Tulane officially introduced Northern Iowa AD David Harris as its new leader and acknowledged it is the second time he’s succeeding former Green Wave AD Troy Dannen. “I guess it (following Dannen again) is a little bit strange and interesting, but it’s just coincidental. I couldn’t have planned this one out, but if you look at where Tulane athletics is now, the success they’re having is certainly partnered to his leadership and we’ll be building off of that.” Harris also discussed the future of Football HC Willie Fritz, who was noncommittal yesterday when asked about his plans moving forward. Harris: “The thing that you have to do is work behind the scenes. These things don’t play out in public. For us, it’s about beginning to develop a relationship, having those conversations and figuring out what’s important to Coach Fritz and how we can go about working with the university to put the right things in place in order to retain him. … We’re not taking anything off the table at this point. We would like to make sure coach Fritz will be here until he retires. There are ongoing conversations. We would like to have that happen as soon as possible, but it will take the time that it takes.” More from Harris. (link, link)

More from the On3 staff, which caught up with dozens of NIL stakeholders to discuss the biggest challenges in the space. North Carolina AD Bubba Cunningham and Iowa Interim AD Beth Goetz have differing opinions about whether collectives should remain unaffiliated with universities, with Cunningham saying: “Universities are not prepared to bring collectives or other elements of NIL in-house. There are too many unanswered questions about employment, compensation, antitrust, Title IX and Title VII that must be considered.” Goetz, however, believes “there’s a lot of merit in considering [collectives moving in-house]. We all know there are other implications that you need to be mindful of if that happens. But I think that anytime you want to ensure that just the connectivity and conversation is happening with your external fans and donors that are donating to both. Those things now have to happen. They’re forced to happen, in a silo, as opposed to being able to have sort of these conversations that, ‘Hey, this is a part of what we do.’ And, ‘How do you want to support?’ The same thing with our student-athletes. They are engaging with our team. They are engaging with the [Iowa] Swarm [collective] team. Having everything under the same umbrella certainly has its advantages.” LEAD1 CEO Tom McMillen acknowledges the divide among ADs and attributes it to the “complexities of Title IX if they bring it in-house. They also think right now that the monkey of paying student-athletes is on the collectives’ back. Putting it in schools would be the schools’ responsibility. So some of our ADs worry that that is just going to set off another arms race.” Lots more. (link)

SBJ’s Ben Portnoy breaks down how potential revenue-sharing models might work, noting the concept can be viewed through three different lenses: athletes becoming employees, group licensing and collective bargaining. The workers’ compensation component of an employment model is particularly tricky, according to Illinois professor Michael LeRoy, who points out that student-athletes who suffer injuries during competition are often on their parents’ health insurance plans. Those plans may not cover major procedures like reconstructive knee surgery; therefore, student-athletes could qualify for workers’ comp, leading to increased long-term costs to the schools. “Workers’ comp is the iceberg underneath the tip of the iceberg.” LeRoy envisions an eventuality in which some sports could break away from the university and become an entity in which the university has a controlling stake (“Alabama Football Inc.,” for example), thereby allowing private equities or other stakeholders to raise capital to support the program. “There will come a time when it just makes financial sense for the premium football and basketball schools to incorporate, form a professional league, have employment, have a union shield themselves from antitrust — because as soon as you have a union all the antitrust problems go away. Whether the schools break away, or the NCAA accommodates them, we are almost certainly trending toward a professionalized league.” More. (link)

