Yahoo’s Ross Dellenger explores the idea of the Mountain West and “Pac-2” creating a two-conference system in which teams can be promoted and relegated ala European soccer for football and possibly other sports. One Group of 5 AD tells Dellenger: “It’s kind of brilliant. The reason it wouldn’t happen is that people wouldn’t enter into something if they have the risk of losing something big [like being relegated]. But the economics could make sense.” Dellenger explains that while the concept is just one of many ideas being floated, the “conferences, if kept separate and recognized as such by both the NCAA and College Football Playoff, would “retain the millions of dollars in assets in existence within the Pac-12, including at least $50M in NCAA tournament basketball shares,” retain AQ spots in NCAA championship tournaments for each league’s champion in all sports except football,” and “retain revenue distribution from the CFP for each league (a real question).” Dellenger provides lots more in the way of details but in regards to whether the leagues would actually do it, one source with knowledge of discussions between the leagues says: “Everything is on the table. We’re looking at a lot of options. This one included.” (link)

U.S. Senator Ted Cruz (R-TX) believes it’s “60-40” that Congress will pass some sort of NIL legislation, and Yahoo’s Ross Dellenger reports a “full-throated applause erupted from his audience (at LEAD1’s fall meeting),” which consisted of more than 75 FBS ADs. Minutes later, Senator Chris Murphy (D-CT) remarked: “The changes are not 60-40. They are less than 50-50 that Congress does something comprehensive in the short term.” Cruz himself acknowledged that while he’s optimistic, “I don’t want to underestimate the challenges. That 40 [percent in the 60-40] is real. I’m optimistic because I think the need is urgent. But we also have a dynamic where there are real, meaningful partisan divides. That being said, we can overcome them.” Lawmakers say the main sticking points are legal protections for the NCAA (GOP generally for, Democrats generally against) and the classification of student-athletes as employees (Democrats generally for, GOP generally against). Murphy to the ADs on what he believes is coming: “The clock is ticking. The appellate courts and the Supreme Court are going to strike down the existing system and paradigm sooner rather than later. I think it’s going to be up to the folks in this room to really lead on reform. Right now, this is not a priority issue in Congress.” (link)

More from U.S. Senator Chris Murphy at LEAD1’s annual fall meeting: “I don’t think the NCAA or the conferences have shown that they have the students’ best interests at heart, and so I’m not interested in giving power back to those entities. I think that would be a big mistake. Neither am I interested in pulling back the rights of students.” Murphy also explained he believes the solution is best figured out via a “direct conversation” between student-athletes and schools/conferences and the NCAA. “It doesn’t have to be a labor union like the Teamsters, but the idea that we find a means to step out of the way and have students speak for themselves in conversation with their employer – and you might disagree, but I think it feels and smells and sounds a lot like employment at the highest level of the sport – is I think increasingly attractive to me as a potential way to move forward here.” In addition, Murphy believes the industry should be more “forward-thinking” in how it approaches revenue sharing and doesn’t agree with the argument that it would be too complicated. “I don’t buy that, that’s an excuse for all of the money to be continually captured by the adults and none of it to be shared.” More from Murphy via CBS’ Dennis Dodd. Even more from the LEAD1 fall meeting, where U.S. Senator Joe Manchin (D-WV) remarked: “You might not like this one, but the Pell Grants – most student-athletes today come from challenged areas and they qualify for Pell, right? All the athletic departments use it. Well, we need that money to help kids who have very little chance of getting an education. … I think that if there's so much money in the athletic departments and there's so much money coming in, you should at least pay for the kid's education. You shouldn't have the federal government with the Pell Grants paying for it.” Manchin also voiced his displeasure with the transfer portal: “Option B is getting an education. That should be Option A. … First of all, I'm probably never going to graduate because I'm flip-flopping back and forth. And next of all, no one's going to be able to develop my skills.” And on collectives:” I've got to be honest with you: I just think they're frustrated athletes that didn't play much or didn't get a scholarship and they made a lot of money and now they want to be in the game.” Also from Manchin: “Should student-athletes be employees? Jesus Criminy, are you crazy?. You want to make a kid an employee of a school because of their athletic scholarship?” (link)

