NCAA President Charlie Baker during this week’s Globe Summit in Boston explained his responsibility during this transformational time in the industry: “More than anything, it should be that I’ll find ways to create what I’d describe as common ground, and get us to the place where we make decisions before things happen as opposed to reacting and responding when something happens.” Baker also restated his position lamenting the lack of “framework” and “transparency,” adding: “it’s virtually impossible for a student-athlete or their family to know if what someone is telling them is true or not -- an agent, a rep -- and that bothers me.” (link)

The NCAA “should be worried” about how yesterday’s class certification hearing before U.S. District Court Judge Claudia Wilken played out, according to Sportico’s Michael McCann and Daniel Libit. Steve Berman and Jeffrey Kessler, attorneys for the plaintiffs in House v. NCAA, argued the thousands of student-athletes who missed out on NIL before 2021 should be included in the suit. NCAA attorney Rakesh Kilaru, per McCann and Libit, contended that if NIL had been allowed before 2021, student-athletes would have earned different amounts, leading some to remain in school rather than turn pro. For instance, based on some calculations, some college athletes could earn as much as $400K, which might have convinced them to stay. Therefore, Kilaru asserted the suit can’t be class-action since it’s impossible to know to whom it would apply. Wilken, per McCann, basically countered that she wouldn’t engage in alternate histories. Wilken is likely to issue a decision in the coming weeks. Lots more. (link, link); U.S. District Court Judge Claudia Wilken has granted class-action status in House v. NCAA for the injunctive-relief portion regarding the association’s NIL rules, per USA Today’s Steve Berkowitz. In response, the NCAA tells Berkowitz: “We expected the order and look forward to defending our rules in court as part of our continued focus on student-athletes.” (link)

The Washington Square News’ Ania Keenan of the NYU student newspaper reports on-leave NYU AD Stuart Robinson was the subject of a Title IX sexual harassment and discrimination lawsuit while the AD at SUNY New Paltz. The suit stemmed from remarks made to a former coach and failing to provide equitable resources to women’s teams and was ultimately ruled in summary judgment against the university, which paid an undisclosed amount to the plaintiff staffer. The NCAA Committee on Competitive Safeguards and Medical Aspects of Sports (CSMAS) has recommended that cannabinoids be removed from the list of NCAA banned drug classes. The committee explains the removal acknowledges the ineffectiveness of existing policy, affirms the role of the NCAA drug-testing program to address only performance-enhancing substances, and emphasizes the importance of moving toward a harm-reduction strategy that prioritizes education and support at the school level over penalties. CSMAS also approved revisions to a variety of concussion resources, including the Concussion Safety Protocol Checklist, the Concussion Safety Protocol Template and the Concussion Fact Sheets. Updates to the checklist included clarifications about stepwise approaches to return to sport, inclusion of the clinical office-based evaluation tool Sport Concussion Office Assessment Tool 6, and additional post-concussion management guidance. Finally, the committee continued to review recommendations from the NCAA Mental Health Advisory Group on how to update the NCAA Mental Health Best Practices resource and will weigh a final draft of the updated document at its December meeting. + Fitch Ratings predicts more colleges will close, merge or significantly restructure operations due to enrollment declines and market pressures such as wage growth and increases in energy costs. From a report released Wednesday: “The higher education landscape remains bifurcated. Institutions without strong brands that are located in markets with the steepest drop in college-aged population are the most vulnerable to enrollment declines. These markets also often have a multitude of public and private institutions competing vigorously for a shrinking pool of students.” The report also observes that “revenue growth prospects are relatively limited for now” at small, nonselective private colleges and some public regional universities.
