 in double overtime, with a huge upset slipping away in no small part because they were penalized a school-record 17 times for a school-record 182 yards. That’s the most penalty yards for any team this season by a whopping 51, and more than any team recorded last year as well.” (link)

Michigan State has sent FB HC Mel Tucker a notice of its intention to terminate his contract for cause. The notice states: “At this point, the university has amassed a body of undisputed evidence of misconduct that warrants termination for cause.” MSU also indicates Tucker material breached his contract with admitted conduct that constitutes moral turpitude and has brought public disrespect, contempt and ridicule on the school. Also per MSU: “This action does not conclude the ongoing Office for Civil Rights case; that rigorous process will continue.” (link, link)

Meanwhile, MSU has retained law firm Jones Day to investigate the leak of Brenda Tracy’s identity, per The Athletic’s Chris Vannini, who notes MSU also hired Jones Day in 2017 to investigate how the football program handled sexual violence allegations. (link)

SMU raised $100M in seven days to support the Mustangs’ transition to the ACC. President R. Gerald Turner: “While there is still much work to be done, the ability to rally this kind of support in just one short week demonstrates that SMU and Dallas recognize the excellence of this opportunity and are stepping up to support it." Mustangs AD Rick Hart adds: “The news has energized not just our fanbase, but the Dallas community. Dartmouth men’s basketball student-athletes Cade Haskins and Romeo Myrthil explain their motivation for unionizing: “First, many of our players currently juggle part-time jobs alongside their academic and athletic commitments to help pay for their tuition and living expenses. While we currently receive many forms of non-traditional compensation, these don’t pay our bills, and so we are unionizing to be compensated like other student employees, with hourly wages similar to other student wages on campus or scholarships. This would alleviate the need for second jobs and enhance our experience as part of the Dartmouth community. … Second, several of our players have suffered serious injuries during practices or games and needed to pay substantial amounts of money out of pocket to cover their health insurance deductibles. We believe Dartmouth should be held responsible for those costs and any long-term disabilities that may arise from our participation in Dartmouth sports.” They go on to “call on other athletes here at Dartmouth, across the Ivy League, and the country to follow this story and join us on the journey to improve the conditions for college athletes everywhere.” Full op-ed. The Toledo Blade’s Dave Briggs reports that “in response to a report of an alleged off-campus hazing incident, Bowling Green State University is preparing to announce that three hockey players have been suspended and coach Ty Eigner has been placed on administrative leave.” Briggs also reports that “star forward Austen Swankler — who was not one of the suspended players — has entered the transfer portal. Swankler is the CCHA preseason player of the year.” (link, link)

The FCS Oversight Committee expressed initial support for a transfer window model that establishes a uniform application of transfer windows in FCS and FBS beginning with the Monday following the second Saturday in December (Monday following FBS conference championship weekend); considers the impact of the early NLI signing period; and consists of three segments, one each in December, January and April. The Women’s Basketball Oversight Committee introduced into the January 2024 legislative cycle a concept that allows skill instruction to be publicized and to be conducted in view of the general public, effective immediately. The committee also supported a proposal to open the transfer notification window for 30 days on the Monday following Selection Sunday and expressed an interest in another option that would result in the transfer notification window opening for 30 days after the second round of the NCAA Tournament. The committee generally supports a concept to allow foreign trips every two years instead of every four years but raised concerns for future discussion. (link)

U.S. Representatives David Kustoff (R-TN), Burgess Owens (R-UT) and Josh Harder (D-CA) have reintroduced the NCAA Accountability Act, which would establish due process protections for individuals and universities under investigation for rule infractions. Specifically, the bill would require the NCAA to give fair notice of enforcement proceedings, establish a two-year statute of limitation for infractions, require investigations be completed within one year and prohibit information from confidential sources from being used in NCAA enforcement decisions. Additionally, the bill would give universities the right to settle disputes through arbitration, requires the NCAA to be fair in its enforcement proceedings, and directs the association to give the Department of Justice an annual report on its enforcement proceedings. A release from Kustoff’s office asserts that “through its monopoly power and lack of oversight, the NCAA investigates and punishes its members with little regard for fairness, due process, or transparency.” Kustoff adds: “It’s time Congress holds them accountable.” (link)

