Extra Points’ Matt Brown parses some of the claims made during yesterday’s congressional NIL hearing, including NCAA President Charlie Baker’s assertion that if all student-athletes are made employees, then an “an enormous number of student-athlete opportunities” will be lost. Brown agrees with the arithmetic but is doubtful that every student-athlete must be designated as an employee. “If a school does not have the money or political will to pay an athlete like an employee, they could simply elect to not treat an athlete like an employee. Rather than wholesale cut programs en masse, Baker, conference commissioners, or school-leaders could also push for a conversation about how to reform the obligations and terms of Olympic sport management to simply comply with the FLSA. That conversation has largely not happened in public.” On the other side of the equation, Brown asks why the NCAA isn’t seeking an antitrust exemption to contain coaching salaries and buyouts as a means to help save the imperiled Olympic sports. “If cost control was actually a major concern from college athletics leaders, you’d think that would also be part of their ask to lawmakers, no? That’d probably help pay for a few more sports programs.” More from Brown. (link)

Yahoo’s Ross Dellenger adds some context to U.S. Congresswoman Lori Trahan’s (D-MA) comment yesterday in which she indicated she was “not optimistic that this is going to be a Congress where we figure out college athletics at large.” Dellenger notes Trahan’s remarks come from “one Democratic lawmaker from one chamber of Congress. In the Senate, Sens. Ted Cruz (R-TX) and Cory Booker (D-NJ) have been engrossed in negotiations over a compromise piece of legislation. In fact, in September, Cruz himself proclaimed that there was a 60% chance that a bill passes this Congress.” (link)

Sportico’s Daniel Libit observes that despite all of the rhetoric about bipartisanship, yesterday’s congressional NIL hearing “captured the emerging political divide over college sports’ future now that the discussion has moved beyond general NIL rights to the more far-reaching (and left-leaning) objectives of athlete employee status, unionization and revenue sharing. Bilirakis’ legislation, which he originally proposed this past May, introduced wedges into the issue of college-athlete moneymaking. The bill would preempt state laws to create a national NIL enforcement standard (and an independent commission), prevent college athletes from becoming employees or union members, and grant the NCAA its long-coveted antitrust protection.” Congressman Frank Pallone (D-NJ), the Energy and Commerce Committee’s ranking member, remarked that “this committee should be working to preserve athletes’ NIL rights. Instead, the Republican committee leadership has chosen to take up a discussion draft that would do more harm for college athletes than good.” Congresswoman Lori Trahan (D-MA) added: “The very people this committee seeks to quote-unquote protect don’t actually trust we have their best interest in heart. And I don’t think the bill as drafted today would do much to change that.” (link)

South Carolina’s Gamecock Club added a record 5,600 members during 2023, bringing its total membership to 19,373, marking just the third time it has eclipsed the 19K mark and the first since 2015. Meanwhile, the Student Gamecock Club eclipsed the 4K mark for the first time with 4,018 members. Gamecocks AD Ray Tanner: “I am extremely proud and grateful for the fantastic support of Gamecock Club members. They have filled the stands, cheered loudly, and donated generously to help us provide a world class experience for our student-athletes. The growth the Gamecock Club has seen this past year is a testament to the strength and spirit of our Gamecock community.” (link)

North Dakota State’s fundraising arm, Team Makers, contributed $5.5M to Bison athletics in 2023. Overall, Team Makers saw cash donations total over $5.5M. Trade for goods and services totaled more than $513,430, in addition to more than $1.7M in other revenues with the total impact for NDSU Athletics in 2023 surpassing $7.7M. (link)

