Kansas Men’s Basketball HC Bill Self and IARP investigators agreed that if Self sat out the 2022 NCAA Tournament, KU could move past the five Level I charges it was facing, The KU Hearings publisher Mike Vernon reports, noting that agreement was ultimately denied, and adding: “In the normal world, this is called a settlement. But this is the NCAA’s world. The decision to accept the agreement wasn’t up to the independent experts.” Instead, the decision was the Independent Oversight Committee’s, which opted to “deny the settlement behind closed doors,” and points out that two of the four Oversight Committee members “also happened to serve as respective chair and vice chair of the Division I Board of Directors.” At the time, KU was told the rules didn’t allow for a settlement, but Vernon states the “rules don’t mention settlements at all. It was left open to interpretation.” Lots more from Vernon, who paints a picture of internal tension and a lack of commitment from the NCAA as contributing factors to the IARP’s issues and ultimate demise. Memphis AD Laird Veatch emphasizes the importance of renovations to Simmons Bank Liberty Stadium moving forward following the Liberty Bowl: “A delay has multiple implications. Even if it’s a month- or two-delay, then we could not complete it by the (2025) season.” Veatch also explained the Tigers want to avoid an “either/or” scenario with the Memphis Grizzlies and FedEx Forum. “Candidly, it needs to be both. We gotta move it forward.” (link)

UCLA AD Martin Jarmond tells the Daily Bruin student newspaper that “we’re in a process where we’re evaluating what other Big Ten schools have. We’re looking at our resources. We’re putting together a strategic plan that hopefully will come out in the next few weeks. There’s a number of things that we’re looking at: academic support, nutrition, food, mental health resources. … It’s going to be a holistic approach that we’ve been working on, quite frankly, for a while, since June 30, 2022. So hopefully, you’ll be able to see that in a few weeks’ time. Hopefully, we can get it done and completed by the end of October, and that’s going to be exciting because that’s going to chart the course for UCLA Athletics for the next five years and beyond.” Jarmond also says the Bruins aren’t focused on adding any sports at the moment. “We’re always looking at the landscape. You’re looking at the Big Ten to see what sports they sponsor and if it makes sense, and then you’re also looking at California high school and youth sports participation. So, we’re tracking on both of those.” (link)

The ACC “didn't get as much of a basketball lift from this wave of expansion as its rivals did,” according to ESPN’s John Gasaway, who observes that over the past five seasons, Stanford, Cal and SMU “recorded an average adjusted efficiency margin of +5.58. That's a good deal weaker than what we see from soon-to-be newcomers to the Big Ten (+14.71), the Big 12 (+14.90) and the SEC (+17.58).” Gasaway also points out the trio “collectively has not won an NCAA Tournament game since 2014” while “Cal and SMU rank near the bottom of the nation's (current or soon-to-be) major conference programs in terms of performance over the past five seasons. For that matter, current ACC members like Boston College, Wake Forest, Pitt and Georgia Tech are in much the same statistical boat. Which means in a year's time the ACC will have six members that, for now, rank among the bottom 12 nationally for performance over the past five seasons.” (link)

San Diego State Men’s Basketball HC Brian Dutcher asserts during Mountain West Media Day that “the one thing I control is the narrative, and I said from the start we are a Power 5 team. I don't care what conference we're in, so if we go to the Pac-12 as it exists we're a Power 5 team in the Pac-12. If we stay in the Mountain West, we are a Power 5 team. So, I'm controlling the narrative, and that's what the narrative is. I don't care where we are. We’re Gonzaga. They’re in the WCC, they're not looked at as a mid-major, and so that we can control – the narrative. As far as college athletics, it's backwards. To not be playing regionally in every other sport other than football makes zero sense. So I'm still a believer that we can still get this right. Maybe in five years when these contracts are up and everyone's renegotiating, let's go back and play regional in everything other than football. Let football be football…and let’s get back to some kind of sanity and play regional sports.” (link)

