NCAA VP of Enforcement Jon Duncan joined Fox Sports/Connect’s Bryan Fischer from the 2024 NCAA Convention to offer his perspective on the current state of enforcement, particularly as it relates to NIL infractions, tampering and the trends in NIL cases. Duncan also outlines topics NCAA enforcement does not handle, the IARP cases that are final, what discussions are like internally and externally in infractions cases and lots more. Duncan shares his reaction to coaches who call on the NCAA to do more to combat tampering: “I would love to show the membership way more activity, way more case outcomes, way more consequences, frankly, for people who have been proven to have committed rules violations. … But we need the members’ help – and I have said that all along – with actionable, documentary, personal knowledge, information from coaches, student-athletes, people around them. We can move quickly, we're cooking with gas. Washington AD Troy Dannen says he was not caught off-guard by the departure of Football HC Kalen DeBoer for Alabama: "Believe it or not I had an inkling around Thanksgiving. We put a pretty good contract offer on the table and, when we couldn't get it signed, that gave me some pause." Dannen also explains that he learned Alabama wanted to speak to DeBoer within 24 hours of Nick Saban’s retirement and went into what he called "full-bore, lockdown search mode" and drew up a list of 10 replacement coaching candidates. At the top of his candidate profile, Dannen wanted “a recruiter, and not just somebody who knew they had to recruit, but somebody that was maniacal about it. … I knew we had the right guy [in new Football HC Jedd Fisch]. Then it became, can we get him?" Dannen called Fisch at 10 PM on Saturday night to ask if the Huskies administrative team could come to Tucson to talk with him. They had a seven-year, $54M deal by midday on Sunday, and Fisch says: “Once they showed me what is possible in Seattle, and what their vision of the future looks like, there was no answer other than yes.” (link)

If Michigan agrees to Football HC Jim Harbaugh’s request to grant him immunity from any finding or sanction related to an NCAA investigation, Sportico’s Michael McCann submits it could “could spark a trend that limits the discretion of schools to invoke ‘for-cause’ firings and undermines NCAA enforcement of head coach responsibilities. … The threat of losing a lucrative contract is an important deterrent for coaches in ensuring compliance with NCAA rules. If coaches have a contractual guarantee immunizing them from such a threat, they will—at least in theory—have less incentive to promote enforcement.” On the other hand, McCann observes that “perhaps other than former New England Patriots HC Bill Belichick, there is no more coveted coach for NFL teams. That’s a key point. If Harbaugh remains at Michigan, it’s not clear if immunity from NCAA sanctions would become a new trend in DI coaches’ contracts or merely mark a special provision for an exceptional coach.” (link); Related, the Atlanta Falcons announce they have interviewed Harbaugh for the team’s HC vacancy. Inside the NCAA’s New Media Deal…
+ Endeavor EVP for Content Strategy and Development/WME Sports Co-Head Karen Brodkin and IMG Media EVP Hillary Mandel join The Athletic’s Richard Deitsch to discuss the NCAA’s new media rights deal with ESPN. For the media rights market writ large, Mandel explains that “the value of live sports today in some ways has never been greater, and the beneficiary of that is certainly the tier one sports who in so many ways are driving the revenue and the audience for all of the sports media players today. So, in understanding the market I think it is definitely figuring out where does your property fit into that ecosystem? And that comes back to managing expectations. … I think that the danger zone and where the headwinds are are taking the businesses right now are clearly for the more niche properties in a tier two to three position…who [need] to get even more creative and think about how can they get around what has always been some licensee money that they could pick up in order to continue to invest in themselves and grow.”
+ Brodkin emphasizes that Endeavor and the NCAA were well aware of the value of the women’s basketball tournament as a standalone entity even though it didn’t go to market, per se. In addition to the “objective, scientific, academic analysis” of the tournament’s value, Brodkin explains the group knew how much the property was worth to other potential buyers. “We understood who was interested in what and how much of the package or how little of the package. … I think the [$115M annual revenue] number does not include the investment in production. That is a separate investment to the tune of many millions of dollars. We understood what the distribution could look like comparing ESPN to another partner. Was it going to be broadcast? Was it going to be heavily distributed on national cable? … I think we can say with no hesitation that the deal that the NCAA secured with ESPN was the best combination of financial deal, production commitment, distribution obligations and maximizing of distribution for that tournament promotion and storytelling that any other comparable deal that was available in the market.”

