Sports Business Journal’s Ben Portnoy adds more detail to NCAA President Charlie Baker’s time at last week’s SBJ Intercollegiate Athletics Forum in Las Vegas, which included insights from Baylor (DI) President/Board of Governors Chair Linda Livingstone: “We’ve historically been very reactive to [charting a future course for college athletics]. We need to really step up and own this and show people that we can actually govern college athletics in recognizing it needs to be done differently than it was done in the past. I think this is a great starting point for that conversation to say, ‘How could we do this?’ This is a framework we can work from and move it forward.” When asked what the NCAA needs to do better, Baker responded, “Get stuff done.” More. PAC Commissioner Joe Onderko chats with The Add/Drop Podcast about the league’s presidential leadership, what that offers, higher education and more. Onderko credits the league’s CEOS with allowing the PAC to remain nimble, adding: “That's really one of the things that differentiates us from a lot of Division III conferences. We’re the Presidents’ Athletic Conference for a reason. Our college presidents, the executives that run our schools, are really actively involved in oversight of this conference, probably more so than your average DIII conference. There's a much higher percentage of ADs in our league that report directly to the president than your average DIII conference. […] I think, in a way, it's allowed us to protect the student-athlete experience. It's allowed us to kind of carve out a nice little niche here in a very relatively small geographic footprint around the Pittsburgh region in western Pennsylvania. I look at the number of athletes that we have, the media coverage we have, in a lot of ways we've never been in a stronger position than we are right now.” On the looming enrollment cliff, Onderko says a condensed state like Pennsylvania with 60 DIIIs requires members to look beyond the local radius, stating: “You better start looking places outside of the 100 mile radius outside of your campus, if you want to stay in business. I think we've seen a much higher percentage of our student bodies be student-athletes over the past 10 years progressively and we’re drawing from a much, much larger geographic area.” (link)

As stakeholders continue to digest NCAA President Charlie Baker’s student-athlete compensation proposal, On3’s Eric Prisbell contends securing some type of antitrust protection from Congress is still “mission-critical” given the myriad legal threats still facing the enterprise. Pittsburgh (DI) AD Heather Lyke adds that it’s "really important to get a bill and to get antitrust protection. Keep kids as students and protect all of college sports. If we start paying them, Division II and III [are at risk], and how do you even keep all of Division I together? So many people couldn't afford it." More. (link)

Tulane (DI) Sports Law Director Gabe Feldman is joined by Winston & Strawn Co-Executive Chairman Jeffrey Kessler to discuss Kessler’s role in multiple antitrust cases against the NCAA. With House v. NCAA scheduled to go to trial in January 2025, Kessler says: “This all should be wrapped up by a year from this January in which we expect all these rules will be struck down, and we expect to obtain a very large damage recovery in the billions of dollars for the athletes.” Kessler also calls estimates of $1.4B in damages “low and preliminary because it was based on an analysis that was done based on just the first year of data that was available at that time. We have updated our damages analysis in a report we recently filed. I cannot disclose that number because I think it's confidential, but I will just say that the damages claim that we present at trial will be significantly more than the $1.4B number.” Feldman points out the damages would be trebled, meaning if the number is, for instance, $3B, then it would grow to $9B. On NCAA President Charlie Baker’s player compensation proposal, Kessler says: “The significance for us is it’s a wonderful admission by the president of the NCAA that these bans on paying for NIL rights directly are antitrust violations because since he now believes he can get rid of those bans without doing damage to college sports, which is what we've argued all along, that's going to be fatal under the rule of reason. In some ways I view this proposal as throwing in the towel on antitrust liability, but what they've offered is not what we would settle for.” Lots more. (link)

Wisconsin-Stout receives a record $5M donation from real estate developers Dallas and Edye Pankowski to support the $30.5M Recreation Complex renovation that could begin construction in 2026. The funds will support a new lounge and retail entranceway that was not previously included in the project. With this donation, $7.3M has been raised with $25.5M to come from student fees. (link)

The NCAA has engaged Signify Group to utilize its Threat Matrix artificial intelligence service to “support the Association in studying and responding to online abuse and threats directed at NCAA Championship participants including student-athletes, coaches, officials and committee members.” The pilot will go live this month and initially focus on Twitter (X), Instagram and TikTok. The Threat Matrix project will offer various capabilities, including monitoring, detection and analysis of the levels of abuse and threat in over 35 languages as well as images and emojis; analysis of abuse related to sports betting; reporting procedures for notifying key stakeholders, including involved individuals and teams, local organizers, law enforcement and social media platforms; direct coordination with social media platforms to report abuses and encourage removal of content and other appropriate sanctioning of account holders; and providing data to support the NCAA’s understanding of the scale and nature of online abuse and threats in college sports, as well as informing future educational and policy developments. Sports psychologist Mitch Abrams, known by many as “the anger management guy in sports,” explains there is a fine line between bullying athletes and administering tough coaching. “There are times that a coach might be the straw that breaks the camel’s back, and the athlete was already struggling with life as it is. The coach needs to create an environment where he or she says, ‘Listen, I’m going to coach you guys hard because I think that’s what’s necessary in order to get you to be the best version of yourself. But just because I’m coaching you hard, I’m not malicious. I don’t want to hurt you. And I want you to be able to talk to me if that’s how you feel.’ … The trick answer is if you don’t know where the line is, ask the athletes, because that’s the line that we use with harassment legally, right?” Abrams also agrees it’s possible that athletes can be “softer” than they used to be; however, he’s quick to point out that characterizing the entire generation as soft is an unfair generalization. There are, he explains, good and bad reasons for athletes being “softer.” The good: they are more willing to speak up when they believe they are being bullied. The bad: “Narcissism is a natural consequence of chronic winning. … And then people start giving me a different set of rules. I don’t have to finish my homework, and now with NIL — oh, my God — let’s give them money and cars, right? … If you don’t have that counterbalanced with the parenting, good coaching, good discipline, accountability, sportsmanship, then you run the risk of these athletes turning into a**holes.” Lots more.