On3’s Eric Prisbell shares his takeaways from the Dartmouth-NLRB hearing and notes that one particularly noteworthy item involves Dartmouth’s legal team espousing “that the players there are not employees because, unlike men’s basketball programs elsewhere, the Ivy League program actually loses several hundred thousand dollars per year. While they certainly didn’t say it, I couldn’t help but think the attorneys are almost conceding the athletes at those other profit-generating schools may be employees, but that athletes at Dartmouth were indeed different because the program loses money and they don’t receive athletic scholarships.” Furthermore, the university’s attorneys argued that it’s men’s basketball players are students first, athletes second. Blurring that line, though, was student-athlete Cade Haskins explaining that when practice conflicts with a class, he goes to class; however, when a game conflicts with a class, he goes to the game. USF Assoc. AD of HR Domenica Jones joins James Moore’s News & Brews Sports Biz podcast to discuss how the proposed Department of Labor increase in minimum salary thresholds could create a domino effect throughout entire athletic departments. “The biggest issue for us is the compression piece. Because now we are going to have entry level positions that are being pushed up against employees that are more experienced making similar salaries. Then those employees, should we choose to move them up, are going to be an added cost and that puts them close to their supervisors, maybe even over their supervisors in salary. And then we’re capped in some areas. We have employees who are at the highest part of their range (such as) supervisors making as much as they can – also maybe the most in our conference. So now we’re taking into consideration other universities in the American Athletic Conference and if we are going to be at the top of those salary ranges.” James Moore President of HR Solutions Julie Kniseley adds, “Don’t do anything yet. Do your analysis, know what you’re getting into, put a plan in place, and then hold on – because it is a proposal. In 2016, at the very last second [a similar proposal] got blocked by a court in Texas, and a lot of organizations had already put their plans in place… Certainly be prepared, but wait and see what the final version is going to be and when it is going to be effective.” More on what institutions can do now to prepare, the impact on existing challenges in talent retention, and more on the podcast. Nissan will continue its naming rights agreement with the Tennessee Titans for the Titans’ new stadium, according to SBJ’s Terry Lefton, who reports the deal is “not fully papered, but the commitment has been made for at least” 15 years. Lefton also notes Nissan’s original deal with the Titans did not automatically carry over to the new stadium. (link)

The national average ACT composite score dropped from 19.8 out of a possible 36 for the Class of 2022 to 19.5 for the Class of 2023, marking the sixth consecutive year the score has declined. Meanwhile, Inside Higher Ed’s Jessica Blake reports only 21% of all students met every college-readiness benchmark in math, science, reading and English, while 43% met none of the benchmarks. (link)

Oregon State AD Scott Barnes inks an extension through June 30, 2030. According to The Oregonian’s Nick Daschel the deal is worth roughly $8M, including base salary, supplemental retirement pay and bonuses. Specifically, Barnes will be paid an annual base salary of $928,836 until the contract expires. In addition, Barnes will receive monthly contributions to a supplemental retirement plan and qualified governmental excess benefit that increase the annual package each year. Barnes’ combined compensation for 2023-24 is $1.14M, and that amount increases by roughly 2.7% each year through 2030, when the combined compensation is $1.311M. Supplemental retirement pay was increased by $100K annually over the previous contract. Also, Barnes received a $100K signing bonus with the new contract and is eligible for two retention bonuses, one of $300K on June 30, 2027, and one of $225K at the contract’s end. If Barnes leaves OSU by his choosing at any point before June 30, 2029, the buyout starts at $1.5M through June 30, 2024, and is reduced to $1.25M through the same date in 2025, $950K in 2026, $650K in 2027, and $350K in 2028 or 2029. The buyout is cut in half if Barnes resigns after June 30, 2027 and there is a change of president. (link)

The Pac-12’s overpayment from Comcast will result in a $72M budget hit, according to commissioner George Kliavkoff’s court declaration in a lawsuit filed against the conference by two former executives. The Mercury News’ Jon Wilner reports: “Under penalty of perjury, Kliavkoff stated ‘the Pac-12 will (have) distributed more than $72M less than previously budgeted…to our member institutions.” Overall, distributions withheld by Comcast to offset 10 years of overpayments (2013-22) total $58M while reductions in distributions in the 2023-24 fiscal years to account for a correction in the subscriber figures total $14M. One source tells Wilner the situation “typifies 12 years of neglect,” and Wilner points out the withholding and reduction of the $72M is underway and should be off the books if Washington State and Oregon State attempt to rebuild the Pac-12 next summer. Also from Wilner: “On the matter of whether [former Commissioner Larry] Scott knew about the overpayments and hid them from Comcast, Kliavkoff stated: ‘While Plaintiffs alleged they verbally reported the Comcast overpayment issue to Scott, Cooley [LLP, which investigated the matter] did not find that claim to be credible.” (link)