College Station Considerations…
+ New Texas A&M Football HC Mike Elko’s six-year deal is worth $7M annually and includes the following incentives: $1M for making the College Football Playoff; $1.5M for advancing to the CFP quarterfinals and/or winning the SEC conference title; $2M for advancing to the CFP semifinals; $2.5M for making the CFP championship game; and $3.5M for winning the national championship. Elko will also receive an additional year for accomplishing any of the postseason incentives. Other incentives include $100K for reaching the SEC Championship game, $100K for being named national coach of the year, $50K for being named SEC Coach of the Year and $50K for a multiyear APR of 960 or above. Elko’s AC/support staff pool will be $11M. Should Elko terminate the contract without cause, his buyout starts at $6.5M and declines each season. The Aggies would owe Elko 75% of his annual base salary for the remainder of his contract should the team let him go without cause. Elko is subject to a duty to mitigate. Aggies AD Ross Bjork says the $11M salary pool for AC/support staff pool is "less than what it was" under Jimbo Fisher but will be among the top eight to 10 such budgets nationally. (link)
+ Aggies AD Ross Bjork on the structure of Elko’s contract: “We know there's got to be a base salary, so that's what you see there, but then the rest of it is built off of making and earning your way through the CFP. And everybody we engaged with, you know, again, this is a little bit different shift. Not that we were trying to reset the market or couldn't really necessarily do that, but if you hire the right person and they believe in themselves and you have the resources like we have here, that contract should be what it's all about and so that's how we approached it going into it." Bjork also addressed the role the search firm played in the process, explaining that it’s their job to understand the landscape all year, not just during football season. “They understand who's movable. Coach Elko was on our list from the very beginning. And as the process unfolded, as the identity of what we really, really wanted and we thought was the right DNA of a program that wins, he obviously rose to the top. + UCLA Football HC Chip Kelly will return next season. Kelly is under contract through the 2027 campaign and will earn $6.1M next season and $6.2M in each of the following three seasons. Kelly’s buyout drops to zero on Dec. 16, 2025, per the Los Angeles Times’ Ben Bolch. (link)
+ New Mississippi State HC Jeff Lebby’s four-year deal includes a base salary of $4.51M as well as the following incentives: $50K for being named SEC Coach of the Year; $100K for being named national coach of the year, and $125K for each SEC victory, starting with the fifth conference win. Lebby can also earn $100K for appearing in the SEC Championship and $250K for winning it. Other incentives include $100K for reaching an SEC “Tier 3” bowl game; $150K for reaching the TaxSlayer, ReliaQuest, Duke’s Mayo, Las Vegas, Music City Texas or Liberty bowls; $200K for a Citrus Bowl berth; $250K for making the College Football Playoff; $350K for making the quarterfinals; $500K for making the semifinals; $750K for making the CFP title game and $1M for winning it. Alabama State breaks ground on a new golf clubhouse, which is expected to be operational by March 2024. Hornets AD Jason Cable: "This is a state-of-the-art facility that is the first of its kind in the HBCU space and is rare among all Division I programs. Our golf clubhouse and training facility will add significant value to the student-athlete experience at Alabama State. This facility will not only help improve our team and its results, but it will serve as an avenue to introduce golf to our campus and local community. Golf is a global sport that is able to transcend graduation and help many in their various career fields and social interactions far beyond their time at ASU.” (link)

Warner Bros. Discovery may be “eyeing one of [the NFL’s] distribution partners,” per JohnWallStreet, who notes that WBD CEO David Zaslav recently stated the company would be an active player in the M&A space over the next year or two, and with no new NFL rights packages slated to become available before the end of the decade, it’s possible WBD would choose that path as an entry point to the league. Fox and Paramount, per JWS, are viewed as “viable takedown candidates.” Guggenheim Securities Senior Managing Director Mike Morris tells JWS: “Putting those pieces together, we feel that’s either the direction they actively are considering or should be considering. … If you look at what David Zaslav’s entities in the past have done, it’s buy out companies and then look for ways to reduce overhead costs.” As for which entity WBD is likely to target, JWS notes Fox doesn’t have a streaming service, a TV studio or a robust networks business and therefore can’t “offer much in the way of efficiencies,” but Morris points out that “WBD would, [however], be at an early stage for using all of [the FOX] content to make money in a streaming world. The Athletic’s Chris Vannini reports the same and notes the addition of the Blue Hens will give the conference 11 full members and increase the size of FBS to 135. (link, link)

On3’s Eric Prisbell catches up with several college sports decision-makers to hear their thoughts on the industry’s uncertain future, and NCAA President Charlie Baker acknowledges the NCAA has been too slow to act in the past, but the “NCAA is making real progress in delivering greater benefits to student-athletes and will continue to, but employment should not be one of those changes." SEC Commissioner Greg Sankey adds: "The NCAA is going to have to adapt. All of us should confess we are part of it. We have been slow to adapt. I think there's a clear need for a national association, and the NCAA can fill that role. But change is going to be a constant and more rapid as we try to decipher what that role will be." Oklahoma AD Joe Castiglione offers his thoughts on what that role will be, telling Prisbell: "I support establishing a new structure that allows for us to rightly share some revenue with student-athletes. That has to be part of our path forward. However, I also recognize that path takes us to an unknown reality with unpredictable economic implications for our departments, dramatically impacting how we can support a broad-based athletics program." LEAD1 CEO Tom McMillen won’t be surprised if “one conference decides to go off and maybe pay some athletes and others decide not to.” (link)

