The next College Football Playoff executive director “needs to be a builder,” according to SBJ’s Abe Madkour, who explains: “They don’t need to be a dyed-in-the-wool, X’s-and-O’s tactician, but it’s a football job and they will need to know the game, and will need that credibility with conference commissioners. … They have to understand how to build a brand and the business of the CFP. That would entail marketing, sponsorship, licensing, ticketing and how to grow the CFP into a global entity.” Madkour also observes that college football is a “political environment, so relationships and a quiet, yet forceful, diplomacy will be key to success. So, add it all up and any candidate would need a very balanced skill set.” With stakeholders like Big Ten Commissioner Tony Petitti and incoming Notre Dame AD Pete Bevacaqua in place, media expertise is one area the CFP has covered, and Madkour concludes: “I would keep my eye on executives who have a diverse and broad background. Overall, it’s a big, intriguing job as the playoff expands and seeks to become an even bigger event and holiday in the consciousness of the U.S. sports fan. That opportunity doesn’t come around often.” (link)

NCAA President Charlie Baker in last week’s Senate Judiciary Committee hearing asked Congress to “codify current regulatory guidance into law by granting student-athletes special status that would affirm they are not employees,” and Sportico’s Michael McCann observes: “There’s a risk for the NCAA in making this request: Why would Congress craft a new, ‘special status’ for college athletes as non-employees if, as the NCAA has argued in court, college athletes aren’t employees under existing law? No special status would be needed – unless the athletes are, in fact, employees. … It’s a two-step dance that might cause the NCAA to trip. Expect attorneys representing college athletes to cite Baker’s testimony in written motions and during oral depositions of witnesses (potentially including Baker), conference executives and athletic directors. The NCAA, those attorneys will maintain, has now effectively conceded college athletes meet employment criteria. … One point is clear: The NCAA and its member colleges are running out of time before a massive shift occurs and a court deems potentially hundreds of thousands of college athletes employees. The NCAA banking on Congress—which doesn’t even have a Speaker of the House, is as politically divided as ever and is entering a contentious presidential election year—doesn’t seem like a wise bet. The NCAA should instead step up and change its rules.” (link)

Virginia State Senate President Pro Tempore Louise Lucas (D-18) offers some words of warning to the NCAA: “Let me remind the NCAA that they are required by their charter to follow state laws where they operate. If they continue to hold [James Madison football] hostage to a technical rule and stop them from competing in the postseason they will face a very unfriendly future from our legislature.” She adds to President Charlie Baker directly: “Since you are new, ask around about the legislative help Virginia has had to give your organization over the years. I've been in the Senate for 32 years and can think of a number of issues you all have needed help on. Virginia will go to war on this.” (link)

USA Today’s Steve Berkowitz updates previous reporting that the NLRB office in Washington informed the NCAA, Pac-12 and USC that motions for dismissal of the Los Angeles Office's complaint against them concerning college athletes' employment status were not filed in a timely manner and are therefore rejected. NCAA spokesperson Saquandra Heath says this evening: "The NCAA believes that the letter rejecting the motions was issued in error and looks forward to working with the Board." (link); USC’s response: “The National Labor Relations Board’s letter rejecting USC’s motion to dismiss appears to have been issued in error. The motion to dismiss remains properly filed with the administrative law judge and will be heard at the outset of the hearing.” (link)

