The DI Council has approved student-athlete NIL protections effective August 1 that include the development of a voluntary registry for providers, aggregating and making available NIL trends and data for student-athletes and member schools and providing standardized contract recommendations and NIL education to student-athletes. Yahoo’s Dan Wetzel: “The NCAA framing this as ‘student-athlete protections’ is clever public relations but it's really just ‘tell us how much you are making so our collectives won't outbid the market.’ The players aren't the side receiving most of the ‘protections.’” Business of College Sports’ Kristi Dosh responds: “I don't think that's the only explanation here. I've been on multiple panels and calls where student-athletes have specifically asked for this. They have no idea how to price themselves. And sure, there are calculators out there, but they're all over the map and not indicative of this market. You could debate if this is the best way to achieve what they need, but I've heard athletes ask for this many times.” (link, link)

The DI Council has introduced a proposal to increase financial penalties for infractions cases. Infractions-related fines go to the Student Assistance Fund, which is administered by conference offices and intended to support student-athletes with financial needs that arise during college that are not traditionally covered by scholarships. (link); The council has also introduced proposals for school involvement in NIL activities. If approved, “schools will be able to better support student-athletes by communicating with NIL entities about enrolled student-athletes, including facilitating deals or introducing student-athletes to providers with potential opportunities. Schools – and associated NIL entities – would continue to be prohibited from engaging in NIL discussions with prospects or potential transfer student-athletes. Schools will also continue to be prohibited from compensating student-athletes for NIL.” (link); More from the DI Council, which has approved proposals to increase penalties for individuals involved in violations. Changes include expanding suspensions to include days between competitions; attaching penalties for schools who hire individuals still serving show-cause penalties; and creating a public database identifying individuals with a history of Level I or Level II violations. The House Subcommittee on Innovation, Data, and Commerce will hold a hearing on NIL and college sports on January 18. U.S. Congressman Gus Bilirakis (R-FL), who has submitted his own NIL bill, chairs the committee. Kennyhertz Perry attorney Mit Winter notes Bilirakis’ bill prevents student-athletes from entering into NIL deals until they’ve been enrolled for 90 days, requires collectives to register and requires disclosure. The Collective Association is “turning to lobbyists to help sharpen its messaging and amplify its voice in ongoing reform discussions on Capitol Hill,” according to On3’s Eric Prisbell, who is told by one TCA source: “When there is a meaningful discussion on NIL, we should be a part of it. No. 1 is getting a seat at the table.” To do so, the source says TCA needs “somebody that understood how to navigate both sides of the aisle and how to get in front of the right people. Playing the traffic cop in terms of managing how time is best spent. Who is best to talk to?” (link)

Rebuilding the Pac-12 with Mountain West schools before August 1, 2027, could cost upwards of $50M in exit fees, according to The Oregonian’s Nick Daschel, who reports the withdrawal fee begins at $10M for the first school and “rises by $500K for each school beyond that. For two schools, it would cost the Pac-12 $20.5M. For four schools, $43M. Six would cost $67.5M. If the Pac-12 were to acquire 11 of the 12 MWC schools, the price tag is $137.5M.” In addition, a school leaving the Mountain West must pay a termination fee of $5.5M. The withdrawal and termination fees are "waived if the entire 12-school Mountain West is accepted into the new Pac-12.” (link)

The Memphis City Council yesterday finalized a resolution allocating $120M in state grant funding to support renovations of Simmons Bank Liberty Stadium and transfer ownership of the stadium to the University of Memphis Auxiliary Services Foundation. The Tigers will immediately initiate a leadership fundraising campaign to match the $50M challenge gift made by the Frederick W. Smith Family for the stadium renovations. (link)

