U.S. Ninth Circuit Court of Appeals Judges Kim McLane Wardlaw and Jacqueline Hong-Ngoc Nguyen have denied the NCAA’s request for an interlocutory appeal (an appeal before a final judgment in a case) of House v. NCAA case before it heads to trial. Sportico’s Michael McCann and Daniel Libit: “Such appeals are rarely granted. Appellate courts strongly prefer to review cases only after a final judgment on the merits, and this case is not scheduled for a jury trial until 2025. The basic logic: A final judgment offers a completed matter to review, while an interlocutory appeal concerns only a preliminary or incomplete matter.” The NCAA had previously warned that “denial of this petition would be the death knell of the litigation.” McCann & Libit also note that plaintiffs’ attorneys “successfully argued the NCAA failed to identify the necessary ‘extraordinary’ circumstances for an interlocutory appeal and questioned the NCAA’s insinuation it would struggle to pay.” From their brief: “More than $7B in annual revenue attributed to P5 public schools alone ought to be enough to cover defendants’ litigation costs.” (link)

NCAA VP of Women’s Basketball Lynn Holzman joins Fox Sports/Connect’s Bryan Fischer from the 2024 NCAA Convention to provide context and details on the new media rights deal and the decision to not break women’s basketball away from the entire package. The two also talk about the potential for revenue distribution, trends in the transfer portal, maximizing opportunities at host sites for championships and more. On the media rights negotiations, Holzman says: “I can assure everyone that throughout the entire process here everything was on the table. … At the end of the day, the objective was really for the NCAA – and then, inherently within that, women's basketball – to make sure we achieved the best we could within the current market around reach, relevance and revenue. With the information what's been shared around having that $65M average annual value for women's basketball, it also was specifically important for us, even with it being a package deal, that that was going to be part of the deliverable out of this is, to make sure that there was a specific assigned value for women's basketball. In some ways [that was] to mitigate what you just said about why didn't you go to market, but I can assure everyone it was very thorough and every single angle was looked at and everything at the end of the day the best deal was made for the organization for our championships and for women's basketball.” Lots more from Holzman on Collegiate Sports Connect. Freshly minted South Dakota AD Jon Schemmel joins the YoteCast and says he’ll be on the lookout for patterns – “good, bad or indifferent” – when talking with coaches, staff and student-athletes in order to determine what issues need to be addressed urgently. Big picture, Schemmel notes: “We look at obviously the climate we're in with NIL, with the collectives, with Alston funding, with all these different things. … We have to work within the rules that the NCAA is allowing us; otherwise, in my opinion, we're doing a disservice to our student-athletes. What does that mean as far as collectives and things for us? I don’t know. Do I ever think we're going to line up and have a starting five that is each being paid $100K? No, I don't. Do I think that we have people out there that want to be a part of that…[and contribute to support NIL]? Absolutely…but I think the biggest thing in all of that is to not kind of set one or two priorities and then shove that down people's throats. We need to set up a giving platform and an engagement process that really brings everybody in.” Schemmel also talks about the transfer portal and points out that “the adults (coaches) are leaving,” though he points out there is often a buyout attached. While he doesn’t suggest attaching buyouts to players transferring, Schemmel does believe “there’s got to be some kind of parameter in which the school that loses somebody, they’re not put at a disadvantage. … [But] until the adults fix what the adults do, I think the student body” has a strong argument for similar agency. North Alabama professor James L. Watkins, North Dakota State professor Kelsey Slater and Big West Asst. Commissioner for Student-Athlete Programming Leslie Chang examine the state of academic advising at FBS programs and find that at least 95.6% of advisors who responded to their survey indicated having a master’s degree while just 10% had a doctoral degree. Additionally, over half of advisors reported that they played a college sport at the NCAA, NAIA or junior college level, with two-thirds of those playing on a DI team at some point. The results, they point out, remain largely unchanged from a similar 2017 study conducted by Kansas State professor Lisa Rubin. While the credentials of academic advisors across FBS, FCS and schools without football (NF) appear largely similar, Watkins, et al. point out that “the advisors at Power 5 and Group of 5 athletic departments were significantly more likely to have worked as a graduate assistant or paid intern in athletic academic support. FCS athletic departments, however, hired more former college coaches. It is important to point out that the advisors in our study only reported what type of work they did before becoming an advisor.” As far as the job itself, the researchers found that P5 advisors advised less teams than their G5 peers. The same applied to advisors at G5 departments compared to FCS and NF departments. Yahoo’s Dan Wetzel weighs in on Michigan Football HC Jim Harbaugh’s contract negotiations and why he is negotiating for for-cause immunity from the school if he is found to have violated NCAA rules. Wetzel believes regardless of any findings, Michigan would not part ways with Harbaugh: “Nobody’s firing Jim Harbaugh for that. This is baked in. He just won the national title. Anybody who tries to fire him will get fired because the fans will revolt.” Wetzel goes on to note, however, that Harbaugh’s representation is insisting on something in writing at least in part because of the NCAA’s strict liability rule. “I think this will be the trend going forward. If Harbaugh gets this, I would think almost every coach in the country is going to try to push for this. … There’s 100 people working for a program. You now have a $10M-a-year job or your career on the line hoping that 100 people follow all the rules to a tee. … So, the NCAA has come up with this strict liability on the coaches, and the coaches are going to seek contractual protection to say, ‘That's a bunch of crap. Michigan State Men’s Basketball HC Tom Izzo has no plans to retire after this season and tells CBS’ Matt Norlander: “I'm too stubborn to even think about doing it in the near future because I almost want to fight the system. And the system might get me. The system may get me. But the system may not get me, either." If/when he does retire, Izzo says: “I'm sure I'll be more in the Jay Wright and Nick (Saban) way of doing it. When it's over, it's over and I'm walking away. But I've got a good recruiting class, I've got an opportunity to coach my former player's son, which I'm really looking forward to — (Jase) Richardson — I'm in a good place in every part for me, except the frustration of the day-to-day, never knowing where you are, you know? That's hard." Izzo also tells Norlander he worries about the balance between player empowerment and player accountability amid the shifting landscape. "I worry about that every day, I swear to God to you I worry about it. Some [doubt my sincerity] because it's always self-serving. If it was self-serving I would've taken a pro job for a lot more money. If it was self-serving I'd get out of it. I still care about these guys. And I'm lucky because I actually got a pretty good bunch of guys and I got some good guys coming in, and so we'll see. I think we still got a couple of runs in us." (link)

