John Carroll is officially leaving the OAC for the NCAC in 2025-26 to become the league's 10th full member. Blue Streaks AD Brian Polian: “We need to be associated with universities that are going to offer us a chance to broaden our reach. We cannot exist into the future here as just a regional school. We’re building a national brand here and association with the schools in the NCAC’s going to allow us to do that.” On comments that JCU is afraid of competition, Polian: “That bothered me a little bit. Carroll has never been afraid of competition. We never will be, and for that matter, for eight straight years we were the OAC all-sports champion in the men’s program, and on the women’s side consistently finished in the top third of the league. Competition has never been an issue here and it’s not going to be moving forward.” (link, link); In response, the OAC released a statement, which reads in part: “The OAC is committed to future strategic conversations with peer conferences and select institutions that align with the conference’s belief that athletics is an extension of higher educational programs and academic excellence. Through these collaborations, the OAC will consider conference-specific composition and scheduling as well as creative approaches aimed at benefiting Division III as a whole. While those strategic conversations are ongoing, the OAC and the Heartland Collegiate Athletic Conference plan to enter into a football scheduling agreement for the 2025 football season and are in the process of determining whether crossover scheduling in other sports for that same year may be appropriate.” (link)

NCAA Legal Matters:

+ U.S. Ninth Circuit Court of Appeals Judges Kim McLane Wardlaw and Jacqueline Hong-Ngoc Nguyen have denied the NCAA’s request for an interlocutory appeal (an appeal before a final judgment in a case) of House v. NCAA case before it heads to trial. Sportico’s Michael McCann and Daniel Libit: “Such appeals are rarely granted. Appellate courts strongly prefer to review cases only after a final judgment on the merits, and this case is not scheduled for a jury trial until 2025. The basic logic: A final judgment offers a completed matter to review, while an interlocutory appeal concerns only a preliminary or incomplete matter.” The NCAA had previously warned that “denial of this petition would be the death knell of the litigation.” McCann & Libit also note that plaintiffs’ attorneys “successfully argued the NCAA failed to identify the necessary ‘extraordinary’ circumstances for an interlocutory appeal and questioned the NCAA’s insinuation it would struggle to pay.” From their brief: “More than $7B in annual revenue attributed to P5 public schools alone ought to be enough to cover defendants’ litigation costs.” (link)

+ The U.S. Department of Justice joined the multistate lawsuit led by Ohio Attorney General Dave Yost which challenges the NCAA’s transfer eligibility rule as an illegal restraint on college athletes’ ability to sell their image and likeness and control their education. The states of Minnesota, Mississippi and Virginia, as well as the District of Columbia, have also joined the suit, bringing the total number of attorneys general who are backing the litigation to 11. Yost: “There is strength in numbers. This case would never have come to pass had many players not been sidelined by the NCAA’s arbitrary and unfair rule. We’re fighting for better competition and long-term change.” (link)

NCAA SVP of Championships Joni Comstock announces her retirement, effective March 1. Comstock’s 44-year career in athletics includes the last 17 in her current leadership role with the NCAA as well as AD stops at American (DI) and UNC Asheville (DI). (link)

Live from on Capitol Hill:

+ During yesterday's NIL Playbook: Proposal to Protect Student Athletes’ Dealmaking Rights congressional hearing, NCAA President Charlie Baker during his testimony indicated that losing the Johnson v. NCAA case would “cost us about half to two-thirds of all the college sports programs around the country." Also from Baker: “If you convert all of college sports into employment, there is simply no doubt, based on math, that you will lose an enormous number of student-athlete opportunities. The money is just not there. Most schools lose money on sports."

+ A key tweet from Yahoo’s Ross Dellenger: “The most noteworthy thing to emerge from the college sports hearing happened afterward, when Rep. Lori Trahan (D-MA) said she doesn't believe Congress will come to a consensus on granting employment exemption & antitrust to the NCAA. "That is not going to pass both chambers. … This Congress just doesn’t seem like the Congress where we’re going to have a lot of bipartisan wins. These are big thorny, tough issues. I’m not optimistic that this is going to be a Congress where we figure out college athletics at large." (link)

+ Dellenger adds some context to U.S. Congresswoman Lori Trahan’s (D-MA) comment yesterday in which she indicated she was “not optimistic that this is going to be a Congress where we figure out college athletics at large.” Dellenger notes Trahan’s remarks come from “one Democratic lawmaker from one chamber of Congress. In the Senate, Sens. Ted Cruz (R-TX) and Cory Booker (D-NJ) have been engrossed in negotiations over a compromise piece of legislation. In fact, in September, Cruz himself proclaimed that there was a 60% chance that a bill passes this Congress.” (link)

Sport Sponsorship + Membership:

+ Capital will grow its department to 22 sports with the addition of Men’s and Women’s Bowling in 2024-25. AD Darrell Bailey, Sr.: “It has been 10 years since we have added a new varsity sport here at Capital University. I am very excited to be a part of adding the sport of Men's and Women's Bowling at a time that seems perfect for our athletics department. Bowling appears to be a sport that will allow us to recruit students in a sport that is popular at the high school level within our area.” (link)

+ Lesley will add Men’s Golf starting in 2024-25, with the Lynx simultaneously deciding to suspend sponsoring its Men’s Volleyball team. AD Dan Campagna: “This was an important component in our decision to add a new sport, knowing that our student-athletes will have immediate access to a conference championship with an AQ on the line will enhance their student-athlete experience and give our first Head Coach something to strive for in the inaugural season of competition. […] Putting a pause on a program is not a fun part of this job, especially a sport in which I competed in as a collegiate student-athlete. However, it was clear that a men's golf program would provide a more well-rounded and positive student-athlete experience than the product of a men's volleyball team. To me, the student-athlete experience will always be of paramount importance and something we're constantly monitoring for all our programs at Lesley." (link)

Lewis & Clark is exploring changing its nickname from the Pioneers after sending a survey to university constituents this week. The 19-member Mascot Steering Committee includes AD Mark Pietrok and FAR Anne Bentley and will present a final recommendation to President Robin Holmes-Sullivan later this spring. (link)

Wednesday’s 211th edition of The Rivalry between Calvin and Hope Men’s Basketball brought 4,102 fans to Van Noord Arena. A testament to the draw of The Rivalry – that total is more than all but 27 DIIIs have had the whole season thus far. (link)
