NCAA President Charlie Baker during this week’s Globe Summit in Boston explained his responsibility during this transformational time in the industry: “More than anything, it should be that I’ll find ways to create what I’d describe as common ground, and get us to the place where we make decisions before things happen as opposed to reacting and responding when something happens.” Baker also restated his position lamenting the lack of “framework” and “transparency,” adding: “it’s virtually impossible for a student-athlete or their family to know if what someone is telling them is true or not -- an agent, a rep -- and that bothers me.” (link)

The NCAA “should be worried” about how yesterday’s class certification hearing before U.S. District Court Judge Claudia Wilken played out, according to Sportico’s Michael McCann and Daniel Libit. Steve Berman and Jeffrey Kessler, attorneys for the plaintiffs in House v. NCAA, argued the thousands of student-athletes who missed out on NIL before 2021 should be included in the suit. NCAA attorney Rakesh Kilaru, per McCann and Libit, contended that if NIL had been allowed before 2021, student-athletes would have earned different amounts, leading some to remain in school rather than turn pro. For instance, based on some calculations, some college athletes could earn as much as $400K, which might have convinced them to stay. Therefore, Kilaru asserted the suit can’t be class-action since it’s impossible to know to whom it would apply. Wilken, per McCann, basically countered that she wouldn’t engage in alternate histories. Wilken is likely to issue a decision in the coming weeks. Lots more. (link, link)

More from yesterday’s media call with Washington State and Oregon State leaders, during which Cougars AD Pat Chun acknowledged that moving forward as a two-team league for the next two seasons may sound unrealistic but noted: “If you had asked me how realistic would it have been a few months ago that the Pac-12 dissolved, or the membership as we knew it, you might get the same answer. We’re just trying to keep as many options open as possible. We’re trying to make sure that we’re positioned correctly and we’ll tackle those options at the appropriate time.” Chun and Beavers AD Scott Barnes acknowledged the possibility of a promotion/relegation model with Chun clarifying: “I’ve said it over and over, Oregon State and Washington State would not be subject to relegation…because I don’t see a model where two Top-25 programs would be relegated.” Barnes also noted that conference affiliation for 2024-25 will need to be made this fall in order to fill out schedules for all sports. “We can put schedules together as late as late fall. We don’t want to wait that long. We want to move as quickly as we can in an informed fashion, as we’ve discussed, making sure we have all the details." (link)

UTSA is proposing a student fee increase of $1.50 per credit hour each year for five years beginning with the spring 2024 semester, per the San Antonio Express-News’ Greg Luca, who reports the current charge per credit hour is $20. If the proposal is accepted the student fee would total $27.50 for the 2027-28 academic year and beyond, meaning a full-time student would pay $660 annually in 2027-28 compared to the current $480, and the athletic department would receive roughly $5M in additional revenue each year. Roadrunners AD Lisa Campos: “To remain competitive, grow in all sports and keep the momentum going, we’re seeking additional donors, ticket holders, fans and sponsors. Student fees are also essential to growing our programs and covering rising expenses.” Luca notes UTSA’s athletics fees generated $14.05M for the department during the 2021-22 academic year, ranking fourth among eight reporting schools in the AAC. USC Football HC Lincoln Riley released the following statement concerning the suspended credentials of Orange County Register reporter Luca Evans: “Last night, I received a call from Luca Evans, and we had a very candid and productive conversation. We agreed that we both could have handled the situation differently. Temple AD Arthur Johnson says one of his two biggest priorities is ensuring the athletic department is aligned with the university. “Our young people spend more time on campus than they do with us. They need to participate in the ecosystem.” Johnson also tells the Philadelphia Tribune’s Marco Cerino: “We got to win more. I think at a time where we can really help the university in everything. For every one of our sports it's important for them to win because there's a segment or pocket of people who follow them. The better we do, the more attention we bring to the university so we serve as the front porch of the university, and that exposes people to the incredible things going on behind the scenes." (link)

Future Football…
+ Ohio has rescheduled football games against Marshall and Texas State that were originally slated for the 2020 season. The Bobcats will travel to San Marcos to take on TSU in 2027 and host Marshall in 2029. Additionally, per FBSchedules.com, Ohio and Marshall have a separate contract for a home-and-home football series that was previously scheduled to begin in 2025 in Huntington. That game will now be played in 2028. The 2027 matchup in Athens remains unchanged. (link)

