Sportico’s Michael McCann provides updates from Dartmouth men’s basketball student-athletes' NLRB hearing. An attorney for the university objects to the use of a “labor organization” representing the players because Dartmouth argues the players are student-athletes and not employees; therefore, the labor organization here is not acting as one.” Dartmouth’s attorney also argues that various benefits players receive (i.e., equipment, apparel, tickets to games, etc.) do not count as compensation under employment law. Meanwhile, a Dartmouth witness notes the school can recruit an athlete and dismiss the athlete for a variety of reasons. The athlete, in McCann’s words, “can then continue to receive financial aid (this to argue that playing hoops is not in exchange for compensation – that financial aid is about being a student).” Also: “Dartmouth witness trying to frame the basketball program is different from big time programs – Dartmouth players are told they must go to class, and if they need to miss practice to go to a lab, they should go to the lab. That there's no special housing. That academics are first.” The student-athletes’ lawyer asked Dartmouth witnesses about major gifts the university has received for athletics, including a substantial pledge from Boston Celtics co-owner Stephen Lewenstein, and McCann explains: “This is to argue even if the team ‘loses’ money, the team attracts millions in donations.” The players’ attorney also asks why the student manager is paid as an employee but the players are not when they're all students on the same team and they're all working for the team? Finally, the players’ attorney cites the circular logic mentioned by U.S. Supreme Court Justice Brett Kavanaugh: “You decide the players are amateurs, and then tell them you can't pay them because they're amateurs?” More from McCann. Former Northwestern Football Pat Fitzgerald has filed a $130M wrongful termination lawsuit against the school. Fitzgerald’s attorney, Dan Webb: “The fact that he was terminated based on no rational reasons or facts whatsoever, the fact that they've gone out and destroyed his reputation as one of the best football coaches in America, based on no legitimate reason or evidence, is disgraceful. It's despicable conduct on behalf of Northwestern. My client and his family are entitled to their day in court for justice." Webb also asserts Northwestern parted ways with Fitzgerald based on “no new facts, no new developments whatsoever” after an investigation found there was insufficient evidence Fitzgerald and other coaches and staff had knowledge of hazing incidents. Also from the suit: "[Wildcats AD Derrick] Gragg also stated that [NU President Michael] Schill felt Fitzgerald needed to 'take a hit' for the findings summarized in the Hickey Report. … Gragg and Graham told Fitzgerald that if he agreed to this plan, wanted the two week suspension to coincide with Fitzgerald's two-week vacation, so Fitzgerald could attend an important recruiting event on Northwestern's behalf shortly after his suspension ended." Attorneys for former Michigan State Football HC Mel Tucker have sent MSU a 106-page letter that contains “new evidence” and asserts Brenda Tracy “appears to have made a career out of misleading and manipulating people." The letter contends Tracy "manipulated a key witness," "deleted key evidence" and selectively gave transcripts to the Office of Institutional Equity. It also suggests Tracy’s motivations are financial, citing parts of alleged redacted conversations Tracy had with her assistant. Specifically, ESPN’s Pete Thamel reports Tracy wrote: "I'm filing a formal complaint with MSU. ... [My lawyer] said after that we can let him know that we want to come to an agreement then it doesn't have to go to a hearing or anything unless he wants it to." Tracy allegedly also wrote: “Money is my only recourse to make him feel like there is a punishment" and "when they do the money I should make him pay me 10k directly." More from Thamel. (link)

Tez Tales…
+ The NCAA has granted North Carolina WR Tez Walker a transfer waiver after receiving “new information” that “had not been made available by UNC previously despite the school’s multiple chances to do so.” NCAA President Charlie Baker and Board of Directors Chair/Georgia President Jere Morehead: “It is unfortunate that UNC failed to provide this important information previously. While we must be careful not to compromise a student-athlete's right to privacy when it comes to sensitive issues, we want to assure the Division I membership and everyone watching how the new transfer rules are applied, that this meets the new transfer waiver standards. UNC's behavior and decision to wage a public relations campaign is inappropriate and outside the bounds of the process UNC's own staff supported. Had the UNC staff not behaved in this fashion and submitted this information weeks ago, this entire unfortunate episode could have been avoided.” (link)
+ Tar Heels AD Bubba Cunningham disputes the characterization, noting that while UNC is happy Walker is now eligible, the “justification provided by the NCAA today is not accurate. The University submitted all necessary information and documentation as it was made available to us at the time, and we still believe Tez met all standards for the waiver in early August. It is not clear why the NCAA delayed making the correct decision then, but we are pleased to get to the appropriate resolution now.” (link)