USC has suspended Orange County Register and Southern California News Group beat writer Luca Evans from team access for two weeks after Football HC Lincoln Riley took exception to a story in which Evans wrote about a conversation two players had while preparing to talk with the media. USC contends that Evans violated its policy prohibiting reporting on anything outside of media availabilities in the practice facility. The SCNG believes the suspension is an overreaction, and has sent a letter asking USC to reconsider. New Trojans AD Jen Cohen replied, stating USC supports the football program’s decision. “We recognize this may be disappointing, but we hope you can understand the need to enforce our media policies as we strive to create a positive and comfortable environment for our players and coaches.” (link)

Ole Miss Football HC Lane Kiffin opens up to the Los Angeles Times’ J. Brady McCollough about his journey, both personally and professionally. Kiffin acknowledges he “fell in love” with USC during his first stint as an AC, which is ultimately why he returned after just one year at Tennessee. ”I would have done it for half [the salary they offered]. I would have walked there. And I left a premier job I was enjoying.” Kiffin goes on to talk about leading a healthier lifestyle, avoiding bread, red meat and alcohol. “I look back and go, ‘Why wasn’t I doing this all along?’ I’m not saying if I wouldn’t have drank I would still be the head coach at USC. But I would have dealt with it better.” He’s also enjoying a closer relationship with his daughter, Landry, whose group of friends “basically took Lane in,” and McCollough points out that when the Auburn job came open, the “opportunity to move up in his profession summoned Old Lane out of hibernation, and Landry could see it happening again. She and her friends put together a slideshow reminding him of all the fun they’ve had, begging him to not upend it. They put the deck on a projector in the Ole Miss conference room. Disney plans to invest $60B to expand its theme parks, cruise lines and resorts over the next decade, “almost doubling its investment in a division that provides its primary source of profits,” the Wall Street Journal’s Robbie Whelan and Alyssa Lukpat report, adding: “As more cable television customers cut the cord, Disney’s TV networks, which include ESPN, ABC, FX and others, are starting to generate less profit, forcing the company to rely on its theme parks as its primary financial engine.” (link)

Michigan State Football HC Mel Tucker has released a statement through his agent in which he asserts: “I don’t believe MSU plans to fire me because I admitted to an entirely consensual, private relationship with another adult who gave one presentation at MSU, at my behest, over two years ago. A cursory reading of the facts and timeline should cause any fair-minded person to conclude that other motives are at play. … MSU knew about the information on which it supposedly relies to end my contract since at least March 2023. Yet only after Ms. Tracy and potentially others leaked the confidential investigation report to the press, did MSU suddenly decide this same information warrants termination." Tucker goes on to remark that "Tracy expressed consent to every facet of our relationship. I look forward to one day obtaining discovery against MSU, including the Trustees and the Athletic Department, to see what they really knew and said about this matter, as well as their motives in handling the entire investigative process." Yale AD Vicky Chun tells the Boston Globe’s Ethan Fuller that most alumni remain more interested in donating to the school’s endowment or the athletic department than to NIL efforts. “I’m sure many alums are looking at the [return on investment]. And the millions that are being spent – I don’t exactly see a ROI because I still see the same teams winning. And it puts mid-majors in a precarious position because they’re trying to raise an enormous amount of money that would really benefit the programs versus going to a handful of student-athletes.” Chun likes the idea of a collective that allows a student-athlete to aid philanthropic causes while earning an income, but, per Fuller, she would prefer donors support athletic programs instead of specific players. She also worries that collectives and their leaders – not the schools – control the money from donors. “It’s very difficult, in terms of communication, when money is exchanging hands but you really don’t have direct oversight over it. It’s almost an AD’s nightmare.” Chun estimates that approximately 20% of Bulldogs student-athletes are profiting from their NIL. (link)

Extra Points publisher Matt Brown says several immigration attorneys and experts believe employment status of Dartmouth men’s basketball student-athletes would compromise international student-athletes’ ability to remain in the U.S. on a student visa. “Those athletes may not be able to obtain other visas. I’m told that a college athlete would not be eligible for an H1B visa.” Furthermore, being recognized as employees comes with a separate set of pitfalls, as one DI AD tells Brown: “You want to be employees? Fine. You won ten games and finished in 6th place. You’re all fired.” More. (link)

The Patriot League and ESPN have agreed on a multi-year extension to keep ESPN+ as the exclusive digital home for live and archived Patriot League sporting events. Patriot League Commissioner Jennifer Heppel: “The opportunity to present our live events and stories on the leading sports streaming service is important to our member institutions and fans. That’s why we are thrilled to continue our relationship with ESPN to showcase the Patriot League and our student-athletes on a platform dedicated to excellence.” (link)

