Florida Attorney General Ashley Moody is launching an investigation into Florida State’s exclusion from the College Football Playoff and has issued a subpoena for all communications relating to deliberations to or from the SEC, ACC, NCAA, ESPN, Group of 5 and Power 5 conferences, and any other individuals involved in the discussions, among other documents Moody: “I’m a lifelong Gator, but I’m also the Florida Attorney General, and I know injustice when I see it. No rational person or college football fan can look at this situation and not question the result. The NCAA, conferences, and the College Football Playoff Committee are subject to antitrust laws. My Office is launching an investigation to examine if the Committee was involved in any anticompetitive conduct. As it stands, the Committee’s decision reeks of partiality, so we are demanding answers—not only for FSU, but for all schools, teams and fans of college football. In Florida, merit matters. If it’s attention they were looking for, the Committee certainly has our attention now.” (link, link)

College Football Playoff Executive Director Bill Hancock responds: “We will carefully review this demand for information, but it sure seems to be an overly aggressive reaction to a college football ranking in which some fans somewhere were bound to be disappointed.” FSU Asst. Ole Miss AD Keith Carter praises the job being done by the Grove Collective, adds: "But as we all know, it's a changing landscape. And I think some of the standards and kind of where we were last year is totally different than where we are this year and it will be different next year. So you just have to make sure you're staying proactive in space. … And as Coach Kiffin has said many, many times, you know, not to just think outside of the box but to create a new box and I feel like here at Ole Miss we've done that.” (link)

Howard AD Kery Davis talks about the important role the Cricket Celebration Bowl plays in elevating the profile of not just the Bison, but of HBCUs writ large. “I’ve said many times that the Celebration Bowl is a three-hour commercial on ABC. That’s something you couldn’t buy. … You know, we take for granted that a national audience knows the history of Howard and what it has meant culturally and socially and politically to this country. But many people don’t.” For example, during last year’s NCAA Men’s Basketball Tournament, many in the crowd in Des Moines were unaware of where Howard was or the prestige of its alumni. “They were asking questions, you know, ‘Why is Kamala Harris at the game?’ They didn’t realize the impact – wait a minute, the second-most powerful person on the planet is a graduate of this institution! You’ve had Supreme Court justices who have graduated from this institution.” (link)

Marquette has so far raised a little over half the needed funds to move forward with the second phase of a $90M expansion of the Athletic and Human Performance Research Center (AHPRC) and the Marquette Gymnasium. The second phase includes new homes for the soccer, tennis, cross country and track & field programs, practice facilities for men’s basketball, new academic spaces for student-athletes and more sports medicine space. Golden Eagles AD Bill Scholl: “We want it to feel like an Olympic village. Every student-athlete we have is being positively impacted by the expansion. All of their services will be much more proximate to them, which enhances their experience here.” (link)

And he was walking out and he got into it with the trainer first – almost to the point of berating the trainer. Over the line, over the line. The strength coach, Jon Sanderson, hears it and he gets pissed. … Again, I talked to somebody who said listen, it was him losing his cool – good kid, just frustrated not being able to get on the court for the last few months. And Jon Sanderson hears this and says something to the effect of ‘That's why the effing culture is the way it is around here.” Juwan Howard, per Goodman, heard the remark, and “he went right up to Sanderson, who’s about six-seven, six-eight, 270. … He's…exactly what you would think of if there was a picture of a strength coach on the wall right now. And [Howard] went right up to him and they got – from what my sources tell me, and this is multiple sources telling me – chest to chest, nose to nose before they had to be separated.” (link)