UNLV is slated to receive $1.98M from the Las Vegas Stadium Authority to make up for a revenue shortfall tied to the school’s 2022 football season. This is part of UNLV’s joint-use agreement with the NFL’s Las Vegas Raiders for playing at Allegiant Stadium, which notes that any net income under $5M generated in a fiscal year would be paid for by a waterfall fund set up to incur such costs. Up to $3.5M is available each year for the first 10 years of Allegiant Stadium being in operation to cover a revenue shortfall for UNLV games. The measure was unanimously approved at yesterday’s Authority meeting. In taking a look at former Richmond men’s basketball student-athlete Tyler Burton’s decision to transfer to Villanova, the Richmond Times-Dispatch’s John O’Connor notes the “Wildcats’ NIL budget for this season’s team is reportedly $3M.” Asked if NIL was the reason for Burton’s transfer, Spiders HC Chris Mooney says: “I would have to assume that NIL was a major factor. Anyone in that situation would have to consider that strongly. … I don’t know specifics. Because this is not governed or regulated or transparent or public, there are a lot of rumors and innuendo. The number that a particular player would be offered could easily be manipulated to (affect) the next school pursuing him. I don’t know that it’s accurate, but I would say that, probably similar to the budgets, (a Power Six) school versus an A-10 school, I would have to assume that there’s (an NIL) disparity.” (link)

Roellke discusses the opportunities before the program, the type of administrative background that fits the department's current needs, how he intends to engage with a new senior leader and what he loves about the DeLand community. On what traits he’s looking for in the next AD: “Kindness comes to my mind again. I happen to believe that kindness is really vital in higher education. I think it's vital in our world, particularly in a divided world. So, I'm looking for an athletic director that's kind. I'm also looking for an athletic director that's empathic and also one that's a collaborator. I've been asked by our donors and others about the qualities I'll be looking for in the next AD, and I think that no matter what role you play at Stetson you've got to be an educator. … I think of being collaborative and nimble and flexible as an important set of characteristics for a successful AD at Stetson University, and I also hope they really want to be here. The U.S. Department of Justice today joined the multistate lawsuit led by Ohio Attorney General Dave Yost which challenges the NCAA’s transfer eligibility rule as an illegal restraint on college athletes’ ability to sell their image and likeness and control their education. The states of Minnesota, Mississippi and Virginia, as well as the District of Columbia, have also joined the suit, bringing the total number of attorneys general who are backing the litigation to 11. Yost: “There is strength in numbers. This case would never have come to pass had many players not been sidelined by the NCAA’s arbitrary and unfair rule. We’re fighting for better competition and long-term change.” (link)

+ During today’s NIL Playbook: Proposal to Protect Student Athletes’ Dealmaking Rights congressional hearing, NCAA President Charlie Baker during his testimony indicated that losing the Johnson v. NCAA case would “cost us about half to two-thirds of all the college sports programs around the country." Also from Baker: “If you convert all of college sports into employment, there is simply no doubt, based on math, that you will lose an enormous number of student-athlete opportunities. The money is just not there. Most schools lose money on sports."
+ UCLA QB Chase Griffin delivered a “withering critique” of U.S. Congressman Gus Bilirakis’ (R-FL) discussion draft legislation, according to On3’s Eric Prisbell. Specifically, Griffin pointed out that the bill includes more than 200 “negative references” to the NIL space with words such as regulate, prohibit, sanction, restrict and inducement. He notes that it is devoid of words such as freedom, growth, innovation, or Title IX. Griffin: “This bill simply codifies an outdated NCAA business model that Supreme Court Justice [Brett] Kavanaugh wrote ‘would be flatly illegal in almost any other industry in America.’ If enacted, this bill would deprive another generation of college athletes of a proven and growing pathway to the American Dream.” Griffin also remarked: “In every other aspect of American life, the expectation is that if you work hard, play by the rules and create value, you deserve to share in that value. Why shouldn’t this core American principle be true for college athletes?”
+ Radford volleyball student-athlete Meredith Page disagreed with Griffin’s stance on student-athletes becoming employees, citing concerns about the elimination of some sports and Title IX compliance. “Many of these questions are at the forefront of the minds of student-athletes and need to be resolved before any new model is implemented. I urge you to take action as the employment model causes grave concern for other athletes to have the ability to do the same thing I have. To grow, to prosper, and acquire an education.”

