As noted yesterday, the DI Board of Directors has charged the DI Council with developing recommendations for a framework that would address the key elements included in NCAA President Charlie Baker's "Project DI" framework. Three key components of the framework – namely, allowing enhanced educational benefits, schools entering into NIL agreements with student-athletes, and establishing a subdivision within DI for higher-resourced schools – will be evaluated independently rather than collectively. Meanwhile, the Board of Directors Finance Committee presented three initial concepts for further consideration, including increasing revenue distributions to create a fund for women's basketball; leveraging annual budget increases to build a women's basketball fund over time; and/or reallocating currently budgeted funds to create the women's fund. The committee also approved the Transformation Committee's recommendation to increase per-diem payments to student-athletes participating in NCAA championships at an estimated cost of $5M. The board also ratified the council's vote Wednesday to implement student-athlete NIL protections. (link)

Meanwhile, a Florida State Football AC violated NCAA rules by facilitating impermissible recruiting contact between a transfer prospect and a booster, who, at the time was the CEO of an NIL collective, according to an agreement released by the Committee on Infractions, which found that the “booster encouraged the prospect to enroll at FSU and offered a name, image and likeness deal as a recruiting inducement. The assistant coach then violated ethical conduct rules when he provided false or misleading information about his involvement in the arranged meeting.” Penalties include a two-year show-cause for the coach, a three-year disassociation from the booster, and a one-year disassociation from the collective, among others. The coach in question is reportedly Seminoles OC Alex Atkins, whose show-cause includes a suspension from the next three regular-season games, a two-week restriction on recruiting communication, and required attendance at a NCAA Regional Rules Seminar attendance. (link, link); The FSU-focused Battle’s End collective subsequently released the following statement: “This evening, it was reported that Florida State, an affiliated NIL collective, and individuals operating that NIL collective will face NCAA sanctions related to recruiting conduct that occurred sometime in the Spring of 2022. These events occurred prior to the November 2022 founding of The Battle’s End. Our organization was in no way involved in either the reported violations nor subject to the resulting penalties. Bully Pulpit Interactive Principal/former White House Press Secretary Robert Gibbs moderated a session on congressional engagement during the second day of the NCAA Convention. Panelists included SWAC Commissioner Charles McClelland, who talked about the importance of informing lawmakers of the myriad differences between divisions and within DI itself. Otherwise, “all of these unintended consequences are going to differ [across all levels]. They have to hear all of this so when they create these bills they don't create something that's going to have a negative impact on us trying to solve something that's not even our issue.” That said, McClelland points out that even though the SWAC and SEC operate at different revenue plateaus, they share similar goals, albeit for different reasons. “We both believe that student athletes being employees will be a bad thing. The SEC has their reasons. Within the Southwestern Athletic Conference, our thought process is being at the FCS level, our scholarships are not dollar-for-dollar like they are in the FBS level. … If you have a student-athlete that is an employee they're going to have to pay taxes on that scholarship. Well, overwhelmingly, 80% of our students overall at our HBCUs are still on some form of financial aid, which, by definition, means that you need help to go to school. Now you're going to have to start paying taxes on money that you're getting to help you to go to school.” Full session. (link)

Mountain West Commissioner Gloria Nevarez on the previously reported “withdrawal” and “termination” fees associated with MWC members leaving to reform the Pac-12: “It was one of the things we prioritized when making the deal. That was a directive from our presidents and athletic directors because, remember, we just watched the Pac-12 implode and schools were left out in the cold. It was an awful process, and we didn’t want to do that. I remember one AD saying, ‘Now is not the time to leave anyone behind.’” The San Diego Union-Tribune’s Mark Zeigler notes the penalties don’t include the exit fees already in place,” which he points out are likely to increase as Oregon State and Washington State will pay the MWC $14M for playing games in the 2024 season and another $9M if the deal is extended to 2025. Doing so would add “about $1M to each Mountain West member’s yearly distribution check, which in turn determines the exit fees.” Nevarez says she’s “optimistic” about the possibility of a reverse merger with the Pac-12, “but I just can’t say for sure because this environment is so fluid. [OSU and WSU] only just gained control of the conference office. I’m sure they’re doing a ton of their own due diligence. … There are assets and liabilities, and we want to make sure we have eyes wide open if we’re going to do something together.” Meanwhile, she adds, if nine members vote to dissolve the league, it’s “clear that the majority feels there’s a better place out there. We didn’t want to mess with that language. We also didn’t want to be broken in half.” More. (link)