U.S. District Court Judge Claudia Wilken this week will decide whether to grant class-action status to plaintiffs in the House v. NCAA case, and Kennyhertz Perry attorney Mit Winter tells On3’s Eric Prisbell: “In a large class action like House, class certification is one of the most pivotal stages of the case. With respect to the three damages classes being sought, the plaintiffs are seeking damages for the NIL opportunities that around 15,000 college athletes weren’t able to take advantage of from 2016 to the present. If those classes are certified, the NCAA and defendant conferences would be facing a potential monetary judgment in the multiple billions of dollars since antitrust damages are trebled.” Prisbell notes the requested classes include one for DI football and men’s basketball players who have competed since June 15, 2016, one for women’s basketball players from the same date and one encompassing all other sports from the same date. Winter: “When you combine all of these factors with the pending Johnson [v. NCAA] case and the NLRB proceedings, we’re looking at a situation where the entire current college athletics model could be over. If I was the NCAA and other leaders, I’d be quickly working on a new model that takes all of these pending proceedings into account.” (link)

The Toledo Blade’s David Briggs notes that details regarding the suspensions of three Bowling Green men’s hockey student-athletes as well as Falcons HC Ty Eigner remain scant. As of now, Briggs notes, the “most we can confidently share comes from the notice BG [AD] Derek van der Merwe delivered to Eigner on Monday, obtained through an open-records request. It said the coach’s leave is ‘pending a review of allegations of hazing involving hockey team members posing a substantial risk of serious physical harm to other players.’” Still, Briggs writes: “Give Bowling Green credit for getting out in front of the story, appreciating what most institutions don’t: the cover-up is worse than the (alleged) crime. BG is taking the allegations seriously, the fate of its proud hockey program be damned. Its priorities are in order.” That said, he adds: “When the investigation is complete, it will not just be Eigner who has to answer for the findings. It will be the highest levels of university leadership. (link)

In soccer, Leo Messi is tapping his 488M Instagram followers to boost not only MLS but Apple, the world’s most valuable company. In music, Taylor Swift’s relatively meager 272M IG fans are helping her cut out movie studios as she puts out a concert doc that will only further her reputation as a one-woman economy.” Feldman notes that while social media was meant to democratize influences – which it has to a certain extent – it also enables “our biggest icons to become global, omnipresent forces.” At the same time, conferences are “forming increasingly irrational alliances in a mad scramble for cash and airtime, fearful of fading into irrelevance. SUNY Morrisville (DIII) broke with tradition by not asking Boise State’s permission before installing a non-green football field, per Sportico’s Daniel Libit, who notes the Broncos in 2008 filed for a federal trademark of its blue turf that it was granted a few years later. Though the mark specifically refers to use of “the color blue,” Boise State, per Libit, has also asserted that it owns “long-standing common-law trademark rights” for the use of “any non-green playing field in connection with an intercollegiate sporting event or exhibition.” In the past, colleges and high schools who have installed non-green playing surfaces have sought Boise’s permission. BSU’s outside trademark attorney Brad Frazer: “While Boise State has not yet opted to enforce its famous and registered blue turf trademark against any non-blue turf or other non-blue usage, a determination as to whether a non-blue usage rises to the level of trademark infringement requiring a license, enforcement or both is a case-by-case determination. Thus, it is an overstatement to say that Boise State claims a trademark right to all non-green playing surfaces, but it is true that if correct facts arose, a non-blue usage might be seen as actionable as infringing our famous color mark.” (link)

This fall, Iowa plans to begin construction of a new $20M Gymnastics and Spirit Squads Training Center. The climate-controlled practice facility will feature competition-style beams, vault runways, uneven bars and a floor-exercise space. In addition to nearly 21K-square-feet of of practice space, the facility will house locker rooms, meeting and athletic training rooms, office space and a multi-purpose room. (link)

+ The ITA announces a partnership with the ITF and WTA to bring professional opportunities to the highest ITA-ranked women players in college tennis via the ITF/WTA College Accelerator Programme. Participants will be chosen from the May 31, 2023 ITA Collegiate Tennis Singles Rankings and include the top five ranked singles players as well as the NCAA Singles champion and finalist. In total, the ITF/WTA College Accelerator Programme will award five ITF main draw wild cards to any qualifying student-athlete who is not returning to college.