Wilner also reports that in court filings for this case, Kliavkoff stated that UCLA and USC “are no longer among the member institutions represented on the Board of Directors.” Wilner: “It shows Kliavkoff, under penalty of perjury, acknowledging that announced departures to other conferences trigger removal from the Pac-12’s board – exactly the point Washington State and Oregon State are arguing in their lawsuit.” Meanwhile, Wilner points out that the day after Colorado announced its departure, Pac-12 general counsel Scott Petersmeyer sent Colorado’s legal officer a letter that included the following: “Chancellor DiStefano provided CU’s written notice of withdrawal to Pac-12 Commissioner George Kliavkoff on July 27, 2023. Under Section CB 2-3 of the Pac-12’s Constitution and Bylaws, Chancellor DiStefano and CU’s representation on the Pac-12’s Board of Directors automatically ceases effective immediately, and CU no longer has the right to vote on any matter before the Board.” The Pac-12 declined to comment. Sportico’s Daniel Libit observes that Big Ten Commissioner Tony Petitti “has shown much less interest in, if outright indifference to, [former Commissioner Kevin] Warren’s view of a more top-down organization that comported itself like a billion-dollar corporation” in favor of a more member-led model like that overseen by previous longtime commissioner, Jim Delany. Petitti: “It’s not any one person’s old vision or new vision. It’s what is best for student-athletes right now against the backdrop of incredible innovation.” Petitti, Libit continues, has “leaned heavily” on Delany, who remains on the Big Ten payroll as an advisor, and “Delany’s renewed influence at the Big Ten, sources say, has manifested in both his day-to-day interactions with Petitti, as well as a number of key personnel moves and strategic emphases.” Lots more, including this stat: Delany's bonus for the conference's 2015 media rights deal may end up being roughly $28M in total. Delany, who has received $2.97M in bonus compensation each of the last four years, earns more now than he did while serving as commissioner. (link, link)

Ohio State AD Gene Smith talks about the importance of student-athlete development: “When I first got here in ‘05, one of the first things I went to was our scholar-athlete banquet. We had 324 student-athletes and no Black football players. And that really pissed me off. We had 1,000 athletes, we only had 324 who were 3.0 [GPA] student-athletes and we had no Black football players. So, I went through the process of continuing to learn like any transition in leadership should do, but then I was very authoritative that we were going to recruit talent, but also academic talent and character. The behavioral issues that we used to have – we used to wake up on Sunday morning and there’d be five players on the front page who just got arrested. That’s not happening now. Because our coaches bought in. Last year we had 765 student-athletes recognized in our scholar-athlete deal.” Smith also believes there will be more concrete guardrails around NIL that will will crystallize by January but notes the landscape will continue to change and “we have to embrace it. Who knows what it’s going to be two, three years from now, but I do see down the road that we’re just going to have a different model. We’ve got too many lawsuits, and we’re going to lose them. In my 39 years in this business, I only remember one that we won.” Full interview. (link)

McCowan will also oversee 2-3 additional sports, handle oversight of DEI matters, strategic planning efforts, membership initiatives and NCAA national matters. She will serve in a supervisory role in regards to pertinent office operations including internal and business affairs, human resources, finance operations, office management, sport administration and all championships. Allstate Sugar Bowl Committee leaders yesterday told a gathering of roughly 250 New Orleans civic and business leaders that without increased financial support from the city's business community, the Sugar Bowl could lose its spot as a regular host of College Football Playoff games, including the national championship, the Times-Picayune’s Stephanie Riegel reports. Sugar Bowl Committee CEO Jeff Hundley noted that the expanded format means more cities will be vying for spots, many with deep pockets, shiny new stadiums and bid packages of cash, revenue-sharing deals and other incentives. As it stands now, Hundley says New Orleans “can’t currently compete,” and Riegel notes the Sugar Bowl currently has over $65M in reserves but has been spending that down over the past decade. Hundley didn’t commit to how much money would be needed but said that he is targeting an additional $1M a year in revenue "just to stay competitive.” (link)

St. John’s Men’s Basketball HC Rick Pitino is working to host Duke in a men’s basketball matchup at Arthur Ashe Stadium during the 2024-25 season. Pitino: “We’re making the schedule as good as it can be. Playing in the Garden eight or 10 times is important.” Pitino also says St. John’s has plans for a new $235M on-campus practice facility to be built. “I’m not sure it’ll be done during my tenure or not. They say ground is going to be broken this spring.” (link)

The Evanston Land Use Commission unanimously voted in favor of stadium renovations at Northwestern's Ryan Field but denied the school's request to hold six public concerts there. Commission Chair Matt Rodgers was unconvinced by Northwestern’s argument that it needed the concerts to make the project viable, calling the claim “somewhat laughable." The decision, though, is advisory only, and the Evanston City Council could still back the project anyway. (link)

In recent years, there has been a significant shift in college athletics from player-focused athletic facilities to a more comprehensive approach centered around Arena, Stadium, and Entertainment Districts (ASED) projects. Recognizing this trend and seeing success firsthand in the professional sports category, universities are embracing this concept. A few examples are CYTown at Iowa State University, The Gateway District at the University of Kansas and Wake Forest University’s Deacon Blvd.

4. Recruitment and Branding Opportunities: ASED projects are powerful tools for attracting top-tier student-athletes and enhancing a university's brand. Impressive facilities and an exciting fan atmosphere can set a school apart from its competitors.
The shift from athletic-specific player facilities to ASED projects in college athletics represents a strategic response to changing fan expectations and the desire to create vibrant, multifaceted destinations. These projects aim to provide not only a memorable game-day experience but also a year-round entertainment and community hub, benefitting universities and their surrounding areas in numerous ways.