Western Carolina AD Alex Gary joins Southern Conference Assoc. Commissioner for Brand Strategy and Broadcast Dave Friedman to discuss his role on the Women’s Basketball Selection Committee, and Gary explains that when he watches games “what I’m really looking for is what teams can potentially win a game in the tournament. We all know there are some Power 5 institutions, whether it be South Carolina, the Notre Dames the UConns…we all know those teams, but what are the teams and some of the lesser-known conferences that can win a game with their athleticism, their style of play, their aggressiveness on defense, their size – all of those things that could translate into success are all things that we look at.” When seeding teams with similar profiles, Gary explains committee members will put the teams up on the board and “go down each set of criteria that we have and have checkmarks in each one of the boxes that we think the better team deserves to have. So, we do use those criteria, but there's a lot of conversation, there's a lot of comparison. I may think one team is better than another based on skill level, based on how they're playing, somebody else may think another team is better based on their availability of talent. So, there's a lot of conversation in the room back and forth go get the best possible 68-team field that we can.” (link)

Outgoing AFCA Executive Director Todd Berry says coaches support federal legislation to manage NIL. While AFCA doesn't want Congress writing NIL policy, a national standard for what NIL is and is not would be welcome. "Certainly we can build up to some 30,000 foot view of what NIL is.” Berry also says AFCA would like for the NCAA to have subpoena power when it deals with tampering. “There's no transparency about what is happening. You've let other entities outside of the universities basically run college football. While I'm not suggesting that these entities are running college football, if we don't get ahead of it, they will." He also acknowledges the idea of a salary cap is likely a non-starter: “I wouldn't pay a nickel to have dinner with Justin Bieber. Someone else would pay a million dollars. And that's fine. But that's the problem with the NIL space.” On coaches’ desire to set an academic threshold for immediate transfers: “Every data point suggests that when you transfer, you lower your chance to graduate. A higher academic standard in terms of GPA and hours to transfer. We understand that we don't need to be restrictive, so if someone is beneath the lines we've drawn, let's let them not be immediately eligible.” The IAWP rule, according to Berry, has outlived its usefulness: “We all recognize that NIL are why players are moving. It's not all of a sudden because I've hired the uncle. Consequently the IAWP rule is unbelievably problematic. It's archaic at this point in time. We need to lose the IAWP legislation. USA Today’s Dan Wolken says he’s learned that “Alabama’s NIL program is not set up to be a turnkey operation for the next coach. It was set up to rely on Saban as the draw. Without him, it’s going to take some work to get the money spigot flowing the way it is at some of Bama’s competitors. Point being, no matter who Alabama hires, the notion that they’re walking into a place where the boosters and collectives have the player acquisition part taken care of just isn’t really accurate. Saban made it easy to get complacent on that front.” (link)

+ Members of the Idaho volleyball team have formally asked President C. Scott Green and Vandals AD Terry Gawlik to place HC Chris Gonzalez and his coaching staff on leave “at least until the Title IX investigation and the upcoming spring season are completed.” From the letter: “We have already identified one individual working in the University’s Athletics Department we believe would be qualified to coach us, we would feel safe with as our coach, and who has said she would be willing to coach us on an interim basis through the spring season – and we believe there may be others, too. We ask that this person or someone qualified who we would feel safe with be assigned to coach us this spring. We have already informed the necessary parties that we are choosing to opt out of all non-physical volleyball activities, per the supportive measures granted to us by the OCRI (Office of Civil Rights and Investigations). But we should not have to avoid volleyball activities just to be safe from our coaches.” (link)
+ Missouri State AD Kyle Moats has released an in-season statement concerning the performance of the men’s basketball team (9-7, 1-4) which reads, in part: “The last two Bears conference games have not been indicative of the kind of basketball we expect from our Missouri State teams. Like you, I am passionate about our program and share in the frustration that many of you have expressed. We expect more. I have spoken to [MBB HC Dana] Ford, and we both expect changes in all aspects of our team's performance moving forward. He has spoken about the team's energy and effort, and we will look to make improvements in those areas as well as toughness on the floor and the results in the standings. It is coach Ford's responsibility to get the players to play at a competitive level. It is my job to continually evaluate the program's progress to make sure that happens.” (link)

