CBS’ Dennis Dodd observes that one hurdle to NCAA President Charlie Baker’s player compensation memo involves the further bifurcation of the Power 5 and the Group of 5, the latter of which, Kennyhertz Perry attorney Mit Winter says, is unlikely to support the proposal. “If you're a G5 school, why would you be in favor of a plan that would require you to, No. 1, pay tons of money to a trust fund?" Dodd notes that “unintentionally suggests that schools in the MAC, Sun Belt and Conference USA might not be able to afford it. FBS membership is like a five-star steakhouse whether you're Georgia Southern or Ohio State. It brands your product. It's the white tablecloth of college athletics. The designation affects enrollment, state subsidies and obviously the ability to sponsor non-revenue sports. A new subdivision potentially stamps those lower-resourced schools with somewhat of a scarlet letter. Estimates are the average school will have to come up with [an] average of $7.5M to stock the annual trust fund.” More from Dodd. (link)

On3’s Eric Prisbell gets reactions to NCAA President Charlie Baker’s proposal from various stakeholders, including student-athletes. On the topic of employment, SMU volleyball student-athlete Alex Glover says: “I don’t feel athletes should be university employees. I believe that scholarships, stipends along with the opportunity to monetize your name, image and likeness are all good examples of ‘payment’ for the student-athlete while representing the said university.” Former Oklahoma State track & field student-athlete Tori Ortiz disagrees. “I believe athletes should be ‘university employees.’ Athletic programs bring in so much money to the university, and NIL deals aren’t promised to everyone. If you are an employee, then they’d have to get paid, and even something as small as a stipend to the players who don’t get much love could go a long way.” Walker Jones, executive director of the Ole Miss-focused Grove Collective, adds: “Anecdotally, our athletes [want] their fair share, but not at the sacrifice of not being a student-athlete anymore. How do we get there? I think there’s almost going to be that special exempt status that we codify these athletes as [student-athletes].” (link)

Clemson AD Graham Neff, Iowa Interim AD Beth Goetz, and New Mexico State AD Mario Moccia took the stage at the SBJ Intercollegiate Athletics Forum to discuss driving incremental revenue and raising brand awareness within their respective programs. Neff noted that “we’re always in growth mode” and called the athletic department “just a huge production house.” He also acknowledged that other departments were in the same position; therefore, the goal is “continuing to differentiate.” Goetz explained that measuring one’s brand is “about a moment in time;” therefore, priorities are “going to change based on where you are in a moment in time and how you’re going to evaluate how compelling your story is.” Goetz mentioned the Hawkeyes’ Crossover at Kinnick event and noted that 25% of the tickets were from new accounts rather than traditional ticket holders for women’s basketball. “From a social standpoint, we certainly have been able to find the reach that we want from our channels, depending on which one you look at.” Moccia explained that the Aggies have taken advantage of consumables with local stores in the Las Cruces area. New Mexicans, he pointed out, like to buy New Mexican products. Specifically, he noted the Lobos bring in $30K a year in licensing after starting out with a beer and moving on to seltzers, wines and liquors. “It's all distributed statewide, so it's in a ton of stores. So, we are able to maximize that around the state.” (link)

The Eastern Washington Board of Trustees today will discuss the Strategic Resource Allocation reports, which were conducted by the University Services and Academic Programs task forces and recommend budget cuts in various departments, including changes to the football program. The report concluded that it is “unsustainable for a university of our size with our budgetary challenges to allow a single unit to accumulate annual deficits as large as the ones listed in this template. … EWU's leadership needs to consider all options to decrease Football's unstainable deficit spending, including moving Football to a lower division.” The board has previously insisted it will not move the football program to a lower division, and EWU Media Relations Specialist David Meany says: "People's lives are involved here and their jobs. That's why we want to be thoughtful and remind people that all these reports did was provide some ideas and recommendations. They're very thorough reports and we owe it to everyone in being thorough in making decisions so Eastern can be viable in the future." (link)