James Madison President Jonathan Alger pens an op-ed in the Daily News-Record about the important role athletics plays in the educational experience and the Dukes’ success since reclassifying to FBS. “These accomplishments don’t just happen. … Our university has planned for such a move for over a decade, and the results are a byproduct of these strategic efforts and support from across the institution. It’s important to note that while our football transition has garnered national attention, all of our sport programs have achieved at a high level—both men’s and women’s teams. It’s a model that has worked at JMU and one to which we are committed long term.” Alger specifically cites “support staff and mechanisms in place to prioritize” academic success, “as well as a leadership development program that prepares student-athletes for success in life after sport” and notes: “As a university president I continue to be guided by the belief that strong varsity sports programs can actually support and even enhance the educational experience. At JMU, we have built a vibrant and nationally recognized athletics program that mirrors the recent recognition of our institution as a national research university—one that continues to emphasize the quality of teaching and a well-rounded student experience.” (link)

Famous Toastery President Mike Sebazco tells SBJ he thought he was being pranked when he was first contacted about the opportunity to sponsor a bowl. “I had kind of a 'Dumb and Dumber' moment like, 'Hey, gee, some lucky fellows get a bowl game.’ We did some kicking the tires on it and the people that are working with us through not just this partnership but our NASCAR relationship with [driver] Michael McDowell. [They] are of the highest integrity and not big pranksters. This was very, very real.” While bowl games typically take a year or more to plan, this process came together in a matter of weeks with the move from the Caribbean to Charlotte, and Sebazco says: “Only in my wildest dreams [did we envision this]. We had never considered anything remotely close to this.” (link)

Due to scheduling conflicts at AT&T Stadium in Arlington, the Big 12 will hold its football media days in Las Vegas in 2024 and 2025, Action Network’s Brett McMurphy reports. Host sites being considered include the Sphere, Allegiant Stadium or an MGM property. (link)

The Consumer Price Index rose 3.1% for the 12 months ending in November, down from 3.2% in October, with gas prices falling 6% last month. As inflation continues to cool, U.S. Treasury Secretary Janet Yellen believes the U.S. will achieve a soft landing and avoid a recession. “[Inflation is] certainly meaningfully coming down. And I see no reason, on the path that we’re currently on, why inflation shouldn’t gradually decline to levels that are consistent with the Fed’s mandate and targets. I personally don’t see any good reason to think that the last mile is going to be especially difficult. … Because inflation expectations had never meaningfully ratcheted up on a long-term basis, we just had to have the economy normalize and get the labor market back to a sort of full employment state to bring inflation down.” (link)

U.S. District Court Judge John P. Bailey will issue a ruling tomorrow morning that could temporarily suspend the NCAA’s transfer policy, paving the way for student-athletes who have had waivers denied or whose waivers are outstanding to play immediately at their new schools, Yahoo’s Ross Dellenger notes, adding: “While the lawsuit in West Virginia seeks to give athletes the ability to transfer an unlimited amount of times and retain their immediate eligibility, some believe that it’s time to make rules more strict by getting rid of the waiver process.” MAC Commissioner Jon Steinbrecher: “I want to propose eliminating waivers. I am teeing it up for the DI Council. … We’re going to get challenged no matter what we do, as we’re seeing. I think it’s crazy we now have attorney generals and senators weighing in on stuff. Come on. “We need to manage our own business. That’s how associations work. If you don’t like the rule, then change something. That’s on us. Do we have a rule problem or transfer problem? I think we have a waiver problem.” Baylor President Linda Livingstone agrees the waiver process has become unwieldy, particularly given the mental health component associated with many requests. “It’s really difficult to judge that and be fair about it. Should we be making determinations about the significance of mental health issues?” (link)

