Tulane Sports Law Director Gabe Feldman is joined by Winston & Strawn Co-Executive Chairman Jeffrey Kessler to discuss Kessler’s role in multiple antitrust cases against the NCAA. With House v. NCAA scheduled to go to trial in January 2025, Kessler says: “This all should be wrapped up by a year from this January in which we expect all these rules will be struck down, and we expect to obtain a very large damage recovery in the billions of dollars for the athletes.” Kessler also calls estimates of $1.4B in damages “low and preliminary because it was based on an analysis that was done based on just the first year of data that was available at that time. We have updated our damages analysis in a report we recently filed. I cannot disclose that number because I think it's confidential, but I will just say that the damages claim that we present at trial will be significantly more than the $1.4B number.” Feldman points out the damages would be trebled, meaning if the number is, for instance, $3B, then it would grow to $9B. On NCAA President Charlie Baker’s player compensation proposal, Kessler says: “The significance for us is it’s a wonderful admission by the president of the NCAA that these bans on paying for NIL rights directly are antitrust violations because since he now believes he can get rid of those bans without doing damage to college sports, which is what we've argued all along, that's going to be fatal under the rule of reason. In some ways I view this proposal as throwing in the towel on antitrust liability, but what they've offered is not what we would settle for.” Lots more. (link)

Mississippi State AD Zac Selmon acknowledges Davis Wade Stadium is due for some upgrades, particularly as they relate to the fan experience. Updates to the audio system and the addition of LED lights are two projects on the horizon, though Selmon doesn’t want to put a timetable on those projects yet. “Sometimes I think the public perception is you can just go to Ace Hardware and buy some steel, erect it, and then turn on the lights and you’ve got a light show. Or go to Best Buy and get a Bluetooth surround sound system and it works. We're dealing with a really old stadium that has a handful of ongoing maintenance items we’ve got to go through. And then you’re trying to modernize it with some of the newer elements, so it takes time. And I feel like we're progressing at a rapid pace. Don't exactly know when we can safely and effectively get things installed or set, but that's something we're exploring to be as aggressive as we can't be with it “ (link)

Toledo AD Bryan Blair tells the Toledo Blade’s Dave Briggs it’s conceivable the Rockets could join the DI “super tier” of football programs outlined in NCAA President Charlie Baker’s proposal. “Looking at the threshold that was laid out, for us, that would be about $6M per year based on [the minimum]. I don’t think that’s an insurmountable number, but, obviously, we have not had those conversations yet. … Regardless of the outcome last Saturday, 11 straight wins, being nationally ranked and in the national consciousness, playing on national TV 10 times, that doesn’t happen at a lot of places. If we want to continue for that to happen and use it as a starting point — not the end — that’s going to require all of us to stretch further than we’ve ever stretched. And that’s not pointing to the football staff and saying, ‘stretch,’ or pointing to the AD and saying, ‘stretch.’ We’ve all got to stretch.” (link)

Michigan officials are reportedly working with a firm outside the athletic department to look into an altercation between Wolverines Men’s Basketball HC Juwan Howard & Head Strength & Conditioning Coach for Olympic Sports Jon Sanderson. Reports of punches being thrown between the two are inaccurate, per a statement shared by The Athletic’s Brendan Quinn. Howard is still recovering from open heart surgery this past summer. Rivals’ Maize & Blue Review adds: “Howard is NOT set to step down or be fired, which has been confirmed through multiple sources.” (link, link)

According to the broadcasters of this weekend’s Norfolk State-Illinois State men’s hoops matchup, “one or two” Illinois State fans made comments of a “racial nature” towards NSU student-athlete Jamarii Thomas. The incident sparked a brief face-to-face shouting match between NSU HC Robert Jones and ISU HC Ryan Pedon. Jones tweeted after the game: “I’m not letting anybody call my players a racial slur. Those are my kids and I will fight for them. We have come too far in society to be called the N word at a college basketball game.” (link)

