Here’s the entirety of NCAA President Charlie Baker’s letter outlining his proposal for player compensation and other “fundamental changes” to the operating framework. In addition to the compensation recommendations that have been well-publicized, Baker points out that “across Division I, schools spend between $5M and $250M annually on their athletics programs. 59 Division I schools spend over $100M annually on their athletics programs. Another 32 Division I schools spend over $50M annually on their athletics programs. An additional 259 Division I schools spend less than $50M, and of those, 144 Division I schools spend less than $25M on their athletics programs.” Comparatively, Baker points out that 98% of DII and DIII schools spend less than $20M annually. Georgia President/NCAA Board of Governors Chair Jere Morehead spoke at the SBJ IAF about a number of pressing topics in college sports, including NCAA President Charlie Baker’s proposal, about which he said: “Charlie is putting out some ideas that he’s thought a lot about to begin a conversation. And I think it'll be a very productive time for all the leaders in intercollegiate athletics to consider a path forward.” Morehead also emphasized the need for more transparency as it relates to NIL: “I'm not sure we can solve that at the NCAA level. I think Congress is going to have to be involved in that discussion, but we've got to look for a solution to stories like a transfer quarterback being paid a million dollars to go to another school. That's not what NIL was ever intended to be.” On the future of power conferences, Morehead noted the “commissioners of the SEC and the Big Ten have to be on the same page.” (link)

Miami (FL) AD Dan Radakovich was asked about the proposal at a press conference for the Pinstripe Bowl and said: “In looking at it, there were some things and some themes that President Baker had talked about previously about giving more autonomy to the schools, especially the higher-resourced schools, to be able to control their own destiny. … But I think that being able to invest and have the schools have the opportunity to do this is really refreshing coming from the NCAA because for so many years it had been more of a least-common-denominator approach to how they put rules in. And I think this opportunity and the discourse that will happen now that this is out front, and we’ll have the opportunity to talk through it and move ahead, I think it’s going to be really good for college athletics.” (link)

Tulane Sports Law Program Director Gabe Feldman talks with Sportico’s Michael McCann and Villanova Moorad Center for the Study of Sports Law Executive Director Andrew Brandt about NCAA President Charlie Baker’s proposed compensation model, and Brandt remarks: “I think [the NCAA] just threw up their hands after Alston on a whole preparation for NIL to begin with and abdicated responsibility, and this has led to where we are now – where they are seeking legislation. They're trying to avoid these lawsuits and all of the ramifications that could come, especially the class action with House. And this is a try, in my mind, a way to try to… preemptively strike against two things. One is antitrust lawsuits. And, two, the problem that they've encountered the last two years with these collectives taking control of NIL away from them.” McCann believes it’s “too late for the NCAA to extinguish some of the legal issues that have been raised in the litigation” and agrees this is an attempt to “preempt maybe future litigation, but I think they should have done this before. I think the reality is we're too far into the game, and we know that the lawyers involved in these cases are really good and they're going to push to get some sort of settlement that's pretty massive if the NCAA is going to be open to settling.” Feldman points out that paying “$30K or $50K or $60K but in an education trust fund as opposed to straight salary and then they're helping them with NIL and maybe licensing their rights for commercials – that's a drop in the bucket compared to revenue sharing of TV deals.” More analysis. There will be layoffs within the Arizona athletics department, according to President Robert Robbins, who also told the Faculty Senate this week that fans would see an increase in ticket prices as the university continues to deal with a budget shortfall. Robbins didn’t offer details about layoffs but said season tickets for basketball and football will increase by 25% while ticket prices in general will also go up. The UA president also pointed out that the athletic department has taken out roughly $87M in loans from the university in recent years. (link)