Georgia football recruiting staffers routinely drove rented vehicles after consuming alcohol, according to an amended complaint filed Thursday by attorneys representing former recruiting analyst Victoria Bowles, who was seriously injured in a January 2023 car wreck that killed former student-athlete Devin Willock and former recruiting staffer Chandler LeCroy. Bowles’ attorney, Rob Buck: “My client’s iPhone survived the crash fully intact and contains thousands of pages of recruiting texts describing the inner workings of UGA’s recruiting activities. … The texts contradict the [UGA Athletic] Association’s pleadings and public statements to its fan base. The texts document that the Association knowingly allowed football staffers to drive Association SUVs while drinking even if UGA had policies stating otherwise.” The amended complaint included a 2019 text message purportedly sent to 13 staff members by then-UGA Director of Player Personnel Marshall Malchow that said: "Hey guys... if you are driving you can have fun at Coach Smarts but if you are driving a recruit make sure you don't get drunk. It will be a bad look if we have people who are supposed to be driving recruits getting lit." UGA in a statement: “We are reviewing the amended complaint, but we dispute its claims and will vigorously defend the Athletic Association's interests in court." (link, link)

Louisiana is simplifying its season ticket pricing structure for football, men’s basketball, baseball and softball. Starting with the 2024 FB campaign, each sport will have just one season ticket price with a Champions Fund Fee requirement that will vary based upon seat location. Previously, there were various price points for both season tickets, per seat donations (PSDs), and Champions Fund giving level requirements. (link)

Paciolan shares several trends in ticketing from the 2023 college football season and reports that 87% of colleges are now mobile-first; the total number of passes moved to digital wallets increased by 40% YoY; digital transfers were up 37%, leading to 930K new accounts, a 30% uptick YoY; revenue increased by 4% to $1.4B; attendance increased by 7%; 98% of Power 5 teams and 88 total Paciolan clients integrated with SeatGeek; and the company’s ALL-IN-1 pass gained adoption by 83 college football teams.” (link)

Arizona AD Dave Heeke says there are no “immediate plans to eliminate sports” as the university grapples with ongoing financial challenges. Heeke does note, however, the hiring freeze instituted in the fall will continue, and all new major construction projects will be paused after the completion of the William M. "Bill" Clements Golf Center. Meanwhile, budgets that don’t impact student-athlete welfare have been trimmed, and the department continues to evaluate new revenue opportunities. Strategies under consideration include increasing ancillary revenue from the multimedia rights agreement, facility usage and other areas, enhancing ticketing revenue through market-driven pricing, strategically investing in marquee programs that generate substantial revenue, and continuing to build on fundraising efforts. Heeke: “As we add more chapters to the rich legacy of Arizona Athletics, we will do so with a continual focus on long-term sustainable models to support competitive excellence, doing so both efficiently and effectively. … We will continue to work together to ensure a bright future for our student-athletes, our University, and our community.” (link)

NCAA President Charlie Baker acknowledges his player compensation proposal likely hinges on action from federal lawmakers: “You would need some sort of protection and special status from Congress, but if a school buys the NIL rights to a player, I honestly have trouble understanding why they should be an employee. That’s a contract, just like any other contract, between two parties.” Yahoo’s Ross Dellenger notes that Baker believes the proposal is important to the NCAA’s lobbying efforts on Capitol Hill and “gives Congress some idea of what something might look like if they would choose to support us on that.” Baker also expresses skepticism that the $30K figure in his proposal will impact ongoing antitrust litigation. “I don’t believe that this organization discussing and debating these issues in the grand scheme of things, particularly given the approach to applying this to enhanced educational benefits, will change anything in the way of court proceedings.” (link)

U.S. Congressman Gus Bilirakis announces he is working with Congresswoman Debbie Dingell (D-MI) and U.S. Senator Ben Ray Lujan (D-NM) to develop a bipartisan, bicameral NIL bill, per On3’s Pete Nakos, who notes Bilirakis also released a new draft of the FAIR College Sports Act and has slated legislative hearing for January 18. (link); NCAA President Charlie Baker is among the witnesses who will appear at the hearing, which will occur before the House Innovation, Data and Commerce Subcommittee, which Bilirakis chairs. According to USA Today’s Steve Berkowitz, it will be the first legislative hearing of this Congress concerning college athletes’ NIL activities. “Up to this point, there have been what are termed educational hearings. The next step would be a mark-up hearing.” As far as the updated discussion draft, Berkowitz observes the “core tenets” remain the same. “In addition to formally legalizing athletes’ ability to make money from their NIL, it would create an independent, non-governmental, self-regulating organization that would “oversee, set rules, enforce, and provide guidance to student athletes and collectives on the NIL process. … The discussion draft also includes a provision that would expressly prevent schools from entering into an NIL agreement with an athlete. That puts the draft at odds with Baker’s recent proposal that would allow schools to have such arrangements.” Additionally, it “includes language that raises questions about whether it would permit” the establishment of a new subdivision whose schools would be required to put at least $30K into a trust fund for at least half of their athletes. + Former Alabama Football HC Nick Saban acknowledges he was going back and forth on his decision to retire as late as yesterday, telling ESPN’s Rece Davis: “It was a hard decision. I love coaching. I love the relationship with the players. The thing that made it more difficult for me is, I felt it might be the right time for me, but how it impacted the players, the coaches, all the people who worked there in the building and contributed to the success of the team, how it would affect them. That was the hard part. That was the part I kept vacillating on back and forth. I was on the phone, we had a meeting at 4 PM. It was 3:55, I was sitting in my chair, looking at the clock, saying you've got five minutes to decide which speech you're going to give. I was actually talking to Miss Terry right up until that time. It was a difficult decision because it impacts and influences the lives of so many people." (link)