UCF and Football HC Gus Malzahn earlier this summer agreed to a contract extension through the 2027 season. ESPN’s Pete Thamel reports Malzahn received a raise to $4M, effective July 1, and will earn $5.5M per year in 2026 and 2027. Thamel adds: “The raise and extension are part of UCF’s transition plan to the Big 12, which the school calls Mission XII.’ The new deal puts him more in line with the Big 12, as he would have entered UCF’s first in the Big 12 as the lowest-paid Power 5 coach without the adjustment. Southern Miss paid Football HC Will Hall $30K in bonuses that he didn’t earn, according to the Hattiesburg American’s Sam Sklar, who explains: “[Hall] guided the Golden Eagles to the LendingTree Bowl game last season that triggered a $20K bonus. An additional $10K was released when USM won the game 38-24 over Rice. However, according to Appendix A of Hall’s contract, he should not have been paid that money due to the team’s failure to reach an academic benchmark laid out in his contract.” Golden Eagles AD Jeremy McClain maintains it was an honest mistake. “It’s just not something we’ve dealt with before and quite honestly a clause that should no longer be in our contracts because APR has changed so much. … “We know with the transfer portal coming into play over the last few years, APR – although it’s still in use – it’s just the dynamics have changed so much. That clause is antiquated for multiple reasons and that’s why we’re trying to make the adjustment to get it resolved.” McClain says an arrangement with Hall has been made to repay the money. (link)

Iowa Football HC Kirk Ferentz is hopeful the NCAA’s new guidance on gambling infractions could lead to the reinstatement of Hawkeyes student-athlete Noah Shannon. “You would think since we had this breakthrough revelation (today) that maybe we could act on it in the next couple of days, have an emergency meeting (with) whoever's got to…rubber stamp all this stuff. … I just hope it does go through and I hope Noah gets on the field this year, because it would be so well-deserved. And then the other side of me said, ‘Could this have taken place somewhere in May, June, July? Anytime before this season actually started and somebody's life was impacted?' And you get a little upset about it. It's unfair. And I think that's the problem with bureaucracies. Now the good news is at least we're getting a response here, like somebody's alive over there and paying attention.” (link)

The Big Ten has released its football conference schedule formats for 2024-28. (link); The Inside Zone’s Matt Fortuna notes that under the “Flex Protect XVIII” model, everyone will play each other at least twice, opponents rotate no more than three times in a five-year period, and 12 protected matchups will be played annually. (link); Big Ten COO Kerry Kenny tells The Athletic’s Nicole Auerbach the league will have no 9 AM local games on the West Coast, although USC/UCLA/Oregon/Washington may play in games that kick off at 11am CT or noon ET on the road. + The AP’s Eric Olsen reports Iowa’s women’s hoops team has sold 13K season tickets, “nearly twice the previous record and 5K more than the Iowa men’s team – and every game at Carver-Hawkeye Arena will be a sellout.” Additionally, more than 47K tickets have been sold for an outdoor exhibition game against DePaul at Kinnick Stadium on October 15. “The event, called ‘Crossover at Kinnick,’ will easily break the world basketball attendance record.” (link)

+ The Charlotte Sports Foundation, which owns and operates the Duke’s Mayo Bowl, has partnered with Opendorse to create a bowl-specific marketplace to connect bowl participants with NIL opportunities. From the CSF: “Businesses and brands can use the marketplace to easily connect with athletes for participation in promotional campaigns or events. Additionally, supporters of both Duke’s Mayo Bowl teams can find, pitch and pay any player for NIL activities in one compliant platform.” (link)