Big Sky Commissioner Tom Wistrcill joins LEARFIELD University Groups EVP Mike Hamilton on From the Chair and discusses the tenure of ADs today, how his experiences on campus inform his decisions at the conference level, the increased value of FCS football and more. Wistrcill says the league had three suitors for its media rights and “ironically we picked the one that didn't offer the most money because our schools really saw the value of working with ESPN and the brand. … And we've helped grow their business tremendously, you know, out here, out west, we have tremendous fan followings in our schools.” Wistrcill continues: “So, we took advantage of our geographic location and we've had ESPN2 games. We'll have back-to-back weeks of them here in October as well where late night Saturday night football and people flip on the TV or they're in a bar somewhere on Saturday night they look up there's going to be Big Sky football on. … it's a great recruiting tool for our coaches and our schools to talk about, the national TV exposure.” More From the Chair. Teams will be allowed to use coach-to-player communication technology in non-College Football Playoff bowl games this year, NCAA National Coordinator of Officials Steve Shaw tells The Athletic’s Nicole Auerbach and Chris Vannini, who report the initiative was approved by the NCAA Rules Committee this summer. Shaw: “This has been a topic front and center of the rules committee for the last couple years. There’s a lot of momentum to opening this up. We’d love to have some really good feedback from the postseason. … The rules of the road, we’re still setting up. Do both teams have to do it? Can they use different technologies? What if one team doesn’t want to use it? Dotting the I’s and crossing the T’s is still yet to be done.” (link)

Michigan State Board of Trustees Chair Rema Vassar responds to the allegations made against her by fellow board member Brianna Scott and asserts that none of the trustees, “including the three trustees manufacturing this distraction,” have provided their cellphones to Jones Day in connection to an investigation into the leak of Brenda Tracy’s identity. Vassar also states categorically that “I had no involvement with the alleged leak and I am not aware of any Trustees knowing the identity of Brenda Tracy prior to its public dissemination. I have been cooperative and forthcoming with Jones Day’s investigation and will continue to be.” Vassar also “wholly rejects the coded language of ‘bully’ when describing me in any context. None of the assertions made regarding me and the Interim President are true. However, I did tell Trustee Scott that she should read about leadership, race and racism, and literature related to Board responsibilities. MoffettNathanson Senior Managing Director Michael Nathanson observes that ESPN’s decision to walk away from some media rights deals helped the company’s overall financials: “Maybe a more telling datapoint is ESPN Linear Networks (including International and Star India sports networks) EBIT actually grew +6% in FY 2022 to $3.3B. We see this as evidence that perhaps passing on some of the prior sports rights has helped ESPN remain more stable and even grow more than we expected. As a reminder, the list of sports rights they have either pared down or dropped entirely include [the] Big Ten, Pac-12, MLS, [UEFA] Champions League and a smaller MLB package. In addition, ESPN passed on NFL Sunday Ticket.” (link)

AAC Commissioner Mike Aresco talks College Football Playoff expansion with On3’s Eric Prisbell and says: "I'm trying to thread the needle. I fully grasp that the 6+6 is already a little bit outdated. But, hey, it's an advantage – I hate to throw away advantages. And so consequently, yeah, I'd like to negotiate something where we would have at least a 5+7 going forward, because that's the minimum." Aresco also doesn’t believe there’s “any traction” for a model in which the 12 top-ranked teams would be invited to the CFP. “You have to have automatics. Winning conference championships should matter. There's no way our group (G5s) can be left out going in – you have to be able to tell your kids you have a realistic shot." (link)

Suspended Michigan football staffer Connor Stalions purchased tickets in his own name for more than 30 games over the last three years at 11 different Big Ten schools, according to ESPN’s Pete Thamel and Mark Schlabach, who also report Stalions forwarded the tickets he bought to at least three different people in different areas of the country. “The NCAA is expected to receive video evidence this week of illegal technology used in scouting tied to tickets purchased by Stalions, according to sources. An opposing Big Ten school looked up in-stadium surveillance video from a game earlier this year, and sources said the person in the seat of the ticket purchased by Stalions held his smartphone up and appeared to film the home team's sideline the entire game. Sources confirmed to ESPN that Stalions purchased tickets on both sides of the stadium -- across from each bench -- for Ohio State's game with Penn State on Saturday.” (link)

The NLRB's Washington office has informed NCAA, Pac-12 and USC that motions for dismissal of Los Angeles Office's complaint against them concerning college athletes' employment status were not filed in a timely manner and has been therefore rejected. USA Today’s Steve Berkowitz reports USC's motion to dismiss was dated October 18, and the first round of trial hearings is scheduled to begin November 7. (link)

