Congrats to the Oklahoma State men’s team and the North Carolina State women’s team for winning their respective NCAA Cross Country Championships yesterday. It was the fifth title since 2012 for the Cowboys, while the Wolfpack completed a three-peat. (link, link)

USA Today’s Steve Berkowitz: “The NCAA and Power 5 conferences have filed a petition with 9th U.S. Circuit Court of Appeals, seeking review of district judge's decision to grant class-action status in damages portion of House/Prince antitrust lawsuit that could put at least $4.2 billion at stake at trial.” Per the filing: “The NCAA disagrees with the district court’s ruling, as NIL is highly specific and certification of vast classes comprised of student-athletes with unique, and often conflicting, interests is clearly contrary to the law. The NCAA fully supports all student-athletes profiting from their NIL and continues to increase benefits for student-athletes — including new health and well-being requirements and guaranteed academic supports for all of Division I – but absent immediate appellate review, the decision could have inequitable and devastating consequences for college sports nationwide.” More in Berkowitz’s X (Twitter) feed. Kennyhertz Perry attorney Mit Winter notes the appeal will be considered on three grounds: “1) If the grant of class status effectively ends the litigation by exerting undue pressure on defendant to settle; 2) if the appeal permits the resolution of an unsettled legal issue that will evade review; and 3) if the decision is erroneous. Notre Dame & NBC have agreed to a broadcast extension through the 2029 season that will almost assuredly keep Fighting Irish football independent. Context: “NBC Sports retains global media rights on all platforms to all Notre Dame home football games. It also allows for select games to stream exclusively on Peacock, which has been the exclusive home of one Notre Dame Football game each season since 2021. Peacock will also be the exclusive home of a new, annual documentary series on Notre Dame Football, debuting in 2024.” No deal details were released. (link)

In other media deal news, Sky Sports has acquired the rights to broadcast college football, as well as ESPN College GameDay, bowl games, select regular season hoops contests, and March Madness, in England through the 2024-25 competition seasons. Like Notre Dame-NBC, no financial details were provided. (link)

NCAA President Charlie Baker: “Yeah, I feel bad for those kids, but I also feel bad for the kids who play for a team that is eligible that would not make it,” [if James Madison got a waiver]. Baker continued: “It’s a zero-sum game. If you put more and more in, it’s not like there’s another space for more and more. Somebody else comes out, who’s qualified and isn’t on probation.” He also acknowledged that while he has “no problem with the rule as it stands” currently, the ever-changing landscape of college athletics “probably means that at this point and time we should take a look at it going forward.” (link)

James Madison fans & supporters set a ESPN College GameDay record yesterday with 26,000 on hand for the show. The previous record for a GameDay party was 18,000. (link); The Dukes went on to lose an overtime thriller to Appalachian State, which Sportico’s Michael McCann says could possibly end any threat of a lawsuit to push for JMU’s postseason access. However, McCann writes on the situation if Virginia Attorney General Jason Miyares presses forward: “Should Miyares sue, he would argue the NCAA and its member schools, which are competing businesses subject to antitrust scrutiny, have illegally conspired to exclude superior teams from playing in bowl games. The NCAA has done so on account of a probationary rule that favors inferior incumbents solely because they have been in FBS for a while and not for meritorious reasons. From that lens, the rule arguably produces a less competitive market. Weaker teams appear in the FBS postseason play, and the losers are not only the superior teams and their schools, but fans and viewers who must watch less talented squads. Expect the NCAA to seek the dismissal of any lawsuit and denigrate it as both relying on flimsy legal principles and constituting a political stunt to win over Virginia voters who are JMU fans.” (link)

Fox Sports’ Bruce Feldman on the developments of the past week that led to Michigan accepting the Big Ten’s three-game suspension of Football HC Jim Harbaugh: “Midweek, Michigan was all in to battle the Big Ten … late Wednesday night, I’m told, they got spooked. They had learned that the Big Ten had really damning evidence.” Feldman believes that given the NCAA’s ongoing investigation into the sign-stealing scandal and the ongoing probe into recruiting violations from the Covid pandemic that “It would not be surprising if Jim Harbaugh , if he is still the coach at Michigan, could be suspended for the bulk of the 2024 season, I’m told.” (link)

As we near bowl season & consider all the permutations of if we’ll need a 5-7 team or three to fill all the bowl slots, The Mercury News’ Jon Wilner reports the Pac-12 is “revisiting'' its policy of not allowing 5-7 programs to participate in the postseason. Washington State & Cal are both currently 5-6 with a game to play. Wilner: “That doesn’t mean the ban on 5-7 teams will be lifted. Nor does lifting the ban guarantee a berth for the 5-7 teams — there might not be any opportunities. But the conference is wise to reconsider its position.” (link)