The NCAA argues in a filing to the U.S. Ninth Circuit that the court should hear its appeal in the House v. NCAA class certification case because “denial of this petition would be the death knell of this litigation,” and Sportico’s Michael McCann points out that use of the phrase “death knell” is not an accident. “The petition’s use of the dramatic phrase ‘death knell’ was made with precedent in mind. In 2005, the Ninth Circuit held that while an interlocutory review of a class action ought to be a ‘rare occurrence,’ it is justified when there is a ‘presence of a death knell situation for either party absent review.’” The petition also rebukes U.S. District Judge Claudia Wilken’s decision, claiming it demonstrates a misunderstanding and misapplication of the requirements for class certification. “Few things are more individualized than one’s NIL. Some star quarterbacks and individual gymnasts have received substantial NIL compensation; thousands of other athletes have received nothing.” The NCAA and Power 5 also maintain there is no way to determine the economic value of an athlete’s NIL unless it is done on an individual basis. ULM AD John Hartwell immediately dismisses the notion that the Warhawks could move to the FCS: “Not an option, not an option. [President Ronald Berry] and I have had that conversation. I had that conversation with him the first night I met with him before I ever took the job. We are making the commitment to be FBS, to be proud members of the Sun Belt Conference. You could argue that the Sun Belt Conference – and the facts don't lie – is the strongest Group of 5 conference there is out there right now. Twelve of the 14 teams in our league – us and our friends in Hattiesburg, we’re the only two that are not playing in a bowl this year – and obviously we want to get ourselves in that group that does regularly play in a bowl game.” (link)

We’ll rack ‘em and stack ‘em here (Monday in interviews) and move forward to having a head coach named prior to the transfer portal window. The 2023 FBS Attendance Trends Database has been updated with all regular season info, and with a 58.19% uptick, Kansas has experienced the largest YoY increase over the past five years, followed by Tulane (38.76%), Georgia Southern (33.97%), FIU (32.65%), Illinois (30.4%), Houston (30.12%), Appalachian State (28.12%), Connecticut (28.09%), Texas State (27.72%) and Florida State (23.30%) in the top 10. Former Michigan Football AC Chris Partridge denies having any knowledge of sign-stealing within the program and rejects any assertion that he destroyed evidence or related to an ongoing investigation. According to his termination letter, Partridge was let go for failing to abide by the university directive “not to discuss the ongoing NCAA investigation with anyone associated with the Michigan football program,” and Partridge goes on to explain: “I take pride in being a trusted mentor to the athletes that I coach. One of my core values is to be a source of support, through thick and thin, for each and every student-athlete that I am responsible for. I have never wavered from that responsibility. While I am extremely disappointed in the university’s decision to terminate my employment, their decision does not change my continued love and support of Coach Jim Harbaugh, the players of Team 144 as they continue on their quest for a National Championship!” (link)

SBJ’s Ben Portnoy takes an inside look at the strategy behind Fox’s Big Noon Kickoff, what makes the show tick and its growth potential. As host Rob Stone puts it, the show is “a toddler, but we’re not in our crib anymore. We’re demanding a king-sized bed.” Now in its second full season on the road weekly, Portnoy notes the show “averaged 1.02M viewers over its two-hour window through the first 10 weeks of the 2023 season (up from 997K last year). Meanwhile, Big Noon Saturday is on pace to be the most-watched game window in college football on any network in 2023, a feat it also achieved the previous two seasons. While the show itself may be young, Portnoy notes the infrastructure consists of “staffers who largely count their tenures in the television business by decades, not singular years.” VP of Production Bardia Shah-Rais, whose duties also include steering the MLB Pregame ship, says of the show’s evolution: “I remember the first year…we kind of rebranded the shows in the studio, it was like ‘S**t, how are you gonna fill an hour?’ After the first week we were like, ‘How are we not getting everything in?’” Portnoy also observes the additions of USC, UCLA, Oregon and Washington to the Big Ten only figure to help the show grow, and Stone remarks: “[Fox] believed in us and believed in the product and said ‘Hey, if we’re gonna go toe-to-toe with a legend in the industry, we’ve got to make it a fair fight.’” (link)

The Pop-Tarts Bowl on December 28 will feature the first-ever edible mascot, per The Messenger’s Kari Anderson, who notes the “mascot will run around at the game, interacting with fans. However, at the final whistle, the winning team will be offered the chance to snack on the super-sized Pop-Tart as a symbol of its victory — a feast of champions, surely.” Anderson adds that while the flavor of the mascot has yet to be specified, promotion photos appear to show the Strawberry flavor.
