More from On3’s State of College Sports report as it asks stakeholders of various stripes what they think is the biggest issue the industry faces. SEC Commissioner Greg Sankey: “No. 1, we collectively have done a bad job of telling the story about the positive aspects present in our programs. And do I think everybody says we do things perfectly? No. But I do think things are done in an incredibly positive manner. … But let’s not kid ourselves, again, in the big picture into believing the current status is the best that we can do for our college athletes. And I’ll go back to some of what’s happening at the state level, and probably going to be introduced again in 2024, which is state legislatures engaging in a race to the bottom so they can establish competitive success.” Big Sky Commissioner Tom Wistrcill: “Two things, sorry. First, how the House case will play out for the FBS Conferences could have a huge impact on all our futures. And No. 2, how we seem to have lost our way with every decision driven by money. Conference realignment, media deals, NIL, transfer portal incentives, coaches salaries and buyouts, etc. We don’t talk about student-athlete welfare, graduation and celebrating the joy of college sports enough anymore.” (link)

The Washington Supreme Court will issue a ruling today on whether it will review the preliminary injunction granted by a trial court which gave Washington State and Oregon State control of the Pac-12 board. Kennyhertz Perry attorney Mit Winter notes that if the court denies the review, the preliminary injunction will go into effect and WSU and OSU will have control. The AP’s Ralph Russo adds: “I’m no lawyer but I think it’s safe to say it would be a little surprising if the state Supreme Court didn’t review the case and just let the lower court’s ruling stand.” (link)

Tennessee AD Danny White talks about the Lindsey Nelson Stadium renovations and says the Vols are building on components that were already in place. “We’re spending $95M on that project, but if we were to start brand new from scratch it’d probably be double that. We have great student-athlete spaces that needed to be renovated and we've done that actually already the last couple years…and they look even better now, so there's no sense in rebuilding that. And then the lower bowl of the stadium is all very functional and fine, so adding a tower, adding a lot of premium amenities, increasing capacity because we've been sold out for the last couple years. There’s a whole lot of Vol fans that want season tickets to baseball [and] they can't get in right now.” (link)

The Atlantic 10 has signed new five-year media rights agreements with CBS Sports, ESPN and NBC Sports. The new agreements represent a 40% increase in rights fee revenue, expansion for the league’s linear coverage, and an increase in the number of basketball championship games by 30% over previous agreements. Endeavor’s WME Sports and IMG advised the A-10 on the new deals. CBS and Paramount+ will continue to broadcast the men’s basketball championship game as part of its NCAA Selection Sunday coverage, while ESPN retains the women’s final. CBS Sports Network will continue to carry both the men’s and women’s semifinals, and NBC Sports will add three opening round games to its linear coverage. Regular season men’s and women’s hoops contests will continue to air on ESPN platforms. (link)

+ FAU must restart its presidential search pursuant to a decision from the Florida State University System Board of Governors, which says it first wants to make changes to its regulations on how presidential searches are conducted. According to the Orlando Sentinel’s Scott Travis, the new rules “may include prohibiting the chair of a university’s board of trustees from leading a search committee, outlining how search committee votes must be taken and allowing a Board of Governors representative on the search committee to have more authority to intervene if the process goes awry.” It remains unclear when the search will restart. CCHA NCAA Compliance Specialist Jane McGill sits down with D1.ticker/Connect’s Anthony Grassi from the 2023 Women Leaders Convention to discuss some key topics in the areas of compliance and the transfer portal, including hurdles student-athletes must overcome and what can be changed in terms of process. McGill also talks about what the NCAA can do to secure the future of Olympic sports: “I think they just have to put their money where their mouth is. Three out of four student athletes are Olympic sport student-athletes – please double check my math – but if we fail to invest in them, we just sort of fail the mission. So, I think Olympic sports are not just products to be marketed; their value is not measured by revenue generation. They are really critical ways that we grow and develop students – hundreds of thousands of students – so if we don’t think they’re worth investing in, then we probably just need to do some organizational soul-searching and figure out what we care about.” Full interview on Connect. For September and October, Michigan State was billed $513,276 by two law firms involved with the investigation into the leak of Brenda Tracy’s name to the press. While Jones Day is investigating the leak itself, the law firm of Quinn Emanuel Urquhart & Sullivan is representing MSU Board of Trustees Chair Rema Vassar, and the latter has billed the university $208,750 for those two months. According to the Lansing State Journal’s Matt Mencarini, the “Quinn Emanuel rates far exceed the 95th percentile of hourly rates charged by Michigan attorneys, according to the 2023 Economics of Law Survey from the State Bar of Michigan. … Two partners at Jones Day have billed for work to investigate the leak. Their rates are $990 an hour and $967 an hour, about half what Quinn Emanuel attorneys billed but still higher [than] the 95th percentile.” (link)

