The FCS Championship field is set. As the top eight seeds, respectively, South Dakota State, Montana, South Dakota, Idaho, Albany, Montana State, Furman and Villanova receive first-round byes. Washington State and Oregon State have received word from the NCAA that they have correctly interpreted the bylaws on conference membership requirements, paving the way for the Beavers and Cougars to operate as the so-called Pac-2 for the 2024-25 seasons, per The Mercury News’ Jon Wilner, who also reports WSU and OSU do not plan to “hoard the entirety of the Pac-12’s current-year revenue (about $420M) if they win the ongoing court fight against the 10 outbound schools for control of the conference’s governing board.” Says a source: “The notion that (WSU and OSU) would take all the money and divide it between the two — that would put everyone right back in gridlock. And the hope is to get out of this gridlock.” The Beavers and Cougars also have no plans to use the money to poach Mountain West schools but rather to “use the Pac-12 assets to fund their athletic departments at levels as close to current standards as possible for as long as possible.” (link)

More on the NCAA’s appeal of class certification in the House v. NCAA case from Kennyhertz Perry attorney Mit Winter, who points out that in addition to the three factors he previously pointed out as the basis for the appeal, the NCAA is arguing the damages would have “devastating consequences for college sports, public education, and countless student-athletes nationwide. It would divert billions of dollars away from college athletic programs and academic opportunities at a time when such funding is sorely needed, necessitating the elimination of scholarships and entire teams at most institutions. … The staggering consequences of class certification alone warrant appellate review.” Winter subsequently notes that “this argument hasn’t been successful lately.” (link)

The Knight Commission emphasized the need to adopt its recommendations for “runaway athletic spending” at its meeting in Washington, D.C., last week, and Co-Chair Arne Duncan noted: “With an influx of billions of dollars in new and uncommitted revenue through an expanded CFP format, it is time for FBS leaders to earmark at least half of those new revenues to benefit college athletes directly through new health and safety protections like a medical care trust fund. If universities, and especially university presidents in the autonomy conferences don’t act now, they will, once and for all, effectively turn over the future of their athletics programs to the courts, their media partners, and coaches’ agents.” The commission also announced the C.A.R.E. Model Conference Grant program, which will provide grants from a pool of $100K in 2024 to DI Conferences that implement the C.A.R.E. Model principles for their distribution and use of “shared athletics revenues.” The model’s principles are based on transparency, independent oversight, gender equity, broad-based sports opportunities, and financial responsibility for student-athlete, education, health and safety. Morgan State AD Dena Freeman-Patton sits down with AthleticDirectorU’s Tai M. Brown at the 2023 Women Leaders National Convention to reflect on her first year leading in Baltimore. Freeman-Patton opens up about her connection to the city and the HBCU community and shares her process for navigating career transitions and opportunities. Freeman-Patton also provides insight into making difficult decisions and crisis management after the Morgan community experienced an on-campus shooting earlier this semester. Freeman-Patton notes there really wasn’t a blueprint for her particular situation in which she had to hire a football coach – in May – right after getting hired. In all, Freeman-Patton made two more new HC hires as soon as she arrived, and on top of that, the Bears were adding two new sports in wrestling and acrobatics & tumbling. “So, I don't think that there was actually a playbook for my year one, but it did help me in trying to figure out how are we moving forward in the midst of making all of those decisions right away – figuring out where we are as a culture, where we are in our resources and things like that. … I had done it at [Cal State] Dominguez Hills (DII) and so it helped me and going forward with Morgan State.” Full interview on ADU. Washington and Washington State will continue playing the Apple Cup through 2028, The Athletic’s Chris Vannini reports. One kick at Lumen Field in Seattle plus the two on each respective campus. According to The Mercury News’ Jon Wilner, "Apple Cup games played in Seattle will be owned by the Big Ten’s media partners (Fox, NBC and CBS) as part of UW’s contract with the conference." The Inside Zone’s Matt Fortuna reports that Northwestern’s six home football games next season “will likely be played across SeatGeek Stadium in Bridgeview, the Cubs’ Wrigley Field and the Bears’ Soldier Field, with the potential for a neutral-site game as well. Northwestern played a home game at Wrigley Field in 2021 and one this season. Don’t be surprised if that number at least doubles in 2024.” Fortuna adds: “Northwestern would love to have Soldier Field for its Nov. 16 game against Ohio State next season, given that the lakefront stadium has a capacity of 61,500 — nearly 20,000 more than Wrigley and 31,500 more than SeatGeek. Soccer fans learned the hard way of a Bears policy that prohibited the MLS’ Chicago Fire from playing at Soldier Field within five days of a Bears’ home game. But the Bears also have a minority owner named Pat Ryan who happens to double as the namesake for Ryan Field, so there is confidence at Northwestern in avoiding any potential conflicts.” (link)

