NCAA President Baker asserts in an op-ed for The Athletic that “for too long, rules meant to govern and protect one generation of student-athletes have been broadly applied to a generation whose needs and priorities have shifted dramatically.” Baker outlines several initiatives the NCAA has recently undertaken to support student-athletes over the past year, including the creation of health insurance and degree completion funds, scholarship protections, and academic counseling, financial literacy and career preparation requirements. Baker also cites steps taken by the the DI Council this month to create “a more transparent, student-athlete-centric NIL marketplace” and adds: “While we can – and are – adapting the NCAA, we can’t expand our own legal authority. Our new NIL bylaw proposals will improve outcomes for student-athletes in an uncertain environment, but there is opportunity to do more. … Schools, conferences and the NCAA are exploring ways to expand the benefits we provide to student-athletes. However, to fully pursue this priority, we need Congress to affirm that student-athletes are not employees. Without that action, courts may implement one-size-fits-all mandates that require all student-athletes across all sports and all divisions receive identical benefits,” which Baker adds would be “untenable.” Full op-ed. “Are we going to have Congress-run college sports?” That’s what AAC Commissioner Mike Aresco would like to know, remarking to On3’s Eric Prisbell: “Are they going to layer on a bunch of things that we don’t really want, and require us to do things that we don’t want to do or can’t afford to do as part of a bill?” Aresco also tells Prisbell his biggest issue with NIL in its current form is the way collectives operate. He specifically cites the Utah-focused Crimson Collective’s recent deal to lease a Dodge Ram to every scholarship football student-athlete. “The whole thing is absurd. It’s great that the kids will have a truck to drive for the next few years. Some of it, you can’t get too worked up over. Everything adapts. And we’ll have to adapt to this. But I hate to see the professionalization of college sports because these are just kids. They’re 18 years old or 19 years old. To some extent, you have to earn this. … You could argue that NIL – we knew it would turn into this. That’s why there was no NIL for many years. Everybody could see what it might turn into. It’s turned into pay-for-play and has nothing to do with NIL.” (link)

Discussions about VCU adding football arose during a recent board meeting, but President Michael Rao remains opposed to the idea on the grounds that it would cost $200M to start and add $1K to student fees, which, at $1,100 already accounted for 57% of the department’s FY22 revenue. Even with that money, Rao points out that football teams without major TV contracts often operate at a loss. Rao says to consider a football team, VCU needs a high-profile conference and population growth higher than what Richmond is experiencing. (link)

SBJ’s John Ourand goes a little deeper on the tightening of the media rights landscape, noting that “it’s not a bursting sports rights bubble that cynics have been predicting for the past three decades. But as consumers continue to drop their pay-TV subscriptions and move toward streaming services, media companies have started giving these deals a lot more scrutiny.” For example, Ourand points out that “when Amazon was negotiating for Big Ten and Pac-12 rights, it wanted packages of programming that it could stream exclusively on specific nights. Think of the way it holds the exclusive rights to the NFL’s Thursday night games. Apple, on the other hand, wants to control everything on a global basis and negotiates the types of deals where leagues and conferences share in the risk. As part of the Pac-12 deal that it negotiated, Apple would have held all global rights to that conference.” Outside of the NFL, NBA and Power 4 conferences, Ourand notes the “next tier of sports rights will be dependent on timing” and points out Turner will likely factor into the College Football Playoff discussion only if it doesn’t retain its NBA rights. Meanwhile, the “bottom rung of sports rights is the one that will see rights fee money shrink considerably.” More. (link)

“It is looking ever likelier that ESPN…goes direct to consumer in 2025,” per the New York Post’s Andrew Marchand, who adds: “We have reported for a long time that it would happen by 2026 at the latest, pointing to 2025 as very possible. Disney is narrowing that down; if you are placing bets, go with 2025. As we have discussed many times in this newsletter, the No. 1 way you win in media is by being the best at distribution. This dates back to the printing press. … There are clear leaders in distribution with companies like Apple and Amazon being among the digital kings. ESPN on Apple would allow it to be preinstalled on all Apple devices around the world and could become a default app on the company’s phones, iPads and computers, while also being able to further leverage Apple’s incredible subscription strength. This could work with many of the top digital players, including Google/YouTube and Microsoft, but Apple makes a lot of sense.” Marchand also notes Verizon and T-Mobile are among the potential partners given their ability to execute the company’s mobile strategy, which “would allow the network to be on every phone and come with service contracts.” On the other side of the equation, Marchand points out that if “Apple wants to be big players in sports on its own, it will take at least another decade — and there would be no guarantees. The same sort of equation holds true with the Verizons and T-Mobiles on the mobile side.” (link)

Saint Joseph’s will add women’s golf beginning with the fall 2024 season. The school will seek a conference partner and conduct a search for a head coach this year.(link)

The Competition Oversight Committee earlier this month was informed that women’s wrestling has exceeded the threshold of 40 sponsoring institutions to be considered for a potential transition from an emerging sport to championship-sport status. The Committee on Women’s Athletics (CWA), which oversees the emerging sports process, is “working on the various steps that must be accomplished to consider the transition, including socializing the concept among the three NCAA divisions. The CWA has indicated it may recommend during its February meeting that the three divisions introduce/sponsor legislation for possible adoption during the 2024-25 academic year (the 2025 NCAA Convention for Divisions II and III; April or June 2024 Council meetings for Division I). The CWA has acknowledged that the earliest a championship could be staged would be in winter of 2026.” The committee also approved a recommendation from the Softball Committee to use the KPI as an additional consideration during rankings and selection effective with the 2024 championship. + Texas plans to reintroduce a grass playing surface at DKR-Texas Memorial Stadium within the next few years. Longhorns AD Chris Del Conte tells the Austin American-Statesman: “I just love football played on grass. It’s as Americana as apple pie. I just think grass is where football is meant to be played.” Del Conte would like to have a natural grass playing surface installed in time for the 2026 season. (link)

The U.S. Court of Appeals for the Fourth Circuit last week rejected former McDonald’s All-American/Louisville men’s basketball commit Brian Bowen’s appeal in his RICO lawsuit against Adidas, and Sportico’s Michael McCann notes that “should Bowen petition the Supreme Court for review, some of the justices might see the case as a useful follow-up opportunity from its 2021 ruling in NCAA v. Alston to further address the legality of NCAA amateurism. Bowen’s argument that Adidas ruined his potential NBA career doesn’t work, according to Judge Allison Rushing, who wrote for the majority, “because the benefits he lost were not promised in the scholarship agreement [with Louisville].” In fact, “Bowen received everything to which his scholarship entitled him.” In his dissenting opinion, Judge Robert King asserted that Bowen was a victim of “Adidas schemers” who plotted “to target elite young talent in the basketball world.” (link)