Cal AD Jim Knowlton joined Chancellor Carol Christ and Academic Senate Chair Maximilian Auffhammer to discuss the state of college athletics. Auffhammer pointed out that “I think many of us don't realize how demanding the life of a student-athlete is, so making sure that student-athletes – especially in this world of conference realignment – get the support they need to succeed in their student lives is something that really I worry about a lot. … if you look at the majors that our student-athletes major in, these are some really, really hard majors. An economist myself, I found economics really hard. I still find it difficult, and it's the top major that our student-athletes major in. The other thing I, of course, do worry about is resource issues, and this goes much beyond intercollegiate athletics. It’s not just athletics that's changing, it's higher education in general that is changing.” Christ noted the Bears will receive roughly $11M per year in TV revenue upon joining the ACC, roughly $13M fewer than the department receives now, but says the university will utilize new revenue streams to help offset the drop, including the “Calimony” payment from UCLA and, hopefully, some support from the Office of the President. “In addition to that, we haven’t really monetized the stadium in ways that we might and I think we haven’t fully taken advantage of the donor generosity that might be motivated by the move to the ACC.” Lots more. In discussing what role the NCAA has moving forward, AAC Commissioner Mike Aresco says the NCAA has the “best brand and the worst brand. The best brand in sports is the NCAA Tournament. You say NCAA tournament, and it’s magic. Outsourcing [enforcement] would be good because everyone hates the NCAA because they levy sanctions against your team. It would be great if you outsourced that and called it a different name. We talked about that internally. The CCA [Conference Commissioners Association] talked about how that wouldn’t be necessarily a bad idea.” LEAD1 CEO Tom McMillen adds: “The only area that I think needs to be studied is this enforcement area. The NCAA has always had difficulty with that because they have had difficulty getting information. Some of the bills in Congress…have subpoena power. They create a third-party organization with subpoena power. Now, that organization would have a lot more than enforcement; they would be looking at health and safety and everything else. But one of the things I think our ADs are frustrated by is that it’s hard for the NCAA to enforce when they don’t have the tools to do so.” Lots more. (link)

Several North Dakota State fans had their football tickets to this weekend’s matchup against South Dakota canceled after using a password on USD’s ticket site intended only for Howling Pack members. Coyotes Director of Ticket Sales & Operations Adam Riley: "The code got out, whether it's our fans or somebody out there who shared the code with NDSU fans. NDSU fans went on there and bought tickets. It lets them, but it says in there it's for Howling Pack members." Bison student-athlete Jake Kava says roughly 15 friends and family members had their tickets canceled. “Not really sure what's going on down there, pretty upset, having family members get tickets and not being able to go now or whatever is going to happen. It will be interesting to see what the number of USD-to-NDSU fans down there will be on Saturday." (link)

NCAA President Charlie Baker is set to introduce new student-athlete compensation proposals at this week's SBJ Intercollegiate Athletics Forum, per Sports Illustrated's Pat Forde. From Baker's letter: "First, we should make it possible for all Division I colleges and universities to offer student-athletes any level of enhanced educational benefits they deem appropriate. Second, rules should change for any Division I school, at their choice, to enter into name, image and likeness licensing opportunities with their student-athletes. [...] Third, a subdivision comprised of institutions with the highest resources to invest in their student-athletes should be required to do two things: Within the framework of Title IX, invest at least $30K per year into an enhanced educational trust fund for at least half of the institution's eligible student-athletes. Commit to work with their peer institutions in this subdivision to create rules that may differ from the rules in place for the rest of Division I." Among the 10 benefits Baker highlights in the proposal is this: “It kickstarts a long overdue conversation among the membership that focuses on the differences that exist between schools, conferences and divisions and how to create more permissive and flexible rules across the NCAA that put student-athletes first. … It also gives the NCAA a chance to propose a better way to support student-athletes at the highest revenue schools by providing significant financial support to student-athletes in revenue positive and non-revenue sports alike.” Lots more. + MAC Commissioner Jon Steinbrecher, who remarked: "I think a lot of people are saying this is a precursor of the great breakaway, right? I would suggest exactly the opposite. It's the relief valve, it's taking the pressure valve off to do whatever institutions need to do. … I view it as a natural evolution of what the transformation committee was walking up to."
+ Sun Belt Commissioner Keith Gill added: “Right now it’s an irrational system. Trying to bring some sanity to it, trying to bring a framework to it is really important.”
+ Meanwhile, Texas A&M AD Ross Bjork asked: “Why are we weaponizing the term NIL? Why not celebrate that? Whatever market has been created, our athletes are thriving in that market. Why are we saying this is a bad thing?"
+ Pittsburgh AD Heather Lyke also weighed in, saying: “We can't ignore the fact that NIL is used in the recruiting world. … With the lack of transparency, the unknown amount that you're getting has driven the inflated numbers to a point that nobody knows what's real."

