USC files a motion to dismiss the NLRB suit that involves the Trojans, the Pac-12 & the NCAA. Here’s what you need to know from On3’s Pete Nakos: “‘Importantly, USC did not originate the phrase ‘student-athlete,’ USC’s lawyers write in the motion to dismiss. ‘The phrase provides an accurate description for the students who participate in athletic programs, has been widely used for decades, and its use is codified by Section 67450 et seq. of the California Education Code, ‘The Student Athlete Bill of Rights.’ It is nonsensical to assert that USC’s use of the term proscribed by its state law, and which is commonly used to describe students who participate in inter-collegiate athletics, is in and of itself a violation of the Act.’” (link)

More from Extra Points’ Matt Brown on the “NIL bill that never happened.” Following Senate Commerce Committee Chair/Senator Maria Cantwell’s (D-WA) statements that the committee came close to an agreement on an NIL bill last session but ultimately didn’t pass it because it could have removed HBCUs from Division I, Brown got statements from two staffers familiar with those negotiations. “The staffers told me that the previous bill discussions included “requirements that Division I schools provide a baseline of health, safety, and scholarship protections for college athletes”, not too dissimilar from the work of the NCAA Transformation Committee. Those requirements, which would have included provisions like expanded health care post-eligibility, would have increased costs, and many lower-resourced D-I schools, including HBCUs, would not have been able to afford those costs. The staffers told me that Sen. Cantwell and other Democrats examined various ways that larger budget institutions would subsidize those expenses for lower-resourced schools (potentially at the NCAA, conference, or school level). But ‘the SEC indicated they would not support that idea’, and given that many lawmakers didn’t want to directly oppose the SEC, the bill ultimately fell apart.” (link)

Michigan Football HC Jim Harbaugh denies any knowledge of the alleged sign stealing or illegal scouting situation that has the Wolverines under NCAA investigation, “I do not have any knowledge or information regarding the University of Michigan football program illegally stealing signs, nor have I directed any staff member or others to participate in an off-campus scouting assignment. I have no awareness of anyone on our staff having done that or having directed that action. No matter what program or organization I have led throughout my career, my instructions and awareness of how we scout opponents have always been firmly within the rules.” Harbaugh’s attorney, Tom Mars: “To me it is astonishing the media is reporting a NCAA investigation regarding Michigan football and as Coach Harbaugh’s lawyer I’m not even aware that there is such an investigation. The NCAA has a duty to inform me as his lawyer if they are investigating anything that might implicate Coach Harbaugh. It’s the same old story. The NCAA takes action that results in national sports news headlines about Michigan football and Coach Harbaugh yet Coach Harbaugh is prohibited from commenting. This is becoming a pattern.” (link)

Meanwhile, the University of Michigan Board of Regents has approved two locker room renovation projects, both of which will be entirely funded through athletic department gifts. The 14K square foot space at football’s Glenn E. Schembechler Hall will be expanded and gender-inclusive locker facilities for student-athletes and staff will be built. This one has a $14M price tag and Integrated Architecture will handle the design work. The 11,500 square foot locker room at the William Davidson Player Development Center, which houses practice and game-day facilities for the basketball teams, will get $10M in similar upgrades, again with the help of IA. Additionally the board voted to move forward with plans to apply for liquor licenses that could potentially allow the sale of alcohol at Crisler Center, Michigan Stadium and Yost Ice Arena by January 1. Rhode Island is taking the first step in its $82.3M facilities plan, with a new $1M video board at Meade Stadium set to be ready by mid-November. That comprehensive plan will include $42M for new east stands and press box at Meade Stadium, plus upgrades to the Tootell Aquatic Center, a new track and field facility and much more. Meade renovations are set to begin as early as 2025, with a fall 2026 completion date. AD Thorr Bjorn says URI still needs to raise $16.4M for the budget total, which will allow for baseball, soccer and softball upgrades. The remaining funds have been provided by the state’s Capital Asset Protection fund, on which Bjorn stated: “[I feel] incredible pride, incredible gratitude. I’m not sure I’ve ever had a prouder moment in terms of the entire state coming together to say, ‘This is important, and we’re gonna do it.’… The state of Rhode Island said ‘we’re giving you RICAP dollars, not bond dollars, to fix these facilities that are in desperate need of repair.’ That’s never happened before.” (link)

Tennessee AD Danny White on the progress of upgrades to Baseball’s Lindsey Nelson Stadium: “We'll have phase one ready for this season, but the remainder of the project and the bulk of the new stadium and tower will be completed by next season, the 2025 spring. But with that new facility and [Baseball HC] Tony [Vitello] and his staff, the program we're building, I'll throw our baseball program and facility and experience up against anybody in the country. Just can't wait to get all that work done." (link)

