More from NCAA President Charlie Baker at the SBJ Intercollegiate Athletics Forum, where he acknowledged his new proposal stops short of classifying student-athletes as employees or sharing media revenue. “I don't think you can go down that road without creating really significant discrepancies around Title IX, which is a success. We should not turn it into something else. The second thing is schools fund their sports through a whole variety of means and mechanisms. And if some of them want to include that as part of the way they do it, fine. If some of them want to do it through donor contributions, fine. If some of them want to do it through some other mechanism, fine. The point here is let's figure out what we consider to be a permissive standard across DI to actually make it happen. … Now, the membership may say they don't want the subdivision, in which case everybody has the ability to do whatever they think makes sense. But this is an attempt to create a way to do what everybody says they would like to do, which is more for student-athletes than they do now in a way that is holistic and supports them.” (link); Baylor (DI) President/NCAA Board of Governors Chair Linda Livingstone also addressed the plan, saying: “If Congress sees us saying ‘hey, we want to benefit them more financially, but we believe keeping them from being employees helps us to support them in different ways and maybe better ways,’ I think we might be able to get some of that protection that probably we won’t get otherwise.” (link)

NCAA Legal Matters:

+ Headlining attorneys Steve Berman and Jeff Kessler have filed a new lawsuit against the NCAA on behalf of Duke (DI) football student-athlete DeWayne Carter, Stanford (DI) women's soccer student-athlete Nya Harrison and TCU (DI) women's basketball student-athlete Sedona Prince. Per the complaint, the plaintiffs are seeking an injunction that would end the NCAA’s rules prohibiting schools from compensating athletes “for their athletic services.” They’re also seeking "substantial damages” for FBS football players and DI men’s basketball and women’s basketball players at Power 5 schools between Dec. 7, 2019, and whenever the date of judgment in this case occurs. From the suit: “These draconian, collusive rules prohibit what the NCAA refers to as ‘pay-for-play,’ but what anyone else would call market-value compensation. In college sports, only the athletes are treated as ‘amateurs.’ Everyone else involved enjoys the compensation that results from unrestrained competition for the athletes’ services.” USA Today’s Steve Berkowitz also notes the complaint “cites NCAA President Charlie Baker's new proposals concerning athlete compensation, and his comments about them yesterday. + Also from Berkowitz: “Seven state attorneys general (West Virginia, Colorado, Ohio, Illinois, New York, North Carolina and Tennessee) have filed suit against the NCAA over its athlete-transfer rules. Case was filed in U.S. District Court for the Northern District of West Virginia. The case prominently features Mountaineers men's basketball player RaeQuan Battle, whose efforts to get a waiver that would allow him to play for West Virginia immediately this season after making a second transfer, have been rejected by the NCAA.” (link)

CCHA NCAA Compliance Specialist Jane McGill sits down with D3.ticker/Connect’s Anthony Grassi from the 2023 Women Leaders Convention to discuss some key topics in the areas of compliance and the transfer portal, including hurdles student-athletes must overcome and what can be changed in terms of process. McGill also talks about what the NCAA can do to secure the future of Olympic sports: “I think they just have to put their money where their mouth is. Three out of four student athletes are Olympic sport student-athletes – please double check my math – but if we fail to invest in them, we just sort of fail the mission. So, I think Olympic sports are not just products to be marketed; their value is not measured by revenue generation. They are really critical ways that we grow and develop students – hundreds of thousands of students – so if we don’t think they’re worth investing in, then we probably just need to do some organizational soul-searching and figure out what we care about.” Full interview on Connect. Moody’s Investors Service assigns higher education a “stable” outlook for 2024 and projects that “revenue gains will materialize across multiple sources as the residual impacts of the pandemic wane” and “expense growth will moderate as inflation cools, preventing further deterioration in operating performance for most of the sector.” Specifically, Moody’s forecasts revenue growth of 4% and adds: “The outlook could move to positive if revenue growth significantly overtakes expenses, supported by material strengthening across multiple sources. A negative outlook could materialize if revenue stagnates and expense growth fails to slow, leading to further erosion in sectorwide operating performance.” (link)