+ Florida A&M AD Tiffani-Dawn Sykes has recommended to the FAMU Board of Trustees that the university hire a search firm to assist with the selection of a new football HC after her recommended candidate, Fort Valley State (DII) HC Shaun Gibbs, opted to stay with the Wildcats. According to HBCU Gameday’s Steven Gaither, Sykes “apologized for the communication break down on her end previously in regards to the coaching search. She also stated that, moving forward, she would like for the BOT to work with her and President Dr. Larry Robinson in finding FAMU’s next head coach. She stated she hoped to have a new head coach before signing day.” (link)

Colorado QB Shedeur Sanders and safety Shilo Sanders were in Paris yesterday to walk down the runway as fashion models in the Louis Vuitton Men's Fall/Winter 2024 Show. Before the show, the brothers met with producer/recording artist Pharrell Williams, who oversees the show as the men’s creative director for Louis Vuitton, and in a video for YouTube shot by Deion Sanders Jr., Shilo remarked: “We want to be multidimensional. We don’t want to be just football.” To which Williams responded: “You already are. It’s just that society makes you think that you are not. And you aspire to be other things, but you guys do so many things already. … If I were you, I would change that language: `I am multidimensional.’ You know what I’m saying? U.S. District Court Judge William Young yesterday blocked JetBlue’s proposed $3.8B acquisition of Spirit Airlines, agreeing with the U.S. Justice Department’s assertion that the deal would eliminate a competitor important to price-conscious travelers. Young: “JetBlue plans to convert Spirit’s planes to the JetBlue layout and charge JetBlue’s higher average fares to its customers. The elimination of Spirit would harm cost-conscious travelers who rely on Spirit’s low fares.” (link)

Ohio State officially announces Texas A&M AD Ross Bjork as the Buckeyes’ next AD, effective July 1. OSU President Ted Carter: “Few athletics directors have established such an impressive and strong record of success in athletics, in the classroom and throughout the community. The bar is incredibly high at Ohio State, and we have found in Ross a highly intelligent and effective leader – not to mention a fierce competitor.” Current Buckeyes AD Gene Smith: “Ross is uniquely equipped to step into our Buckeye community and make an immediate impact. Incoming Notre Dame AD Pete Bevacqua will officially take over on March 25, according to Irish Illustrated and The Irish Tribune, the latter of which also reports Bevacqua “has been in a very active role on campus for several months now, attending many athletic events and is in the offices into the evenings during the week. Current AD Jack Swarbrick will remain in the Notre Dame offices until June 30, and will be in a supporting role to aid Bevacqua.” (link)

This week’s congressional hearing to discuss U.S. Congressman Gus Bilirakis’ (R-FL) NIL bill now has a title: NIL Playbook: Proposal to Protect Student Athletes' Dealmaking Rights. Neither the hearing nor the bill, however, are “about protecting NIL rights,” per Kennyhertz Perry attorney Mit Winter, who contends the goal is rather to “restrict college athletes and keep them amateurs.” He adds: “In addition to containing an antitrust exemption and a provision that says athletes can’t be employees, the related bill prohibits schools/conferences/the NCAA from directly compensating athletes. It also attempts to severely regulate collectives and deals viewed as inducements.” Winter also notes UCLA football student-athlete Chase Griffin will be a witness during the hearing and expects “forceful pushback” from the Bruins QB. + Florida State Deputy AD for External Operations Janeen Lalik has been named EVP at Sabertooth Sports & Entertainment (SS&E), which is operated by the ownership group of the NHL’s Nashville Predators. As part of her new role, Lalik will assume the responsibility for the day-to-day operations of SS&E, including its relationship with Austin Peay athletics, F&M Bank Arena and existing Ford Ice Centers in Antioch, Bellevue and Clarksville. Georgia AD Josh Brooks comments on the football team’s GSR rate of 41, which was the lowest in the SEC by a wide margin, with LSU being the next closest at 69. “We have worked hard to be thoughtful and intentional about implementing strategies that will hopefully lead to better GSR outcomes. But it should be made clear that GSR is not the most reliable indicator of our student-athletes’ academic success — our efforts are not limited to a six-year window. Graduation along with providing targeted, differentiated and informed support for our student-athletes continues to be the goal. We have made significant progress in this area and acknowledge there is more work to be done to ensure that our vision is realized.” Among all Power 5 schools, UCLA was the next closest with a GSR rate of 64. + Arizona taps San Jose State Football HC Brent Brennan for the same role in Tucson. (link)
+ Michigan Football HC Jim Harbaugh remains engaged with the school about a possible contract extension, according to Yahoo’s Dan Wetzel, who reports that Harbaugh is “seeking language that would grant him immunity from termination from any finding or sanction that could arise from multiple current NCAA investigations into the football program. Harbaugh is also seeking a delay in the start date of the new contract to maintain a lower buyout that NFL teams would have to pay Michigan to hire him away. The buyout in his current contract dropped from $2.25M to $1.5M on January 11. Michigan is seeking that to rise to about $4M in a new deal. Harbaugh has sought to have the new deal not start until February 15, thus maintaining the lower, and more favorable, buyout number until after the NFL hiring cycle has concluded. Harbaugh is seeking a matrix of fines be spelled out if there are any future NCAA violations as well as prohibiting the school’s athletic director from firing him ‘for cause’ and instead having that decision, should it ever arise, rest in a three-member arbitration panel, sources said. … Michigan has already offered to make Harbaugh the highest-paid coach in college football via a guaranteed six-year deal worth $11.5M annually. There would be additional performance-based bonuses.” (link)
+ New Washington Football HC Jedd Fisch’s seven-year contract will pay him $7.5M to start and include raises of $75K annually for a basic total of $54.075M and an average salary of $7.725M, per USA Today’s Steve Berkowitz. If let go without cause, Fisch would be owed 85% of the pay remaining on contract. The buyout he would owe if he terminates the contract starts at $12M, then drops annually to $10M, $6M, $5M, $3M and $1M, respectively. Fisch will also be eligible for up to $1.55M in bonuses annually, and Washington will cover the $5.5M buyout he owes Arizona. Fisch's pay for 2024 and the deal's AAV put him among the top half of Big Ten coaches. He was making $3.25M this past season at Arizona. (link)