Sports Illustrated’s Future…
+ Authentic Brands Group, the owner of Sports Illustrated, is pulling Arena Group’s license to publish SI and “we will be laying off staff that work on the SI brand,” according to an email sent to Arena Group. Sportico’s Brendan Coffey and Jacob Feldman unpack the logistics: “Arena Group is a publicly traded publisher that acquired the rights to publish SI in 2019 from ABG. Authentic Brands bought SI from a traditional publishing house in 2019 for $110M. ABG is a business that acquires the intellectual property of stars and brands and makes its money from licensing deals—their portfolio includes Muhammad Ali and Marilyn Monroe. Arena Group missed a $3.75M quarterly payment on its license at the end of 2023, triggering the right for ABG to pull the license.” In a filing with the Securities and Exchange Commission today, Arena Group indicated the loss of its SI license means it immediately owes ABG $45M; however, Arena suggests the loss of the license or some of the financial terms aren’t set in stone yet, stating it is “engaging in continuing discussions with ABG regarding the Licensing Agreement.” More from Sportico. + Sports Illustrated’s Pat Forde: To correct some erroneous reporting, Matt Lombardi of the Arena Group: ‘We are going to continue to operate Sports Illustrated. ... Either Arena or someone else is going to have the license to operate Sports Illustrated.’” Forde adds that the entire staff was not laid off. “There still is a website and a magazine. That said: Ugly, brutal day with many layoffs. Nothing quite like hearing colleagues and friends saying they just got termination emails in real time while on a Union zoom call.” (link)
+ According to an email obtained by The Athletic’s Richard Deitsch, Arena Group informed employees that all those who are impacted will receive severance pay and be entitled to any applicable notice period outlined in the union agreement. Employees who are laid off immediately will be paid in lieu of the lack of notice period, pursuant to the union pact. (link)
+ In a press release, Arena Group says the company is “actively engaged in negotiations with Bridge Media Networks, LLC, (‘Bridge Media’) a wholly owned subsidiary of Simplify Inventions, LLC (‘Simplify’). The ongoing efforts aim to conclude the transaction in early 2024, including a substantial investment as part of the Bridge Media deal.” Arena Group Chief Business Transformation Officer Jason Frankl: “My immediate focus is to collaboratively design a growth-oriented media company, ensuring the financial stability necessary to cultivate and grow the brands we cherish. Utah Representative Jordan D. Teuscher (R-Salt Lake) has introduced HB202, which outlines what would and would not be permissible by student-athletes and universities in regard to NIL. The bill also gives donors a path to receiving perks for supporting collectives. Teuscher says several collectives informed him donors were hesitant to contribute because they didn’t feel they were getting enough in return. “One of the gaps that they saw is that a lot of donors wanted to get booster credit for the donations that they were making to the collectives so that they could get…some sort of personal benefit beyond just altruistically wanting the teams to perform better and being able to pull in better athletes.” Specifically, the bill states that it would not limit or prevent “a collective from creating a loyalty points program to recognize or provide benefits to donors.” Teuscher, who serves as vice chair of the House Rules Committee, says any such program would need to be agreed upon by the universities and collectives. “What we were trying to do was just put in statute what the current situation is in alignment with NCAA rules and what the different universities have done.” (link)

USF Vinik Graduate Sport Business Program Director Emeritus/South Carolina professor Bill Sutton outlines his plan for college sports moving forward, and it starts with accepting student-athletes as employees. “Let’s cut to the chase. Given that these athletes technically work in the promotion of the college/university and provide entertainment that has a value defined by media companies, gate prices and development efforts by that same university — create employment contracts. The contracts should be standardized — set employment terms and limits, set working conditions, establish a wage scale with appropriate benefits such as insurance, medical coverage and retirement plans along with workers’ comp and catastrophic insurance. Such a move could logically lead to unionization but that’s for another column at another time.” Sutton also calls for eliminating the focus on enrollment in classes while student-athletes are eligible to compete. “The Dream Team demonstrated that national pride and winning was more important than amateurism. … Am I denigrating the value of a free education? Absolutely not. Under this new philosophical approach, every student athlete will be awarded a scholarship following completion of the terms and length of their employment (previously referred to as eligibility).” Finally, Sutton believes a collectively bargained model would “limit the transfer portal and the gunslinger-for-hire mentality that NIL and the transfer portal has created.” More.