In an update on reporting from yesterday, Oregon State men’s soccer student-athlete Javier Armas and HC Greg Dalby will be suspended for the College Cup. Armas has been suspended for two games overall, and Dalby received a four-game suspension after Armas was found to have been ineligible to play against North Carolina with eight accumulated yellow cards during the season. D1Baseball and 6-4-3 Charts have partnered to create The Diamond Sports Ranking (DSR), designed to “revolutionize how college baseball and softball teams are ranked.” From the release: “Unlike RPI, which primarily focuses on win-loss records and strength of schedule, DSR introduces a more contextual game evaluation. It considers the specific circumstances of each match-up, such as the margin of victory and the game’s location, offering a deeper insight into a team’s performance. DSR assesses team strength dynamically at the time of each game, rather than allowing the value of a win or loss to fluctuate based on opponents’ future performances. This approach provides a more accurate reflection of a team’s capabilities during specific periods. DSR incorporates the margin of victory into its rankings, recognizing that the extent of a win can be a significant indicator of a team’s dominance, an aspect completely overlooked by RPI. DSR ranks teams based on their probability of defeating an ‘average team.’ In contrast, RPI doesn’t necessarily ensure the better team is ranked higher when comparing teams.” (link)

North Carolina Attorney General Josh Stein joins Ovies + Giglio to discuss the recent action he and six other attorneys general have taken against the NCAA concerning its transfer eligibility rules. Stein notes that in addition to North Carolina football student-athlete Tez Walker and Wake Forest men’s basketball student-athlete Efton Reid, he’s aware of several other student-athletes in the state in similar situations. “And rather than play whack-a-mole and go athlete by athlete, we just need to get rid of the rule so that all of these young people can get on the court immediately. We’re seeking immediate relief to strike down the transfer eligibility rule because it's inhibiting the ability of young people to do whatever it is that they desire, which is to play and compete. And it's against the law, there's no legal basis for this restraint on their ability to pursue their dreams.” Stein also points out there are no restrictions on coaches, administrators or other students who want to leave for another institution, and “if you’re going to restrict somebody's ability to pursue their dreams, you have to have a valid pro-competitive reason for doing so, and there are none.” Stein also notes: “My phone will continue to operate even after we file this lawsuit today. If they want to come to us with some kind of rule that allows students to transfer from one school to another as long as they are in good academic standing and on track to graduate then you know we can get rid of the lawsuit.” (link)

+ ESPN platforms delivered their second most-watched college football season since 2016, averaging nearly 1.7M viewers per game across ABC, ESPN, ESPN2 and ESPNU. ABC finished on par with the 2022 season, producing its second-best season since 2017 with nearly 4M viewers. ESPN aired its second most-watched season since 2017, averaging just over 2M viewers. Meanwhile, ABC led the way across all networks and media companies with more total minutes watched than any other individual network, as 24% of the sport’s viewers tuned in to ABC. Among the highlights: ABC’s Week 4 Colorado-Oregon (10M viewers) was the most-viewed Pac-12 conference game since 2006. Also, The Athletic’s Stewart Mandel points out the release indicates there were 11 games across all networks with at least 9M viewers this season, which ESPN says that’s “the most in nearly three decades.” ESPN platforms aired four of those games. AAC Commissioner Mike Aresco will retire at the end of the academic year after serving as the league's only commissioner. Aresco: “It has been the supreme privilege of my long career in sports to have had the opportunity to lead this great conference from its reinvention in 2013, and to represent its outstanding student-athletes, coaches and administrators. I am grateful to the Board of Directors for giving me this opportunity to serve. It would take many pages to list this conference’s numerous athletic and academic accomplishments. There have also been some disappointments and difficulties along the way, most notably, the P5-G5 divide, realignment, College Football Playoff access for our deserving teams, and some competitive heartbreak in big games. But these have not affected in any way my enthusiasm in leading this terrific and resilient conference or my optimism for its long-term future.” (link)