The Arizona Daily Star’s Greg Hansen calls Arizona President Robert Robbins’ assertion that athletics staff would be let go and ticket prices would increase as a result of the school’s financial situation “callous,” adding: “It was a bad look for Robbins, Tucson's most visible sports fan, a message that the UA sports community would pay for a blundering administration's $240M miscalculation in projected cash reserves.” Hansen also points out that Robbins’ claim that UA is at the bottom of the Pac-12 in ticket prices is inaccurate. “I studied the ticket pricing charts of every Pac-12 school last week and found (1) tickets at McKale Center are the most expensive in the league, by far; and (2) Cal, Stanford, Oregon State, Washington State and UCLA all charge less for football tickets than Arizona.” Meanwhile, Hansen notes Wildcats AD Dave Heeke has “assured his head coaches that there is no plan to eliminate sports. He is not firing people, although there is a hiring freeze; the department's workforce is being trimmed through attrition. Positions related to health and safety — training and medical staffs — will remain fully manned.” Robbins is scheduled to deliver a university-wide financial plan to regents this week. (link)

More from last week’s SBJ Intercollegiate Athletics Forum, where NFL Hall of Famer Ronnie Lott and National Football Foundation President/CEO Steve Hatchell discussed the state of college football. Hatchell pointed out that “this past year there were more young men playing high school football than there have been in the last 15 years. There are 772 colleges and universities playing football. That’s a lot of opportunities for guys to get degrees. ... There’s a lot of chaos on the surface, but we can’t get away from what is [under that] that says ‘This is still a hell of a game’ and we got to promote that.” Hatchell also explains the “idea that we firmly believe is that football is a great platform. We don't care if you transfer. We don't care how much money you take – you're going to graduate. That’s the mission we’re stepping off the curb with.” Lott remarked that it’s an “exciting time” for the game. “To watch kids be kids…watch them flourish and possibly make a couple of bucks, I think is real valuable. It gives kids the idea they could do more beyond the game of football.” (link)

Paramount Global Non-Executive Chairwoman/National Amusements President Shari Redstone is in talks to sell a controlling stake in National Amusements, Paramount’s parent company, to Skydance, according to the New York Times’ Benjamin Mullin, who reports it’s “unclear whether a deal will be reached, and the value the talks place on Ms. Redstone’s stake couldn’t be determined. A deal for Paramount, if it came to fruition, could be a starting gun for a far-reaching reordering of the media industry over the next year. Comcast, the TV and cable giant that owns NBCUniversal, is on the prowl for deals. Warner Bros. Discovery, the owner of HBO and CNN, in effect, comes on the market next year because of arcane tax reasons.” (link)

Sports Business Journal’s Ben Portnoy adds more detail to NCAA President Charlie Baker’s time at last week’s SBJ Intercollegiate Athletics Forum in Las Vegas, which included insights from Baylor President Linda Livingstone: “We’ve historically been very reactive to [charting a future course for college athletics]. We need to really step up and own this and show people that we can actually govern college athletics in recognizing it needs to be done differently than it was done in the past. I think this is a great starting point for that conversation to say, ‘How could we do this?’ This is a framework we can work from and move it forward.” When asked what the NCAA needs to do better, Baker responded, “Get stuff done.” More. Duke Football student-athlete DeWayne Carter is the namesake in the new Carter v. NCAA lawsuit filed last week. Carter was on hand yesterday for the introduction of new Blue Devils Football HC Manny Diaz, but was not allowed to engage with the media. Duke AD Nina King: “DeWayne is a fantastic kid. We don't treat him any differently. We won't deal with him any differently. But we're still looking at what all of that means for us.” (link)

VCU AD Ed McLaughlin says the university is prepared to pursue legal action and "exhaust every option" in advocating for the eligibility of men's basketball student-athlete Joe Bamisile, whose appeal request for immediate eligibility was denied last month by the NCAA. McLaughlin: “We’re hoping and expecting the NCAA will reconsider his case at this point and grant him the ability to play right away. It’s what’s fair and just in this situation. We hope the NCAA comes to a fair and just resolution with this. And if not, there’s obviously legal action we will pursue immediately because, I’ve told this to Joe and I’ve told it to everyone, I will exhaust every option for this young man. And it’s not because of our basketball program. … I’m willing to fight for that dude every day of the week and twice on Sundays.” Bamisile has been on the rosters at Virginia Tech, George Washington and Oklahoma, where last year he was granted a waiver to compete for the Sooners. On a recent episode of Sporting Class, former ESPN President John Skipper denies that he or anyone at ESPN holds sway over the College Football Playoff selection. In fact, if he had his way, the playoff would have been eight teams all along. Skipper: “They never asked for my opinion, I never offered it to them. The idea that there’s some secret call made from ESPN into the 13-member room, it’s silly. … We did not get to pick Alabama being in and FSU being out. I will guarantee you that nobody at ESPN called and said, ‘we’re going to pay you less money,’ or ‘you have to do this for us.’ We didn’t. … Maybe since I left, [the selection committee has] become corruptible.” (link)