+ Ohio State AD Gene Smith says he is “100% supportive” of these proposals; however, several DI members have voiced concerns about the financial and competitive consequences, “particularly against the backdrops of Division I rules now allowing athletes to transfer once without having to sit out for a year, as used to be the case, and now allowing athletes to make money from their NIL,” according to USA Today’s Steve Berkowitz. Sportico’s Michael McCann and Daniel Libit unpack the legal takeaways, starting with this: “The NCAA might save the non-elite schools by separating them from the top. … By separating the top from the rest, the NCAA can better defend the lesser programs from legal arguments that their players are employees or are owed more money. If the schools are all grouped together—as they are in some of the legal controversies—it disadvantages non-elite schools, which might convert varsity teams into club or intramural sports if they are required to pay the players.” Also, the NCAA can, however, “credibly defend its plan under antitrust law. … The NCAA is taking a nuanced and flexible approach. Here’s why that matters: If an athlete challenges the plan as still placing barriers on compensation, the NCAA can point to case law indicating that reasonable approaches withstand antitrust scrutiny. … To that point, recall what Justice Neil Gorsuch wrote in NCAA v. Alston. Although the Court sided against the NCAA, he wrote a “no Lamborghini rule” would be a reasonable restraint on athlete compensation, since it is logical and would advance the larger educational goals of colleges.” Finally, McCann and Libit note the NCAA is tacitly acknowledging that its current system is “problematic” and expect to see Baker’s memo in future court filings. Plaintiffs’ attorneys in House v. NCAA, Jeffrey Kessler and Steve Berman, argue in a brief filed today that the NCAA and Power 5’s contention that a House victory would equate to a “death knell” for college sports is “specious” and “preposterous.” From the filing: “More than $7B in annual revenue—attributed to P5 public schools alone—ought to be enough to cover defendants’ litigation costs.” Similarly, they underscore that the damages claim for TV money—a 10% cut to the players—is “a miniscule amount of their overall revenues that continue to grow significantly year over year.” The players also assert the NCAA’s “death-knell forecasts” are “even more preposterous juxtaposed against the profligate spending that defendants and their members engage in voluntarily.” More from Sportico’s Michael McCann. USF has released new conceptual renderings of its new on-campus football stadium. While some details are subject to change throughout the design process, features include a dedicated students section in the west end of the stadium that includes a design unique to USF featuring Bull horns and amenities that will cater to the student experience; an open concourse around a majority of the stadium that provides views of the field, even as fans are walking to concession or restroom areas; and a variety of premium seating options, including suites, loge boxes and club areas. USF also announced it received a $6M gift from the USF Federal Credit Union to name the walkway that will lead into the main entrance of the new stadium and will serve as home to the football team’s traditional Bulls Stampede pregame walk. USF has now raised more than $43M of its $50M goal for the project. The facility is now due to open for the 2027 season. (link)

Florida Governor Ron DeSantis has set aside $1M in his newly released state budget to fund a lawsuit against the College Football Playoff Selection Committee. The stores take customers' credit card information upon entry and use AI tools, such as computer vision and deep learning, to determine what they take. According to CBS, the matchup was the most-watched conference championship game on any network in the last five years. Additionally, the game was the most-streamed college football game on Paramount+ to date. (link); The Big Ten Championship between Michigan and Iowa was the second-most-watched conference title tilt, drawing 10.02M viewers to Fox, followed by Washington-Oregon (9.25M to ABC), Texas-Oklahoma State (7.89M to ABC), Florida State-Louisville (7.03M to ABC) and SMU-Tulane (1.88M to ABC).
