SEC Commissioner Greg Sankey was asked if the House v. NCAA developments from Friday night was bad news: “It certainly wasn’t good news.” (link); Sportico’s Michael McCann on key nuances of what could come next: “The NCAA can file an interlocutory appeal, meaning an appeal of a case before it is decided, to the U.S. Court of Appeals for the Ninth Circuit. Appellate courts, however, usually reject those appeals on grounds they would rather review a completed case. As the NCAA continues to lobby Congress for passage of a federal bill that would create a federal NIL standard, supply an antitrust exemption and deny employment recognition for college athletes, truly transformative legal controversies are playing out in courts and at federal agencies. Unless the NCAA attempts to settle In Re College Athlete NIL Litigation, as well as Johnson v. NCAA and NLRB petitions involving USC and Dartmouth athletes (and maybe others in the near future), it could be federal judges, rather than NCAA president Charlie Baker or conference commissioners, who decide the future of college sports.” (link)

Ahead of his meeting with Big Ten Commissioner Tony Petitti, Michigan President Santa Ono sent an email to Petitti, noting that no program wants to be in the position the Wolverines are in currently, and that he is “deeply concerned” about the allegations, adding that UM is “committed to ethics, integrity and fair play.” Further, Ono urged Petitti to let the NCAA’s investigation play out before imposing discipline. Ono shared the email with the other league chancellors and presidents. The letter, in part: "It's precisely at these times -- when all key facts are not known but others are all too comfortable offering strongly held opinions -- that it is essential for everyone to ensure that investigations are conducted fairly and that conclusions are based on what actually happened. … The reputation and livelihoods of coaches, students, and programs cannot be sacrificed in a rush to judgment, no matter how many and how loudly people protest otherwise. Due process matters. We, as would any other member of the Big10, deserve nothing less. Our students, our coaches, our program -- all are entitled to a fair, deliberate, thoughtful process. We are aware that other representatives of the Big10 are demanding that you take action now, before any meaningful investigation and full consideration of all the evidence. That is not something our conference rules permit. And we both know it is not what any other member would want if allegations were raised against their people or programs.” (link)

From The Athletic’s Nicole Auerbach & Austin Meek: “If (Big Ten Commissioner Tony) Petitti were to act against Michigan, the likeliest penalty is a head coach suspension, multiple sources within the conference said. The NCAA has moved away from penalties that punish players who were not involved in rule-breaking, and it’s hard to imagine the Big Ten would impose a postseason ban for the same reason. It is not clear what the length of a potential suspension for Harbaugh would be. School officials in Ann Arbor and elsewhere in the conference expect clarity in the coming days.” (link)

UC Davis AD Rocko DeLuca Q&As with The Daily Democrat. He covers a wide range of topics, but describes his first couple of years in the big chair: “Taking over in the midst of a pandemic was interesting. We were dealing with a lot that first year and a half. It’s been a really fruitful start. We just launched our strategic plan called Ignite, it kind of lays out our roadmap for the next five years. We’ve got all the tools and a lot of the resources available to be one of the best FCS programs in the country, collectively, and that’s not just football, but with all 25 varsity sports. USA Today’s Steve Berkowitz with the latest football coaching bonuses, including Ole Miss’ Lane Kiffin’s at $200K; Coastal Carolina’s Tim Beck with a $150K payday; Kentucky’s Mark Stoops getting $100K for bowl eligibility; Florida State’s Mike Norvell adds $100K to his pot for clinching a berth in the ACC title game; Army’s Jeff Monken gets $75K for beating Air Force; Kansas’ Lance Leipold and West Virginia’s Neal Brown each get $50K for their wins yesterday. In addition to a $50K bonus for the Beavers seventh win of the season, Oregon State HC Jonathan Smith picks up an automatic one-year extension with the added year scheduled to be worth $5.45M. The Pasadena police report that several of the items stolen from Colorado’s locker room at the Rose Bowl last week have been returned. The suspects are juveniles and the investigation is still ongoing. Earlier this week, Buffs football HC Deion Sanders: “All that stuff should be replaced. This is the Rose Bowl. They say the Granddaddy of them all, right? I’m sure Granddaddy has some money. Grandpa should have some money to give these kids.” (link)

Now live on Connect: Texas Assoc. AD for Risk Management and Compliance Services Blake Barlow joins Connect/MBSports’ Matt Banker to share his perspective from serving on the National Association for Athletics Compliance (NAAC) Board of Directors before the two discuss navigating state laws, NIL, sports wagering and mental health. When it comes to coaches asking for guidance, Barlow explains that a big part of the job is helping to sift through misinformation. “I think coaches read an article and perceive a state law to read in a certain way, and so really trying to dig into the details with them (in regards to Texas’ state NIL law, which took effect in July) to really help reiterate some of the things that it says as well as what it doesn’t say. It doesn’t necessarily give you all the protections that you might think that you’ve read in the media, for example. So, really trying to help them understand what those nuances are.” (link)