As the university implements changes to its admissions process, Harvard AD Erin McDermott says the Crimson are not currently contemplating specific changes to recruitment practices for student-athletes. “I’d say all of our coaches are certainly wanting to recruit as inclusive of a class and cohort as possible, so I think it’s something that they are mindful of. They are also obviously looking at academic credentials and athletic talent and all the things that will help with being a great Harvard representative.” On the topic of player retention, McDermott acknowledges the lack of athletic scholarships in the Ivy League is a significant driver but notes many athletes who step away from their teams remain enrolled at the school: “I think this is a benefit of being need-based aid for student athletes – as well as obviously general students – they can have whatever experience they want when they’re here, and there’s not the financial impact for them if they make a decision not to be on a team any longer.” More. Softball is the next women’s sport Miami (FL) “would look to add,” according to Hurricanes AD Dan Radakovich, who adds: “Now the timing, as it relates to a lot of things, is a little bit up in the air still, but it’s part of our initiatives to kind of move that along as quickly as we can.” Radakovich explains the logistics of adding a softball team are still being worked out, including where to put a stadium and how to bring in the money to launch the program. “We have some folks who are very, very interested in being benefactors of the softball program, so we’re putting proposals in front of them to get some of the dollars necessary to build a stadium and start a program. I’ve kind of done that before, so I understand the timing of how that all works. Really excited about that opportunity.” No new men’s sports are currently being considered. (link)

Niagara has to withdraw from a men’s hoops MTE at Youngstown State scheduled for next month due to NCAA rules prohibiting teams from playing in the same MTE more than once in a four-year span. The Purple Eagles previously played in a 2021 MTE hosted by the Penguins. According to Niagara AD Simon Gray, Niagara and YSU mutually agreed to invalidate the contract for this year’s multi-team event, and Niagara does not owe Youngstown State $100K, as had been stipulated in the contract. Overtime announces the creation of Overtime Select, an eight-team summer league for elite girls’ high school basketball players. Sportico’s Jacob Feldman reports the league has already signed up Aaliyah Chavez and Jasmine Davidson, the two top-ranked recruits according to HoopGurlz’s Class of 2025 ratings. College and pro stars including Paige Bueckers, Zia Cooke, Flau’jae Johnson and Breanna Stewart have signed on as advisors for the league, and Overtime CEO Dan Porter explains players will have the chance to compete in high-level matchups while also learning how to maximize their financial opportunities. “I think doing a lot of storytelling and helping athletes build their brands, especially through video…which is what we do, means it’s that much more valuable when they get to campus.” (link)

+ The U.S. sports betting handle for September is pacing 32% ahead of last year, SBJ’s Bill King reports. BetMGM CRO Matt Prevost tells King he believes streaming “clearly is the long tail of sports” even though up until now his appetite for streaming has been limited to sports that bettors can’t find elsewhere, such as table tennis. “There is incremental betting activity there that would not happen otherwise, and that return on investment is crystal clear. It is highly positive, because the prices of those streams are super cheap. But the NFL? There are a lot of ways to get that content. Is it worth it? I don’t know. We’ll see.” More. (link)
+ DraftKings has overtaken FanDuel for the overall market share lead in U.S. online gambling, according to a new study by Eilers & Krejcik Gaming, which indicates DraftKings has captured 31% of overall gross gaming revenue compared to FanDuel’s 30%. (link)
+ Social sports betting site BroThrow believes ESPN BET’s new logo is too similar to its own, and BroThrow CEO Brady Sharp says of the similarity: "The problem is it's not like we are a single hardware store in Iowa. We're in the same [business] category." The Action Network’s Darren Rovell reports that “although BroThrow had not filed with the U.S. Patent & Trademark Office by the time the ESPN Bet logo was unveiled, Sharp said the logo has been in use for at least two years.” (link)