Razorbacks AD Hunter Yurachek: “Our team was extremely excited last night after the game when I informed them that Coach Pittman is our head coach and will be moving forward into the 2024 season. + Sportico’s Daniel Libit examines how former Indiana/Texas Tech Men’s Basketball HC Bob Knight’s son, Pat, and two business partners are managing the legendary HC’s personality rights through a for-profit entity called Knight Legacy LLC. Libit explains Knight Legacy “was created with the long-term goal of preserving—if not rehabilitating—the public image of a coach famous not just for his winning programs, but fits of rage. While the latter ultimately cost Knight his job at Indiana—and untold other professional opportunities—it also helped make him one of the most recognizable personalities in college sports history.” IP management firm CMG Worldwide’s CEO, Mark Roesler, believes Bob Knight’s NIL has significant commercial value. “It is such a crowded marketplace, you look at things that stand out. He is the most colorful college basketball coach of all time. You can look at John Wooden, but with all due respect, he was not very colorful.” In September, Knight Legacy and the National Bobblehead Hall of Fame and Museum in Milwaukee released two officially licensed Knight dolls: a $30 version featuring Knight in his familiar red sweater and a $40 version with Knight in “mid-chair-heave. The latter has now sold almost 4,000 (of 19,850 produced), making it the museum’s highest-selling bobblehead of the year. In fact, it had already reached that status prior to Knight’s passing.” More. USA Today’s Steve Berkowitz: “The NCAA and Power 5 conferences have filed a petition with 9th U.S. Circuit Court of Appeals, seeking review of district judge's decision to grant class-action status in damages portion of House/Prince antitrust lawsuit that could put at least $4.2 billion at stake at trial.” Per the filing: “The NCAA disagrees with the district court’s ruling, as NIL is highly specific and certification of vast classes comprised of student-athletes with unique, and often conflicting, interests is clearly contrary to the law. The NCAA fully supports all student-athletes profiting from their NIL and continues to increase benefits for student-athletes — including new health and well-being requirements and guaranteed academic supports for all of Division I – but absent immediate appellate review, the decision could have inequitable and devastating consequences for college sports nationwide.” More in Berkowitz’s X (Twitter) feed. Kennyhertz Perry attorney Mit Winter notes the appeal will be considered on three grounds: “1) If the grant of class status effectively ends the litigation by exerting undue pressure on defendant to settle; 2) if the appeal permits the resolution of an unsettled legal issue that will evade review; and 3) if the decision is erroneous. Notre Dame & NBC have agreed to a broadcast extension through the 2029 season that will almost assuredly keep Fighting Irish football independent. Context: “NBC Sports retains global media rights on all platforms to all Notre Dame home football games. It also allows for select games to stream exclusively on Peacock, which has been the exclusive home of one Notre Dame Football game each season since 2021. Peacock will also be the exclusive home of a new, annual documentary series on Notre Dame Football, debuting in 2024.” No deal details were released. (link)

In other media deal news, Sky Sports has acquired the rights to broadcast college football, as well as ESPN College GameDay, bowl games, select regular season hoops contests, and March Madness, in England through the 2024-25 competition seasons. Like Notre Dame-NBC, no financial details were provided. (link)

