Sportico’s Michael McCann explains why it will be the judicial rather than the legislative branch that decides the future of college sports: “It will be judges, who at the federal level have lifetime appointments and who usually resolve debates by applying law to specific questions presented in a case. That means judges won’t abstractly determine if states can prevent the NCAA from enforcing NIL rules. Instead, they’ll consider if the law of one state violates provisions in the state and federal constitutions. How that impacts other states and their laws could spark additional legal controversies. That’s how precedent works: taking one decision spawned by a unique set of facts and arguing the decision and accompanying legal reasoning ought to apply in a particular way to a similar set of facts. Likewise, judges won’t consider if the NCAA’s system of amateurism is illegal under antitrust law. Instead, they’ll attempt to resolve usually confined antitrust disputes, such as whether Power 5 conferences should be able to share broadcast money with players. … How those resolutions ought to impact judges in other state and federal jurisdictions and antitrust challenges to other NCAA rules is what lawyers are paid to figure out. … Law works incrementally. Decisions are subject to appeal, subject to additional appeals. The unhurried pace is even more noticeable in this era of instant news and hot takes.” (link)

Auburn finished FY23 with $195.3M in revenue and $192M in expenses. The Montgomery Advertiser’s Richard Silva notes, however, that the surplus was “made possible by the $25M athletics received in direct institutional support, which is way up from the $9.7M the department received in 2022. These numbers come a year after Auburn had a $22.9M surplus in 2022, which was an athletics department record according to data dating back to 2005. The previous high was $19.4M in 2008, with other high-profit years including $17.8M in 2020, $15.2M in 2016 and $14.6M in 2017. The operating revenue in 2023 ($195.3M) was higher than it was in 2022 ($174.6M), but the operating expenses increased more than $40M from $151.6M to $192M.” The uptick in expenses is partially attributable to former Football HC Bryan Harsin’s $15M buyout, half of which was due within 30 days of his departure. Overall, the Tigers reported severance expenses of $19.9M, up from $8.2M in FY22. Silva also notes that football was still the biggest revenue generator for the athletics department. “The program had an excess of just under $54.5M. That number does include $21.9M from direct institutional support, though. The program was given $616,050 in 2022. Meanwhile, the men’s basketball team finished the year $4.2M in the black. (link)

VCU will begin work on its new Athletic Village this spring. The project will include new athletics fields, an indoor/outdoor tennis facility, a soccer stadium, futsal courts and more. Rams AD Ed McLaughlin: “The practice fields will be the first (phase) because our teams don’t have practice fields right now. So that’s priority number one.” McLaughlin also notes much of the village will be open to the public. “We want these facilities to be busy 350 days a year and have them be really highly useful for our community.” Meanwhile, McLaughlin confirms that the timing of the pending sale of Sports Backers Stadium won’t impact the Athletic Village’s construction, explaining that “we’re moving forward on what we’re doing. The momentum that we have is great, so we’re not stopping. … “Hopefully we’ll all have ballpark agreements done soon and have some clarity on the Diamond District too. I think both sides of Hermitage Road will help each other be successful.” (link)

SBJ’s Bret McCormick provided three sports real estate experts with Tennessee’s RFP for a mixed-use development around Neyland Stadium, and “one sports real estate developer who studied the RFP six weeks ago while considering a potential bid noted that the district size is small (only one building pad; other potential retail space could be developed above an existing parking deck), there might not be enough parking, and that the sheer scale and adjacency of Neyland Stadium could be tough to design and develop around, especially if the stadium was only active seven or eight days each year.” The developer tells McCormick: “Felt like the kind of thing an alum who has some [financial] juice would pick up.” Transwestern Managing Director for Sports and Entertainment Tim Katt, who helped Overtime Elite develop its facility in Atlanta, similarly felt that most private developers unaffiliated with UT would likely pass on the opportunity: “The TBD land lease structure, program, and design requirements, required layers of approval, developer responsibility for all costs, and the university’s desire to play a role in any and all economics will make it a real challenge for any developer to move forward under the current process.” Pontem Resources Founder/President Malaika Rivers, however, says the partnership with a government entity could provide enough stability to outweigh the red tape and bureaucracy. UCF-focused The Kingdom NIL Executive Director SJ Tuohy talks with the Orlando Sentinel’s Matt Murschel about the collective’s growth and says: “The good thing about the Big 12 and the good thing about UCF is that we’ve pushed the boundary on a lot of stuff. There’s no finish line with the Kingdom or NIL. The more money you raise, the better players you get, the higher the expectations will become and then it starts over. … It may take a minute to get our heads above water and understand what it’s going to take to hang in this league, and once you realize where you stand and what it takes you can start trying to be competitive and get ahead.” Meanwhile, Knights AD Terry Mohajir tells Murschel the collective’s fundraising efforts do not appear to be eating into UCF’s revenue generation: “Our fundraising is at an all-time high. Our annual fund is at an all-time high, our major gifts are at an all-time high, but now, we have more people giving to the NIL. … We are promoting the Kingdom. It’s one of our four parallel tracks: operating budgets, personnel, facility maintenance and then recruiting and that’s the Kingdom.” Mohajir also notes: “We’re a young fan base and we have a lot of unbelievably dedicated and wonderful supporters helping us fund it. We keep grinding at it, of course, no one ever has enough.” (link)