Squire Patton Boggs attorneys David Elkins and Lauryn Durham in an article for The National Law Review outline the way AI is already being integrated into sports and point out that while there are many benefits being realized AI’s use “can trigger legal implications, particularly when personal information is collected and disclosed to third parties.” In addition to President Biden’s Executive Order on the Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence, which outlines eight principles to create a framework for managing AI risks, Elkins and Durham note several cities have passed their own legislation. New York, for example, passed a law that prohibits employers from using an automated employment decision tool (AEDT) to make employment decisions, unless the tool is audited for bias annually. They add: “As with any rapidly evolving technology, AI’s regulatory and legal framework are moving at an extraordinary pace. Protecting players while staying compliant with legal and regulatory requirements is an important balance to consider as this exciting area continues to develop. Organizations would be wise to engage outside counsel to assist in the myriad of issues that can impact each organization.” (link)

Transfer Tension…
+ The NCAA today walked back its interpretation of yesterday’s transfer policy ruling by U.S. District Court Judge John P. Bailey and tells Front Office Sports’ Amanda Christovich it is now unsure whether student-athletes who play following the ruling would burn a year of eligibility if the ruling is overturned. Due to the suspension of the restitution rule, the NCAA yesterday indicated eligibility would not be impacted. Christovich: “The NCAA, which was unable to provide an interpretation of its own rules, has now further complicated an already extremely confusing situation for athletes and coaches across the country. Some athletes are in a holding pattern while they wait for clarity. Others have already played since Wednesday’s ruling, and could lose eligibility because of the NCAA’s lack of a firm stance. … As the college basketball season heats up and bowl season kicks off, the consequences of the NCAA’s unclear positions could be dire.” (link)
+ Yahoo’s Ross Dellenger reports the NCAA has since provided clarity, and a student-athlete who competes in a game over the next 14 days will, in fact, lose a season of eligibility if the court’s ruling is reversed. From an NCAA Q&A: Question: Does the season of competition legislation apply if a student-athlete competes during the 14-day TRO?” Answer: “Yes. The 14-day TRO only enjoined Bylaw 14.5.5.1 and does not change the season of competition legislation.” The Q&A also indicates a first-time transfer sitting out a year because they transferred after the window closed can compete during the TRO. Dellenger: “Some have misinterpreted the restitution rule & eligibility issue. (1) Judge suspended restitution rule, which prevents NCAA from punishing school/athlete for playing if ruling is reversed. (2) If ruling is reversed & an athlete has played, he/she has used a season of eligibility. An important note here: Like any NCAA decision/rule around an active court case, the judge will have an interpretation in this matter.” (link)

AAC Commissioner Mike Aresco tells Sportico’s Daniel Libit he “won’t look back” once he retires but will continue to work on bridging the gap between the AAC and the Power 5 while he’s still in the role. “Maybe that is just not realistic, but you fight for it anyway. I hope my successor continues the big fight, because it is worth it—it is worth it for these student-athletes. … It probably will be harder, only because the money it will take will be greater. We are about to embark on another arm’s race, just a different kind of arm’s race…but we’ve got schools that are going to be able to do that – they are going to have to struggle a bit, but are going to be able to do it.” For the next six months, Aresco says he will continue fighting for the league, but once he officially steps down, “I really do want to call it a day. I don’t want to be hovering over my successor. I think I owe it to my wife and family to wind down and have some fun.” (link)

Lubbock Christian (DII) names Texas Tech Assoc. Director of Development Andrew Sorrells as its next AD. LCU President Scott McDowell: “I have been incredibly impressed by his depth of character and his winsome ability to connect with people. His passion and energy are contagious, and I’m enthusiastic about both his ability to partner with our already successful coaching staff and his ability to serve as a role model for our remarkable student athletes. LCU is a standard-bearer for Christ-centered athletics, and Andrew has the ability to grow that influence even more to build on the rich legacy of this place.” (link)

