Transfer Tension…
+ U.S. District Court Judge John P. Bailey has granted a 14-day temporary restraining order prohibiting the NCAA from enforcing its transfer waiver rules. The TRO also prohibits the NCAA from enforcing its rule of restitution, which allows punishment for playing athletes who are later deemed ineligible. During the hearing, West Virginia men’s basketball student-athlete RaeQuan Battle compared his “NIL contract” at WVU to an employment contract and argued the NCAA is preventing him from accessing his full payment. “I’m not going to get what I signed for.” A full hearing is set for December 27. + As for how many schools will play student-athletes while the rules are suspended, Kennyhertz Perry attorney Mit Winter remarks: “I think it’s unlikely the NCAA tries to enforce its transfer rules against any athletes now. It will instantly get sued. And I think the judge is also likely to grant a preliminary injunction after the end of the TRO’s 14 day period.” Winter also points out that to grant a TRO, a court “has to find there’s a likelihood of success on the merits of the underlying claims. This means the judge believes the state AGs will likely prevail on their claim that the NCAA’s transfer waiver rules violate fed antitrust law.” (link)
+ Ohio Attorney General Dave Yost: “At the hearing, we found out that 99 players had been denied a waiver, and 44 are currently in process waiting. It’s reasonable to believe that 100 athletes or more could be impacted by today’s restraining order against the NCAA double transfer rule.” (link)
+ The NCAA says in a statement to Ross Dellenger that as a result of the decision, it “will not enforce the year in residency requirement for multiple-time transfers and will begin notifying member schools.” (link)

The DI Board of Directors during a video conference last week reviewed the agenda for the Board of Governors’ January 10 meeting during the NCAA Convention and took note of key items, including a potential recommendation to extend Phase Two of the NCAA’s Transgender Student-Athlete Participation Policy, potential approval of the revised Mental Health Best Practices document, and updates on congressional engagement. Additionally, the Board Administrative Committee reviewed an NIL interpretive decision made by the Interpretations Committee and upheld by the Legislative Committee. The Administrative Committee ratified the decision and agreed to remand the enforcement implications and provide guidance to the Legislative Committee to consider the interpretation as a “determination,” which means that the “institution’s actions constituted a violation of the legislation, policy and guidance but the legislation, policy and guidance were not clear enough that the institution should be held accountable for its actions in this case. Clarification will be provided to the membership and future actions contrary to the clarified guidance after it is published will subject institutions to enforcement implications.” More. (link)

Coastal Carolina Chair of Athletics/Executive Adviser to the President Joe Moglia, in a guest column for Sportico, says of college athlete unionization: “This is going to happen no matter what. Even if Power 5 football doesn’t break away or enter the proposed subdivision, there will be collective bargaining, at the very least between the players and the booster collectives. The NCAA ducked on NIL when it was happening; they can’t duck unions now.” As such, Moglia asserts college athletics “cannot do what they did with NIL, which is make believe it wasn’t happening. … The rise of unions is inevitable due to the gusher of NIL and TV money flowing into college athletics. Now, athletics directors and schools must not wait to prepare themselves for those labor negotiations.” Moglia goes on to call it “wishful thinking” to assume athletic departments are prepared for such negotiations. “Making collective bargaining work in college sports is going to take a while. The first step is for someone to show proactive leadership on it, whether that’s the NCAA, the Power 5 or a university president with a lot of clout. The second step is looking at what the professional leagues already do and shaping it to the unique requirements of college athletics. And the third step is actually cutting a deal with the players. … It’s time for athletics directors and their superiors to go to school and learn how to negotiate.” (link)

Michigan Strength & Conditioning HC for Men’s Basketball Jon Sanderson filed an HR claim following his confrontation with MBB HC Juwan Howard, according to The Athletic’s Brendan Quinn, who reports the school now looking into the matter. Quinn also points out the “overarching issue with such an HR review is that [Howard’s] employment at Michigan is under a ‘zero-tolerance policy’ instituted by the university stemming from a postgame skirmish at Wisconsin in February 2022.” The university’s HR department will compile the facts of the incident and present a report to Wolverines AD Warde Manuel, who will then determine whether the policy was violated. Student-athletes are reporting fewer mental health concerns than they did during the height of the pandemic, according to the NCAA Student-Athlete Health and Wellness Study. In men's sports, the biggest drops occurred in constantly feeling overwhelmed (down from 25% to 17%) and being mentally exhausted (down from 22% to 16%). The most significant decreases came among DI men's sports student-athletes. Among women's sports participants, reported mental health concerns were also down in nearly every category, but the decreases were smaller in comparison: 44% of women's sports participants reported feeling overwhelmed (down from 47%), and 35% reported feeling mentally exhausted (down from 38%). When responding to questions regarding their comfort in talking to their coaches about mental health issues, 40% of women's sports participants and 54% of men's sports participants said they would feel comfortable doing so. Those numbers were lower (a decrease of nine percentage points for women's sports and eight points for men's sports) than reported in pre-pandemic studies. As it pertains to health and safety educational training, 42% of men's sports athletes and 47% of women's sports athletes reported receiving bystander intervention training. NCAA CMO Brian Hainline: "As schools continue to improve their mental health care services while fostering an environment of well-being, student-athletes will continue to reap the benefits of wellness and mental health care seeking. College tennis has a cheating problem, according to USA Today’s Dan Wolken and others who observe the sport, including longtime pro and current ESPN commentator Brad Gilbert, who notes the problem with players making their own calls has been a problem at least since he was the 1982 NCAA runner-up. “It’s the same when I was playing, especially on big points, 30-all points, but it’s gotten to a whole other level. Sometimes on a far sideline you can miss a call or miss one that’s really close, but the obvious cheating in college tennis has to be cleaned up.” Kentucky Tennis HC Cedric Kauffmann: “We’re the only sport, or one of the very few, that we make our own calls. … I don’t think people go in and say, ‘I want to cheat or win by cheating.’ I don’t think it happens like that with 99.9% of the players. Facility Features…
+ Wisconsin’s McClain Center, which houses the Badger’s indoor football practice field, is no longer scheduled to be converted to an indoor track and field venue, according to plans shown at a presentation Tuesday. Instead, the center is slated to be replaced by a new training center that will “centralize the football team's strength and conditioning location, locker room, offices and meeting rooms,” according to the Wisconsin State Journal’s Todd Milewski. The $285M project, which is scheduled to be completed in 2026, involves the demolition of the Camp Randall Sports Center and construction of a new indoor facility that will fit a full-sized football field with a height suitable for kicking drills, something the McClain Center lacked. UW officials and a designer from architecture firm HOK showed the latest concepts from the schematic design process at a meeting of the Joint Campus Area Committee earlier this week. Per Milewski, the project includes a new weight room (an estimated 22,400 square feet), athletic training facility (14,200), locker rooms (15,000), equipment room (8,400), dining hall (10,200), meeting rooms (12,100) and football offices (29,100).