Following the weekend’s court-storming incidents, particularly Iowa women’s basketball star Caitlin Clark’s collision with an Ohio State fan, Sportico’s Michael McCann examines the risks involved from a legal standpoint and explains: “While these types of incidents are uncommon, they can spark liability if injuries result. Fans and players assume numerous risks by virtue of attending a sporting event, but the risk of being injured by rushing fans is arguably outside the scope of that assumption. The reasonableness of the facility’s security measures to deter and stop the rushing are key parts of the legal analysis.” To date, the amount of litigation in such cases has been sparse, but McCann notes that in 2003, a former Ball State student sued the manufacturer of a football goal post after the post collapsed onto him and broke his back. The post snapped under the collective weight of fans, who stormed the field and climbed the post after Ball State defeated Toledo. Ball State was also a defendant and negotiated a settlement.” (link)

+ DePaul has parted ways with Men’s Basketball HC Tony Stubblefield. (link); The Messenger’s Jeff Goodman notes that “one of the reasons DePaul made the move now was because it was nearly impossible to raise NIL while Tony Stubblefield was head coach and the program was floundering (even worse than usual). It’s a lot easier to raise NIL for a new coach than it is for someone few really believe can get the job done. DePaul is dead last in the Big East in NIL, per source, at below $500K per year while six schools in the league are at around or in excess of $2M per year.” (link)
+ Michigan Football HC Jim Harbaugh is expected to participate in a second interview with the Los Angeles Chargers, according to Football Scoop’s Zach Barnett, who notes: “The Chargers and Harbaugh have been closely linked throughout the process, and it wouldn't be a surprise at all if an offer was made and accepted at the conclusion of that interview. Coaches sounded off on the NIL state of affairs at this month’s AFCA Convention, with one FCS HC telling On3’s Jesse Simonton: “This is the worst time in the world to have this (AFCA Convention) now. Nobody comes. None of the big dogs are here unless you’re a couple hours away because they’re wearing their ass out back home trying to hold onto their rosters.” A former SEC AC says: “It’s the biggest s–t show. I see all these young guys here and think, ‘Boys, you really want to do this?’” A Group of 5 HC agrees: “It’s all gone to s–t. It’s driving good coaches out (of the business).” Several staffers believe the transfer portal window should be decoupled from the academic calendar and advocate for a single spring window. SMU HC Rhett Lashlee, for example, says: “We’re not sustainable where we are. We’re not doing what’s in the best interest of kids and student-athletes long term. There’s not another sport that has free agency start while your season’s going on, and there’s no contracts.” Another HC says: “We make good money. But our compliance people can’t even enjoy Christmas because they’re waiting for the next (transfer) email to drop.” Marshall HC Charles Huff favors a system where players would sign a universal contract for three or four years, and a portion of funds would also be put in escrow. “You can still have your transfer availability, but now a kid’s really got to think about, ‘Okay, I’m in my second year, I’m going to give up X amount of dollars plus my escrow money to go start over.” More from Simonton. On3’s Pete Nakos reports Ohio State hasn’t quite reached the $13M NIL budget that Football HC Ryan Day said would be needed to maintain the Buckeyes roster, but “speaking with sources, it’s clear the Buckeyes are operating in the top echelon of college football. … Following three consecutive losses to Michigan and seeing the Wolverines win the national title earlier this month, Ohio State has fully embraced the transfer portal, using the portal to refine and upgrade its roster, setting the stage for major expectations in the 2024 season. Winning in free agency comes with a strong NIL infrastructure, which has woken up in the last 10 weeks.” On3 CEO Shannon Terry adds: “The deepest funded NIL Collectives/School NIL Operations are running between $10M to $15M for college football only.