Arizona SVP/CFO Lisa Rulney has resigned in the wake of the university’s financial crisis, and the Arizona Board of Regents yesterday approved several measures to correct the situation, including implementing a hiring and compensation freeze and eliminating tuition guarantees for new students beginning in fall 2025. ABOR also approved plans to adopt additional financial management and reporting oversight, implement monthly budget reviews, increase transparency, and centralize administrative services in IT, HR, communications and marketing, and advancement. The university will also freeze international employee travel, defer nonessential capital projects and conclude strategic initiatives funding. President Robert Robbins acknowledged the role athletics plays in the overall picture. “Athletics is the most difficult part of the university’s budget. I also believe that athletics is a core part of the University of Arizona and a key element to our long-term success. I have had many great meetings with the athletic department and we are committed to putting together a multi-year plan to bring their budget into balance.” ABOR Executive Director John Arnold will take over as UA’s interim CFO/VP of Business Affairs. ABOR has also asked Robbins to hire outside experts to overhaul the university’s budgeting and controls. (link, link)

Playfly Sports is unifying its branding by creating four core divisions of business: Playfly Media, Playfly Sports Properties, Playfly Global Partnerships and Playfly Tech. SBJ’s Ethan Joyce: “This move will turn the branding of acquired companies – such as Home Team Sports, which Playfly bought as a three-division purchase from Fox Sports in 2021, and The Aspire Group, purchased earlier this year – into a unified offering.” Playfly CEO Michael Schreiber: “We still now use some of those ingredient brands as products, but ultimately we’re now at the corporate level a branded house. It’s what I would call a maturity moment for us.” (link)

USA Today’s Nancy Armour takes a look at volleyball’s sustained growth nationwide and notes the “number of high school girls playing volleyball has grown by almost 12% in the last decade and, with 470,488 players last year, is the second-most popular sport, according to the National Federation of State High School Associations participation survey.” Boys’ volleyball, meanwhile, is the fastest-growing high school sport in the country. While the grassroots growth continues to work its way upward, Armour points out the sport at the college level continues to benefit from broadcasters recognizing its appeal. “The Big Ten Network, SEC Network, ESPN and Fox are not only airing more volleyball, they’re putting it in windows where it will draw big numbers. Both Final Four matches Thursday will be on ESPN on Thursday night. The championship game will be on ABC on Sunday afternoon.” Florida HC Mary Wise: “I don’t know if the sport can truly grow without television. The people that are making decisions are advocates for the sport. They see the value.” Wisconsin HC Kelly Sheffield believes the sport should embrace its individual stars as part of its growth. “We look at ourselves as the ultimate team sport…and I think we’ve been a little bit leery about elevating certain people. But we need to get past that as a sport and bring personalities out to the forefront. Because personalities stir passion and personalities stir attention.” (link)

Accordingly, Intersport and Fox are partnering to host a Labor Day volleyball showcase next season featuring Minnesota, Stanford, Texas and Wisconsin at Fiserv Forum in Milwaukee. Wisconsin will take on Texas and Stanford will play Minnesota on September 1, and matchups the following day will feature Wisconsin-Stanford and Texas-Minnesota. Two of the four matches will be broadcast on Fox with the other two appearing on FS1. Intersport VP Mark Starsiak: “There is an obvious growing appetite for the sport of volleyball, evidenced by roaring attendance numbers and record-breaking television ratings. It will be an incredible sight to help further amplify the sport with an elite early season showcase on network television.” (link, link)

+ Tennessee is set to issue an RFP for its Neyland Entertainment District project. UT is seeking to engage a Master Developer to develop, finance, operate, and maintain the mixed-use assets along the Tennessee River waterfront near Neyland Stadium through a public-private partnership in which the Developer would ground lease University-owned land. Vols AD Danny White: “We have seen a tremendous response from a wide array of top developers to be a part of this extraordinary opportunity to create the Neyland Entertainment District. We are incredibly excited about the next step in the process, and bidders submit their final proposals for this massive project that will positively impact our entire campus and the city of Knoxville.” UT’s initial concept includes a boutique, full-service hotel with condominiums and conference/event space, among other amenities.