+ More than 20 HBCU presidents have left their jobs since 2022, and Best Colleges’ Pamela “Safisha Nzingha” Hill cites several reasons for the trend, which include conflicts with governing boards, job demands, financial constraints and resource allocation. Former Dillard (NAIA) President Walter Kimbrough tells Hill: “The average candidate for a presidency really does not understand how hard the job is, especially in this political climate. People are sometimes too hungry to be a president without being discerning enough to know if that presidency is best for them.” More. (link)
+ Fitch Ratings predicts more colleges will close, merge or significantly restructure operations due to enrollment declines and market pressures such as wage growth and increases in energy costs. From a report released Wednesday: “The higher education landscape remains bifurcated. Institutions without strong brands that are located in markets with the steepest drop in college-aged population are the most vulnerable to enrollment declines. These markets also often have a multitude of public and private institutions competing vigorously for a shrinking pool of students.” The report also observes that “revenue growth prospects are relatively limited for now” at small, nonselective private colleges and some public regional universities. Oregon State President Jayathi Murthy and Washington State President Kirk Schulz today held a media call concerning realignment and the state of the Pac-12. Schulz remarked that the “current state of the Pac-12 conference was not a situation of our making. We refuse to let it define us." He added: “The fiscal condition of the Pac-12 conference is far from clear. ... Our two schools continue to seek financial records from the conference and are painstakingly reviewing documents to get an accurate picture of the conference's fiscal position. This is not a case of two underperforming teams being relegated. In fact, these are two of the best college football teams in the country going head-to-head this weekend at a sold-out stadium on national television. … I don't think it is going to take us months to get the full picture (of assets and liabilities, and potential partnerships). I am optimistic that in the next 30 days or so we're going to have a pretty decent idea of a lot of this and that will help our decision-making." Beavers AD Scott Barnes also joined the call and said a promotion/relegation model is "worthy of our study,” adding that he believes uneven media revenue distribution, contraction, and/or pure relegation "will take place, I think. I think that's coming." Schulz, meanwhile, went on to observe that with so many schools locked into media rights deals it's hard to imagine a disruption in football governance over the next four to five years. “Practically, we can all come up with something that would be better than the way it's done today I just don't see a great, easy pathway to get there without a major market disrupter coming in with a lot of financial resources to say let's do something different." The Chicago State Board of Trustees approved a proposal to launch a public fundraising campaign to “expand the University's athletics programming.” Fundraising will support the expansion of DI sports and the potential addition of an FCS football team. The initial goal is $4M. If approved, football could begin as early as fall 2025. The board also approved the launch of a women's triathlon program, set to begin in fall 2024. Big Ten Network analyst, CSU sports exploratory committee member Howard Griffith: “Expanding women's athletics and having a Division I football team will make such a positive impact on the community – from young aspiring athletes in the neighborhood schools to local business owners.” (link)

More from Ohio State AD Gene Smith during yesterday’s House hearing on NIL. In discussing the decision to hold Buckeyes WR Marvin Harrison, Jr. out of the College Football Playoff semifinal after he was injured, Smith remarked: “Structurally, you need to put the people in place who are the experts to make those types of decisions. My coaches are experts on the Xs and Os. Not a doctor. I’m not sure if any of you saw, but we just had a session recently on CNN with one of our former athletes [Harry Miller], who walked into our coach’s office and said he wanted to kill himself. Fortunately, we’ve empowered our coach to make sure they’re very sensitive and humanistic in those situations and listen, and then determine who’s the expert to help that individual. That’s the culture you have to create.” Meanwhile, Heitner Legal’s Darren Heitner criticized former Duke women’s lacrosse student-athlete Maddie Salamone, “who was really the impetus for the discussion shifting to athletes’ health and welfare, she doesn’t believe that there’s going to be any progress on NIL at the federal level because they can’t stay focused on NIL. This was not the time to talk about health and safety, even though it was a priority for her.” (link)

The Commercial Appeal’s Jason Munz has obtained documents that shed light on how Memphis pitched itself to the Big 12. For example, an email from President Bill Hardgrave to Big 12 Commissioner Brett Yormark dated February 28 reads: “I thought you might enjoy the letter from the Governor. With us, you will have the backing of major corporations such as FedEx and Lowe’s and of the entire state, as suggested by the Governor. I know it is an interesting time for you. … Let me know if you need anything from us.” Hardgrave also emailed Yormark two weeks later after the Tigers upset Houston to win the AAC Tournament. “Did you catch any of our AAC finals game against Houston? Up by 20 in the first half; knocked off #1 team in the country. Although the game was in Ft. Worth, our fans probably outnumbered the Houston fans — great turnout.” Hardgrave also sent a text to Baylor President/Big 12 Board of Directors Chair Linda Livingstone which read: “Since I sent you the note last Monday, the sands have shifted … We are ready to join the Big 12. We bring great basketball and football, an entire city of supporters, and key financial backers. You know we can be flexible on our share.” Livingstone replied: “Appreciate the outreach, Bill. We will continue to see how things fall out with the Pac12 and will know more about a path forward.” (link)

Athletes.org Co-Founder Jim Cavale tells On3’s Eric Prisbell that “I think revenue sharing is inevitable. And if college athletics leaders don’t figure out the best solution for athletes to share in media revenue, I think the government will figure it out for them a la Johnson [v. NCAA] and the NLRB cases.” Cavale adds: “The question is: How do those groups go separately – because they’re not going to go there together – and sit at the table together, separately, to collectively bargain certain standards of media revenue sharing, medical coverage, scholarship protections, mental health resources, et cetera? … For those categories, a standard can’t be set that’s fair and equitable for athletes if they’re not separately sitting at the table negotiating that. Right now what happens is people make decisions for them on what the best standard is. That needs to change and they need to speak into it.” Cavale says several ADs have reached out asking how they could help, and “for those folks, great, raise your hand and leave the preservation phase and jump into the AO council for college athletics leaders. Now we can get some of your feedback and thoughts to start getting your mind going on the model you know exists today versus the model that may exist tomorrow.” (link)