U.S. District Court Judge Claudia Wilken has granted class-action status for damages in the House v. NCAA case. USA Today's Steve Berkowitz explains: "Attorneys for the NCAA and the conferences had written in legal filings that the athletes are seeking more than $1.4 billion. The filings did not specify whether that figure takes into account the tripling of damages awards that occurs in successful antitrust cases. If it does not, then more than $4.2 billion could be at stake in the case. Specifically, the suit claims that football, men’s basketball and women’s basketball players at schools in the Power Five conferences are entitled to damages related to the use of their NIL’s during telecasts of games and that athletes in any sport at a Power Five school are entitled to damages related to social media earnings." Also notable from today's proceedings, per Boise State Asst. Professor Sam Ehrlich: "The NCAA's expert witness (testifying on the Title IX impact of revenue sharing) is excluded. ... Embattled Michigan football staffer Connor Stalions has resigned. Stalions’ attorney, Brad Beckworth, released this statement: “As he informed the school earlier today, Connor chose to resign because recent stories regarding his time with the University of Michigan have created a distraction for the team. He hopes his resignation will help the team and coaching staff focus on tomorrow’s game and the remainder of the season. Connor also wants to make it clear that, to his knowledge, neither Coach Harbaugh, nor any other coach or staff member, told anyone to break any rules or were aware of improper conduct regarding the recent allegations of advanced scouting.” (link)

More on the Big Ten’s 2024 football schedule, this time from The Athletic’s Scott Dochterman, who notes USC’s first Big Ten game being played at Michigan is both lucky and strategic. B1G COO Kerry Kenny: “It’s a great talking point to say these two historic programs are going to open up in a historic venue, and obviously, one of our TV partners will be thrilled to get that game. But we also looked at it in a couple of different points within the schedule. We felt like through the lens of both individual schedules, it was an equitable outcome in the sense that both had a similar lead-in and ramp-up to get to that game, whereas if we dropped it in other portions of the schedule, it skewed too much in favor of one team versus the other.” Kenny also explains that with the schedule being set, the league will “work collaboratively with the TV partners to understand which games are eligible to move to Friday based on the parameters that are in place, which games are non-negotiable – that they can’t leave Saturday because of the broadcast position – and the selection process. That will be over the next several weeks and hopefully not months. But something that we’re hopeful to get done here sooner than later is identify which of those games will be eligible to move to Friday.” The league will also schedule a primetime game for Sunday of Labor Day weekend, and Kenny notes: “The goal is to really capture every night of that Labor Day weekend short of the actual holiday on Monday. I think from a baseline perspective, it would be one game on Thursday, one game on Friday and then one game on Sunday in addition to the full slate on Saturday.” (link)

According to a new research note from Bank of America Global Research, ESPN “carries a value of $24B and will continue to attract potential investor interest from sports leagues, major technology companies including Apple, and telecommunications powers such as Verizon,” Front Office Sports’ Eric Fisher reports, adding: “Many of those prospective suitors for an ESPN equity partnership have already been disclosed. But the latest research provides further support for ESPN’s ability to weather crises such as layoffs, industry-wide cord-cutting, carriage battles, and a potential sale of all of Disney’s linear properties.” The note does add, however: “ESPN is still a strong business and a premier brand, but it sits at the nexus of possible major business transformation. Transitions have historically proven difficult and typically not conducive to significant growth.” (link)

Further, Disney has decided that if it gives up equity in ESPN it will do so to a league or leagues, according to the New York Times’ Kevin Draper and Benjamin Mullin, who note the company has had specific discussions with the NBA. Awful Announcing’s Andrew Bucholtz offers some analysis: “Beyond the NBA specifics, though, the most interesting thing here is that idea that Disney and ESPN executives are now only targeting leagues as equity partners. That doesn’t mean that will happen, of course: some equity searches end in a deal not being struck (and can still be valuable as a way to evaluate market interest in the company, as well as potential partners for deals not involving equity), and the report here comes with a strong ‘if they are to give up equity’ caveat. And there are particular image, content, journalism and possibly even antitrust concerns around ESPN specifically selling stakes to leagues. … So none of this is necessarily definitive. But Draper and Mullin have gotten plenty of sports business scoops in the past, and it’s certainly notable that ESPN/Disney sources are telling them leagues are now the main equity partners they’re considering.” (link)

Boise State gets an anonymous $1M donation toward future capital projects following the launch of Unbridled: The Campaign for Boise State University. The gift is the twelfth commitment of at least $1 million to the Lyle Smith Society since the philanthropic giving society started in December 2020. Nine different individuals or families have combined to make the 12 seven-figure gifts. (link)

Belmont unveils renovations to the Vince Gill Room, which has long served as the premium hospitality space during Bruins’ basketball games at the Curb Event Center. The new space is nearly double, now 5,500 square feet, with views of the court and surrounding campus landscape as well as 16 high-def TVs, a new, state-of-the-art video wall, renovated kitchen and more. Baldwin Wallace (DIII) College of Education and Health Sciences Steve Dittmore wonders whether college athletics has reached peak sport sponsorship and notes that in DI the “overall number of sports sponsored in 2021-22 (6,682) has regressed to 2016-17 levels (6,669), despite six more schools. According to EADA data, there were 352 Division I institutions in 2021-22, up from 325 in 2002-03 (according to EADA data). Those 325 schools in 2003 sponsored 6,242 sports, an average of 19.21 per institution. In 2021-22, the 352 (according to EADA data) Division I schools supported 6,682 sports, an average of 18.98 per institution.” Dittmore goes on to note that the number of sports sponsored for DI women increased each year over the “past 20 years except 2020-21 (down n = 23) and 2021-22 (down n = 1).” Meanwhile, on the DI men’s side, the “number of sports sponsored in 2021-22 (n = 2,987) was just 37 sports greater than in 2002-03, despite 27 more institutions. By comparison, there are 403 more women’s sports in the same time period.” Given those figures, Dittmore asks: “How can we believe Division I athletic directors are sincere when they talk of creating a positive experience for student-athletes while simultaneously not growing opportunities for athletes? Division I administrators appear to emphasize the revenue-producing benefits of athletics and tolerate the presence of non-revenue sports because they are required to.” More on AthleticDirectorU.
