“It’s a fairly radical notion, but if we could find a way to reach binding agreements with our student-athletes, most of this goes away. We don’t have a mechanism to [collectively bargain] without them becoming employees. It would require a new mechanism that would recognize the rights of student-athletes to negotiate for the terms and conditions of their participation as athletes without being employees. I think it’s worth considering.” That’s Notre Dame AD Jack Swarbrick to Yahoo’s Ross Dellenger after yesterday’s NIL hearing on Capitol Hill. Ohio State AD Gene Smith follows up with Dellenger on how the model could work: “We give room, board, tuition, cost of attendance and Alston money. What you’d do is add to the scholarship model an amount of dollars for NIL.” More Swarbrick: “There is no disagreement between us and our student-athletes when we talk to them about these things. That’s the frustration here. All the same things we are talking about here they are concerned about. I’d love to be able to reach an agreement with them and some [entity] say, ‘We’re going to enforce that agreement.’” More. (link)

In 1998, Intersport launched a women’s college basketball all-star game known as the WBCA All-Star Challenge. While the event was not a success 25 years ago, Intersport Founder/President/CEO Charlie Besser is bringing it back now. Besser: “The first time around, the marketplace wasn’t ready to support an event like this. Now, women’s sports have risen to the level they should be, and it’s time to showcase all of these great players.” The Women’s College Basketball All-Star Game, produced and operated by Intersport, will be played in Cleveland on April 6, the Saturday between the Final Four and National Championship. The new event will be played at Cleveland State’s Wolstein Center and participants will likely be players whose college eligibility has expired. (link)

South Alabama Football HC Kane Wommack, who is a Southern Miss alum, took exception to a series of billboards that were placed in Mobile in recent weeks leading up to the Golden Eagles game against the Jaguars last night. Following the 55-3 Jags’ win, Wommack let the media know how he felt about the messages on the billboards: “Whoever the administrator is that made a decision to put billboards that were disrespectful for the City of Mobile and disrespectful to the University of South Alabama just needs to know that sometimes those things are great in a board meeting, but it’ll get your ass kicked on the playground. So let’s make sure that we do things the right way. And my alma mater, I think, should hold themselves to a different standard than that.” (link)

UMass Men’s Basketball HC Frank Martin on close friend & former West Virginia HC Bob Huggins during a convo with the Field of 64 crew: “He hasn’t had a drink since that day. One day he’ll speak about what transpired. It’s more complicated than the story that got out. And it’s sad. But he’s in great spirits. He’s lost weight… He’s in a great place right now.” (link)

Another Congressional hearing on NIL went down this morning on Capitol Hill, this time with the Senate Judiciary Committee, which was full of equally insightful & head-scratching comments. A number of high-profile industry reporters, including USA Today’s Steve Berkowitz & Yahoo’s Ross Dellenger were on hand for the festivities…
+ Here’s NCAA President Charlie Baker’s full written testimony. (link)
+ Sen. John Kennedy tells Baker: "You might regret asking Congress to intervene here. ... I'd be real careful about inviting Congress to micro-manage your business."
+ Sen. Ted Cruz: "Bad things will happen, I believe, if government takes over college sports."
+ Sen. Richard Blumenthal: In addition to need for national NIL standards, Congress "needs to address enforceable safety standards" for college sports.
+ Judiciary Committee ranking member Lindsey Graham says that between NIL and the transfer portal, "college football is in absolute chaos" but a federal solution "can't make it so expensive" that it affects lower budget schools in D-1 and schools in D-2 and D-3.
+ Saint Joseph’s AD Jill Bodensteiner, a witness at the hearing, asks an important question: Why are all NCAA athletes in jeopardy of becoming employees “based largely on the issues in one sport (football)"?
+ Big Ten commissioner Tony Petitti says his conference's schools are open to providing additional health and welfare benefits for athletes to receive additional benefits "directly from institutions"
+ Sen. Thom Tillis: "Congress has to get involved (in college sports) to get it right." But he asks Notre Dame AD Jack Swarbrick if he can offer model Congress can follow, and Swarbrick says he cannot.
+ Without Congressional action, Notre Dame AD Jack Swarbrick says, "We will wind up with a series of rulings that declare students as employees … and create an unsustainable difference state to state.”
+ Ole Miss collective director Walker Jones, a witness at the hearing, says collectives are responsible for 80% of NIL compensation. Roughly 20% is from brands and such.