Specifically: “Drummond will be responsible for developing and implementing strategic communication campaigns and leading the execution of the organization's internal and external communications strategy. He will oversee the UGA sports communications team led by Claude Felton, digital and social media strategy, content creation, and overall communication efforts for the University of Georgia's 21 varsity sports programs.” Drummond was most recently the Carolina Panthers’ VP of Football Operations after serving as VP & Chief Communications Officer. SBJ’s Michael Smith and Bret McCormick take a look at LEARFIELD’s restructuring, and CEO Cole Gahagan points out that if the company would’ve had to pay the roughly $1B in debt that was due by the end of 2023, then “not only would the school agreements have been terminated…but so too would the sponsor agreements as well. What I was trying to avoid was the disruption to their business. I wasn’t going to let that happen.” Smith and McCormick note Gahagan’s transparency with ADs was key in getting deals with schools reworked. Florida State AD Michael Alford: “We wanted to be a good partner to them and understand their financial situation. I think they would understand if I came to them with a financial situation, they would work with me on it. So [we] worked it out in the best interest of both parties.” In all, LEARFIELD reworked its deals with five schools (Boston College, Cal, Florida State, UCLA and Utah), which played a pivotal role in helping the company reduce its debt from $1.1B to $500M, and Gahagan says: “That was the hardest conversation I’ve ever had to have in my career about the realities of what lies ahead. And those realities I laid out were relatively simple. Either we were going to find an equitable landing spot or, if we didn’t get there, someone from the new ownership group would make the decision.” Kansas AD Travis Goff: “I think it’s a credit and testament to Cole and his leadership to create this pathway. This new $150M equity investment…we see that as providing us new opportunities in the partnership. + Army West Point and Football HC Jeff Monken have agreed to a new contract through 2027 worth an average of $2M per year, per Yahoo’s Ross Dellenger, who also reports: “Army is in the midst of serious negotiations to join the [AAC]. While the arrangement is not final and hurdles are still left to be cleared, the school and league are optimistic that the deal will happen in the coming weeks.” (link)

Memphis Mayor Jim Strickland recently presented the framework of a deal to University of Memphis and Memphis Grizzlies officials that would provide nearly $500M to renovate FedExForum and $220M for renovations to Simmons Bank Liberty Stadium. That would be in addition to the $350M approved by state lawmakers earlier this year. The Commercial Appeal’s Jonah Dylan and Mark Giannotto report the proposal “features new tax mechanisms and funding streams to increase the amount of money at the city's disposal, in hopes of financing both projects before Strickland leaves office at the end of this year. … If this proposed deal were approved, there would be an estimated $712M in the city's pot of money to dole out for the two projects.” If the Tigers’ full plans for Liberty Stadium renovations are realized, the total price tag would be around $295M. Memphis President Bill Hardgrave on the proposal: “It's not an 'or' situation. It's an 'and' situation. That's what it was supposed to be from Day One. We hope it stays that way.” More. (link)

ESPN Chairman Jimmy Pitaro during last week’s inaugural IMG Summit in London intimated that it was critical for ESPN to secure an NBA rights deal and noted that any agreement would likely have a direct-to-consumer component. “We’ve been very clear on one thing, which is this idea of parallel paths. We’re invested in direct-to-consumer, and ESPN+ is well ahead of where we thought it’d be at this point. We’re at over 25M subscribers, which is great. At the same time, when we acquire rights, we acquire rights for multiple platforms, and most of these deals are still led by the linear component. If you were to talk to any commissioner, whether a professional league or a conference, they will tell you that they prioritize linear because of the exposure and the reach. … I don’t see that changing, at least over the next several years.” (link)