South Carolina State taps Walsh (DII) AD Nathan Cochran for its AD post. The Bulldogs have also named Benedict (DII) Football HC Chennis Berry as the school’s next Football HC. Headlining attorneys Steve Berman and Jeff Kessler have filed a new lawsuit against the NCAA on behalf of Duke football student-athlete DeWayne Carter, Stanford women's soccer student-athlete Nya Harrison and TCU women's basketball student-athlete Sedona Prince. Per the complaint, the plaintiffs are seeking an injunction that would end the NCAA’s rules prohibiting schools from compensating athletes “for their athletic services.” They’re also seeking "substantial damages” for FBS football players and DI men’s basketball and women’s basketball players at Power 5 schools between Dec. 7, 2019, and whenever the date of judgment in this case occurs. From the suit: “These draconian, collusive rules prohibit what the NCAA refers to as ‘pay-for-play,’ but what anyone else would call market-value compensation. In college sports, only the athletes are treated as ‘amateurs.’ Everyone else involved enjoys the compensation that results from unrestrained competition for the athletes’ services.” USA Today’s Steve Berkowitz also notes the complaint “cites NCAA President Charlie Baker's new proposals concerning athlete compensation, and his comments about them yesterday. It alleges that ‘any continued claim’ that amateurism is a justification for prohibiting schools from paying athletes ‘is now factually bankrupt.’” (link, link); Full complaint. (link)
|
Also from Berkowitz: “Seven state attorneys general (West Virginia, Colorado, Ohio, Illinois, New York, North Carolina and Tennessee) have filed suit against the NCAA over its athlete-transfer rules. Case was filed in U.S. District Court for the Northern District of West Virginia. The case prominently features Mountaineers men's basketball player RaeQuan Battle, whose efforts to get a waiver that would allow him to play for West Virginia immediately this season after making a second transfer, have been rejected by the NCAA.” (link); West Virginia AG Patrick Morrisey: “The complaint alleges the NCAA restrains athletes from marketing their labor and is in violation of the Sherman Act. In our complaint, we discuss the arbitrary and inappropriate way the NCAA has treated RaeQuan Battle and other athletes. Every athlete must be treated fairly and no organization is above the law. I’m pleased to join this bipartisan effort and believe the law is on our side. It’s time for change to come to the NCAA. In a separate filing, we are asking the Court for a temporary restraining order against the NCAA to bar them from enforcing their transfer rule.” (link)

Reactions from around the industry continue coming in regarding NCAA President Charlie Baker’s proposed new framework, with several wondering where the money is going to come from, according to Yahoo’s Ross Dellenger. One AD asks: “Does he know something we don’t? If not, we are going to get sued again.” Dellenger subsequently notes: “To be sure, the congressional wheels are turning. Sens. Ted Cruz (R-TX) and Cory Booker (D-NJ) and their staffs are making progress on federal legislation, U.S. Senate aides tell Yahoo Sports. There seems to be a compromise on at least one important subject: addressing employment. Discussion continues on granting the association at least a narrow legal protection. Meanwhile, USA Today’s Steve Berkowitz reports groups representing FCS schools have hired a consulting firm to help figure out where they fit into this new model. Big West Commissioner Dan Butterly asks: “What is doing (what Baker is proposing) going to do to schools in the Big West or the Coastal Athletic Conference or the (Atlantic 10)? What happens to them? And, really, what happens to two, three to five of the conferences in the Group of Five?” As this all plays out, Baker’s message, per Dellenger, is for everyone to take a deep breath. The proposal, Baker explains, is “what we call a place to start.” More. (link, link)