The News & Observer’s Andrew Carter reports the ACC on Wednesday hired a team of five Tallahassee-based lawyers to defend the conference in the lawsuit brought by Florida State. “The ACC’s legal team in Florida: Alan Lawson, Jessica Slatten, Raymond F. Treadwell, Amber Stoner Nunnally and Robert E. Minchin III, all of the Lawson Huck Gonzalez firm.” Lawson, Carter notes, recently retired from the Florida Supreme Court and founded the firm. For the lawsuit the ACC filed in Mecklenburg County, the conference has hired a team of three lawyers from Womble Bond Dickinson's Charlotte office: Sarah Motley Stone, Patrick G. Spaugh and James P. Institutional Compliance Solutions, the outside firm hired by Michigan State to investigate sexual harassment claims against former Football HC Mel Tucker, has denied Tucker’s appeal of the school’s findings of fault against him. Institutional Compliance Solutions Founder Courtney Ballard: “Based on the facts outlined in the record, the (Resolution Officer) had a reasonable basis for each of the challenged findings. The RO’s Decision is upheld. This decision is final.” Per USA Today’s Kenny Jacoby, MSU leaders “will now determine any sanctions to issue Tucker. Although he is no longer an employee, they can still ban him from campus, future employment at MSU or participation in school activities, such as attending football games.” (link)

Sportico’s Daniel Libit unpacks an ongoing legal battle between former Short’s Travel Management Charters President Ryan Dohmen and the company, which began after Dohmen’s resignation early last year. Short subsequently started two new companies, Top Flight Charters and Air Charters Solutions, seeking to “move into the same college sports travel space,” per Libit, who adds: “After Short’s warned Dohmen about violating his two-year confidentiality and competition agreement, Dohmen filed a lawsuit in federal court in August, seeking a declaratory judgment and alleging defamation. Short’s, meanwhile, has filed counterclaims accusing Dohmen of breach of contract for soliciting its clients and misappropriating its trade secrets. That ‘confidential information’ included Short’s strategy for pursuing college sports customers, the prices and structures of their contracts, and ‘information regarding financial resources to secure contracts.’” In his suit, however, Dohmen argues: “There are no secrets in this business. Collegiate athletics air charter companies advertise the colleges they work with. Universities do the same regarding their current air charter providers. Obtaining contracts is straightforward: Jobs are awarded overwhelmingly by bid. University decision makers are well known and easily accessible. The preeminence of price (not to mention public records laws) means that the process is transparent amongst competitors.” Short’s asserts Dohmen’s actions have led to damages in excess of $1.3M based on lost 2023 profits alone. Dohmen contends that the “uncertainty around his ability to lawfully compete” has personally cost him at least $100-200K. Trial is set for October. (link)

Since at least 2010, ESPN was submitting fake names to the National Academy of Television Arts & Sciences (NATAS) to secure Emmys for on-air talent that was ineligible to receive them, per The Athletic’s Katie Strang, who reports ESPN “then took the awards won by some of those imaginary individuals, had them re-engraved and gave them to on-air personalities. Kirk Herbstreit, Lee Corso, Chris Fowler, Desmond Howard and Samantha Ponder, among others, were given the ill-gotten Emmys, according to a source briefed on the matter, who was granted anonymity because the individual is not authorized to discuss it publicly. There is no evidence that the on-air individuals were aware the Emmys given to them were improperly obtained. … The fraud was discovered by NATAS, which prompted an investigation by that organization and later by ESPN. Those probes resulted in sanctions beyond the return of the trophies. While it is not known who orchestrated the scheme, Craig Lazarus, vice president and executive producer of original content and features, and Lee Fitting, a senior vice president of production who oversaw College GameDay and other properties, were among the ESPN employees NATAS ruled ineligible from future participation in the Emmys.” Lots more from Strang.