In his latest ‘Ask the AD’ segment, Kansas State boss Gene Taylor notes that he’s commonly seen on the football sidelines next to Wildcats HC Chris Klieman during games. However, that doesn’t mean the two are talking Xs & Os: “I don't think an athletic director should ever, particularly one who has never coached, sit down and talk to a coach about X's and O's, particularly during the game. I'm really cautious about talking to coaches during the game. I usually kind of wait. I'm on the sidelines most of the game, every once a while during a dead ball of some sort or timeout. When I see Chris, take his headset off and walk towards me. I figure okay, there's a conversation. A lot of times it's maybe about an officiating call. Sometimes it's just generally how we're playing or not playing. But it's never about ‘hey, how come we’re not doing this or doing that?’ Because he would look at me with like, I have two heads or something. Because he knows I don't know football very well.” (link)

The Seton Hall-focused Onward Setonia NIL effort has rolled out some of its experiential benefits structure for donors, which include opportunities like dinner with Pirates HC Shaheen Holloway before an exhibition game next week for $125 a pop, plus others that are coming online soon like an opportunity to play basketball on the Prudential Center floor before certain home games in 2023-24. Deputy AD for Revenue Generation, NIL & Strategic Initiatives Mike McBride: “Traditional fundraising is you donate X and you get these very specific benefits; we’re throwing that concept out the window and trying to create benefits that are important to the individual. For higher-end contributors it’s going to be, ‘What do you want? Do you want to have dinner with coach? Let’s have dinner with coach. Do you want to attend a practice? Let’s attend a practice. Do you want a certain player to show up for a function? Let’s figure that out.’” (link)

More from the Waco Trib on yesterday’s Title IX trial proceedings involving former Baylor/current Liberty AD Ian McCaw & former Bears FB HC Art Briles. Notably: “McCaw said the university’s Title IX coordinator had found more than 400 possible Title IX complaints in the few years prior to the Pepper Hamilton briefing. Those included cases of interpersonal violence, sexual discrimination and sexual assault, in a variety of contexts – some at home, some on campus, some with unknown perpetrators. McCaw said he couldn’t stand by the regents’ choice to blame it all on Briles. In late May 2016, McCaw resigned his executive role with Baylor and became athletic director at Liberty University in Virginia that fall.” More. (link)

U.S. Bank Stadium will be replacing its turf next February & March, leading to Minnesota Baseball having to find a new location for 15 games that were scheduled to be played indoors. Golden Gophers HC John Anderson: “I started calling coaches, saying 'find other games,' and now we're on the road for three or four weekends when we would've been home. Have you checked prices for flights lately, even the cheapest deals you can find? Flying 40-some people and all that equipment is a killer. As it is, we now have 50 games scheduled, and the Division I limit is 56.” (link)

Bethune-Cookman has opened its new on-campus football practice field. “The field was named the John L Bryan Sr. Practice Field. Mr. Bryan is an avid supporter of B-CU Wildcat athletics and recently donated $20,000 to the football and basketball programs. His donation wasn’t the first directly attributable to the practice field; that came from NBA Hall of Famer Charles Barkley in the form of a $1 million check.” (link)

SEC Commissioner Greg Sankey was on the Paul Finebaum Show today with follow-up thoughts on the Senate Judiciary Committee hearing earlier in the week: “Collectives are shifting the oversight of athletics programs away from our campuses, that's a reality. [...] Obviously, right now Washington D.C. is a challenging place given the reality in the House of Representatives and the change in speakership and the waiting to see what might be next. The international stage is new. It was already challenging to begin with and occupies a great deal of time for our nation’s leaders, and we respect all of that. But we know how important college sports is.” And though an NIL bill hasn’t made it to the floor for more serious consideration yet, Sankey notes: “That doesn’t mean that every question or every answer was exactly on point, but we do see the interest level growing and the information we’ve shared has obviously made an impact. What we need to continue doing is broadening that education and information. We’re certainly open to answering questions.” Sankey also notes the sharp increase in college football viewership on TV this season is coinciding with the Writers Guild strike, which means no new shows have hit the airwaves in weeks. Purdue AD Mike Bobinski dives into the possibilities for Phase 2 of Ross-Ade Stadium renovations which could include a north end zone revamp, expanded concourse, modernized pavilion and premium seating and a new upper deck on the east side. While $45.4M Phase 1 is still ongoing, Bobinski on the financial implications for the next phase: “It will take a significant fundraising effort to prepare for that. We’re working with architects and others right now to identify the absolute right elements to include in that phase and what our fundraising capacity will be. That’s part of the equation. We have to raise the funds necessary to do whatever we believe are the right elements, but there’s certainly more to come. Our model is we’ve got to raise every dollar we’re going to commit to this. There are no other funds arriving here to do this and when you see people that are announcing multi-hundreds of millions of dollar renovations, it’s not the same model we operate under. They’re getting support from the state, the institution and who knows where to do these things, but that’s not how we do it.” Mackey Arena has also received some upgrades, with four new court level scoreboards, a new sound system and lighting and more. UNO has introduced a new life skills development program with microcredential programs on financial literacy, NIL, DEAI training, career preparation and more; onboarded a sport psychologist and nutritionist; partnered with Student Life and Wellbeing to add a mental health therapist for athletics and much more. Dowell: “UNO’s athletic operation is admittedly modest in scale compared to other Division I athletic departments in our own state and nationally. Despite this, with innovation and collaboration, Omaha Athletics is uniquely positioned to become an industry standard in holistic care through partnerships thanks to the generous support of our philanthropic and business communities and the impactful teaching, learning and research taking place on our campus, so that all students can benefit.” (link)