This week the list is topped by Iowa HC Kirk Ferentz ($200K for Big Ten title game berth), followed by Texas HC Steve Sarkisian ($100K), Georgia Tech HC Brent Key, Missouri HC Eli Drinkwitz, UCLA HC Chip Kelly and Washington HC Kalen DeBoer (each with $50K). Oregon HC Dan Lanning added a year to his deal worth at least $9.2M, which takes him through January 31, 2030, while Kansas State HC Chris Klieman picked up an automatic one-year contract extension worth at least $6.5M and takes his deal through December, 31, 3031. USA Today’s Dan Wolken presents this week’s Misery Index, headlines with Florida State student-athlete Jordan Travis’ injury: “Rarely is watching this sport or being a fan of a team associated with actual, real life misery. It's just entertainment, after all. But for maybe the first time in a decade of doing this every week, we saw that very thing unfold Saturday at Florida State. There’s nothing snarky or funny to say about what happened to the Seminoles against North Alabama, when quarterback Jordan Travis was carted off after a run that ended with part of his lower body bent the wrong way. Though the official diagnosis had not been given Saturday night, we don’t really need one. It’s bad, and it’s almost certainly going to end his season and Florida State’s hopes of making the College Football Playoff.” Others in misery: Michigan, Auburn, USC and North Carolina. (link)

Details of the contract extension for Kansas State AD Gene Taylor include an annual retention bonus of $250K through FY27, then $500K per year through the end of the deal in FY30. If Taylor chooses to exit before the end of FY24 he would owe the Wildcats $3M, if before the conclusion of FY25, the buyout is $2M, between 2025 & 2029 it’s $1M, which reduces to $0 in the last year of the deal. Ohio State Football hosts Minnesota today with aims of remaining unbeaten leading into next weekend’s finale at Michigan. Next year, the Buckeyes will have eight home games - two more than this season - which means increases to ticket prices. Key context from the Columbus Dispatch’s Joey Kaufman: “The pricing of the six seating zones for the general public ranges from $596 to $1,365, an increase of an average of $269 per section. It was $398 to $944 in 2023. The increase is only slightly more than when the Buckeyes last had eight home games in 2022 and prices were between $559 and $1,287.” (link)

As Mississippi State embarks on a search for a new football HC, On3’s Pete Nakos explains that a “source familiar with the situation said the Bulldog Initiative collective has seen an influx of cash in the last six months bringing the budget up to the $5M mark. That would bring the school closer to the middle of the pack in the SEC.” NFL veteran-turned-agent Trace Armstrong explains that knowing what kind of NIL war chest a school has is an increasingly important factor for coaches who are weighing which jobs to pursue. “It’s almost a mindset. If people are willing to do the things it takes to win, NIL’s going to be a factor. You just added another area that people will evaluate. Leadership, facilities, commitment to sport… It’s definitely another box to check.” On Thursday, the collective announced a group of donors is stepping up to match the next $1M in donations, part of the group’s “Winning Drive” campaign. North Carolina Central Men’s Basketball HC LeVelle Moton explains how the NIL era is teaching him patience: “I feel this transfer portal, it makes you adjust as a coach, right? So you can’t sell history to a player right now. You can’t sell banners and championships and Sam Jones and accomplishments and great education and great social life, and you can’t sell that. They do want to know how much money (you can offer)? So that’s what they’re leading with. So it’s hard. But you got to adjust. … And then when you assemble your team, you got to make sure you’re getting good characters and people that want to be here for the right reasons. Because at the end of the day, it’s bigger than them, it’s bigger than me, it’s bigger than everyone. It’s the name of that chance. And that’s North Carolina Central University.” (link)

SBJ’s John Ourand and the New York Post’s Andrew Marchand discuss ESPN’s direct-to-consumer plans, and Ourand remarks: “I would assume that it’s going to be priced high enough that they're going to want to keep people on the cable, and I would assume that ESPN's direct to consumer is going to be made available for free to cable subscribers or, if not for free, at a very small markup, so if you're within that cable bundle on you’re authenticated, then you'll be able watch that as well.” Marchand ponders whether ESPN will be able to secure local team rights as well as a digital partner, such as Verizon or T-Mobile, noting that would create a “pretty powerful package that they could provide in terms of you get all these games and then for an extra $5, extra $10 a month, you can get your local teams. … One thing that I think is overrated is the idea that there's so many people who are right now going to just leave the bundle because ESPN goes [DTC].” Marchand cites fledgling RSN numbers that prove “going it alone does not work. You need to be in a bundle of some sort, and I think that's what the leagues understand, that's what the digital players understand, that's what ESPN, Max they all understand.” Ourand goes on to wonder whether there’s an incentive for ESPN+ to retain rights to international soccer and conferences like the Ivy League, and Marchand believes there is “because they’re not big money, but they’re sticky.” (link)

Miami (FL) has launched the UStrive Leadership Program, which was created to help develop leaders within the department through a nine-month curriculum that explores leadership, communications, recruiting and hiring, resource management and sport administration, among many others. The program also features guest speakers from sports industry leaders, South Florida business leaders and UM faculty and staff. Southern Miss has received the $35M Educational Building Corporation bond approval from the Mississippi Institutions of Higher Learning Board of Trustees, which will increase the budget for the Reed Green Coliseum renovations “dramatically.” Originally budgeted for $15M the project looks closer to $43M and change, now. Adding 33K square feet, new scoreboards and sound system, expanded concourse and ADA seating options, mini suites, new training facility and practice court and “other facility improvements” are part of the scope. Geis Companies and The Landes Group, Lincoln Property Company, Oak View Group and Rock Entertainment Group were the four finalists invited by Cleveland State and its development arm Euclid Avenue Development Corp. (EADC) to submit proposals to build, at minimum, a new multi-purpose, 5K-seat arena for the university. In addition, their proposals could also include a parking garage and mixed-use district of housing and shops that were proposed as part of its $650M campus master plan unveiled last year. (link)