During today’s Women’s Basketball media day, Big 12 Commissioner Brett Yormark was asked about the possibility of adding Gonzaga: “There’s nothing imminent. But I do explore all options that come to me. And if it creates value for membership — both short and long-term — I’m gonna pursue it even further. But right now, we love the makeup and composition of this conference. … We’re strategizing on what next year looks like. So there’s nothing imminent with respect to expansion.” On what the next dream scenario for Yormark would be: “Just to continue to create value where I can. When I think about our conference, we’re 27 years old. I think, in many respects, we’re a mature startup. We’re in our infancy stages. We have to explore every possibility and opportunity to continue to grow and create value for our members institutions, and that’s what my job is. … We’ve become national. That was a goal of ours, from coast to coast. We’ve doubled down on basketball for all the right reasons through expansion. I’m very bullish on our future.” (link)

+ ESPN’s Dick Vitale plans to return to the booth on November 28 for the Kentucky-Miami (FL) game in Lexington as he fights vocal cord cancer. Vitale: “I hope and pray that I can be there. I love all of you and thank all of you for your prayers. … It’s been tough, but I just say have faith and think positive.” (link)

+ South Carolina Football HC Shane Beamer has been added to the Gamecocks’ injury report as the HC broke his foot after kicking something following Saturday’s loss against Florida. (link)
+ Clemson Football HC Dabo Swinney on the expectations of the Tiger faithful: "We're at a point where If you don’t go undefeated - you are losers, you’re terrible... and that is just such a terrible mindset. And honestly, maybe we need to lose a few games and lighten up the bandwagon. Sometimes the bandwagon can get a little too full. [...] That is the one good thing about going through a little so-called adversity - you really find out who is with you and who is not.” (link)
+ Former Bowling Green/Utah/Florida/Ohio State Football HC Urban Meyer during an appearance at the Knoxville Quarterback Club last week was asked whether he would consider coaching college football again. His response: “No desire. … I never really took a day off. People, when I say that, they scratch their head. I am like I never took a day off. I had some health stuff go on. I became addicted to sleeping pills. I was just a maniac worker. … So, no. No desire.” Meyer went on to point out how difficult it is to coach in college right now: “There is nothing wrong with agents. They’re great. But when I am the head coach having to deal with a high school player that (says) meet with my agent first. I am going, ‘I want to meet with your family because you are talking about recruiting and other stuff.’” (link)

Speaking of shoe deals, the AP’s Eric Olson details how upstart shoe brands, like Volleyball startup Avoli, are using NIL to gain brand awareness, even if they aren’t making it onto the court. The product is boxed out due to department’s apparel deals, which have led some student-athletes like Texas’ Reilly Heinrich and Nebraska’s Harper Murray to switch between volleyball and basketball shoes to find what fits best for them. Avoli Co-Founder Mark Oleson: “Are they making bad volleyball shoes?. I would say what we’re doing is we’re making a very specific volleyball shoe for the female athlete, how she moves, jumps, squats, pivots, dives and how she’s basically going to live throughout her entire tournament.” Further, Co-Founder Rick Anguilla states: “With somebody like Harper Murray or any of the athletes we’ve signed to NIL deals, they’re reaching 25, 50, 100,000 people on their social media. When we start thinking about the audience, NIL is going to really impact the value of those all-school contracts long-term. If we can use athletes to bring awareness to our product, and if the product is great, we like that equation.” More. (link)