Overall in FY23, Penn State generated roughly $202.2M in revenues and incurred $202.07M in expenses. Revenues rose by nearly $21M, while expenses jumped by $31.5M. Jones notes the operating margin of $126K is a marked decrease from last year’s $10.6M surplus. The Nittany Lions’ football program saw a slight ticket revenue increase from $40.6M to $41.8M. Football as a whole brought in nearly $110M in revenue, up from $105.6M in FY22. The men’s basketball reported $1.76M in ticket sales, up from $624,335 the year prior. (link); Penn State football reported a revenue stream of $9.6M in program, novelty, parking and concession sales for FY23, a bump up from $7.82M the year prior, according to StateCollege.com’s Ben Jones, who adds: “While the athletic department does not attribute the increase in revenue to any specific change, the reporting year does coincide with the decision to sell beer at Beaver Stadium starting in October of the 2022 season. Murray State announces a significant renovation to the men's basketball locker room and team spaces. Funded through the private support, the upgrades will also feature new branding and will be completed prior to the 2024-25 season. Racers AD Nico Yantko: "We are continuing to invest championship resources into our basketball program and enhancing our locker room and team spaces are a big component of that plan. These renovations are long overdue and are vital to the continued emphasis of the student-athlete experience around our men's basketball team. We cannot wait for these upgrades to be completed." Packages are now available to current season ticket holders. The Grand Forks Herald’s Brad Elliott Schlossman takes a look at what is holding college hockey back from holding NCAA Men’s Hockey Tournament regionals at home sites and notes: “According to conversations with a dozen college hockey leaders, there are athletic directors and coaches who believe it's unlikely their teams will ever be in the top eight of the Pairwise Rankings and have the ability to host. So, they'd rather play in an empty arena in the middle of a college hockey desert than in a packed house on campus. They believe that gives their teams the best chance to advance. It's not good for the players. It's bad for the fans. It's terrible for television. It's a short-sighted approach and one that doesn't even add up.” ESPN’s John Buccigross also weighs in and says: "Obviously, the strength of college sports is the atmospheres. In some cases, it's what separates it from pro sports. Sometimes, the intensity is the same, but college fans tend to be younger, which is obviously more boisterous, engaged and energetic." Denver HC David Carle is also a proponent and tells Schlossman: "Us and Boston College have won more than anybody in the current model. It's not coming from a stance that this would be better for Denver. The current model works for us. … I'm a young coach. I plan on doing this for a long time. I want to see our game grow. I think we need to think outside the box and have some uncomfortable conversations and think of ideas of how to actually make the game better and not just stick with the status quo." (link)

Sportico’s Michael McCann believes the most significant NIL development last week was U.S. District Court Judge Robert Gettleman’s ruling against Chicago State men’s basketball student-athletes Matt and Ryan Bewley, who were seeking to have their eligibility reinstated after receiving compensation from Overtime Elite. “Judge Robert Gettleman also clarified that although the NCAA lost NCAA v. Alston and is losing Ohio v. NCAA, neither antitrust case involves NIL. Instead each concerns specific and fairly narrow situations (education-related benefits and repeat transfers, respectively) that shouldn’t be interpreted as broad repudiations of amateurism. It was perhaps the best week for the NCAA’s leadership on NIL in two decades.” Still, McCann notes the NCAA risks antitrust challenges anytime it limits opportunities for student-athletes to pursue compensation or for schools and conferences to pay athletes. “But fear of antitrust litigation isn’t a good way to conduct business, especially since defendants usually win antitrust cases. … More flexible NCAA rules, such as allowing NIL but meaningfully regulating collectives, would probably withstand legal scrutiny. The NCAA could also credibly challenge state laws that restrict its ability to enforce NIL rules.” (link)