It remains to be seen whether NCAA President Charlie Baker’s player compensation proposal will be a positive or negative for Washington State and Oregon State, but JohnCanzano.com’s namesake publisher is “left thinking that some kind of shakeup of the ecosystem is exactly what the Beavers and Cougars need.” Another point of uncertainty moving forward involves the future of the Pac-12 Networks, and Canzano reports former NCAA EVP for Regulatory Affairs Oliver Luck, in his capacity as a consultant for the Pac-2, is focused on that particular topic. “Luck and his team have been charged with exploring whether there’s a business model that would support keeping the Pac-12 Network operating beyond this summer. One question that continues to come up in my conversations with leaders at the 10 departing schools is whether they’ll need production services themselves. They previously relied on the Pac-12 Network, which was linked directly to each campus.” As far as next year’s football schedule, Canzano cites a source who believes the Beavers will try to sell their games a la carte for an estimated value of $5M to $7M total for the season. One source tells him: “I’d think Oregon State might value the exposure more than the money.” In regards to the conference office, Canzano reports Deputy Commissioner Teresa Gould is “part of a small team exploring whether a ‘skeleton crew’ might stay on. It’s unknown if Gould would remain employed.” (link)

The SWAC has announced the creation of the SWAC Student-Athlete Enhancement Initiative, which will provide funding for the continued implementation of enhanced student-athlete support services in the areas of academics, sports medicine and sports information. Additionally, schools can use the funds to help support student-athlete’s mental health initiatives, cover cost of attendance allowances and assist with Alston awards. The league will distribute a total of $4.8M for the endeavor. Commissioner Charles McClelland: “This unique strategic initiative will go a long way towards assisting our league with making significant strides as it relates to enhancing our member institutions’ student-athlete support services areas, while simultaneously enhancing the overall student-athlete experience through an increased offering of impactful resources and high-level supplemental support.” (link)

CAA Commissioner Joe D’Antonio joins The Add Drop Podcast and explains the thinking behind changing from the Colonial Athletic Association to the Coastal Athletic Association: “Approximately three and a half years ago, we started down a path of wanting to make sure that, in terms of the longevity of the conference, we were creating a model that was going to be both sustainable and competitive in the ever changing world of college athletics. One way in which we did that was through expansion, in which we added five institutions, six if you include the addition of Bryant in football next year. … And through expansion, when you look then at the makeup of the conference, the conference really was up and down the East Coast, so it was no longer this conference that was centric just to Virginia and North Carolina – it was much broader than that. So we looked at the name change as a subtle last step in a very, very long process. I think we wanted to be able to keep the CAA logo and the acronym because we thought that had some power behind it and we were able to accomplish both things.” Asked whether this is the CAA he envisioned, D’Antonio responded: “Well, it's what I think we envisioned it would be as it relates to the fact that we brought in five, and now with Bryant six, great institutions into the conference. So that part is 100% envisioned. What the future holds, I don't know if anybody has a crystal ball for that because we are in an ever changing landscape within the industry and within the business.” (link)

While the industry continues to evolve rapidly, Big Sky Commissioner Tom Wistrcill tells JohnCanzano.com that “in the Big Sky, we’re really proud. We know who we are and we’re comfortable with that. All the stories out there — the never-ending chase for money, ‘We gotta pay kids more money’ and ‘We need more NIL money for the collective’…that just doesn’t exist for us. We certainly have our eyes open to what’s going on, but that’s not us. … The Big Sky is a really good place for people to play the sport they love.” (link)

Kansas City’s plans to build a new 5,000-seat volleyball and basketball arena are on hold after RFPs came back with higher than expected costs. UMKC Vice Chancellor of Finance and Administration Sean Reeder says the university isn't shelving the project and plans to push forward after conducting a feasibility study in the coming months. Reeder adds: “Based on current specifications, an analysis of the proposals showed that the proposed private development included in the plans wouldn’t generate enough revenue to cover project costs.” The current RFP will remain open while the university completes its analysis in the Spring of 2024. The Harvard Corporation this morning released a statement that reads, in part: “President Gay has apologized for how she handled her congressional testimony and has committed to redoubling the University’s fight against antisemitism. … Our extensive deliberations affirm our confidence that President Gay is the right leader to help our community heal and to address the very serious societal issues we are facing. … In this tumultuous and difficult time, we unanimously stand in support of President Gay.
