AAC Commissioner Mike Aresco believes the NCAA should outsource its enforcement operations, telling On3’s Eric Prisbell: “We’re getting sued for nonsense. College sports is not the candy store for these lawyers – that’s how they view it now. … You’ve seen some things right now where every time the NCAA turns around, some attorney general or someone in the state legislature is threatening to sue them. Then you have nothing but the balkanization of college sports, total fragmentation. In some ways, we almost are [there now]. Almost anything goes. It’s hard to enforce NIL. At some point, it almost blends into just paying players – the veneer is so thin. It is a real concern for me.” (link)

Yahoo’s Ross Dellenger chronicles SEC Commissioner Greg Sankey’s experience at the Red River Rivalry, which included selfies with fans, “S-E-C!” chants, a visit with Matthew McConaughey, a sampling of funnel cake and more. Does Sankey worry about where college sports – particularly football – are headed given the multifrontal siege closing in via NIL, employment status, et al.? “I’m not living in fear, but yes, I’m concerned.” Sankey just returned from two days of DI Council meetings and tells Dellenger he is “questioning the value of it,” noting, for example, the lack of an SEC representative on the Baseball Committee. “There is no system where that makes sense.” Sankey also argues that having a subsection of programs governing themselves does not pose a threat to smaller leagues losing their March Madness AQ status. “There is something healthy about March and non-conference scheduling in college football. The breadth has meaning. But we have to look at the governance structure. Is this the best way to do it, to put Fordham and Florida in the same room to discuss issues?” More. (link)

Big Ten Commissioner Tony Petitti discusses an array of topics with The Athletic’s Scott Dochterman, including the league’s newly released football schedules from 2024-28. Each team will play one another at least twice over the next five years, and Petitti says the “real art was the fact that they were able to salute competitive balance and tradition at the same time. … We’re having not every school (with) the same number of protected matchups. Your first instinct in scheduling based on my experience would have been to try the same structure all the way across, but that’s not what happened. That was incredibly smart because it allows you to get to the competitive balance.” Petitti also dismisses the idea that expansion will be followed by contraction: “I’ve never talked about any idea that we would ever be smaller. It just never gets discussed. The simplest way to put it is, I think the job as commissioner and the job of the staff that we have in the league office is to make sure the Big Ten is as great tomorrow as it is today. The expansions that we’ve got coming helps that, but we look at it as one league.” More from Petitti. (link)

On3’s Eric Prisbell covers the latest from the Dartmouth men’s basketball team’s hearing with the NLRB, noting the athletes' attorney, John Krupski, “called Dartmouth's arguments ‘circular’ and says the ‘self-fulfilling’ arguments ‘defy common sense.’” Krupski was also “repeatedly stressing the ‘unilateral control’ he says Dartmouth College has over the athletes. … School says amateurs can't be paid. Athletes ask why can't they be paid? Because you're an amateur. Krupski: ‘Self-imposed by college to avoid collective bargaining.’” Big Green student-athlete Cade Haskins contends that athletes agree to give NIL rights to Dartmouth without compensation, and Prisbell writes: “Through line of questioning from athletes' attorney, Dartmouth men's basketball player Cade Hawkins is now discussing the drug test consent form he signed in July to ensure that he is eligible to practice and compete during the 2023-24 school year. … Dartmouth attorney Ryan Jaziri's cross-examination of hoops player Cade Haskins: Focus on whether coaches explicitly prohibit players from taking classes that conflict with practice. Haskins says you can select a class that conflicts but ‘we'd be asked to change the class slot.’” (link)

Kansas is expected to receive a ruling in its men’s basketball infractions case tomorrow, Sports Illustrated’s Pat Forde reports, adding: “In ruling on FBI-related infractions cases involving Arizona, LSU, Louisville and North Carolina State, the IARP set a precedent of not applying sanctions that banned any of those programs from postseason play. The only school that was caught up in the federal investigation and received a postseason ban was Oklahoma State in 2021, for seemingly lesser violations that some of the other schools had committed.” This also marks the final case to be adjudicated by the IARP. The NCAA has launched its first e-learning module dedicated to sports gambling, its harms and the risks it poses to the integrity of their games. The module also covers social media harassment and NCAA rules. NCAA President Charlie Baker: "One of the first things I did when I took over as NCAA president was gather as much information as possible about sports betting on college campuses. This educational resource is directly informed by that data. We believe this new program will help protect student-athletes from the risks that come with sports wagering. The data is clear that athletes with firsthand experiences connect with current student-athletes better than any other material we could develop, so we are incredibly grateful for their participation in this effort." An Ingham County judge has granted a temporary restraining order prohibiting former Michigan State Football HC Mel Tucker and his lawyers from releasing additional text messages from Brenda Tracy’s cell phone. Specifically, the judge ordered that Tucker's legal team is barred from "releasing, possessing, using, distributing, retaining any messages, calls, text, emails, and any other data and/or information from Ahlan Alvarado's cellphone…relating in any way to...Brenda Tracy” or anyone affiliated with Tracy’s Set The Expectation organization. According to The Detroit News’ Tony Paul, neither Tucker nor his legal team participated in the hearing. (link)

Saint Louis held a ribbon-cutting ceremony for the $20M, 25K-sq-ft O'Loughlin Family Champions Center, which features a student success suite, performance nutrition center, team dining suite, basketball operations suites, student-athlete development program, technology suites and more. More spending on NIL, less on facilities. That’s Oklahoma State Football HC Mike Gundy’s stance as articulated yesterday when he remarked: “Don’t build it, put the money in the bank. Put the money in the bank and spend it on NIL. That’s just the future, and I’m not saying I agree with it. I only know the sign of the times. … Players used to want to go somewhere for shiny new facilities and new uniforms and things like that — they still want to go somewhere where they win, but they also want the other stuff. I’m going to hypothetically build a situation: if you brought in 50 of our players and said we’ll NIL you $50-60K a year cash or we can build you a new weight room and meeting room, which one do you want? They’re gonna take [the money], right? That’s what kids do nowadays. … You can’t blame them for doing it, but that’s what’s going on.” (link)

Syracuse.com’s Brent Axe asks Syracuse Football HC Dino Babers about the Orange’s midseason depth, and Babers responds: “It’s the same old thing. Depth is gone. Depth is in the transfer portal. You know how many guys we lost, you know what schools they play at. Schools like us, we’re not going to have a lot of depth because it gets bought away.” Babers goes on to cite Florida State’s use of the portal and NIL and what can happen “when you do it right.” When asked if the Orange were getting stronger in NIL capabilities, Babers said he “wasn’t going to talk about that stuff.” (link)

Meanwhile, Iowa women’s basketball star Caitlin Clark inks an NIL deal with State Farm. As part of the deal, Clark could appear in commercials, social media promotions or at events representing the company. State Farm CMO Kristyn Cook: “Sports marketing is a key part of our growth strategy, and our investment over the last several decades has shown great business impact. Welcoming Caitlin Clark to our team expands and strengthens our ability to positively impact communities, engage with audiences in meaningful ways, and reinforces our commitment to raising the visibility of women in sports.” Clark is the first college athlete to sign an NIL deal with the Good Neighbors.