CBS’ Matt Norlander believes college basketball teams should follow Baylor’s (and Texas’ and TCU’s) lead when it comes to investing in a smaller basketball arena, submitting that “Foster Pavilion has the potential to be one of the elite home-court environments – in addition to being one of the best arenas – in college basketball. It's a 223,547-square-foot, 7,500-capacity venue that took barely over a year and a half to open and is the perfect building at the perfect time for Baylor's basketball endeavors. … There are maybe two dozen Division I schools that have proven they can consistently support and validate playing in arenas with a capacity of 12,000-plus. For all others, the 7,000-9,500 range is the ideal size in an era when attendance at sporting events across the country has become more challenging.” Norlander identifies 12 schools who would benefit from playing in a smaller venue, including Georgetown, Ohio State and NC State, and notes: “Dozens of programs are playing in barns that are too big. It has an impact on environment, which means it has an impact on home-court advantage and long-term program success.” (link)

Promoter Roy Englebrecht is petitioning the NCAA to host the Irrelevant Bowl, which would pit the season’s worst two FBS teams against one another. Englebrecht: “No polls, no rankings, no controversy, just two winless or near winless teams looking for redemption and one elusive win. Knowing that the NCAA has become more flexible with the number of teams’ wins to qualify for a bowl, I will petition the NCAA asking them to grant a waiver in 2024 so that two teams would be eligible to play in the inaugural Irrelevant Bowl.” The bowl would provide six-figure payouts to both teams, as well as team travel, lodging and meals in a host city to be determined. Action Network’s Brett McMurphy: “There is ‘no chance’ NCAA would issue a waiver & allow a proposed Irrelevant Bowl in 2024, matching CFB's 2 worst teams, sources told Action Network. ‘A conference or team is not going to mock itself for going 1-11 or 2-10,’ source said.” (link, link)

Mouthpieces have become the latest fashion statement in football, both college and pro, and The Athletic’s Joseph Person and Brian Hamilton examine the trend. “The pacifier-style piece – a combination of lipguard and mouth guard – in particular has spurred the trend toward bright colors and wild designs. If players don’t like the feel, more and more of them like the look. ‘I feel like if somebody busts my lip or something like that, then I’ve gotta do better,’ said Carolina Panthers safety Sam Franklin, who occasionally hooks a colorful guard to his facemask but never puts it in his mouth. ‘They’ve got a good dental plan. So if your teeth get knocked out, they’ll put (them) back in tomorrow.’” According to a 2021 report by Polaris Market Research, the industry is worth roughly $3.71B, and Shock Doctor SVP of Innovation Jay Turkbas estimates the demand for bolder mouthpieces reached an inflection point in 2015. It was a slow burn from there, and then it started to speed up. The last four years it’s really taken off.” He notes the company tries to keep up with teenagers’ tastes by surveying high school players at 7-on-7 tournaments and points out that while the pros may have started the trend, teenagers can turn it into a tidal surge. “Instead of old guys like us deciding what to do, we let the kids decide.” That has led to Shock Doctor offering stock that includes chrome and iridescent mouth guards and lipguards featuring 3D stitching, chains and charms, including dollar signs and crosses. There’s also a Kool-Aid flavored mouth guard. (link)

NFL ratings were up 7% YoY with an average viewership of 17.9M for games across all networks. Amazon’s viewership was up 24% to an average of 11.86M. CBS saw a 5% bump to an average of 19.35M for overall coverage and an average of 24.64M for late Sunday afternoon games. CBS also had the season’s most-watched game, bringing in an average of 41.76M for the Washington-Dallas game on Thanksgiving. Monday Night Football viewership increased by 29% with an average of 17.4M viewers. Fox saw a 2% uptick, averaging 24.62M for its America’s Game of the Week national broadcasts. The network was down 2% overall to 19M for its NFL coverage. NBC’s Sunday Night Football experienced an 8% rise to a 21.4M average. Front Office Sports’ Eric Fisher: “The league’s viewership improvement is the result of several factors, including weaker overall broadcast primetime performance due to the writers’ and actors’ strikes, better scheduling that allowed for top contests in national windows, a heightened emphasis on Christmas Day, and additional exposure of ESPN’s Monday Night Football on sister broadcast network ABC.” (link)