Army West Point has secured the $170M in private funding necessary to break ground on the Michie Stadium Preservation Project in the spring. The project includes extending the Corps of Cadets seating section from end zone to end zone, adding premium seating and offering improved concessions. In addition, the surrounding landscape will be reconfigured to improve accessibility while capitalizing on the panoramic views of Lusk Reservoir, the Cadet Chapel, Fort Putnam, and the scenic Hudson Valley. Black Knights AD Mike Buddie: “It is a remarkable testament to the generosity and loyalty of the West Point community that we were able to raise $170M in funding. This aspirational project more than tripled the scope of the next closest gift-funded project in the Academy’s history. To have secured two individual lead commitments of more than $20 million and several commitments of more than $5 million is humbling and overwhelming and speaks to the impact of the West Point experience. This project will support the entire Corps of Cadets and our fans, not just football and lacrosse cadet-athletes.” The project is expected to be completed in the summer of 2026. (link)

BYU AD Tom Holmoe acknowledges there are Cougar fans not in favor of Utah’s joining the Big 12 but says he is. “I think some fans on both sides make it very difficult, and I think that is what some people are worried about, is those fans, not the games. My responsibility is not for those outlier fans. It is for the people that are playing in the games who love the games. They are competitive and it is as fun of a game to play in as you can imagine.” On being an AD during these tumultuous times: “I could say, ‘Wow, this is hard. Woe is me.’ And we wouldn’t get any better. We would just kinda be stuck. For me, I haven’t seen any of these things (happening) in advance any more than anybody else. We are all in the same boat.” Full Q&A. (link)

Florida State has parted ways with Childers Construction, the firm that was handling the Seminoles’ new $138M standalone football facility project. From FSU: “Seminole Boosters is taking necessary steps to advance the project forward on schedule and within budget. The process has already started to select a new construction manager to complete the project, and we anticipate an announcement by the end of the month.” According to Warchant’s Ira Schoffel, FSU and Childers could not come to an agreement on a guaranteed maximum price for the facility’s construction. Plans to free up PNC Arena’s north-side loading docks into new offices for the Carolina Hurricanes have been changed after the initial cost was estimated to be between $45M and $65M. CAA/ICON Co-CEO Marc Farha: “We’ve heard from both Gale Force and N.C. State, and they didn’t believe that made sense from a financial standpoint.” He adds the initial planning and programming phase would likely take another four to five months, which would put the renovations “right on the edge of the timeline” proposed in August, which was to begin construction in 2024, according to the News & Observer’s Luke DeCock. U.S. Soccer has selected a 200-acre site in Fayetteville, Georgia, for its new $200M+ National Training Center. The site is located about 25 miles south of downtown Atlanta and 15 miles from the city’s airport. Oregon State may have used an ineligible player in the College Cup quarterfinals. JohnCanzano.com’s namesake reports Beavers student-athlete Javier Armas received his eighth yellow card (11/25 v. SMU) and should have sat out quarterfinal. Canzano adds: “Armas and head coach Greg Dalby facing suspension for this weekend. Team trying to provide extenuating information to NCAA Rules Committee. Appears to be an administrative oversight at this point. The only way OSU can avoid a penalty is by establishing that one of the yellow cards was charged to the wrong player. But this is usually done within 48 hours of the game. Rules Committee has final say, and has upheld the rulebook penalty in two other situations already this year.” (link)

As part of its new media rights agreement with NBC, Notre Dame will feature in a new Hard Knocks-style series on Peacock each season. Fox Sports’ Bryan Fischer notes the Fighting Irish will also have their own channel on the streamer. Speaking at this week’s SBJ IAF, Notre Dame AD Jack Swarbrick commented on the media rights deal itself and acknowledged the network’s partnership with the Big Ten “was an important part of our decision. … We were on a bit of an island.” The Irish also have no plans to join a league for football anytime soon, per Swarbrick, who explained: “We don’t do it because it’s financially advantageous or competitively advantageous, we do it because of the value to the university. … I think my successor has the same view as I do. If he has a career comparable to mine, it’ll be at least that long [that ND remains independent].” (link)