The NCAA has launched an investigation into Michigan Football for allegedly scouting future opponents in-person, per Yahoo Sports’ Ross Dellenger and Dan Wetzel, who add Michigan had individuals attend future and potential College Football Playoff opponents to try and gather intel on signs to call both offensive and defensive plays. More from Dellenger and Wetzel: “Two of Michigan's opponents this season told Yahoo Sports they became aware that Michigan knew their play signs.” The Athletic’s Brendan Quinn adds: “Upon learning of the pending investigation, Michigan State initially warned the Big Ten it might consider not playing Saturday’s game out of concern for health and safety for its players, according to two sources briefed on those conversations. On Thursday morning, MSU confirmed it will play the game. From College Hockey Insider’s Mike McMahon: “Bowling Green will make an announcement later today re: the hazing investigation into the hockey program, according to multiple sources. Head coach Ty Eigner has returned to the team. More details will be announced later today, I'm told. Have confirmed that the Bowling Green Police Dept. closed its criminal investigation into the matter relatively quickly. No criminal findings were discovered. The school discovered ‘code of conduct violations’ during its investigation.” (link)

Oklahoma State Men’s Basketball HC Mike Boynton on the Kansas-IARP outcome confirmed Boynton’s program would be the only one who received a postseason ban as part of the MBB-FBI proceedings: “If somebody would call and just say, 'You know what, Coach? I get it. We did the wrong thing. That shouldn't have happened. We can't change it but I want you to at least know we acknowledge that.' Because that's all that can be done at this point. [...] I don't want Kansas to be more severely punished," he said. "I don't think the kids on their team deserve to be banned from the postseason, either. They didn't have anything to do with what happened before, either. Neither did the kids at LSU or Arizona. But none of them have been [banned from the postseason]. We were. LSU has inked Baseball HC Jay Johnson to a seven-year pact for a total of $12.55M, which makes him the second-highest paid skipper in the sport behind Vanderbilt’s Tim Corbin. Notably from The Advocate’s Wilson Alexander: “Over the life of the new contract, Johnson will make an average of $1.79 million per year before incentives. His annual compensation will increase incrementally until he earns $2 million in the final year of the deal. [...] He can earn $75,000 for reaching the College World Series — a $25,000 bump — and $200,000 for winning another national championship, among other potential postseason bonuses. The total incentive package increased to a maximum of $460,000 per year.” (link)

The Grove Collective Executive Director Walker Jones chats with On3’s Pete Nakos about his time in front of the Senate Judiciary Committee and more. On his back and forth with NCAA President Charlie Baker: “I will say that I think Gov. Baker and myself both realized we have a lot more points in common than we realized previously, in some areas. I’m happy to work with Gov. Baker and his staff on meaningful legislation and oversight. We don’t shy away from that. I told him that after the hearing. He was like, ‘It’s good to hear that you guys want rules and regulations.’ I said, ‘We’ve always said that nobody’s ever asked us.’” On the involvement of collectives in recruiting: “We don’t want to be involved in recruitment. Collectives, whatever reason they were formed 12 to 18 months ago, I can’t really speak to that. I can just tell you now that we at the TCA and other collectives really don’t have the time or resources or desire to dally in recruiting. Are there collectives out there in recruiting? Of course, there are. Is there some element of pay-to-play? Of course, there is. But there’s always been some element of pay-to-play, it just wasn’t called NIL. That wasn’t brought about by NIL or collectives. We’re at least now adding some sort of structure and model to that system. We want to leave that to the coaches and their recruiting budgets and their staff to do those things. Look, should the efficiency and the success of the collective be another recruiting point for our coaches, sure. They should be able to refer to the collective as being really efficient, really well-run and very impactful. I think there’s nothing wrong with that, as long as they don’t get into the specific recruiting piece, which I think was a problem a year ago but it’s become less and less. The transfer portal is not the pot of gold that everybody thought it was.” On the health of the industry: “So the overall health, like I said in my written testimony, is actually pretty good. And all these doomsday predictions, we’re just not seeing that yet. That’s why I would just caution all of us to take a policy here about running the epitaph of college athletics and tying it to NIL, the transfer portal or collectives. Collectives were needed because nobody else stepped up to give these athletes the ability to have structure, guidance and advice to navigate this.” More. (link)

ESPN’s Paula Lavigne reports some of the testimony and comments from the Title IX case involving former Baylor Football HC Art Briles and former AD and current Liberty AD Ian McCaw. “McCaw said the ex-chairman of the board of regents told him in May 2016 that Briles was ‘going to take the fall’ prior to the release of the findings of the sexual assault investigation that found failings campus-wide and within football. … This comes with testimony today in Waco as two sides in the Title IX/negligence trial try to establish who at Baylor knew what, when and what action did they take or not take regarding reported domestic violence incidents involving a football player. … McCaw said there were longstanding problems throughout the school and to ‘single it out on one individual and one program was irresponsible.’” (link)