Louisville AD Josh Heird tells LEO Weekly’s Tim Sullivan he’s fully aware of how quickly the landscape is changing, but “I haven’t had a single phone call with anybody else questioning the future of the ACC. I do think we always need to remember that while we have these ideas that the demise of the ACC is coming, there’s four elite conferences and we’re in one of those. That’s pretty good. I’m very comfortable saying we are proud members of what is still considered one of the top conferences in the country.” That said, Heird acknowledges there’s a gap between the SEC and Big Ten and everyone else. “In any industry, you feel the financial constraints that are put on you. I don’t think there’s anyone out there that said, ‘If I had a little less money, this would be easier.’ As athletic directors, that is what we are all tasked to do, (manage) the resources that are provided to us. I think we’ve proven and the ACC membership has proven that those financial constraints have not hindered the success of this conference.” Heird on Florida State’s legal action against the ACC: “Most of the time when both parties agree to a contract, in order to be relieved of those responsibilities that each side has agreed to, there has to be concessions somewhere. Everything has a price. What are those concessions? Is either side willing to entertain them? I have no idea.” (link)

+ Major athletic departments likely will end up spending a combined total of at least $200M in connection with football coaching and staff changes made during and after the 2023 season, according to USA Today’s Steve Berkowitz, although he notes the “final overall total for the 2023 cycle will not be known for several years. Some amounts owed to fired coaches are set to be made over time, and many of those amounts are subject to coaches having to make good-faith efforts to find new jobs that create offsetting income.” Taking into account the offsets known so far, USA Today still estimates major universities will spend upwards of $191M in coaching turnover, including $127.1M to HCs, $32M to ACs and $32.4M to cover amounts newly hired HCs or ACs owe a previous employer. However, “all of this is without Alabama, Washington and Arizona having officially announced their full assistant coaching staffs. The U.S. Ninth Circuit Court of Appeals yesterday ruled that six former Fresno State women’s lacrosse players suing the school for Title IX sex discrimination “were not implicitly biased against the interests of its other female athletes,” according to Sportico’s Daniel Libit, who notes the appeals court “vacated a district court judge’s order denying class certification in the case based, in part, on the argument that the plaintiffs would favor the school’s former lacrosse program over its existing female varsity sports.” The lawsuit was originally filed in February 2021, following Fresno State’s decision to cut its women’s lacrosse and men’s and women’s wrestling teams, and the Ninth Circuit found that the district court “clearly erred” in its ruling and agreed with an amici curiae brief filed by 18 civil rights organizations that stated: “If attorneys are not automatically disqualified where actual conflicts exist in class actions, young women who seek to represent and protect other women’s rights, as they seek to vindicate their own, should not be disqualified based on speculative conflicts.” Plaintiffs’ attorney Arthur Bryant: “The district court held that women on one team could not constitutionally represent women on other teams. The Ninth Circuit’s ruling makes clear that isn’t so.” (link)

The College Sports Research Institute has released its 14th annual FBS Adjusted Graduation Gap (AGG) report, which indicates that the “overall FBS AGG improved/decreased from -17.5 in 2022 to -16.7 in 2023. While both Power 5 and Group of 5 AGGs improved/decreased slightly year-to-year, there remains a significant gap between FBS football players’ graduation rates and those of full-time male students.” Meanwhile, the College Football Playoff top 10 have an AGG of -28.7, greater than the overall P5 AGG (-18.6) and greater than the G5 AGG (-14.8). The 2023 P5 conferences’ AGG “remains sizable and significant at -18.6,” while the G5’s AGG of -14.8 reflects a 1.3% decrease from 2022. In addition, the AGG for P5 Black players (-24.2) improved/decreased by 1.2 percentage points from 2022, while the AGG of White players on Power-5 rosters (-2.9) improved/decreased by 0.8 percentage points. Also from the report: The difference in the Black-White AGG is much less in the Group of 5 (10.9 points ) than the Power 5 (21.5 points), but the gap has grown 2.2 points since 2022 (-8.7). Among the Power 5 leagues, the Big 12 continues to have the smallest AGG (-13.6), while the SEC had the largest AGG (-22.4) for the third consecutive year. The MAC continues to have the smallest G5 AGG (-6.3), while the AAC has the largest (-29.0) for the second consecutive year. Full report. (link)