While it may seem like college football’s new clock rules were simply designed to sell more commercials, The Athletic’s Stewart Mandel and Seth Emerson point out that’s not the case. SEC Assoc. Commissioner Mark Womack calls the contention “completely false” but concedes there are times when commercial breaks get bunched together because the previous quarter didn’t have its full allotment. Further complicating matters, Womack points out, is that timeouts aren’t always in the TV network’s control and can be denied by officials on the field. “If there’s an interception deep into the other team’s territory, they intercept it and return it to the other team’s 15, he can say, well, that’s a change of possession, I’m not going to grant you a timeout because we’ve got momentum involved and we don’t want to stop that for a TV timeout.” Mandel and Emerson also break down the different break schedules for each network. The SEC on CBS runs four breaks of 2 minutes, 20 seconds each quarter as well as a 3:25 break at the end of the quarters. Fox’s Big 12 in-quarter breaks are 2:35 with a 2:40 end-of-quarter break. SEC games on ESPN and ESPN2 have three in-quarter breaks for the first and third quarters and four in the second and fourth. Times range from 3:05 to 3:20, while end-quarter breaks last 3:25. (link)

Alabama A&M has sent a cease-and-desist letter to the Alabama Sports Council, which oversees the Magic City Classic, asking the council to stop using the school’s branding. The Bulldogs are set to play Alabama State in the classic on October 28, and Magic City Classic Executive Director Perren King says the game will go on as planned but adds: “We were a bit caught off guard. … Clearly there’s some confusion but we are definitely working through as a group to make sure that there’s clarity sought.” AAMU is also demanding the council make all records available for inspection relating to revenue and compensation paid under a management agreement between the ASC, AAMU and ASU. Birmingham Mayor Randall Woodfin says he’s reached out to AAMU leadership and notes: “This doesn’t fit the tenor of good faith or relationships. To be clear this back and forth hurts the brand of the Classic and what we have built for more than 80 years. Alumni of both institutions want and deserve a Classic we can all be proud of.” (link)

The Wadsworth Softball Team Operations Facility – so-named in honor of the Wadsworth’s gift – will provide 12K square feet of space including new student-athlete and coaches' locker rooms, staff locker rooms, offices, training room, nutrition support, laundry room and other player development spaces. + Cincinnati announces Cincy Reigns as its official NIL Partner after the collective signed a deal with Bearcats Sports Properties through LEARFIELD. The partnership gives Cincy Reigns the ability to use official UC Athletics' logos and marks, and Bearcats AD John Cunningham says: “This is a game-changer for us in the NIL space and will enable Cincy Reigns to take its fundraising and collaboration with student-athletes to the next level as our official partner. As I have said, we need to radically accept and embrace NIL. Partnerships like this one will empower student-athletes and incentivize businesses to work with our Bearcats.” (link)
+ The SIAC (DII) has joined the ACC’s football officiating alliance that includes the ACC, Big South and OVC, CAA, Ivy League, NEC and Patriot League. The SIAC is the first conference consisting mostly of HBCUs to join a football officiating alliance. (link)
+ Columbia inks a deal with Metropolis Country Club, which will serve as a new practice and training location for the Lions’ men’s and women’s golf programs. The programs will maintain their existing relationships with Saint Andrew's Golf Club, Haworth Country Club and Sunningdale Country Club. (link)

The Disney-Charter negotiations are likely to result in “a rights fee pool that grows less than people expected, and in aggregate, best case scenario, stays flat,” Crakes Media Principal Patrick Crakes tells JohnWallStreet, adding: “Sports media economics have always obeyed power law distribution principles. It’s [going to become] even more extreme. If there was a double-digit number of properties dominating majority share of the rights fees pool before, now that figure will be in the single digits.” One possible benefactor of this splintering could be Barstool Sports, whose CEO, Erika Ayers, tells JWS: “Everybody is fighting for the [cable] deal. And that’s great if you’re the NBA, NHL or [MLB]. But everybody else needs to stop shopping at that store. There’s no more money. The funds have already been used up.” In fact, Ayers goes on to say: “We’re seeing, in the last 2.5 years, that [rights owners] who would never talk to Barstool Sports [before] are asking [if we can do something for them].” JWS observes that while partners shouldn’t expect a lot of upfront cash, “Barstool’s ability to create a funnel of new fans for a sports property is a strong selling point, one that should make it increasingly attractive to challenger and established leagues alike.” Ayers adds: “The currency isn’t going to be cash, it’s going to be fans; and also, about the [ability to monetize those fans on the] back-end.” (link)