NCAA President Charlie Baker: “Yeah, I feel bad for those kids, but I also feel bad for the kids who play for a team that is eligible that would not make it,” [if James Madison got a waiver]. Baker continued: “It’s a zero-sum game. If you put more and more in, it’s not like there’s another space for more and more. Somebody else comes out, who’s qualified and isn’t on probation.” He also acknowledged that while he has “no problem with the rule as it stands” currently, the ever-changing landscape of college athletics “probably means that at this point and time we should take a look at it going forward.” (link)

James Madison fans & supporters set a ESPN College GameDay record yesterday with 26,000 on hand for the show. The previous record for a GameDay party was 18,000. (link); The Dukes went on to lose an overtime thriller to Appalachian State, which Sportico’s Michael McCann says could possibly end any threat of a lawsuit to push for JMU’s postseason access. However, McCann writes on the situation if Virginia Attorney General Jason Miyares presses forward: “Should Miyares sue, he would argue the NCAA and its member schools, which are competing businesses subject to antitrust scrutiny, have illegally conspired to exclude superior teams from playing in bowl games. The NCAA has done so on account of a probationary rule that favors inferior incumbents solely because they have been in FBS for a while and not for meritorious reasons. From that lens, the rule arguably produces a less competitive market. Weaker teams appear in the FBS postseason play, and the losers are not only the superior teams and their schools, but fans and viewers who must watch less talented squads. Expect the NCAA to seek the dismissal of any lawsuit and denigrate it as both relying on flimsy legal principles and constituting a political stunt to win over Virginia voters who are JMU fans.” (link)

Fox Sports’ Bruce Feldman on the developments of the past week that led to Michigan accepting the Big Ten’s three-game suspension of Football HC Jim Harbaugh: “Midweek, Michigan was all in to battle the Big Ten … late Wednesday night, I’m told, they got spooked. They had learned that the Big Ten had really damning evidence.” Feldman believes that given the NCAA’s ongoing investigation into the sign-stealing scandal and the ongoing probe into recruiting violations from the Covid pandemic that “It would not be surprising if Jim Harbaugh , if he is still the coach at Michigan, could be suspended for the bulk of the 2024 season, I’m told.” (link)

As we near bowl season & consider all the permutations of if we’ll need a 5-7 team or three to fill all the bowl slots, The Mercury News’ Jon Wilner reports the Pac-12 is “revisiting'' its policy of not allowing 5-7 programs to participate in the postseason. Washington State & Cal are both currently 5-6 with a game to play. Wilner: “That doesn’t mean the ban on 5-7 teams will be lifted. Nor does lifting the ban guarantee a berth for the 5-7 teams — there might not be any opportunities. But the conference is wise to reconsider its position.” (link)

This week the list is topped by Iowa HC Kirk Ferentz ($200K for Big Ten title game berth), followed by Texas HC Steve Sarkisian ($100K), Georgia Tech HC Brent Key, Missouri HC Eli Drinkwitz, UCLA HC Chip Kelly and Washington HC Kalen DeBoer (each with $50K). Oregon HC Dan Lanning added a year to his deal worth at least $9.2M, which takes him through January 31, 2030, while Kansas State HC Chris Klieman picked up an automatic one-year contract extension worth at least $6.5M and takes his deal through December, 31, 3031. USA Today’s Dan Wolken presents this week’s Misery Index, headlines with Florida State student-athlete Jordan Travis’ injury: “Rarely is watching this sport or being a fan of a team associated with actual, real life misery. It's just entertainment, after all. But for maybe the first time in a decade of doing this every week, we saw that very thing unfold Saturday at Florida State. There’s nothing snarky or funny to say about what happened to the Seminoles against North Alabama, when quarterback Jordan Travis was carted off after a run that ended with part of his lower body bent the wrong way. Though the official diagnosis had not been given Saturday night, we don’t really need one. It’s bad, and it’s almost certainly going to end his season and Florida State’s hopes of making the College Football Playoff.” Others in misery: Michigan, Auburn, USC and North Carolina. (link)
