Baker Goes All In:

+ NCAA President Charlie Baker is set to introduce new student-athlete compensation proposals, per Sports Illustrated's Pat Forde. From Baker's letter: "First, we should make it possible for all Division I colleges and universities to offer student-athletes any level of enhanced educational benefits they deem appropriate. Second, rules should change for any Division I school, at their choice, to enter into name, image and likeness licensing opportunities with their student-athletes. [...] Third, a subdivision comprised of institutions with the highest resources to invest in their student-athletes should be required to do two things: Within the framework of Title IX, invest at least $30K per year into an enhanced educational trust fund for at least half of the institution's eligible student-athletes. Commit to work with their peer institutions in this subdivision to create rules that may differ from the rules in place for the rest of Division I." Among the 10 benefits Baker highlights in the proposal is this: “It kickstarts a long overdue conversation among the membership that focuses on the differences that exist between schools, conferences and divisions and how to create more permissive and flexible rules across the NCAA that put student-athletes first. … It also gives the NCAA a chance to propose a better way to support student-athletes at the highest revenue schools by providing significant financial support to student-athletes in revenue positive and non-revenue sports alike.” Lots more. + Baker made his first public remarks since issuing yesterday’s memo, saying during the SBJ Intercollegiate Athletic Forum: “The proposal that I made yesterday was kind of an amalgamation of a bunch of different thoughts and observations and approaches. For me, this is a conversation we need to have and now we need to actually have it. … We need to anticipate where conversations are going and to try and get this big, huge, diverse, 180 committees and like 2000 members, to a place where they're talking about stuff that's coming and not just reacting and responding to other people's agendas. … By the end of the year, we'll see what happens in December and January, but I believe by the end of the year we're going to have policies in place brought to and voted by the DI Board around consumer protections for student athletes.” On the $30K trust fund included in his proposal: “That's a permissive standard, it's a standard designed to establish the minimum. People can do more and people who don't want to be in this division can do pretty much whatever they want." Also from Baker: “I want a little antitrust exemption. I just want something that the NCAA and federal government agree that we are allowed to actually have an actual standard." Is the proposal a repeal of pay-for-play? “I guess my answer would be no.”

+ Baker also addressed other topics, noting that “in the NIL space and other spaces, part of the reason why we're talking to Congress is the ability to codify something to say that yes, the NCAA is membership based and they should be able to actually do their job. … There is a difference between the top 100 schools in terms of resources in DI and the other 250. And what happens is the NCAA ends up in one of these collisions that takes place. …. This stuff really matters. GLVC Commissioner Jim Naumovich joins The Add/Drop Podcast about how the league has changed over his 23 years at the helm and what are the next steps in the evolution of DII. With a number of membership changes including six schools reclassifying to DI during his tenure, Naumovich says the seamless transition in both membership and geographic footprint has been the most surprising. On the future of DII: “It’s how we recreate ourselves as a division. […] I think for us, it's how do we help our schools create a niche market with academic programming or other things of that nature, but I think just remaining viable and having the resources needed to have a competitive athletic program while also maintaining the viability of the school.” (link)

Across the NCAA Universe:

+ Georgia (DI) President/NCAA Board of Governors Chair Jere Morehead spoke at the SBJ IAF about a number of pressing topics in college sports, including NCAA President Charlie Baker’s proposal, about which he said: “Charlie is putting out some ideas that he’s thought a lot about to begin a conversation. And I think it'll be a very productive time for all the leaders in intercollegiate athletics to consider a path forward.” Morehead also emphasized the need for more transparency as it relates to NIL: “I'm not sure we can solve that at the NCAA level. I think Congress is going to have to be involved in that discussion, but we've got to look for a solution to stories like a transfer quarterback being paid a million dollars to go to another school. That's not what NIL was ever intended to be.” (link)

+ Sportico’s Michael McCann and Daniel Libit unpack the legal takeaways, starting with this: “The NCAA might save the non-elite schools by separating them from the top. … By separating the top from the rest, the NCAA can better defend the lesser programs from legal arguments that their players are employees or are owed more money. If the schools are all grouped together—as they are in some of the legal controversies—it disadvantages non-elite schools, which might convert varsity teams into club or intramural sports if they are required to pay the players.” Also, the NCAA can, however, “credibly defend its plan under antitrust law. … The NCAA is taking a nuanced and flexible approach. Here’s why that matters: If an athlete challenges the plan as still placing barriers on compensation, the NCAA can point to case law indicating that reasonable approaches withstand antitrust scrutiny. … To that point, recall what Justice Neil Gorsuch wrote in NCAA v. Alston. Although the Court sided against the NCAA, he wrote a “no Lamborghini rule” would be a reasonable restraint on athlete compensation, since it is logical and would advance the larger educational goals of colleges.” Finally, McCann and Libit note the NCAA is tacitly acknowledging that its current system is “problematic” and expect to see Baker’s memo in future court filings. + Plaintiffs’ attorneys in House v. NCAA, Jeffrey Kessler and Steve Berman, argue in a brief filed today that the NCAA and Power 5’s contention that a House victory would equate to a “death knell” for college sports is “specious” and “preposterous.” From the filing: “More than $7B in annual revenue—attributed to P5 public schools alone—ought to be enough to cover defendants’ litigation costs.” Similarly, they underscore that the damages claim for TV money—a 10% cut to the players—is “a miniscule amount of their overall revenues that continue to grow significantly year over year.” The players also assert the NCAA’s “death-knell forecasts” are “even more preposterous juxtaposed against the profligate spending that defendants and their members engage in voluntarily.” More. + U.S. Senators Chris Murphy (D-CT) and Bernie Sanders (I-VT) are reintroducing their bill that would amend the National Labor Relations Act to define any college athlete as an employee of their college if they receive direct compensation from their college, USA Today's Steve Berkowitz reports. The bill would also allow student-athletes to collectively bargain. Congressman Jamaal Bowman (D-NY) has introduced companion legislation in the House of Representatives. (link); The reintroduction includes endorsements from the MLBPA, NFLPA, NBPA, NHLPA, and MLSPA in support of college athletes becoming employees and being allowed to unionize, according to Front Office Sports’ Amanda Christovich. The national four-cohort DII ASR average remained steady at 76%, while the DII FGR continued to outpace the general student population 60% vs 53%. Per the NCAA: “Notable single-class student-athlete increases in ASR over the 17 years of calculating this rate in Division II include overall (from 69% to 77%), Black men (from 42% to 51%), Black women (from 61% to 76%), Hispanic/Latinx men (48% to 66%) and Hispanic/Latinx women (63% to 80%). In addition, there have been notable increases in ASR for two-year transfer student-athletes (from 57% to 73%) and four-year transfer student-athletes (from 66% to 77%) over the past 10 years.” (link, link - Full presentation)

Nebraska-Kearney Men’s Basketball HC Kevin Lofton’s resignation was apparently spurred by being informed that the Lopers would not renew his contract that had an unusual end date. AD Marc Bauer: “We told Kevin that we were not renewing his contract. The contract ended on Nov. 30, which we were almost there. He knew that. Again, this was his decision on how he wanted this. [...] Obviously, the decisions that were made, a lot of it was predicated on that date. It’s been tough. It really has been. [...] The pressures are high right now in our men’s basketball program. Our fans want to see us win, our alumni want to see us win, and quite frankly, that’s part of the Division ll experience is that you have that opportunity to compete postseason and we haven’t been.” (link)