More ESPN notes as College GameDay announces it will be on hand for next year’s Week 0 matchup between Florida State & Georgia Tech in Dublin, Ireland. It’ll mark the first time GameDay will be broadcast outside the U.S. (link); New GameDay personality Pat McAfee says he’ll be back on the show next year, though he points to some vitriol he receives via social media as one downside of being on the show: “How about this? I’m back. I don’t love it. I don’t love that my life is just going to continue to have people telling me to run into oncoming traffic, swallow a barrel.” (link)

USA Basketball earlier this year unveiled a new website in partnership with WMT, and USA Basketball Director of Communications Michael Terry tells SBJ’s Ethan Joyce the revamp had three overarching goals: to create an easier user experience for fans, a quality content management system for the team to use now and build on, and an ability to respond quickly to commercial opportunities around new competitions. To accomplish those objectives, Terry says: “We needed someone who was very familiar with working in sports, and also a partner who could really help us on the tech side of things.” The challenge piqued the interest of WMT Chief Innovation Officer Chris Freet, who calls USA Basketball a “one of one brand” and adds: “Those are the challenges, quite honestly, that we like. We’re not an out-of-the-box solution. We’re not an SaaS company. We like interesting problems.” The finished product’s benefits include “enhanced historical record-keeping and a site structure that placed editorial content on an aesthetically pleasing pedestal,” and Terry notes: “We're spending a lot more time and resources, creating more editorial content, digital and written. What we now know is that having this website means that people are actually seeing it, people are actually reading it, people are consuming it, which I think we were worried about prior just because it was a little harder to get around.” More. Akron and the Zips Athletic Club announce The Summit Circle, dubbed “an exclusive philanthropic giving society designed to maximize the resources for Zips student-athletes and improve the landscape of Akron Athletics.” Gifts can be directed to capital projects, scholarship endowments or sport specific funds for excellence. Membership requires a gift of at least $25K over a five-year period. (link)

Georgetown is the winner of the 2022-23 BIG EAST Presidents’ Award, given to the league member that has “excelled at the highest levels in academics, athletics and citizenship during the preceding academic year.” Hoyas student-athletes compiled a 98% graduation rate, took home the league’s Male (Men’s Lacrosse student-athlete Will Bowen) and Female (Women’s Soccer student-athlete Julia Leas) Scholar-Athlete of the Year Awards, finished 67th in the LEARFIELD Directors’ Cup final standings and captured nine NCAA Championship berths overall. Sports psychologist Mitch Abrams, known by many as “the anger management guy in sports,” explains there is a fine line between bullying athletes and administering tough coaching. “There are times that a coach might be the straw that breaks the camel’s back, and the athlete was already struggling with life as it is. The coach needs to create an environment where he or she says, ‘Listen, I’m going to coach you guys hard because I think that’s what’s necessary in order to get you to be the best version of yourself. But just because I’m coaching you hard, I’m not malicious. I don’t want to hurt you. And I want you to be able to talk to me if that’s how you feel.’ … The trick answer is if you don’t know where the line is, ask the athletes, because that’s the line that we use with harassment legally, right?” Abrams also agrees it’s possible that athletes can be “softer” than they used to be; however, he’s quick to point out that characterizing the entire generation as soft is an unfair generalization. There are, he explains, good and bad reasons for athletes being “softer.” The good: they are more willing to speak up when they believe they are being bullied. The bad: “Narcissism is a natural consequence of chronic winning. … And then people start giving me a different set of rules. I don’t have to finish my homework, and now with NIL — oh, my God — let’s give them money and cars, right? … If you don’t have that counterbalanced with the parenting, good coaching, good discipline, accountability, sportsmanship, then you run the risk of these athletes turning into a**holes.” Lots more.
